We previously discussed the free speech litigation at Clovis Community College, which censored students promoting Freedom Week in November 2021, a week in which student groups oppose socialism and support conservative causes. It has now settled that case and must pay $330K, adopt a new speech-protective policy, and train staff in the First Amendment. Yet, there is no indication that any of these officials who denied the free speech of students will be held accountable after this ruling.
The lawsuit was brought by the Foundation for Individual Rights and Expression (FIRE) attorney on behalf of three students at Clovis Community College. The students are members of the school’s chapter of the Young Americans for Freedom. They allege that they had received approval to post anti-communist and anti-socialist flyers on bulletin boards inside campus buildings last November. However, Clovis President Dr. Lori Bennett allegedly ordered the flyers taken down.
The defendants in the suit are Clovis Community College President Lori Bennett, Vice President of Student Services Marco De La Garza, Dean of Student Services Gurdeep Sihota Hebert and Senior Student Services Program Specialist Patrick Stumpf.
The college insists that it reserves the right to remove flyers over “inappropriate or [offensive] language or themes.” The lack of any definition for those vague terms would weigh heavily with the court in granting the preliminary injunction.
FIRE produced emails showing that a college administrator offered to “gladly take down” the flyers after “several people” said that they were “very uncomfortable” with the flyers, including a person who allegedly threatened a “harassment claim” if the posters were not taken down.
The lawsuit includes a claim that, in December 2021, the students were denied permission by the dean of student services to post pro-life flyers on bulletin boards inside campus buildings. They were told they could instead post them on a “free speech kiosk,” which is described as “a small box covered in rotting wood planks… at the edge of a walkway students virtually never use because it does not lead to any building entrances or parking lots.”
Under the settlement agreement, Clovis’s community college district will:
- Adopt a new posting policy that will protect the First Amendment rights of all student groups across the district.
- Hold annual First Amendment training sessions for all district administrators and certify in writing who attended and what training materials were used in 2024 and 2025.
- Pay the students $20,000 in damages each, plus $250,000 in attorneys’ fees, for a total of $330,000.
Unfortunately, as we have seen repeatedly, school officials deny free speech to students and faculty but are rarely held accountable. To the contrary, these cases (while expensive for taxpayers and donors) are personally beneficial for these officials.
Universities and colleges routinely lose in courts over these denials but there is still no evidence of a deterrent effect on actual conduct.
Instead, these settlements and verdicts are treated as a cost of doing business for anti-free speech administrators.
What ever happened to Judges who thought the losers in a case would need provide a report to the Judge in 6 months showing compliance of his order? Seems to me that would pour cold water on these losers who will simply go on doing what they can get away with, in-spite of the trial outcome.
As a tax paying hard working American, I don’t want my tax money used by wrong headed anti-free speech administrators.
Some nation wide action by the Dept of Ed (joke) would be to subtract financial support to a school (or district) in the amount of the judgment, thereby making the judgment painful which is the intent.
Nothing will change until there are ‘tangible’ consequences unleashed upon these college administration personnel. They’re not paying any of the $330,000 — so that’s not in any way consequential. And as Prof. Turley points out, this ruling can add to the ‘cred’ of these college administrators.
So — should Judges hand down SENTENCES — like 6 months in jail, or 2 years in a prison? That would be very tangible.
And in the extreme, sympathizers with the conservative movement/free speech movement — they’re the 3/4 of the population that own guns — perhaps if they used them, the consequences would not only be tangible, they would be immediate and not ‘appealable for months or years in court.’
I would never condone such gun violence, but back in the late 1800’s, settlers in the western territories and states called the six shooter and the rifle the ‘great equalizer’…..for good reason.

Trustworthy elections are easy.
Vote only on election day – no only is the simplest means, not only is this what the constitution and most state constitutions require, but it provides an independence check on the election.
We know that Maduro stole the Venezeualan election – because independent exit polls had Maduro losing by more than 40%.
Trump obliterated Biden in exit polls in 2020 – but because of the massive mailin voting – independent exit polls no longer function as a check on Fraud. Maduro’s mistake was not implementing mailin voting.
Vote in person on election day with photo ID in a precinct with no more than 30,000 registered voters, with paper ballots being hand counted in public on election day with the press and both parties observing and all totals and subtotals provided to the press immediately.
Ballots never leave the precinct. There is 100% transparency.
This is the way elections in the US have been conducted for over 100 years.
I am an embedded software developer. I write code for systems more complicated than voting machines, and I can do a better job then the people who provide our electronic voting equipment.
There are ways to use computers to count ballots that can be made secure – though not the ones we have used.
I will happily address ways to use voting machines that are far harder to engage in fraud. I can come up with ways where fraud by the voting machine is impossible.
But there is no way that they can be made trustworthy. Any form of electronic counting device is a black box that requires that you must trust some expert.
Hand counting paper ballots in public does not require you to trust a black box or some expert.
Systems design – and that includes voting systems has a crritical principle – the KISS principle.

The reality is American elections have pretty much always been corrupt and rigged whether the votes are counted by humans or machines. Look at history. All informed and credible people regardless of party affiliation now agree that LBJ stole his first primary election for the U.S. Senate via old fashioned ballot box stuffing.
Elections were not fair during the “machine politics” era where bosses like Daley, Pendergast, Tammany Hall as well as bosses in most other major cities rigged elections. While disputed, solid circumstantial evidence suggests JFK may have won the 1960 election via fraud in Chicago. The 1874 presidential election was corrupt, as was Clay’s “corrupt bargain”.
We’re supposed to believe mid and late 20th century “reforms” made elections fairer. Perhaps. But politicians have given themselves the power to confiscate several $TRILLIONS from taxpayers every year. That is bound to breed corruption. Perhaps that is why $BILLIONS are spent on elections. Because then those with the most influence can have some say in how those several $TRILLIONS confiscated from taxpayers is doled out.
Remember that the polls were wrong in 2016. They could be wrong again in 2024.

If a Republican is within 4 pts in national polling, that is an electoral win.

Vance went after Harris over weird – pointing out the many ways Harris is weird – including coming to atlanta and suddenly talking like a southern belle.
CNN interviewed a bunch of black men in a barbershop and expected them to be very critical of Trump – instead they were hard on Harris. Earlier CNN had a focus group of Black voters – and most were voting for Trump and NONE knew anyone who had changed their minds and was now backing Harris.
These and many others may be outliers.
But I think Trump and the trump campaign are specifically targetting Harris as inauthentic.

The next big issue was that there was a total communications failure between local police and the Secret Service. It has been noted that the local police were aware of Crooks long before he acted. They were also aware that he was on the roof and trying to deal with him. But they were unable to communicate any of this with the SS. Local police were communicating over radio. the Secret Service was communicating over radio,
But communications between the SS and local police required radio to cell to radio communications.
It appears that the Secret Service snipers did not know anything about Crooks until a few minutes before he fired.
