Below is my column in The Hill on the controversial role played by the ABC moderators in the presidential debate. Three false claims in the debate continue to be repeated in what is now our post-truth political environment. (ABC later challenged another claim by Harris on the deployment of U.S. troops).
Here is the column:
“You are entitled to your opinion. But you are not entitled to your own facts.”
That famous line from Sen. Daniel Patrick Moynihan (D-N.Y.) remains a virtual mantra for politicians and pundits. Yet, judging from the presidential debate between former President Donald Trump and Vice President Kamala Harris, we have officially entered the post-truth political era.
ABC News has been widely criticized for the bias of the two moderators Linsey Davis and David Muir. Even liberal outlets acknowledged that the two journalists seemed inclined to “fact check” only Trump. In the meantime, they allowed clearly false statements from Harris to go unchallenged.
Three of the unchecked claims are being widely disseminated by supporters, including some in the media. Here are three legal “facts” that are being repeated despite being clearly untrue.
“Crime is down under the Biden-Harris administration.“
One of the most notable slap downs by ABC followed Trump commenting that crime rates have drastically risen during the Biden-Harris administration. Muir immediately balked and declared: “As you know, the FBI says overall violent crime is coming down in this country.”
Harris and her allies have been repeating the claim by ABC. But the actual statistics show that Trump was right. The Justice Department’s released survey found that, under the Biden administration, there has been a significant increase in crime. Violent crime was up 37 percent from 2020 to 2023, rape is up 42 percent, robbery is up 63 percent and stranger violence is up 61 percent. Other reports had shown startling increases such as a doubling of carjackings in D.C. in 2023.
“Harris has not supported transgender operations for undocumented migrants.”
Some of the greatest mocking in the media concerned Trump’s statement that Harris has supported transgender conversion treatment for undocumented persons. New Yorker staff writer Susan Glasser immediately wrote “What the hell was he talking about? No one knows, which was, of course, exactly Harris’s point.”
On CNN, Wolf Blitzer declared how “outlandish” it was for Trump to make such a claim.
But it’s true.
In 2019, Harris told the ACLU that she not only supported such operations but actively worked for at least one such procedure to take place. When it was reported by Andrew Kaczynski on CNN, host Erin Burnett was gobsmacked by the notion of taxpayer-funded gender transition surgeries for detained migrants. “She actually supported that?” Burnett exclaimed.
Even the New York Times later admitted that the “wildest sounding attack line” from Trump was “basically true.”
Harris does not support the right to abortion in the final three months of a pregnancy.
Trump also hit Harris on her no-limits position on abortion rights, allowing women the right to abort a baby up to the moment of birth. Trump said Harris supports laws allowing abortions in “the seventh month, the eighth month, [and] the ninth month,” to which Harris retorted: “C’mon,” “no,” and “that’s not true.”
The hosts again said that Trump was making up his criticism of late-term abortions, including the risk of babies being born but allowed to die.
But in fact, many states, including Minnesota under Gov. Tim Walz (D), protect the right of a woman to abort a baby into the ninth month. While it is often said that this is left to the mother and her doctor, the law gives the decision to the mother.
Late-term abortions are relatively rare, but they do occur. A Centers for Disease Control and Prevention report estimated in 2019 that about 4,882 abortions were performed that year at least 21 weeks or later into pregnancy.
More than a dozen states, in fact, allow on-demand abortions after a baby is viable and can even survive outside of the womb. Nine of those states permit abortions throughout the entirety of pregnancy. Harris has supported these state laws and certainly did not answer the question on what limits she would support, other than saying that she supports Roe v. Wade.
Clearly, many late-term abortions occur to protect the life of the mother. However, you can have (as both Trump and Harris support) exceptions to protect the life of the mother without allowing abortions up to the moment of birth.
To be sure, Trump did not help himself with his wilder claims. These included debunked accounts of Haitian migrants eating people’s pets in Ohio, which Ohio’s Republican governor, Mike Dewine, has denied.
The issue is not fact-checking, but the failure to do so equally and accurately. ABC actually disseminated false information under the mantle of fact-checking, and that’s a real problem.
Moderator Linsey Davis admitted later that ABC did not want a repeat of what had happened in the last debate, wherein Trump was given free rein and the moderators limited themselves to asking questions and enforcing time limits. CNN was praised in that debate across the political spectrum for being even-handed.
What is most striking about this election is that none of this seems to matter. Indeed, even the debate did not matter. While Trump can legitimately object to a three-against-one debate format, Harris’s victory was clearly not dependent on bad calls by the refs. However, there has been little overall movement in the polls, even though 67 million people were watching.
The era of post-truth politics is evident in Harris repeating false claims about Trump’s support for “Project 2025” and debunked claims regarding his comments about an extreme-right Charlottesville rally in 2017. Leading Democrats continue to make these false claims, in some cases despite knowing that they are false.
On the other side, Trump is making promises he has to know can never be fulfilled. For example, he has pledged to make flag-burning a federal crime with a penalty of two years’ incarceration. The Supreme Court, including conservatives like the late Justice Antonin Scalia, has ruled that flag burning is protected speech under the First Amendment. Neither a president nor Congress can change the meaning of the Constitution without amending it.
With the help of the media, we have reduced our election to a political Slurpee. It’s all sugar rush and no nutritional value. We now have pundits supporting the idea of no further debates and even arguing that Harris shouldn’t give any interviews because it’s too risky.
Rep. James Clyburn (D-S.C.) explained that Harris should avoid one-on-one media interviews because “sometimes, you drill down into a question until there’s a word that’s uttered that can be used in a negative way.” I suppose, as president, she will need to insist on meeting foreign leaders only in CNN town hall events.
If you do not say anything, there are no facts to check. The election then becomes a vote over whether you are for or against “joy.”
What is clear from the ABC debate is that citizens are on their own in the election to find actual facts and substance in the super-sized Slurpee of the 2024 election.

A particularly disturbing phenomenon in the politicized dialogue (if you can call it that) is neglect (or avoidance) of actually reading references and/or critical thinking. Besides overlooking Minnesota’s explicit elimination of protection for children born during abortion (2023), the long-term debate over “Roe v. Wade” ignores the decision itself. Setting aside the point that the legal issue at hand was right to privacy, not abortion, the majority opinion advocated anything but unlimited abortion. Instead, the justices presented strong arguments for unborn children’s rights, which they stipulated should weigh more heavily as the child matures – in balance with any competing maternal issues. This is in stark contrast to characterizations by pro-abortion advocates; and those who advocate constraints on abortion fail as miserably in their research for the debate.
“With fact-checks like these how does truth stand a chance?”
Simple.
Assume everything they say is a lie intended to control a narrative until proven to the contrary.
Complain to their advertisers.
Alternatively, never listen to them or watch their political circus shows.

As the election inches nearer, Dennis McInliar appears to be getting very desperate, and projecting more each day. It is also apparent that his goal is to tell so many lies in one post that it will make our job of choosing just one very difficult.
Who can blame him for speaking for Kamala Harris, since she won’t speak for herself. Lets start with this:
What is Harris’s position on abortion? She has clearly stated her position that she supports Roe v. Wade and opposes the Dobb’s decision.
First of all, this is not a position on abortion, as the POTUS has ZERO popwer to change EITHER of those decisions. Kamala has CONSISTENTLY refused to answer the question of whether she supports ANY restrictions on abortion. Because she does not.

Harris co-sponsored legislation that would block any state in the country from placing limits on abortion and effectively mandate all-trimester abortion without limits throughout pregnancy. The Biden-Harris administration strongly supported this bill. Most recently, Harris has been unwilling to name a limit she can support.
Also, as California AG, Kamala fought for restrictions on pro-life advocacy establishments.
What is McIncrier’s motivation for lying about this? We suspect that he is fine with 3rd trimester abortions, aven after viability, just like Harris is. They just don’t want to admit it during an election season. Viability. What is that anyway, Jonathan? Thats when a fetus becomes a human? What a ridiculous premise. Is that when a baby can survive outside the womb on it’s own??? We’re pretty sure that happens around age 12 years.
And then there is this gem:

It appears that Dennis has learned his lesson well. He and Kamala are peas in a pod. When asked a direct question, she refuses to answer and instead, either pukes up a word salad or starts yapping about Trump. McInliar must have gotten the same marching orders from the DNC.
Of course, in any discussions about abortion, mutilation of minors, services to illegal aliens and convicts, they ALWAYS leave out the words “TAXPAYER FUNDED”. Why is that? Disingenuous LIARS, all.

“The True Administration Of Justice Is The Firmest Pillar Of Good Government” This is the engraved words of George Washington upon the New York County Courthouse. The word Justice has been altered in its definition so that it depends on who is saying it as to whether they are corrector not. Same words, completely different context of meanings. Kamala has to explain hers with diversions and misdirections like a magician, while Trump often accepts plain sense, but fails to realize his opponents are so delusional that they think and believe most plain sense meaning is to them morally wrong because it is not immoral and exclusively in their favor alone. When you realize Kamala thinks and operates on a plane of fervent religious immorality, like Hillary Clinton did as a literal witch, you can read the intent of her words, regardless what she says or how she says it.
Jonathan: So now your are the the “Fact Checker” of the ABC fact checkers? It appears your attempt at “fact checking” is really just an attempt to embrace DJT world view that facts don’t really matter. Here’s what I mean:
1. Crime rates under the Biden/Harris administration: The DOJ’s statistics are based on its National Crime Victimization Survey that covers about 150,000 households. The FBI’s national reporting database compiles crimes reported to local police departments. A lot of crimes are not reported. That’s the first problem. Neither agency probably has a handle on the actual violent crime rate. So Joe Biden liked the FBI data that shows violent crimes in 1974 per 100,000 were 461. In 2022 the figure was just under 370. Violent crimes peaked in the early 1990s with more than 750 per 100,000. So technically, Biden is correct that the violent crime rate is “near” a 50 year low. No solace for the victims of violent crime. And really nothing to crow about by Biden. But, hey, we are in an election year and Harris will have to run on that.
2. Does Harris support transgender operations for the undocumented? DJT has made his position clear. He would ban taxpayer funding for sex-change surgeries for inmates and the undocumented. And he would ban schools from “promoting gender transition”. He also would reverse Title IX protections for gender identity.
In 2015, while the AG of California, Harris reached what was an historic settlement to move a transgender woman inmate to a facility for transgender medical care deemed necessary by a number of medical and mental health professionals. Harris has not said what is her position on the same treatment for undocumented inmates.
3. What is Harris’s position on abortion? She has clearly stated her position that she supports Roe v. Wade and opposes the Dobb’s decision. She has never said she “supports” abortion on demand in the 9th month or after birth as DJT falsely claimed in the debate. Harris believes the decision on abortion should be left to the woman in consultation with her doctor. But you bizarrely claim “But, in fact, many states, including Minnesota under Gov. Tim Walz, protect the right of a woman to abort a baby in the ninth month”. Here is where you veer from “fact checking” to your own biased religiously held beliefs. Whatever happens in the 9th month for a pregnant woman it has nothing to do with “choice”. An abortion at that time is always related to either a threat to the life of the pregnant woman or a fatal fetus abnormality. What is clear is that Harris does not support wholesale abortions on demand “up to the moment of birth”. That’s where your own fact-checking breaks down.
Finally, while DJT has tried to distance himself from “Project 2025” he owns it now. The 900 page prescription for how DJT would rule in his second term was written by over 100 former members of his own administration. It’s how DJT would rule on day one if he were to be “dictator”. Hard to walk back that! But you seem to think the Harris campaign has made a “false claim” about that. Really? Most legal scholars, on the left and right, have described “Project 2025” as a blueprint for an authoritarian dictatorship. Just ask conservative former federal judge Michael Luttig or George W’s AG Alberto Gonzales. Not exactly left-wing firebrands!
Let’s face it. You are finding it hard to defend DJT. You are desperate. You should follow your own admonition that “You are entitled to your own opinion. But you are not entitled to your own facts”. You forgot that in your column!

According to Turley: how dare Davis point out that Trump lied when he claimed that Democrats favor killing healthy newborn infants–“post-birth abortion”. That is murder in all 50 states, and is NOT done. Trump has doubled down on this lie, too, claiming Governor Northam admitted this happens. He took out of context a statement by Gov. Northam, a pediatric neurologist, who described the situation of a near or full term infant with congenital abnormalities that are incompatible with life and which has so many severe abnormalities that there is no way to treat it. The Governor said that after consultation with at least 2 physicians and the parents, the infant would be kept comfortable and allow death to occur naturally. That is not abortion,

What is astonishing is the laissez-faire attitude about the attempts on President Trump’s life by the media and the public at large. By laissez-faire I mean “unwilling involvement”. For the most part, I’ve learned (often the hard way) to do my own fact checking. Can’t be too careful these days. .. the recognition that human behavior is learned is fundamental to understanding human behavior.
