  3. Jonathan: Your column is better titled “Be careful what you wish for”. Left-wing pundits, like Michael Moore and Keith Obermann, are now urging Biden to implement measures that the Roberts “immunity” decision would deem “official acts”. But I doubt Joe Biden would grab the “powers of a monarch” to push through measures popular with the public. He is an “institutionalist” who follows the rule of law and constitutional restraints. Kamala Harris is in the same mold.

    In contrast, DJT sees so such restraints in his quest for the powers of a “dictator”. In Aurora, Colorado last week DJT said he would invoke the Alien and Sedition Acts of 1798 to round up, incarcerate and deport millions of immigrants, regardless of their legal status and immigration laws. These Acts have only been used 3 times–during the War of 1812 and during the two world wars. Roosevelt used the AEA to put Japanese-American citizens in concentration camps without due process. Roosevelt’s actions have been a stain on our history ever since.

    But DJT would go further than Roosevelt. He would use the Acts to prosecute and imprison members of the press who might criticize his actions. He has already called for the revocation of the broadcast licenses of ABC, NBC and Google because he doesn’t like their treatment of him. If DJT got back into power is there any doubt he would try to take away the “free speech” rights of the press?

    But you seem to think the Roberts “immunity” decision would be a constraint on DJT assuming dictatorial powers. I disagree with your characterization of Roberts’ decision as adopting a “middle road on immunity”. That decision declared that “official acts” are absolutely immune from criminal prosecution. If DJT were to order the military to round up and deport millions of immigrants, order his AG to prosecute his political enemies, shut down the Jack Smith prosecutions or order the FCC to cancel the broadcast licenses of certain media outlets–what makes you think the right-wing supporters of DJT on the SC would not deem all those actions consistent with the executive powers of the President? In other words “official acts” and not “unofficial, or private actions” as you think. I am not as sanguine as you on how the Roberts court might rule when it comes to “immunity”. The Roberts decision itself gives a President almost unlimited powers–a decision with no constitutional justification.

    In August in Wilkes-Barre, Pennsylvania DJT made it plain about he would do with any criticism of court decisions that rule in his favor. He told his supporters: “I believe it’s illegal what they do…playing the ref with our judges and our justices should be punishable by very severe fines and beyond that”. What does DJT mean by “beyond that”? It probably means the persecution and prosecution of the press or legal scholars that might criticize future decisions by the courts that would endorse any DJT unconstitutional or other illegal acts. It’s pretty clear what DJT has planned for his “internal enemies”– the stamping out of any dissent. He calls Kamala Harris, Jack Smith and Adam Schiff all “criminals” who need to be prosecuted.

    Ruth Ben-Ghiat, historian and professor at NY University, has cogently summed up DJT’s rhetoric about criminalizing dissent in her book “Strongmen: From Mussolini to the Present”: “This is out of the autocratic playbook. As autocrats consolidate their power once they’re in office, anything that threatens their power, or exposes their corruption, or releases information that’s harmful to them in any way becomes illegal”.

    Frankly, I don’t see anything in the Roberts “immunity” decision that would prevent that!

    A while back in political live chat I had the displeasure to be educated by one of the commie psychophants who was dreaming of his master Raul granting him his own restaurant – he went on for quite some time about his dream and how his master of you know where was in charge of dream becoming real. It was quite the eye opener.

    I consider michael mooore’s and keith olberman’s public display in a similar light only worse, since they are begging to destroy a fellow American.

    NEVER allow the government more power, always take actions to reduce it, you will often lose, but that power check must be exercised.

    I think they might benefit from spending some time in North Korea, hanging out with someone who seems to share their values. Perhaps a stay over in a Tehran prison?

    I saw the inside of a New Delhi prison in 1976 when I was in my late teens. I wasn’t a prisoner, only there to provide some supplies (part of a humanitarian effort) to the foreign prisoners at Christmas. It made an impression on me. We were allowed inside several locked doorways. I also traveled in Iran, Afghanistan and Pakistan in those days.

    Put it this way, I salute the flag of the United States and sing our anthem. I have seen the crushing poverty and oppression abroad. We may have our trying times and delayed justice, messy governance, but we still have a good system.

    Why are these lunatics so hell bent on destroying things? If they don’t like it, they can leave.

    But most of it just can not be done unilaterally by a president

    The president can direct people in the executive to not follow the law
    In which case they must resign
    But even if he succeeds
    That lasts only until another president starts following the law

    Much of what Biden is being called on to do at best he can do only temporarily

    If he wants to do unconstitutional things that will be reversed by the next president or the courts
    Then impeach him
    The senate can try and remove him
    And THEN he can be prosecuted

    SCOTUSs immunity decision gave the courts to much power
    A president has zero absolute immunity and 100% immunity until congress removes it

            50 years retroactively, the Supreme Court in 2022 struck that corrupt attempt to defraud America down as irrefutably unconstitutional.

            The American Founders incorporated impeachment and conviction into the Constitution to address those high-crimes and misdemeanors.

            Comey proved Hillary guilty and then stated that he was going to absolve her – yet another high crime.

            The entire communist American welfare state violates Article 1, Section 8.

Secondly, the new President could immediately rescind any unconstitutional act as such and given the Democrats criminal acts have all these communists arrested. Part of the conundrum we find ourselves is that these politicians from each party are never held accountable for their crimes. Because Trump has never been in their club, he’s the only President ever gone after like this through lawfare. They’re panicking now because they fear the will soon no longer control the machine and they themselves will now be held accountable.

    Far fetched but lately I have been wondering if China is using us as a proxy for conflict against Russia. The Chinese are smart enough to think of such a thing and our administration is easily stupid enough to fall for it. Just wondering.

      Seems to me, anything that weakens the American is in China’s best interest. Yes, I think they would use the Ukraine/Russia war as a proxy against us. At the same time, I think China is supporting Russia. They both and others saw a weak America in the Biden/Harris admin and took advantage of it. That is why they and other want Harris to win the election. It is in their best interest.

  19. The SC case on Presidential Immunity does not shield the President from Impeachment (and the Democrats set the precedent that Impeachment can happen after he leaves office)
    Impeachment can them make the former President then stand trial for the actions he was Impeached on (and the fact of Impeachment makes it clear that those actions were not within his authority)

Just this morning, Trump said in an interview broadcast on his employer’s network, that he would use the MILITARY to go after his perceived enemies. Turley KNOWS just how dangerous this is–that the US military CANNOT be used against American citizens, but Turley’s list of items he says would be “gutting the Constitution” is: “emptying death row, canceling all student and medical debt, halting weapons shipments to Israel, ending the death penalty, declaring the Equal Rights Amendment a constitutional amendment, and granting clemency to nonviolent drug offenders.” Turley considers THESE things more dangerous to the Constitution than a sociopathic narcissist using the military to go after his political enemies. Of course, a secondary reason for today’s little toilet piece is to get in some licks at Michael Moore, Keith Olbermann and Harvard Constitutional Law Professor Laurence Tribe, someone of whom Turley is obviously jealous—Professor Tribe’s books are authoritative. Turley, of course, has little criticism about Leonard Leo’s SCOTUS allowing a POTUS to do every one of these things–the intention being to benefit Trump–so why shouldn’t it benefit Biden, too? Oh, because, according to Turley, this would be wrong. This is WHY, IMHO, Turley has lost all credibility.
