The Thrill is Gone: Will the Prosectorial Campaigns Collapse with the Political Campaigns Against Trump?

Below is my column in the New York Post on the developments in the pending Trump cases. I previously wrote that, if Trump prevailed in this election, it was likely that Special Counsel Jack Smith would “not see a jury in either of his cases.” This morning, Smith is reportedly in discussions on the possible dropping of his two federal cases against the president-elect. The prosecutorial campaigns appear to be collapsing with the political campaigns against Trump.

After years of thrill-kill prosecutions, the thrill is gone for lawfare warriors.

Election Day’s greatest losers may be special counsel Jack Smith, New York Attorney General Letitia James and Manhattan District Attorney Alvin Bragg.

Donald Trump’s victory was the largest jury verdict that some of us anticipated for years of unrelenting weaponization of the legal system.

Smith’s prosecutions ended with the 270th Electoral College vote secured around 2 a.m. Wednesday. His unrelenting efforts to convict Trump and then, when prevented from holding a trial, to release damaging material before the election have collapsed with the blue wall in the Midwest.

Trump has said he plans to fire Smith on Day 1. That means the end of both the January 6 and the classified documents cases.

That leaves James and Bragg as residue of long-forgotten lawfare battles, but even there Trump’s prospects look good.

James was able to secure a fellow lawfare warrior in Justice Arthur Engoron, who imposed a grotesque $455 million in fines and interest.

That ruling is pending an appeal that is expected to be a partial or even total victory for Trump.

Unlike Engoron, the appellate judges expressed great skepticism in September over the size of the penalty and even the use of this law.

Trump faced half a billion dollars in penalty in a case where no one lost a dime, and the alleged victim banks wanted more business with Trump and his company.

Separately, there is a hearing scheduled in front of Judge Juan Merchan for Nov. 11 on the “hush money” case involving Stormy Daniels, and a possible sentencing on Nov. 26.

If Merchan seeks to jail Trump, it is unlikely to be carried out, as Trump appeals the case and the many alleged errors committed by the judge.

Merchan made an utter mess of a case that should never have been filed, let alone tried. Even commentators like CNN’s senior legal analyst, Elie Honig, have denounced the case as a selective and unfounded prosecution.

The case should result in a conditional discharge with no jail time if Merchan can resist the temptation to unjustly punish Trump, a level of restraint that has largely proven difficult for him in the case.

Merchan created layers of appealable errors in the case. Putting those alleged errors aside, any sentencing to jail would create its own constitutional conflict with Trump’s performance of his federal duties.

The question is whether the election will bring a moment of sobriety for New Yorkers who have spent years in a full rage-driven celebration of lawfare.

While Trump did not prevail in New York, he came closer than any Republican in decades.

After this steady diet of politicized prosecutions in New York, Trump secured 44.3% of the vote, while Harris received 55.7%. In 2020, the margin was 23 points.

It is doubtful that the election will completely kill the appetite for lawfare in New York. As I wrote in my recent book, The Indispensable Right: Free Speech in an Age of Rage,” “rage is liberating, even addictive. It allows us to say and do things that we would ordinarily avoid, even denounce in others.”

What people do not want to admit that is that they like the rage.

Rage addicts will continue to push James and Bragg to continue these unhinged campaigns. It is not prosecutorial — it is recreational.

We can only hope that James and Bragg feel a twinge of humility when their cases fall apart along with the Kamala Harris campaign.

And Merchan has the opportunity to use this brief sobering moment and issue a conditional discharge without home or actual confinement.

He can take judicial notice of Trump’s election as our next president and end this circus in Manhattan.

Instead of listening to the braying mob, he can act as a judge and tell New Yorkers, in the immortal words of B.B. King:

  1. Trump is too soft-hearted. and sentimental, talks tough but lets bygones be bygones too quickly. Firing Smith is not nearly enough. MSNBC and others of their ilk will have a place for him, they are probably already beckoning. More must be done than mere loss of his job, something shockingly disproportionate. A warning marker must be set to ensure that nothing like this happens again, to anyone, of either party. Trump has sworn off revenge, but I demand a reckoning, and I’m confident I’m not alone. The Left must be crushed. Trump must appoint some cold-hearted deputies to do the things he is too magnanimous to do.

      I’m fine with Trump passing up pure acts of revenge. He has far too much on his plate in terms of policy decisions and actions needed to begin to straighten out the economic and foreign relations mess that we have been immersed in. However, I do very much hope that he, or his AG, will identify a few of the driving forces behind both the Democrat lawfare, and the attempts to cripple our form of government, and if legal offenses can be identified, prosecute those individuals to the full extend of the law. That would serve a dual purpose: it would forestall any attempts by those public serpents to resume their nefarious activities at some future date; it would serve as a clear warning to any who might aspire to adopt such behavior in the future that the ultimate reward of such activity is hard time in a barren concrete condominium with bars on the windows.

    1. Well, you make a valid point: The American electorate has soundly rejected this form of politicking for fear it will destroy America and with it the hopes and dreams of all mankind. Corny, I know, for those so far removed from all that threatens… we can expound upon this, and rightfully somebody probably should, but a party of losers is just that, a party of losers. But there are broader punishments that need to be meted out. Unfortunately, I’m hearing talk from the Trump camp that they want to “rise above” retribution, with one of Trump’s own sons saying that Hunter Biden should be pardoned. That’s absurd and if such action is actually taken will only incentivize the Deep State to continue its destruction of the Trump presidency the same as they did the first term. Trump cannot be nice to the Deep State as they will only interpret that as weakness, which it is. And taking the right kinds of actions againt the Deep State operators isn’t retribution. It’s justice.

  4. A major voting bloc I haven’t seen discussed is the Catholic vote. There are 52 million Catholics of voting age in the US. In 2020 they split about 50-50 between Biden and Trump. Yesterday it was more like 59-41 in favor of Trump.

    Harris alienated Catholics in a few ways. She openly opposed religious exemptions for Catholic doctors who declined to perform abortions. She opposed judicial nominees based on their Catholicism. And her comment “you’re at the wrong rally” in response to a person who said “Jesus is lord” was a turnoff to many Catholics. The difference in Catholic support between Biden and Harris contributed to Harris losing a number of swing states that Biden won.

    We may come to different conclusions. That is fine.

    Democrats need to figure out what they did wrong on their own. They are not going to listen to anyone else.

    I am not hearing claims the election was stolen – Trump won more than enough swing states by 3pts or more to win the EC.
    He won the popular vote by 3pts – because he knew he had to or you would steal it from him again.

    Trump lost 2020 by a mere 44,000 votes accross 3 states. I do not think there is a single Swing state Harris did not lose by significantly more than 44,000 votes, and she would need atleast 4 to flip this. I am sure Harris’s people spent all night plotting legal challenges and fraud claims. Otherwise she should have conceeded when PA was called at 2am.

    Harris conceeded at 4pm – because there was no republican fraud anywhere close to the numbers needed to flip this.

      2. James – “separation of church and state” is given shape by the Establishment Clause of the First Amendment. That clause prohibits laws or official governmental policies that establish a religion by the government, or that favor one religion over another. A politician quoting scripture in a speech is permissible. That has nothing to do with the Establishment Clause because it doesn’t create law or establish official government policy.

        James, the separation of church and state has nothing to do with a person quoting scripture. It was to prevent the federal government from establishing one religion over all others. Some states had a state religion supported by the state.

        Words that are not found either in the Constitution or the Bill of Rights – but many today repeatedly throw those words out there as though they are written word by word in either one of them or both.

        The “establishment of religion” clause of the First Amendment means at least this: neither a state nor the Federal Government can set up a church… The First Amendment has erected a wall between church and state. That wall must be kept high and impregnable.”

        The actual words in the First Amendment are completely different: “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof”. The word “separation” is not in there.

        The words “In God We Trust” have survived First Amendment challenges from followers of the religion of atheism, and few complain about having the Christian holiday of Christmas observed and paid as a statutory holiday. Just as few oppose laws relating to murder and theft as being government adopting Christian theology from the Ten Commandments as secular law.

        I don’t have to draw a connection to either religion or atheism to justify when I either agree or disagree with the opinion of anyone inside or outside of government. Logic and rational by themselves should suffice to do either.

        For those offended by either deist religions or by atheism being the theology of communism… well, suck it up and make a better argument based on logic and rational.

        Separation of church and state does not preclude politicians from quoting scripture.

        I quote the scripture frequently – not as a means of evangelizing, but because it often expresses universal truths or contains interesting observations.

        I have some policy problems with Trump. That does not change the fact that neither Harris nor Biden were within an order of magnitude of comparable.

        Regardless, only those on the left expect lockstep agreement.

    What this votes says is that fair minded Americans do not want to up fundamentally change the structure that makes this nation great. They don’t want to blow it up. They don’t want tens of thousands of illegal La dumped into small communities that do not have the infrastructure to absorb them. They don’t want gestational genocide to the moment of birth. They care sick of being treated like little children, tired of buying a 100 dollars of groceries and not needing a cart, they don’t want coward men playing women’s sports. The list goes on and on.

      The “will of the people” is only material within the parameters of those documents of fundamental law.

      However unfortunate, parasites and leeches may not vote for largesse in the forms of “free stuff” and “free status,” aka welfare and affirmative action, aka unconstitutional Social Security, Medicare, etc. 

      The American thesis is freedom and self-reliance. 

      Corrective action is mandatory to end the deterioration and decline of America into communist chaos, anarchy, and, ultimately, “dictatorship of the proletariat (i.e. hired help)” under the brutal control of the Intelligentsia.

        One difference between 45 and 47 will be that 45 accomplished everything from the WH, He did not trust much of the executive branch therefore nearly all important actions did not involve people beyond the WH.

        While I think things like ending the Ukraine war will be accomplished inside a very small circle – restoring the executive to constitutional limits requires lost of very good and trust worthy people throughout government. Trump says he is now well prepared to do that. We shall see.

        Regardless Trump is coming to DC with his own people – they are taking over. They have no interest in the input of the Biden/Harris people currently holding the reigns of power.
