In following the defamation trial against CNN by veteran Zachary Young, we have previously (here, here, and here) marveled at how bad things were going for the network. It appears that they are getting even worse. This has been a brutal week as CNN figures, including host Jake Tapper, took the stand. If “this is CNN,” the judge (and possibly the jury) are not liking what they are seeing.
The report at the heart of the case aired on CNN’s “The Lead with Jake Tapper” on Nov. 11, 2021, and was shared on social media and (a different version on) CNN’s website. In the segment, Tapper told his audience ominously how CNN correspondent Alex Marquardt discovered that “Afghans trying to get out of the country face a black market full of promises, demands of exorbitant fees, and no guarantee of safety or success.”
Marquardt piled on in the segment, claiming that “desperate Afghans are being exploited” and need to pay “exorbitant, often impossible amounts” to flee the country. He then named Young and his company as an example of that startling claim.The evidence included messages from Marquardt that he wanted to “nail this Zachary Young mf**ker” and thought the story would be Young’s “funeral.” After promising to “nail” Young, CNN editor Matthew Philips responded: “gonna hold you to that cowboy!” Likewise, CNN senior editor Fuzz Hogan described Young as “a shit.”
As is often done by media, CNN allegedly gave Young only two hours to respond before the story ran. It is a typical ploy of the press to claim that they waited for a response while giving the target the smallest possible window.In this case, Young was able to respond in the short time and Marquardt messaged a colleague, “f**king Young just texted.”
In the last week, Tapper was seen on video by the jury and was mocked for claiming under oath that he “doesn’t pay attention to ratings,” a claim that could make him unique as a network host. While Tapper can argue that he was referencing the following of daily numbers, critics hammered him by showing repeated clips where he discussed ratings.
However, the most damaging testimony may have come from top producers who told the jurors that they opposed the modest apology given to Young on air. Since Young seemed to do well before the jury, the testimony of senior editor Fuzz Hogan, CNN correspondent Alex Marquardt, CNN producer Michael Conte, CNN’s executive vice president of editorial Virginia Moseley, and CNN supervising producer Michael Callahan undermined any effort to portray the network as seeking to amend a wrong or reduce damage to Young.
Arguably, the worst moment came with an argument by CNN’s lead attorney, David Axelrod. Axelrod introduced a document that he claimed was a smoking gun and showed that Young was a liar. Pointing dramatically at Young and waiving the document in the air, Axelrod declared that he had the proof:
“Plaintiff’s entire case, sitting right there, is that after the publications, he couldn’t get any work…Mr. Young knew, when he filed this lawsuit that he had entered into a new consulting agreement with a government contractor one month after CNN’s publication. This entire lawsuit was a fraud on this court. It was a fraud on CNN. This man knew it. I don’t know what they know. But when his came up in discovery, CNN’s counsel asked Mr. Young about the Helios connection, and he completely lied in his deposition. Over and over again, he made up some incredible ruse that Helios just had his security clearance because it was a company that held security clearances. It makes no sense. He knew at that time that he had a consulting agreement with Helios Global and he didn’t disclose it. It was an outright lie.”
However, it turned out that the document merely was Young’s application to maintain his security clearance.
Young’s attorney, Vel Freedman, later laid waste to CNN. He told the court that Young had lost his security clearance back in 2022 and that he hadn’t been aware of that until he double-checked after his testimony in the case. Freedman asked for the right to present a witness who would testify on the issue and Axelrod objected. Judge Henry had had enough and blew up at CNN. He read back Axelrod’s comments and said “You called him a liar multiple times there.” He told Axelrod that he owed an apology to the plaintiff. After telling CNN that “this isn’t Kindergarten, ” he added “Right now, your credibility with me, Mr. Axelrod, is about none.”
That is never a good thing to hear from a judge.
Axelrod apologized but the damage is clearly considerable.
The most chilling aspect from a litigation perspective? Axelrod replaced the earlier lead counsel who also imploded in court over ill-considered arguments.
None of this bodes well for the network. Alienating the judge is obviously never good, but it also could have a material impact if there is an award that CNN wants reduced by a order of remittitur. In addition, having top producers expressing a lack of regret and even opposition to the on-air apology could push such damages higher for a jury. Both sides are arguing that “this is CNN,” but these moments are building a more negative view of what that is.

California’s Air Resources Board sent a letter on Jan. 14 to the U.S. Environmental Protection Agency, withdrawing its prior waiver request that would have forced a transition from diesel to zero-emission trucks in the state.
The federal environmental agency responded to the board’s withdrawal request on Jan. 14 with notice that no further action will be taken, and the matter is considered closed.
Regulators had previously requested in November 2023 that the agency approve a waiver to allow the state to enforce stricter rules for automobiles and diesel trucks.
One state lawmaker said the decision to rescind the waiver request would benefit the state’s economy and noted the decision could be one of the other policy shifts seen soon as state agencies respond to a change of power at the federal level.
“I think it’s great news. This is good for everyone,” Republican Leader Assemblyman James Gallagher told The Epoch Times on Jan. 15.
“They’re waving the white flag because they couldn’t get the waiver approved before the Trump administration came in.”
Highlighting the integral role trucks play in delivering many of the goods Californians rely on, he expressed concern that if only electric vehicles were allowed, costs would inevitably increase.

That is fantastic news. CARB already caused great mayhem in trucking. It unilaterally decreed that no medium and heavy duty trucks built prior to 2010 could be registered in the state. That affected trucking companies, and any business or individual that relied on larger vehicles. The company that pumps septic tanks in my neighborhood had to buy an all new fleet, which skyrocketed prices, and those trucks are not strong enough to drive up steep hills. The new engines are far less powerful. Truckers already had to buy new vehicles, because retrofitting to meet the CARB requirements just blew up their engines. This also affected people with horses who had medium duty trucks to haul.
Thus, CARB already jacked up the cost of most goods and services, by requiring transportation companies to buy new vehicles that cost anywhere from $80,000 to $200,000, each.
CARB was on a roll, and had determined to destroy the economy with that mandate for EV trucks.
California has an unstable power grid. They shut the power off when there are high winds. In fact, my son’s school is still shut down due to no power. We rely on gas-powered generators, but Newsom banned those, too, beginning in 2028, if I recall correctly. Mandating electric vehicles will kill people. You can’t charge an EV during a power cut, and you can’t escape a fire if the car won’t start. I have asthma. If I suffered an exacerbation when there’s smoke (like every year) during power cuts, if I can’t get the generator started, I could always plug it into my car with an adaptor. With an EV, I couldn’t even do that. I live in an area without cell service. A generator allows us to have WiFi, and runs the pump for our well, during the day while we run it. Banning generators means people like me won’t receive emergency evacuation notices, and we won’t have water, and if we have an EV, we won’t be able to leave, either, unless we hike for miles through arid drylands. Western movies have been filmed in this region of California, so you’d be hiking out, through a wildfire, in the setting of a Clint Eastwood movie. It’s getting harder to find anyone who can work on a generator, as well, because with the ban looming, that industry is leaving the state.
Democrat supermajorities have enacted policies that have been catastrophic.

I can actually tell you, the mentality at least, is not new: if they weren’t rich, they stood on street corners with cardboard signs and shouted; if they were rich they funded other people who stood on street corners with cardboard signs. As you know this week DJT suffered three straight losses before the SC. For obvious reasons, you haven’t discussed any of them. So permit me to discuss the latest defeat, and it’s much bigger than the CNN case. It’s Sunoco, LP, et.al. vs City and County of Honolulu, Hawaii. In 2020 Hawaii sued big oil under state consumer protection laws for lying about the toxicity of their products. The case wound its way up to Hawaii’s SC court that upheld Hawaii’s consumer laws. In January of this year big oil file for a writ of certiorari before the SC alleging the Hawaii case was preempted by federal law. This week the SC denied the writ. At the time of it’s request for a writ big oil and right-wing groups, like Leonard Leo and the Federalist Society, launched a media blitz to try to convince the right-wing of the SC to should oil companies from the Hawaii lawsuit. Justice Alito recused himself from the case because he is heavily invested in oil stocks.
Defending it’s lawsuit against big oil Hawaii stated: “Defendants have known for more than 50 years that greenhouse gas pollution from their fossil fuel products would have a significant adverse impact on the Earth’s climate and sea levels”. It’s like the consumer lawsuits against big tobacco years ago when the tobacco companies finally had to admit it’s products were dangerous to human health and they were forced to pay billions in damages. Hawaii pointed out that heat waves linked to climate change gave stressed Honolulu’s electric grid, and that a waste water treatment plant would need to be retrofitted against sea level rise at a cost of hundreds of millions of dollars. Hawaii wants big oil to pay for those retrofits.
So the dam has been broken. Local communities and states can now bring lawsuits against big oil to make them accountable–to force them to compensate for the toxic environment they have created. Eleven state AGs and about 86 municipalities have filled similar lawsuits, like Hawaii, against big oil over the past few years. Now those lawsuits can proceed. That’s big oil’s biggest nightmare! I’m quite sure CA Gov. Newsom is preparing lawsuits against big oil to make them pay for the cleaning up and rebuilding due to the wildfires in SoCal which will cost hundreds of billions of dollars. Most climate scientists say these wildfires were exacerbated by fossil fuel induced climate change.
The SC court’s ruling is a big blow to DJT’s “Drill, baby, drill” agenda. His campaign last year was “fueled” by millions in campaign contributions by big oil that thought it was buying protection from lawsuits like the one in Hawaii. Will big oil be asking DJT for a refund?
OH, I hope the dam has been broken, and that “Big Oil” pulls completely out of Hawaii as a result! My guess is, within a week, Hawaii would dismiss its lawsuit.

Gavin Newsome knew that the dams he removed had already built salmon accessible ladder runs but he had the dams destroyed for political gain and SoCal is suffering from his decisions and the failed policies of the Democrats. Wise citizens are figuring it out.
The denial of cert is disappointing but expected, and ultimately not significant. SCOTUS rarely grants cert at such an early stage of a case. The outgoing solicitor general advised the court to let the case play out in state court, and then let any appeal make its way up the chain through the usual channels, and the court seems to have accepted that advice. That is all.
The underlying case is completely frivolous, to the point where an honest court would sanction the plaintiffs’ lawyers for wasting the court’s time and burdening the defendants with the cost of preparing a defense. But there is no need at this stage for federal intervention; the defendants will have to waste millions defending themselves against this frivolous action, probably lose in a corrupt state court system, and then appeal to federal court and win.

There still is no actual decision. It is extremely rare for SCOTUS to stop any case no matter how meritless prior to a final decision in the lower courts.
Despite conservative attacks on Roberts and Barret SCOTUS also refused to block Merchan’s sentencing.
That was the correct decision. SCOTUS should not intervene unless and until all the lower courts get this wrong.
It is not SCOTUS’s job to intervene in every bad lower court decision.
We have appellate courts for that.
There is no doubt that Merchan’s case will be thrown out.
