Panic Politics: The Press and Pundits Face Devastating Polls on the Threat to Democracy

Below is my column in the New York Post on the growing hysteria among press and pundits proclaiming the imminent end of democracy if Kamala Harris is not elected. The predictions of mass roundups, disappearances, and tyranny ignore a constitutional system that has survived for over two centuries as the oldest and most stable democracy in the world. More importantly, the public appears to agree that democracy is under threat but appear to hold a very different notion of where that threat is coming from.

Here is the column:

“Democracy dies in darkness” is the Washington Post’s slogan, but can it handle the light?

The Post has been doggedly portraying the election between former President Donald Trump and Vice President Kamala Harris as a choice between tyranny (Trump) and democracy (Harris). Yet when it commissioned a poll on threats to democracy shortly before the election, it did not quite work out.

Voters in swing states believe that Trump is more likely to protect democracy than Kamala Harris, who is running on a “save democracy” platform.

The poll sampled 5,016 registered voters in Arizona, Georgia, Michigan, Nevada, North Carolina, Pennsylvania and Wisconsin.

When asked whether Trump or Harris “would do a better job” of “defending against threats to democracy,” 43% picked Trump while 40% picked Harris.

Notably, this was the same result when President Biden was the nominee. While over half said that threats to democracy were important to them, the voters trusted Trump (44%) more than Biden (33%) in protecting democracy.

Even with the slight improvement for Harris, the result was crushing for not just many in the Harris campaign but the press and pundits who have been unrelenting in announcing the end of democracy if Harris is not elected.

Former Rep. Liz Cheney (R-Wyo.) has declared with authority that either you vote for Harris, or this “may well be the last real vote you ever get to cast.”

I have long criticized the apocalyptic, democracy-ending predictions of Biden, Harris and others as ignoring the safeguards in our system against authoritarian power.

Nevertheless, Harris supporters have ratcheted up the rhetoric to a level of pure hysteria. Recently, Michael Cohen, a convicted felon and Trump’s disbarred former lawyer, told MSNBC that if Trump wins the election, he will “get rid of the judiciary and get rid of the Congress.”

Recently, MSNBC host Al Sharpton and regular Donny Deutsch warned viewers that they will likely be added to an enemies “list” for some type of roundup after a Trump election.

MSNBC host Rachel Maddow also joined in the theme of a final stand before the gulag: “For that matter, what convinces you that these massive camps he’s planning are only for migrants? So, yes, I’m worried about me — but only as much as I’m worried about all of us.”

Rep. Alexandria Ocasio-Cortez (D-NY) was quick to add her own name to a list that seems to be constantly updated by the media. She told podcast host Kara Swisher, “I mean, it sounds nuts, but I wouldn’t be surprised if this guy threw me in jail.”

On ABC’s “The View,” the hosts are becoming indistinguishable from tinfoil-hatted subway prophets. Whoopi Goldberg even explained how Trump is already committed to being a dictator who will “put you people away … take all the journalists … take all the gay folks … move you all around and disappear you.”

Of course, assuming that Cohen is wrong that there will be no courts after a Trump victory, this would require federal judges to sign off on the rounding up of MSNBC personalities, all gay people, all reporters, and, of course, Whoopi Goldberg.

All that is required is for over two centuries of constitutional order to fail suddenly, and for virtually every constitutional actor in our system to suddenly embrace tyranny.

Those pushing this hysteria often curiously cite the January 6 riot as proof that the end is near. Yet that horrible day was the vindication, not the expiration, of our constitutional system. The system worked. The riot was put down. Congress, including Republicans, reassembled and certified Biden as the next president.

In the courts, many Trump-appointed judges ruled against challenges to the election.

Our system was put through a Cat 5 stress test and did not even sway for a moment.

Nevertheless, the same voices are being heard on the same media outlets with doomsday scenarios.

Former Acting US Solicitor General Neal Katyal told MSNBC’s “Morning Joe” ominously, “We are looking at a very possible constitutional crisis and one that’s going to make January 6, 2021, look like a dress rehearsal. And this year, the rogues have had four years to go pro and perfect the big lie.”

In other words: Be afraid, very afraid.

Then, in a New York Times column, Katyal lays out scenarios premised on a complete breakdown of the oldest and most stable democratic system in history.

It is like telling passengers on an ocean liner that we will all drown and then whispering that this is “assuming the crew intentionally scuttles the ship, all bulkheads and sealed departments fail, and every lifeboat and life preserver is discarded.”

But then we are all going to die.

The only way to avoid that watery grave (with the death of democracy itself)? Vote Democratic.

There is, however, some good news in all of this: Despite years of alarmist predictions from Biden, Harris, the press, and pundits, the public is not buying it.

It is not because they particularly like Trump. Many of his supporters seem poised to vote for him despite viewing him as polarizing and, at times, obnoxious.

No, it is because the American voter has a certain innate resistance to being played as a chump. Many of the same figures claiming that democracy is at stake supported ballot cleansing to remove Trump and others from the ballots. They supported the weaponization of the legal process in New York against Trump. Likewise, as Harris insists that she is the only hope for fundamental rights, many cannot fail to notice that she is supporting an unprecedented system of censorship that one court called “Orwellian.”

None of this means that the choice between Trump and Harris is easy. However, Harris’ claim to be the only hope for democracy is proving as tin-eared as running on pure “joy.”

Voters are clearly demanding more than a political pitch of abject fear mixed with illusive joy.

  1. From what I’ve seen, Trump’s campaign focuses on the border, the economy, crime, forever wars, and men competing in women’s sports.

    From what I’ve seen, Harris’s campaign focuses on January 6 and abortion.

    January 6 is something a vanishingly small segment of voters care about. Relatedly, they are not buying that Trump is a “threat to democracy.” As for abortion, that is a winning issue for Dems, and the strength of the abortion card for the national election will be enhanced in states where an abortion referendum is on the ballot: that will draw voters to the polls who are more likely to vote Harris than Trump. But, it would have to be important enough to enough people to outweigh their concerns about the above-listed issues Trump is focusing on. Also, Trump has blunted its effectiveness to some degree by promising to veto a federal abortion ban. His pitch that he wants the issue decided state-by-state is attractive to many . . . and interestingly it shows he wants more democracy, not less . . . which “circles back” (h/t Jen P.) to the threat-to-democracy card being such a weak card to play.

      Surprisingly, I have not heard a single–not one–rebutting commercial or candidate response, e.g., “Women: you know immediately if you were raped–you don’t have to wait until you find out if you are pregnant. You have at least 24 hours to [take the morning-after pill]. And why aren’t schools and parents effectively talking to young girls about not being afraid to come forward if incest occurs, even if bribed or threatened otherwise?”
      This is one type of responsive commercial that could at least bring more substance into the conversation and get people to at least consider more options.
      I do believe that Republicans/conservatives can lose on this issue only because of their non-responsive silence.

        The Democrats gratefully thank both Trump and all Republicans for accepting the invitation to fight a defensive battle on a non-existent federal battleground where they hold the fake high ground.

        Democrats repetitively lie that the Trump/Vance platform includes a national ban on abortion, etc. The fact that there is absolutely nothing like that in the Trump/GOP platforms means nothing: they throw that lie out there and Republicans take the bait of responding to what is a “Do you still beat your wife?” tactic.

        SCOTUS was as clear as possible in ruling that the Federal government and no Federal politicians have any say in making law concerning abortion. It isn’t about religious beliefs: what the Bible, the Torah, the Quran says. Its about the Constitution and the division between federal and state powers.

        Abortion, especially elective birth control abortions, SHOULDN’T be an issue in this or any other federal election. But Democrats have successfully make it a federal election issue. It’s a strategic election strategy win when Republicans willingly agree to fight on that Democrat fake battleground. On that Democrat background, Republicans invariably find themselves fighting a defensive battle against Democrat lies like claims Trump will criminalize all abortions.

        Democrats know that. Just as they know that if Kamala Harris is elected and tries to allow Democrats to pass laws forcing all states to provide elective birth control abortions up to the moment of birth, that legislation is DOA on arriving at the Supreme Court – if it gets that far. But if Trump/Republicans acknowledge and engage on that Democrat battleground, that’s an avenue to potential Democrat electoral victory.

        You don’t fight battles on the ground and at the time of the enemy’s choosing; you reject the enemy inviting you to fight on their terms and pick your own battleground.

        What Trump and the Republicans SHOULD be saying (in my opinion) is something along the lines of “SCOTUS has clearly said Harris and the Democrats cannot pass the federal laws they promise that will legalize elective birth control abortions up to the moment of birth – SCOTUS ruled they have to get abortions like that legalized in the states they’re from. Lets all be clear: Trump has said this is a state issue multiple times. Even if Democrats were telling the truth with their claims Trump intends to criminalize abortions, SCOTUS would reject a federal law like that as well”.

        If it MUST be a federal election issue, hammer the fact that Harris and the Democrats want to force on all states ELECTIVE birth control abortions up to the point of birth.

        But instead of attempting to take all claims regarding federal abortion law off the table, Trump and Republicans have given Democrats and Biden/Harris the election campaign gift of responding as though federal abortion law is indeed constitutional.

        There’s unchecked reproduction in India resulting in 1.5 billion people living within that land mass. Others have taken the anti reproduction route of homosexuality and abortion.

        Self sterilization is an option . Let the meek inherit the earth. Sad but true.

  3. I am concerned that the only safeguard in our system against authoritarian power is the judicial branch. While it may be argued there are others, it cannot be denied that they have been greatly weakened by an ever expanding and dogmatic federal government continuously seeking to wholly supplant all aspects of individualism with those of collectivism. So long as the courts and particularly the Supreme Court hold steadfast in favor of the written Constitution and not the erosion of it by the Administrative State, democracy will remain viable however more tenuous it may yet become.

    I’m not sure the present Democratic Party is capable of self reflection and re-alignment if they lose. They lost in 2016 and showed no such tendency and instead just went back to Biden who was the deflated spare tire on the Obama SUV and then we ended up with this miscarriage of an administration that even Obama has trouble recognizing.
    Can they re-energize and realign as the Republicans did in 1994. Even that was not a total victory since Bill Clinton still won in 1996 and when Bush won in 2000 we got Neocons who now root and push for the Democrats and ensconced us in 2 wars that lasted decades . Remember the Tea Party started under Bush and Bush also got the multi-trillion dollar debt bomb rolling.
    Realignment and soul searching is not always what it is cracked up to be unless it leads to better performance and service to the people and the nation.
    Bush also wanted to toss open the gates to immigration but was blocked by the down ballot officeholders (that may have been closer to the people). So be careful about what you wish for.
    Better to find a new leader who can lead you out of the wilderness then set up a strategic planning committee. Not the other way around. And try to keep it in constitutional norms. We have survived this far by never going too far left or right except for the civil war and that was the worst war we ever fought. Moderation failed then and left only a military solution and the nation bled horribly.

It IS immensely troubling that former national security advisors, chiefs of staff, chairmen of the joint chiefs, and defense secretaries are sounding the alarm on the dangers of another Donald Trump presidency. This has NEVER happened before. Throw in the whole January 6 debacle, which was absolutely an attempt to prevent a peaceful transfer of power, and the whole debacle becomes terrifying for our nation. There is no defending these facts and no amount of whitewashing can mitigate them away. Your effort to do so is embarrassing.

  10. Scholars and philosophers try to agree on, or at least define, the meaning of the terms they use. Politicians, journalists, and pundits not so much.
    I doubt that Harris or Cooper could define the term “fascist,” yet they use the term, evidently assuming it to be a synonym for “dictator.” But there is no consensus among those who have studied “fascism” regarding what a “fascist” might be, as anyone who has read the literature knows.
    When they use the term dictator, it is not clear if they are referring to the Roman dictator, who was given extraordinary powers during a crisis or a modern dictator, who might seize power on an island in the Caribbean and rule with the help of the Ton Ton Macoute or overthrow the Spanish Republic, align his new regime with Fascist Italy and Nazi Germany, and ally his country with the United States after 1945. Certainly, they do not mean tyrants, who were Greek . . . .
    Authoritarian is a term without a clear meaning coined by Adorno & friends during the late 1940s. In search of an ‘authoritarian personality’ susceptible to “fascism,” they settled on a model so flawed that it applied more to physicians and housewives than to actual “fascists.”
    The term ‘fascist’ was coined by Mussolini & friends, who came from the left of the political spectrum, embraced corporatism, and replaced political parties with the (deep?) State. Fascists differed from Nazis, who also came from the left (NSDAP/National Socialist German Workers Party), in a number of ways. For example, while the Fascists saw nationality as a cultural and political question, the Nazis viewed it as a racial question, a crucial difference.
    So what sort of “fascist” do Cooper and Harris have in mind? The 1919 variety, which included revolutionary syndicalists, anarchists, and the conductor Toscanini; those like Giuseppe Bottai, who set out a cultural Fascism and embraced a corporate system of government; or those who joined the Fascist Party because it assured them a career?
    It would be helpful if rather than engaging in name-calling, Harris & her supporters in the media would discuss policy, explain why the administration of which she was an integral part failed to do in the past all the things she now promises to do in the future, and stop making ad hominem attacks, which is an admission that they have lost the argument.

    Its because SHE was involved in the Democrats plans to do just that. And the difference is, it wasnt Republicans falsely claiming what the Democrats would do. The Dems announced it. They tried and still want to:

    Abolish the filibuster and then:

    1. Add 2 blue states and 4 Dem Senators

    2. Pack the Supreme Court with liberal activists

    3. Pass any and all legislation they choose, whether constitutional or not, with their newly packed scotus to approve it, including abolishing the electoral college and the green new deal.

    Bye bye safeguards. Only Joe Manchin stood in their way when Kamala and friends attempted this. He should go down in history as the man who saved a nation.

    This is why they started yapping about “threat to democracy” 3 years ago. To distract from their own failed intentions.

Moreover, many of the same people now engaged in this bout of mental illness, over Trump, are the very ones telling us the 2020 election was the cleanest in history despite all safeguards against voting and election shenanigans having been removed over the COVID hysteria. In fact, many of them worried about the election until their candidate won. Should have done a thorough debunking back then, but many people were afraid of what they might learn.

So the problem Democrats and Never-Trump Republicans have with this “Trump is_______,” (Fill in the blank, Hitler, Fascist, anti-Democracy, racist, misogynistic, homophobic, anti-immigrant, anti-military , anti-veteran, etc) is that it has no ring of truth when describing Trump but makes absolute sense when describing Democrats.

    First, we have four years of his Presidency to judge his leadership. Nothing he did remotely points to fascism.

    Secondly, we have oodles of candid footage proving the genuine mutual affection and respect he has for all Americans.

    Thirdly, he has a very close knit family and successful company with no shortage of intelligent and independent women with whom he also shares a mutual respect.

    Fourth, it is this administration, including many never Trump Republicans who’ve demonstrated a penchant for using their power to attack political enemies.

    Fifth, Trump constantly demonstrates trust and respect for the collective wisdom of the American people, as opposed to those in power now who conversely hold the American people in disdain, taking every opportunity to silence their critics, using the levers of power at their disposal.

    Sixth, Trump, even though he was considered the de facto leader of the Republican Party, submitted himself to the rigorous process of the primary. Harris was the anointed candidate after the incumbent inexplicably dropped out for reasons no one was allowed to acknowledge and that he himself didn’t believe.

    If this were sure to be a free and fair election, I have absolutely no doubt that Trump would win another term, having earned it.

    But it’s becoming crystal clear that this administration and all of the bureaucrats standing in lockstep behind it have no intention of surrendering the reins to Trump. They have lost trust in their own electorate and, I believe, will act contrary to the very Constitution which they’ve pledged to protect and defend. They view Trump and those who support him as “domestic enemies” from whom they must protect America.

    We are living in a very dangerous time. Pray, fast and prepare, for only the very Creator who granted us the blessings of Liberty can save this nation, if He finds us worthy.

    So be worthy, my fellow Americans.

The Democrats are pre-justifying their inevitable seizure of power in spite of the election results, “to save democracy”. Listen to the words coming out of their mouths, especially imbeciles like Raskin. They have no intention of allowing the mere loss of an election to interfere with their grip on power. The star officers in the military are unreliable. The manufactured and well-financed resistance will get so bad that martial law will be declared, and the Democrats will attempt to solidify their hold.       If Trump manages to have coat-tails in either House or Senate elections, the critical period will be from November 6 to January 2, since the new Congress will be seated on January 3. I predict that the corrupt judge Merchan will sentence Trump to prison time on Wednesday, November 6, and that Demons in Congress will attempt to use that to refuse to certify his election. That will only be the first of many attempts to prevent his inauguration, possibly culminating in another assassination attempt.
