We have previously discussed the defamation case involving Georgia gynecologist Dr. Mahendra Amin who was allegedly defamed by MSNBC, including by host Rachel Maddow, as the “uterus collector.” Now, not long after a settlement of CNN of another defamation case, MSNBC appears to have forked over damages to Dr. Amin to avoid a trial.
The case was not going well for NBC before it threw in the towel to avoid the April trial. That trial would have been embarrassing for hosts Maddow, Hayes, and Wallace as well as NBC News reporters Jacob Soboroff and Julia Ainsley, MSNBC producer Denis Horgan, senior director of stands and practices Mary Lockhart, deputy head of standards Chris Scholl and others.
The complaint alleged that NBC reporters Jacob Soboroff and Julia Ainsley developed the story on the whistleblower’s claims despite initial skepticism from the network’s standards department.
MSNBC quickly followed with a series of on-air reports in which the doctor was often referred to as the “uterus collector.” The story was based on allegations by “a former nurse at the facility named Dawn Wooten.” Wooten is quoted extensively in the opinion:
We’ve questioned among ourselves like goodness he’s taking everybody’s stuff out …. That’s his specialty, he’s the uterus collector. I know that’s ugly … is he collecting these things or something[?] … Everybody he sees, he’s taking all their uteruses out or he’s taken their tubes out.
Despite misgivings about Wooten’s credibility, MSNBC continued with stories that portrayed Dr. Amin as a virtual Dr. Mengele. Critics charged that the story was irresistible for the channel because it combined reproductive health, immigration, and social equity issues. Whatever the reason, hosts and executives set aside their doubts and ran stories that made Dr. Amin an infamous figure throughout the country.
Judge Lisa Godbey Wood (S.D. Ga.) found that the stories were false in claiming that Dr. Amin performed “hysterectomies that were unnecessary, unauthorized, or even botched.” She also found that MSNBC may have published the reports knowing that the allegations were false or with reckless disregard for the truth.
In granting summary judgment in favor of Dr. Amin, Judge Wood wrote:
Multiple statements are verifiably false. The undisputed evidence has established that: (1) there were no mass hysterectomies or high numbers of hysterectomies at the facility; (2) Dr. Amin performed only two hysterectomies on female detainees from the ICDC; and (3) Dr. Amin is not a “uterus collector.” The Court must look to each of the statements in the context of the entire broadcast or social media post to assess the construction placed upon it by the average viewer. Doing so, the undisputed evidence establishes that multiple NBC statements are false.
The Court emphasized that “it does not matter that NBC did not make these accusations directly, but only republished the whistleblower letter’s allegations. If accusations against a plaintiff are “based entirely on hearsay,” “[t]he fact that the charges made were based upon hearsay in no manner relieves the defendant of liability. Charges based upon hearsay are the equivalent in law to direct charges.”
That can be a chilling standard for the media, which often reports on the fact of allegations that are newsworthy. However, Judge Wood said that NBC went well beyond such a role in this case:
…the focus of these three broadcasts was not on unnecessary or unconsented-to “medical procedures.” The focus was on “mass hysterectomies” and “high numbers of hysterectomies,” performed without necessity and consent, at the facility. This is reinforced by MSNBC’s own headlines: “WHISTLEBLOWER: HIGH NUMBER OF HYSTERECTOMIES AT ICE DETENTION CTR.” and “COMPLAINT: MASS HYSTERECTOMIES PERFORMED ON WOMEN AT ICE FACILITY.”
The court noted that “[w]hile opinions and hyperbole are typically non-actionable, they become actionable when they are capable of being proved false.” That includes MSNBC referring to Dr. Amin as someone known to be a “uterus collector” and “taking everybody’s stuff out” state facts that can be proved false. Judge Wood held that “[t]hese statements are not mere subjective assessments of Plaintiff over which reasonable minds could differ. They are also not simply rhetorical hyperbole or obviously exaggerated statements that are unprovable…”
Under Georgia law, the court held that this met the “actual malice” standard. Given the earlier losses in court, the expectation is that Amin received much, if not all, of the requested $30 million demanded in the lawsuit. It appears that Dr. Amin is now the “damages collector.”
Jonathan: In a previous comment (“Crash Landing”, 2/21@12:13pm) I pointed out how a town hall meeting called by MAGA Rep. Rich McCormick in his Georgia district turned into a shouting match–constituents pushing back on McCormick’s slavish support for DJT’s policies. Now we have other constituents in open rebellion. There is something palpable in the air!
In a DJT+6 district in Wisconsin MAGA Rep. Glenn Grothman faced another hostile crowd at his town hall meeting. Grothman told his constituents DJT had done “some very good things”. He was met with resounding boos and catcalls. In West Bend, WI MAGA Rep. Scott Fitzgerald was asked by a woman “When are you going to stand up to them [DJT and Musk]?” The town hall meeting erupted in applause.
Seems the luster is coming off of DJT and Musk’s victory parade. MAGA voters are starting to have second thoughts!
Yawn…
“Yawn”.
Aren’t you cute.
More astroturf.
Dennis – no one thinks these political stunts matter.
If History is a guide Trump will lose the house majority in 2026.
Though there is a reasonable chance of 2 pickups in the Senate.
and near 0 chance of D senate pickups.
That will be true even if he does remarkably well in the next 2 years.
But if an election were held today – House democrats would be wiped out.
The only people less popular in Washington that democrats – are their leaders.
It is possible that there is a hidden large angry mob that is suddenly incredibly unhappy with Trump,
but the polls are saying the opposite.
In fact Trumps actions are more popular than Trump is.
And the popularity of democrats in is the $hitter.
Take some political advice from DEMOCRAT political experts.
The democratic party is in trouble
https://www.liberalpatriot.com/p/one-simple-question-for-democrats
Dennis – you have been predicting Trump’s demise for years – yet it has never come.
When you controlled governemnt you threw EVERYTHING at him – and failed to thwart him.
Why do you beleive you will do better when Trump has power ?
When do you realize your waiting for something that never will come ?
John Say,
One thing you can count on, is Dennis to be wrong, again.
“MAGA voters are starting to have second thoughts!”
You’re lying, yet again, about the makeup of those town hall meetings.
Imagine that.
Sam,
He is lying alright. We are not having second thoughts. We are happy and cheering Trump, Musk, DOGE and all of Trump’s appointees on! This is what winning looks like!!
“We are not having second thoughts”
I do not consider myself a “MAGA voter”. Trump’s personality continues to irritate me frequently, and I have zero expectations that I am going to agree with everything he says, or does, for the next four years. However, I voted in this past election in the hopes of seeing someone start throwing roadblocks in the way of the runaway train to the utter destruction of this nation and everything it once stood for that the Democrats had us on. Over this past month, Trump and his administration have far exceeded my expectations in that regard. I don’t know if Trump can derail that train, stop in in its tracks, or even do more than slow it down. But I am very pleasantly surprised with the results to date.
Jonathan: What you ignore in your discussion of the MSNBC settlement with DJT is all the other cases he lost this week in federal courts around the country.
Take, for example, the case in Baltimore where a federal judge stopped DJT’s attempt to cut federal spending for DEI programs. Judge Adam Abelson ruled that DJT’s policies violate the First Amendment because they chill the “free speech” rights of federal contractors–they will be punished if they don’t eliminate DEI programs from their workplaces.
Within minutes of Abelson’s order another federal judge barred Musk’s DOGE from accessing sensitive Treasury Dept. data bases. That was followed up by the SC that maintained a TRO blocking DJT’s ability to fire an ethics watchdog IG. Left and right DJT is losing legal battles over his policies that violate the law. That puts the MSNBC settlement in perspective!
THE EXECUTIVE POWER, THE WHOLE EXECUTIVE POWER, AND NOTHING BUT THE EXECUTIVE POWER, SO HELP YOU GOD
This utterly corrupt judge must be impeached and convicted for egregious subversion, conspiracy, corruption, insurrection, abuse of power, usurpation of power et al.
This utterly corrupt judge knows full well that he has not a scintilla of executive power and only the president exclusively has all executive power.
This utterly corrupt judge should adjudicate accordingly; that is the nature of power or a lack thereof.
_____________________________________________________________________________________________________________
Article 2, Section 1
The executive Power shall be vested in a President of the United States of America.
Dennis McInliar is just another stooge that claims he is a lawyer but somehow doesnt know the difference between a TRO and losing a case.
These cases will work themselves through the process and most will be upheld. It is a normal part of our process. He will win most and lose some. This time, however, most of the EOs are carefully crafted in such manner that they will eventually pass through. Good thing DJT now has an army of thousands of attorneys and deep pockets.
Zzzz…zzz…zzz…
I still can’t believe that I ever watched MSNBC thinking I could get “the news” from them. They were the ultimate betrayal of Journalism. Their people are re-programmable zombies selling the network’s political agenda.
Los Angeles Wrestling Match Blacks vs Lesbians. Who will win? The firefighter dyke who can swing an ax like Paul Bunyan or the black mayor partying in Africa only to return to Los Angeles and act like a karen?
Who will the mainstream media choose to win? Who will LA voters support?

The voters of LA tend to vote for bad candidates over better ones. You can count on it. Exhibit A is that they choose Karen Bass over Rick Caruso.

Canadians have been notoriously and proudly unpatriotic and disdainful of American patriotism.
Trump fixed that.
Now singing O Canada and saluting the Maple Leaf flag and cancelling trips to the US are popular.
https://nypost.com/2025/02/22/us-news/canadians-cancelling-us-travel-en-masse-in-face-of-tariff-threats
I hope they don’t realize they are citizens with a country to preserve before Alberta and Saskatchewan [the good provinces] become the 51st and 52nd States.
They can keep the rest.
I hope they don’t realize they are citizens with a country to preserve before Alberta and Saskatchewan [the good provinces] become the 51st and 52nd States.
For every Canadian ignorant of their American neighbors, we have at least as many Americans equally ignorant of our Canadian neighbors. Both of those “good provinces” have elected socialist governments in the recent past. Alberta’s current premier is in danger of being replaced by the socialist party that her party managed to defeat and put her in power. Alberta and Saskatchewan, as well as some other Canadian provinces are similar to states like California and Washington: a large number of those outside the urban centers are blue collar workers and vote conservative – but the large urban areas vote socialist.
That aside, I do know that the idea of making a country the size of Canada – bigger than the USA – into one massive state is probably the stupidest thing ever conceived or suggested by anyone who prefers Republicans to run the country rather than Democrats. What a spectacular way to decide your party will commit suicide.
If Trump were to magically absorb Canada as the newest state in the near future, his presidency and the Republicans would be crushed in the upcoming midterm elections. Those weird, ungrateful Canadians are a bunch of lowbrow patriotic nationalists who don’t like the idea of being told which country they should belong to. Weird indeed that they think like their American neighbors when it comes to things like that. Trudeau may be hated from sea to shining sea with the heat of a thousand burning suns, and they can’t wait to throw him and his Marxist buddy out – but one way to get rid of the political divisions in that country is to threaten and belittle them.
The new 51st state, after being absorbed, will send two new Democrats to the Senate – not Republicans. And all those new Congressmen that would go to the House to represent those 36 million people – anyone believe the vast majority would be Republicans instead of a replica of California’s House members?
Who convinced Trump that Canada would send a majority of Republican House members, instead of Democrats? Trump’s last two years would be two years of gleeful Democrat endless impeachment proceedings and Trump’s/our agenda down in the dirt beside his dick that he stepped on to bring that about.
Smell the victory from all of that!
We in America have been notoriously and proudly disdainful of our Canadian neighbors if we want to look into that mirror of contempt for a neighbor. Over the years many Americans have proudly proclaimed they will no longer travel to Canada for various reasons, won’t buy Canadian products, etc. We did it when Trudeau was elected. We did it again when he changed Canada’s gun laws with his phone and pen. We did it when he rammed through his anti-free speech legislation.
It’s not like being a nationalistic retard is a mental malfunction only found on the Canadian side of the border. Populists in both countries prey on and hope to improve their image by appealing to that mindless emotional defect.
Meanwhile, polling on both sides of the border over many years, including long before Obama, Trump, Trudeau, Biden, etc have shown that the unwashed masses of both countries have ranked their neighbor as their favorite foreign country. Approval ratings for America prior to Trump shooting his mouth off with this populist threat that maybe we would annex Canada were just over 80% – that poll was just after Trump won the election, so they didn’t mind Trump being elected then. Year in and year out, Americans and Canadians like each other, even when we’re respectively electing politicians like Trudeau and Trump respectively talking shyte about the neighbors. Imagine that – ordinary people are more adult than their elected leaders are!
But now, Trudeau and his Leninist Liberals are incredibly grateful that Trump has decided to use the oldest trick in the book to unit the citizens of a country – threaten it or attack it in some way. Suddenly they have a chance to not only survive the upcoming election, but remain as the political party in power. Talk about being thrown a lifeline by Trump!
Trudeau’s Liberals were looking at a crushing defeat, not even the status of Official Opposition, leaving them as the party that would be in fourth place after whenever the Canadian election is held in the next few months. Their popularity was in the low 20% range, with the Conservatives under Pouillivere looking like it would be an easy cruise to a large majority win.
Trump’s lapsing into his old style of motor mouth concerning Canada has turned all that around. The Liberals are claiming that Pouillivere is like Trump – and now they’re up to within a percentage point or two of the Conservatives. It is now quite possible that, instead of getting Pouillivere who is far more fiscally conservative than Trump, with IMF bankster Carney as the new Liberal leader, Canadians and we are more likely to get yet another round of Liberal socialism.
Perhaps Trump never thought that attacking Canada while it was on the verge of an election, where all polling showed the Liberals as dead men walking, wouldn’t affect that election. Or perhaps Trump believes he can get better deals, partnership, and support out of a Canadian socialist government than he would with a government led by a strong conservative like Pouillivere?
Only the mind of Trump knows the answer.
Satisfying to see justice done for this savagely maligned doctor.
OT:
There is some call for President Trump to receive the Nobel Peace Prize.
I think not.
It is a big step down for him to receive a ‘prize’ already dirtied by the likes of Arafat and Obama.
It wouldn’t add to Trump’s luster. The Nobel committee would only nominate Trump to try to recover a bit of their own degraded reputation.
He is simply too big for their trinket these days.
The epitome of covetous, failed, barren, prole parasites: Arafat and Obama.
Young,
Trinket. Exactly!
Jonathan: A doctor collects from MSNBC because they caved. On the opposite side there is another media giant has not caved in to DJT. It’s CBS who is in merger talks with Paramount. Several months ago DJT sued CBS for $20 billion claiming reputational harm to all his companies after the media giant allegedly edited an interview with Kamala Harris that made her look good and DJT look “bad”. CBS has told DJT in a recent court filing “if you want to go down that road, fine, we are prepared to do that”. So CBS has asked the court in Texas to either dismiss the case or grant discovery into all of DJT’s personal finances of all his companies. CBS also wants to depose DJT to see if he can back up his claims of reputational harm.
Remember when DJT sued Michael Cohen for defamation and hundreds of millions in damages. When it came time to put up or shut up DJT caved. Shortly before DJT was set to be deposed he dismissed that case. Why? Because DJT doesn’t want anyone to see the finances of any of his companies–the fact that Truth Social is losing hundreds of millions every year.
Let’s hope CBS stands up to DJT who thinks he can get his new FEC Chairman to lean on CBS to settle to get approval of the merger with Paramount. That’s using a federal agency for purposes of extortion. Naw. DJT wouldn’t do that, would he?
ENOUGH!
Civility Rule violation here by egregious impudent impertinence designed, not to contribute, but to disaffect, to inject mayhem into the deliberations herein.
If a lie or otherwise falsehood or defamation is found anywhere in Dennis McInliar’s posts, the blog must:
BAN FOR LIFE?
“A doctor collects from MSNBC because they caved.”
They settled because they were going to lose and a settlement is less damaging than a loss.
“On the opposite side there is another media giant has not caved in to DJT. It’s CBS who is in merger talks with Paramount. Several months ago DJT sued CBS for $20 billion claiming reputational harm to all his companies after the media giant allegedly edited an interview with Kamala Harris that made her look good and DJT look “bad”.”
The editing is not alleged – CBS has had to produce the raw tape and Not only is it clear the video was edited but that is was done highly decepitively. I do not beleive anything in either the edited or unedited version made Trump look bad.
“So CBS has asked the court in Texas to either dismiss the case or grant discovery into all of DJT’s personal finances of all his companies. CBS also wants to depose DJT to see if he can back up his claims of reputational harm.”
This case is essentially a civil election interferance case. There is a basis for FEC sanctions. There is a basis for the FCC to get involved.
But I am not sure what Trumps claim can be. He won the election – a civil complaint requires real harm.
Given that Trump won what is the real harm.
Lying about someone else is NOT defamation.
It is my understanding that the FCC is investigating.
Given the law – I think CBS has a real problem there. They are a Broadcast network, not a streaming one or a cable one, so they are fully subject to FCC laws covering election related broadcasting. And by editing the interview in a highly deceptive way they went from protected reporters, to political advocates.
That said – the FCC is unconstitutional and a bad idea.
With respect to the FEC when CBS shited from reporter to advocate, the interview became a massive inkind contribution.
“Because DJT doesn’t want anyone to see the finances of any of his companies”
I do not want you to see any of my finances. DJT stock closed at 27 today – with a market cap of almost 6B
Conversely Bluesky has a market cap of 12.4M
Damage to reputation is an area that is only addressed in court AFTER the defamation is established.
There is no basis for CBS to try to address nbet worth finances or reputational value prior to that.
“Let’s hope CBS stands up to DJT who thinks he can get his new FEC Chairman to lean on CBS to settle to get approval of the merger with Paramount.”
As I noted above – I would abolish the FCC – but given that they exist and the existing law – CBS is in serious trouble with the FCC.
But they would not even be subject to the FCC if they were a cable or streaming only service.
Personally I do not think Trump should win this – he won the election there is no actual damage.
More generally EXCEPT for our own government trying to influence out elections, all laws or pretense of laws that pretends that trying to influence an election is a crime are both wrong and unconstitutional.
You can say anything you want to get elected. Lying is not a crime, and the punishment for candidates lying is the ire of the voter.
That said – we have heard this constantly left wing nonsense about election interferance or influencing.
Which all seems to boil down to my team can do whatever it wants – yours can only do what I allow.
Which is not free speech and not how the US is supposed to run elections.
But today we have LOTS of evidence that the US was influencing and actively interfering in foreign elections.
“That’s using a federal agency for purposes of extortion.”
Nope.
Again I would abolish the FCC., further it is bizarre that print journalism, streaming, and cable are not subject to FCC election laws, But broadcast news is.
I see lots of good reasons to toss this case. But that does not change the fact that CBS deceptively edited the interview and viewers – not Trump or the FC should hold CBS accountable – which they are, which is why they are despate be sold. Perhaps Kevin O’Leary will buy them for pennies on the dollar, fire 3/4 of the company and bring back a lean mean rationalistic machine.
Trump is suing for harm to his campaign based on the texas deceptive trade practices act.
With respect to your nonsense – CBS has no right to finances outside those of the campaign.
At the same time – Trump won therefore the lawsuit should be dismissed.
the FCC complaint is more of a problem for CBS.
For those of you in Rio Linda, PMSNBC turns out to be a $30 million mad cow.
Best Result, hit the Radical Left Wing MSM/Liberals where it hurts, take their $$$$$$$ away. The one thing they care about is $$$, so take it away from them.
Then they go to their local NGO for USAid handouts to replace the thirty million. Just ask Stacey Abrams who got two thousand million, that’s two BILLION to essentially do absolutely nothing. Oh, they’re going to DE-CARBONIZE homes in the US. Uh huh, sure…
Looking it up. 2 BILLION?
NBC spun them
Off on their own. Soon they will be lost in space. They are down to ratings similar to SpongeBob SquarePants.
The hosts may need to go to night school and learn coding, that is if they can keep up with a third grader from India.
MAD COW disease!
So where is Mike Obama?
I agree with Professor Turley when he said “that can be a chilling standard for the media”. However, I wish he explained or analyzed the issue further in his post.
Concerned Citizen
Turley abandoned any attempt at detailed legal analysis a long, long, long time ago.
He has no interest in “detailed legal analysis” any more
He is now nothing more than a bought and paid for shill for Rupert Murdoch, Fox “News”, and the MAGA cult.
He has sold out for the big bucks.
One of CNN’s fired journalists who was richly rewarded for promoting the Clinton/Obama/Biden/DNC “Trump-Russia Lie” has popped up here to flex and pose on behalf of the Soviet Democrat-Marxist Mainstream Media Propaganda Complex. The message:
BBBBBUUUTTTTT…. MUH TRUMP!!!!! BBBBBBUUUUTTTT…. MUH FOX!!!!
He has not sold out for big bucks. He has multiple streams of income. He is not dependent on anyone of them. He is a tenured professor at GW University. He has a highly successful book that is on it’s fourth printing. He has appeared on Capitol Hill. He gives speeches, I am assuming paid speaking engagements. And he writes columns for not only Fox, but the NY Post, The Hill and USA Today. He probably could retire tomorrow but loves what he does. Good on him!
. . . bought and paid for shill for Rupert Murdoch, Fox “News”, and the MAGA cult.
Translation into English: Professor Turley refuses to regurgitate left-wing talking points.
Well, Anonymous (in my imagination, you are Rachell Maddow or maybe Adam Schiff), it’s funny, but no one is suing him for saying anything false. It’s hard to do legal analysis in a few paragraphs (perhaps you don’t know that) but he does better than just about anyone else at it. He’s exceptionally fair minded. That’s my guess why Fox has him on.
#74 The malice idea? Yes, good one. The effect is mal, foul. Pretty good…there’s harm as evidence.
Dear Prof Turley,
How much if MSNBC called me a Putin-puppet KGB secret asset? Probably stole the election.
*damages is one way to cut down on excessive media mis/disinformation .. .
Negligent disregard…
The real head scratcher is by reporting on the case, someone or someones skepticism from the network’s standards department, then others ignored or dismissed that skepticism and ran the story anyways. Did they actually believe they would and could get away with it? That they were too powerful to stand up to? Or too powerful for any scrutiny? That their own journalistic integrity would stand up to scrutiny? Yes, I see why they would settle. A trail could of reviled all kinds of things. Not that it would of matter much anyways. It would only confirm what we know of MSNBC already, they are hacks. Would explain why their ratings are so bad and why MSNBC is on the For Sale block.
Elon Musk should buy them! I would watch just to see Rachel Maddow cry!
“Elon Musk should buy them!”
Musk has a sh1t-ton of money, but he cannot buy every leftist loser outfit and turn it around. Most of them must be allowed to go to their richly deserved demise.
It would seem that basic research into the allegations and the credibility of the whistleblower would have revealed the truth.
Not every whistleblower is innocent as the driven snow and not every focus of an expose is a villain. It would seem that modern day journalists no longer have the capacity to conduct a legitimate search and vetting. The story does not write itself but is supposed to have a human brain involved in there somewhere that can think, assess and the make judgements. When the story seems to good to be true, then one should be even more diligent in the search for balance and truth. Recent events would seem to prove that. Now the journalists need to only learn the lessen.
GEB,
I agree that some basic research, vetting likely would of proven the story false in the first place, advocacy journalism does not conduct such journalistic practices. They forego them long ago. Rather it is about the narrative, the spin, the propaganda. That is why so many people are switching MSM off. The Food Network and Sponge Bob have higher ratings.
research might have ended their agenda-driven story…now why on earth would a propagandist want to miss and opportunity to push that agenda? We truly need to stop looking at news agencies as that and expect propaganda when reading their dribble. Ii do agree with Nigel Farage that the woke west is no longer the viable path to the future but is now seen as the flawed ideology that ruined (almost beyond repair) the western world. Perhaps these institutions are realizing that trend and want to repair their ability to be seen as viable (that won’t happen but let them dream).
I remember when the baying wolf pack went after Dr. Amin. An immigrant himself, he was under contract to ICE, as I recall. And while I remember he was not the greatest obgyn, they knew at the time he had performed only two hysterectomies. The outcry brought an investigation, which verified both were medically necessary.
MSNBC was manifestly unjust.
The have no shame or even a concept of what shame is. Or morals, ethics.

I’ve been in the White House press room. There are only a finite number of seats. And obviously space on an airplane is limited. Not all who want access can be accommodated. Helen Thomas was ousted after 50 years, when she criticized Israel’s displacement of Palestinians.
Oooooohhhh…. the D.C. Docket Watch!!!!
Got any content to show us from where those DC courts hauled all those Washington DC Democrat lawyers serving in the Obama/Biden administrations back into their courtrooms to answer for their repeated felonies of perjuring themselves to those courts and those judges. Uttering false documents to those courts while doing so?
Any action on the DC Docket dealing with that Democrat crime wave that took place right inside their courtrooms?
Are we wrong to believe that the D.C. courts are the Democrats equivalent of the old Soviet KGB: the sword AND shield of their political masters?
Trump should REALLY troll the AP and their defenders by announcing there’s very few available seats, and he has reassigned the AP’s seat to Breitbart News.
The AP Complaint (Page 8-14), Now this is Juicy !
I give it 5 Filet Mignon 🥩 🥩 🥩 🥩 🥩
That is your idea of Juicy ?
Frankly it is boring.
Lets presume every word in it is true.
There is not some first amendment right that belongs exclusively to the AP.
As AP notes – other reporters are covering the evnts they are not.
As the AP notes other reporters refer to the gulf as the gulf of mexico.
So what is the AP’s claim ? If they claim they are being censored for refusing to capitulate to Trumps request
then Why by their own evidence ONLY AP ?
The claim seems to devolve to – “its unfair” – that is not a valid first amendment claim.
That is not a valid legal claim.
I would note that historically the WH has blackmailed and blackballed reporters to get the coverage it wants.
Mostly that does not work – though it did for Obama.
Regardless if you take everything AP claims as true – their being discriminated against.
So WHAT ? That is legal There are a few SPECIF reasons you can not be discriminated against – such as race, or religion.
What you call the gulf does not put you into a protected class.
I suspect that Trump will lose this in the DC courts – but that just continues Trump’s efforts to pain the DC courts as politically biased.
At the supreme court – this gets more complicated.
This is not a free press case – Trump has not reduced the size of the press core.
AP is claiming to have special privileges – that is a really unappealing argument.
They are making a claim of compelled speech – but this is not about Trump compelling the press as a whole,
By AP’s admission it is very narrow and specific to AP. And AP’s own argument that it is special – backfires.
Trump appears to be targeting the AP Style sheet – because other reporters are practically FORCED to follow it.
So AP is saying Trump can not compel us, but we can compel others ?
Hypocrisy is not always a correct legal counter, but it undercuts all your moral authority.
I am not sure that Trump will win this fight in the courts.
But I am sure that this is close to a win win for Trump.
Even if Trump loses – he wins.
A story to irresistible to not report, even if someone at MSNBC thought it might be questionable. Good on the doctor for getting damages out of them. Serves them right. On the flip side, it would of been awesome to see it go to trial, see them get put on the stand and torn apart with their own reporting. Journalistic integrity is something MSNBC and MSM is not known for.
Upstate Farmer. That would have been nice to see. Sort of like going to a Nascar race mainly to see the crashes .
Is there any other reason to go to a NASCAR race, other than maybe a fight in the pits?
How long until they pull the plug on MSNBC – it can’t be making any money – not with their ratings and the salaries they are dishing out to some of their “stars”
I wonder the same thing, myself.
