Something Wicked This Way Comes: Both Parties Deploy Legions of Lawyers For Election Challenges
Below is my Hill column on the current litigation controversies around the country. We are still watching litigation playing out just a day before the election. At the same time, we have some figures like Rep. Jamie Raskin (D., Md.) reserving any recognition of a victory unless they are satisfied with the integrity of the election. While I remain hopeful that the courts have gotten a head start on addressing many issues, there is a virtual army of lawyers in place from both major parties waiting for a green light to deploy. We just had a new filing in Georgia over handing in mail ballots and the Supreme Court has ruled against a RNC challenge with a statement that essentially said “don’t sweat the small stuff” when only a tiny number of ballots are impacted.

“Something wicked this way comes.” Those words from William Shakespeare’s “Macbeth” capture a certain dread that takes hold of some of us tasked with covering the legal elements of the presidential election.

Just as Halloween ended, things in the days leading into Election Day have begun to get…well, spooky. Call it election jitters, but some of us have been here before.

More than 200 cases have been filed around the country before the election this year. In the last week, worrisome elements have begun to pop up in various swing states.

Over the last couple of decades, I have covered presidential elections for three networks (as I will do for Fox News in this election). The lead-up to elections always includes a flurry of lawsuits. As the voting margin shrinks between the parties, the number of lawyers increases.

Some lawsuits are important efforts to make changes to remove barriers for voters or the counting of early balloting. For example, on Friday an emergency lawsuit filed by the American Civil Liberties Union secured an order for election officials in Cobb County, Ga., to overnight mail ballots to roughly 3,000 citizens and to guarantee that they be counted after a snafu by election officials. Other lawsuits are what I call “placeholders,” where campaigns establish areas of concern to be able to reference later in any specific challenges on or after Election Day.

The Supreme Court has already intervened to stop an effort by the Biden-Harris administration to force Virginia to put people back on the voting rolls who had identified themselves as non-citizens. It is a crime for non-citizens to vote. Although Virginia allows any mistaken information to be corrected (and also allows for challenged voters to file provisional ballots), lower courts ordered Virginia to enable people to vote who had said they were not citizens.

Critics charge that the case is the continuation of the administration’s unrelenting attacks on voter identification and proof of citizenship laws, even though 84 percent of Americans support such laws. In California, Governor Gavin Newsom and Democratic legislators actually made it a crime for any poll worker to ask voters for identification.

Some of these early challenges are welcomed, in the sense that we still have time to work out problems. Courts are notoriously reluctant to intervene after an election with the limited time before the certification of votes. They often refuse challengers access to vital election board information or bar cases as speculative or litigants as lacking in standing. This fuels the public’s distrust of the integrity of the election.

Some challenges potentially involve a high number of votes in swing states. For example, in North Carolina, the Republican National Committee is suing the North Carolina State Board of Elections over 225,000 people who may not have been appropriately registered because that state failed to require a driver’s license or partial Social Security number.

In Arizona, a judge had to order Democratic Arizona Secretary of State Adrian Fontes to release the names of roughly 218,000 voters who may have been allowed to register without the proof of citizenship required by state law.

There is also a growing concern over possible systemic voting registration violations in multiple districts in Pennsylvania. Initially, 2,500 forms were marked as suspicious for possible false names, duplicative handwriting or unverifiable or incorrect identifying information. Lancaster County District Attorney Heather Adams and her team found that about 60 percent of the 2,500 forms were potentially illegitimate. Monroe County District Attorney Mike Mancuso linked the registrations to “Field and Media Corps,” a subsidiary of Fieldcorps, an Arizona-based organization.

Field and Media Corps appears to have taken down its website, but it previously identified itself as a subsidiary of FieldCorps. It described itself as “connecting campaigns and projects with communities of color across the state. Our clients benefit from our social activism and coalition leadership experience gained through decades of leading campaigns, highlighting social inequalities, and developing BIPOC coalition building.”

FieldCorps has reportedly been working for the Harris-Walz campaign, the Mark Kelly campaign in Arizona and other Democratic campaigns. Efforts to reach FieldCorps for comment have been unsuccessful.

The concern is that companies like FieldCorps could be replicating errors across districts and states in the rush to register new voters. If these are knowing falsifications, it could constitute a federal crime.

We also have the same controversies arising in this election about changes to voting laws just before the election. In 2020, many voters were opposed to courts in states like Pennsylvania issuing last-minute changes. Many assumed that these laws had been finally worked out to guarantee the criteria for consideration of mail-in ballots and other forms of voting.

However, with less than two weeks to go, a divided Pennsylvania Supreme Court voted 4-3 to order a significant change in election rules. The Election Code in the state is a model of clarity — it says that a provisional ballot “shall not be counted if the elector’s [mail] ballot is received in a timely manner by a county board of elections.” However, the court ruled that provisional ballots must be counted even if an individual has already sent in a mail ballot rejected for violating a mandatory rule, such as failure to place the ballot in a secrecy envelope or to date or sign the envelope. Late Friday night, the Supreme Court declined to block the counting of the provisional ballots.

However, on Friday, the Pennsylvania Supreme Court did hold the line on another major change of the state election laws ordered by a lower court. The court stayed a decision that it is unconstitutional to reject mail ballots without handwritten dates on the return envelopes. The stay means that the law will remain in effect for the election. Justice Kevin Doughtery (joined by Chief Justice Debra Todd) wrote a reassuring concurrence for many of us having to follow these cases: “‘This Court will neither impose nor countenance substantial alterations to existing laws and procedures during the pendency of an ongoing election.’  We said those carefully chosen words only weeks ago. Yet they apparently were not heard in the Commonwealth Court, the very court where the bulk of election litigation unfolds.”

In what may be the closest election in history, late changes to election laws are inflammatory for an already suspicious electorate. According to the Gallup polling, only 63 percent are “very (34 percent) or somewhat confident (29 percent) that votes in the upcoming midterm elections will be accurately cast and counted.” That is near a record low, and there is a 45 percentage point gap separating Republicans (40 percent) and Democrats (85 percent) in their confidence in election integrity.

To my astonishment, voting officials are still committing basic errors. In Bucks County, Pa., voters were turned away in their attempt to apply in person for mail-in ballots. Some were told that there were computer or staffing problems. A court then ordered additional days to request ballots, so that matter at least is resolved. Yet such glitches are concerning. This is not rocket science. Rocket science is Elon Musk catching a massive booster rocket on what looked like a giant barbeque fork. Getting the staff and computers in place in a historic election should not be a great challenge.

Given the emotions and closeness of this election, any such irregularities will only confirm the worst expectations of some voters. They are often neither sinister nor particularly suspicious. With tens of millions voting, there are going to be problems. Election officials can help reduce the suspicions by being more forthcoming in sharing information. In past years, officials have acted reflectively to oppose any disclosures while seeking the dismissal of cases. That largely succeeded legally but proved costly politically. It left many allegations (including ill-supported theories) unresolved in the minds of many citizens.

It would be far better for the nation to resolve questions before the elections and strive for greater transparency in post-election challenges. That is why, if something wicked this way comes, we can more easily send it along its way.

          As to the concerns of my livestock and their well being, there is something I learned at Paris Island, “Time management, management of resources.” I have arranged my farming operations in the most time efficient and resource management methodology. Granted it did not come about with out a degree of trial and error. I have made some, thankfully minor, mistakes and learned from them. So, I can easily conduct operations with little effort and maximum time management. That is what efficient farms and to the larger extent companies do. Government bureaucracies on the other hand and as exemplified by the Biden/Harris admin, do not.

  8. Here is a good example of why Americans of all stripes have low confidence in elections. Problems in King County, Washington. The county that more or less determines the winner of elections for Federal offices. Same problems as 2022, but a bit worse.

    The fold on the ballot produces a shadow on the ballot that causes the scanner to mismark choices. It causes ballots clearly marked for one of the major candidates to be recorded as a vote for one of the minor parties — green or socialist. While the automated machines flag some of these as “doubtful” votes, which are then sent to election judges to correct and tally, no one can be sure that all such spurious votes will be flagged. And are voters relieved by having election officials inspect ballots?

    In a very large number of precincts, districts, counties, states,… incompetence appears to be in control. Why aren’t problems like this spotted early and corrected? Recall that the 2000 election came down to being decided by a couple of Florida counties, which the left have whined about to the present day.

    1. This is a known problems.

      It was made public in the Needham Massachusets audit in 2020 – and it nearly cost the Reppublican a house seat.

      But what was learned was that DVS knew about this problem and has known about it for many years.
      But has done nothing because before 2020 few ballots were ever folded.

      Now all early and mailing ballots are folded, and a significant portion fo the tabulators screw up a sufficient percent of the time when scanning the fold to alter results.

  9. Biggest news in polling in recent days has been in the data showing that D’s will motivate and vote for Harris while R’s drop ten points in whether they support their own candidate. R’s, despite an ever shrinking base, usually support their candidate more than D’s do…, so this is bad for trump. Really bad.

    Comfortable Harris win. Trump will, of course, go for the steal. So the legal war between now and January will be huge but the R’s schtick no longer has the element of surprise, and likely this will keep the election out of the hands of the SCOTUS. Good thing, because this stacked right wing court would gladly throw the election to trump given any opportunity to do so.

    Bonus points: trump gets jail time in his NY sentencing later this month.

And to get me, somebody would have to shoot through the fake news. And I don’t mind that so much”. Calls for violence against his “political enemies” and in the press has been DJT’s mantra since he lost the election in 2020.

    And then we have Elon Musk and all his weird stuff. Rolling Stone had a story yesterday titled “Elon Musk PAC Fired and Abandoned Canvassers in Michigan Who Voiced Concerns”. It appears Musk hired out-of-state Black people, “had them sign non-disclosure agreements and transported them to Michigan neighborhoods in the back of a Uhaul without seats or seat belts”. When the canvassers complained about their treatment to the press they were fired without their full pay or transportation home. Sounds like DJT’s boondoggle at Coachella when he bussed his supporters to the venue but left them high and dry after the rally was over. DJT and Elon Musk–birds of a feather…!

      It is pretty obvious before the fact that uhauls do not have safety belts.

    5. If Trump is even half as far ahead in inperson voting in swing states as he was in 2020 – then the election is over by the time the polls close.

      Democrats do NOT have this huge advantage in early voting to allow them to catch up

      Democrats MUST get to within a point or two of Trump in election night voting – or the election is over.

      If Trump does as well by 9pm as he did in 2020 – even if most GOP early votes were rejected – Trump would win. Democrats are way behind in early voting from 2020.

      It may take a long time to count the mailin votes – though I expect that many states will be called with lots of early ballots uncounted – when it is clear Harris can not catch up.

      There are TWO things to watch for tomorow.

      1). How large is the democrat in person vote. Democrat early voting was way down from 2020.
      Unless inperson voting by democrats is way larger than 2020 – Democrats are going to lose – badly.

      We have heard over and over that Democrats are enthusiastic. But there is no actual evidence of that.
      Tomorow we will see if that claim is true.

      2). How much did Republicans “canabilize” their inperson voting by boosting their early voting numbers.
      Polls are indicating that 90%+ of Republican early voting is new voters or low propensity voters.
      If that is correct we should see Trump turnout in person very close to what we saw in 2020.
      If GOP turnout is low – that indicates that Republican enthusiasm is low and that they canibalized their vote with early voting.

      Regardless we do have two Key data points to follow that will tall us the real outcome long before all the votes are cast.

      If Trump is behind in the swing states at 9pm – the election is over.
      If Harris is not within a point or two in swing states at 9pm the election is over.
      There will not be democrat pickups of hundreds of thousands of votes as early and mailin ballots are counted.

Kamala’s handlers (aka Biden’s handlers) resorted to putting Cardi B on stage to publicly declare her endorsement but it turned into a laughing stock. Did they do it to attract black male voters? Female-to-male Trans / Male-to-female Trans voters? Voters who like to grab em by the p****?

Oh, it’s going to be ugly, and I am already braced for the inevitable violence from the ‘tolerant left’ on Wednesday (and tin foil hat me thinks they are hoping for retaliation that will justify further Federal idiocy).         Pollsters poll a couple of hundred people – rarely couple of thousand.

        If they guess wrong about the number of republicans voting, or the number of blacks – there results can be way off.

        Rassussent adjusted their results – to what they beleive is the likely electorate tomorow.
        But even rassmussen thinks they are going to be 2pts off in favor of Harris .

        But atleast one credible pollster beleives that Trump support is being underpolled by as much as 10%.
        If True we should see that quickly.

        The theory – which was True in 2016 and 2020, is that Trump voters are NOT responding to polls.

        The pollster predicting 10pts of unpolled Trump voters is basicially saying that the secet Trump voters grwe from 4pts in 2016 to almost 7 in 2020, and that likely means they are ar 10 now.

        I am very reluctant to stick my neck out that far.

        But I would be shocked if the polls are accurate, and ay more shocked if the polls overstated Trump support.

        RCP has Trump at 287:251 – I think that is the FLOOR for Trump.

        Betting markets favor Trump by 18pts.

        Predictions of hidden Republicans in 2022 were false – the results can in pretty much right on the pols.
        So maybe pollsters corrected.

        Every sign I see is that Trump’s support is far stronger than in 2016 and 2020.
        HOWEVER, I do see more Harris/Walz signs in my Travels than I did Biden/Harris or Clinton/Kane.

      Then, there’s opportunity–Trump only cares about opportunity for the very wealthy–who will receive huge tax breaks, paid for by cutting Social Security Medicare, Medicaid and school lunch programs. The wealthy who own businesses engaging in consumer abuses and environmental damage will have regulations rolled back so they can abuse consumers and pollute. Trump says “drill, baby, drill”, even though America is producing more petroleum than ever before. Harris proposes a $6,000 tax credit for parents of a new baby and $25,000 to help purchase a first home, along with construction of new rental housing and new homes for purchase, to help ease the cost of housing, and to allow families to create the opportunity for intergenerational wealth. Trump will abolish Obamacare–something millions of Americans rely on. He has “concepts of a plan”–which is nothing. What opportunities will people have if they don’t have health insurance, don’t receive care to prevent cancer and other illnesses?

      I notice also that you echo the MAGA media message that non college educated whites “are likely more intelligent than the ‘educated’ modern aristocracy”. MAGA media preaches the trope that educated people think they are better than non-educated people–“aristocracy”–that’s not true at all.   14. There’s ample reason why both parties will have lawyers at the ready. Trump tried to cheat last time and he’s bound to try again this time. Democrats have been planning for these kinds of lawsuits since last year. Turley forgot to mention that last time Trump sent lawyers all over the country suing counties and states on allegations of voter fraud that never produced evidence or lacked standing to sue. The allegations were wild. All based on conspiracy theories bereft of evidence and “witness testimony” that was largely hearsay.

    Jack Smith already has enough evidence to show how Trump and his sycophants tried to use fake electors and submit fraudulent certificates of those electors to overturn an election he clearly lost. Trump has already signaled he won’t concede if he loses just like last time. Will the Capitol be ringed with fences and extra police and national guard troops? Will they maintain a more robust perimeter this time?

    Trump’s campaign seems a little too confident. I suspect there will be a huge upset since most pollsters are not paying attention to the women’s vote and the fact that not all republicans may be voting for Trump. Younger women are more likely to vote for Harris, but also older women. Records numbers of early voting may be a bad sign for Trump. We’ll find out in the next few days how things pan out.

    1. I live in PA. I think the odds of Harris winning PA are very slim.

      But this election is complex.

      1). Harris does NOT have Scranton Joe’s PA cred. It is likely Trump is going to win in counties that he lost in 2020.
      2). Harris is actually doing poorly among black voters. That would be Philly and other major cities in PA.
      The major issue is no her percent of black voters, but that black voters appear to be sitting out this election.
      3). Mailin ballots from Democrats in PA are WAY down.
      4). Over the past decade and especially the past 4 years Republicans have made huge gains in PA.
      The number of registered democrats in some places has DECLINED. While statewide there are almost as many registered republicans as democrats. Republicans have had a net gain in registered voters since 2020 of nearly 200,000.
      5). Mostly “purple” states are like PA – they have a deep red portion and a deep blue portion. In PA we call the red part of the state Pennsyltucky. The red regions are growing and the blue regions are becoming lighter blue.

      BUT the big Trump “negative” is still going to be White Suburban Women. I live in a Reddish suburban area.
      There are significantly more Harris/Walz signs out than there were Biden/Harris or Clinton signs in past elections.

      While there is still REALLY REALLY strong Trump support – there is zero doubt PA Trump voters will come out.
      Probably in larger numbers than ever.

      There is more Harris/Walz support – in suburbs that I have seen for democrats in the past.

      As myriads of people are noting – we are in the midst of a massive voter realignment.
      My expectation is that PA will be solid red in a few years.
      But that is NOT today. things are still in flux.

      How the eastern suburbs – from Philly to Harrisburg vote will likely be decisive.
      Philly itself is likely to be down. It will still go democrat, but it will not provide near as many votes.
      Pittsburgh voting will be down, and the pittsburgh surrounds will be redder than ever.
      Butler – where the assassination attempt was is 20min from Pittsburgh and it is definitely Trump country, as is everything near it except pittsburgh itself.

      I think Trump will win PA by 2-3 pts.
      But I could be wrong and Harris could pick up enough suburban women to eek out a narrow victory.

        Interesting. I am in Southern NJ. I occasionally drive through Millville, which was once a heavily industrialized manufacturing (mainly glass; some iron and masonry makers) town dominated by union voters. After nearly all the industry left, it became mostly a slum, dominated by un- and under-employed financial aid recipients, although there remain plenty of retired union workers. Unlike most of this region, it has traditionally been reliably blue. In 2020, I saw hundreds and hundreds on Biden/Harris signs, with possibly a dozen Trump signs, on my drive through. A couple of weeks ago on the same route, I saw almost no political signs at all. In total, I counted 5 or 6 Harris signs and 2 Trump signs. Obviously, there has been a huge decline in the level of enthusiasm about this election (and probably politics in general). However, I cannot help but think that, on balance, the change in sign display is a positive sign for Trump. Not that he will get any of NJ electoral votes.

        You think Trump will win Pennsylvania by 2-3 points. Since Trump lost Pennsylvania by 1.2 points and the popular vote by 4.5 Points, Trump needs +3.3 points (all states increasing Trump’s vote equally) to break even on the popular vote.

        (Excluding a larger number of people voting.)

        4.5 points + (-1.2 points) = 3.3, which is higher than your estimate and doesn’t include the increased security in this election that alone should reduce Democrat votes.

        Does that mean you do not believe Trump will win the popular vote?
        Or Trump will not do as well in PA as elsewhere (on average)?
        Or ballot security in PA will not be as good as some predicted.?

        1. S. Meyer – I predict the margin will be smaller. I still think Trump is more likely to win PA than Harris, but I predict it will be more like by 0.5%. Pennsylvania voters are much more liberal than Ohio. In 2022 there was a gubernatorial and senatorial election in a year that was supposed to be a red wave. Shapiro won by a huge margin . . . and as for the Senate, at that time Fetterman could not understand spoken English, or speak English coherently. He was also know to be not just left but far-left. Yet he beat a famous and popular TV doctor (Mehmet Oz).

          P.S. Having said that about Fetterman, his language ability has improved since the election, and he has also had something of a revelation possibly from a near-death experience that has moved him to be more centrist.

            I would add that one thing that has been either looked over or purposely left out is PA is a major fraking/energy state. The Biden/Harris admin has been very anti-fossil fuel and Harris is well known to be against fracking. There are a lot of good paying jobs in the energy sector of PA. Also, a recent article found that natural gas would be the best, cheapest, fastest source of energy for future data and AI facilities as that industry is expected to grow immensely. PA would be a great benefactor and possible the Silicon Valley of the East Coast.

All fracking in NYS is on hold pretty much permanently, yet the Marcellus Shale has enough natural gas to power not only NY but many more states for years. If NYC and Philly could be given to NJ, then NY State and PA could become economic powerhouses. NJ is already deep blue so that would be a net win energy-wise.

                Why do Democrats who act as though they’re concerned about allegations of rape attack every single woman who says she was raped by Bill Clinton or Joe Biden? Why do they act as though Biden’s own daughter who said The Big Guy was screwing her in the shower was lying, just like the women they say were lying when they said they were raped by Bill Clinton and Joe Biden?

                Why don’t Democrats pretending to care about this not ask why Clinton and Biden weren’t attending court and sitting in the chair defending themselves. Same question that they level at Trump.

      2. The ruling was for sexual assault that may have occurred several decades ago or in the interim without forensic or witness evidence, or filing with the authorities. A strong case of judicial inference, prosecutorial indiscretion, with “benefits”.

        1. Let’s not forget that the Statute of limitations also had to be extended specifically for bringing this civil case. Ironic that the very Democrat that championed this ended up being sued for sexual assault by a woman that had surpassed the very same thing. Karma is a biotch!

  20. Return to jointly verified paper ballots like the old days where I grew up. We never had a problem….

      2. Most of the country did NOT use punched card voting.
        while there are places other than parts of FL that did.
        It still was not everywhere.

        In my community we used horrid mechanical voting machines – good riddance.

        in 2004 we had a choice between terminals and paper ballots.
        Today it is all paper ballots.

    2. And a purple thumb to prevent voting in multiplicity, from the penumbra of viability, etc. as done under UN convention in third-world nations.
