“Defamiliarizing” the Border: Professors Denounce Borders in Opposing Trump Immigration Policies

For years, the mantra on the left was “reimagining” everything from policing to free speech to defense. Reimagining often was a synonym for defunding or limiting the subject matter. Now, Georgetown Law Professor Sherally Munshi and others are attacking border enforcement as “ethically indefensible.” Munshi calls it “defamiliarizing” the whole concept of borders, which she and others in higher education now find morally reprehensible.

Munshi’s talk, “Unsettling the Border,” is an example of how radical many law faculties have become. She is by no means a standout in such theories. While schools have purged their ranks of conservative, libertarian, and dissenting faculty, there is no limit to faculty writing on the far left.

Munshi insists that “there is nothing natural or inevitable about the United States’ contemporary borders.” She mocked the whole notion of “the so-called border crisis.” Millions of unvetted people just walking over the border is not a crisis… at least not for the country. It is failure in ourselves; “a crisis of imagination.”  Accordingly, she is calling for reimagining or defamiliarizing borders:

“Our task, as I put it, is to unsettle the border, to defamiliarize, disenchant, and recontextualize it by critically evaluating the historical processes, the legal developments, the discursive formations that naturalize and legitimate the border.”

It is, of course, racist to want to have secure borders:

“Rather than redress the fact that the international border regime is practically unsustainable [and] ethically indefensible, majorities in the whitest and wealthiest nations are embracing an increasingly authoritarian form of nationalism and exclusion.”

Borders, according to Professor Munshi, are just a construct “within the American imaginary, the southern border divides white from indigenous, purity from heterogeneity, civilization from savagery, settler from Indian.”

Of course, this reimagining of borders will have to extend back a tad further than the American founders. The concept of the nation-state with sovereign borders was recognized in documents like the Treaty of Westphalia in 1648. It was credited with maintaining a Westphalian peace with nations able to maintain their own territory and governing systems. That, in turn, allowed nation-states to form international bodies and further stabilize global relations.

I have heard other faculty present papers along these same lines, dismissing the very concept of border enforcement as racist, privileged, or archaic. It is far more rare to hear conservatives on campuses arguing for border enforcement and deportations. It is even less common to find such advocates on both faculties.

In my book “The Indispensable Right: Free Speech in an Age of Rage,” I discuss the intolerance in higher education and surveys showing that many departments no longer have a single Republican as faculties replicate their own views and values.

The problem is not that there are radicals teaching at law schools, but that most faculties seem to run only from the left to the far left.

Perhaps it is time to . . . wait for it . . . reimagine or defamiliarize law school faculty appointments.

These are hard-core socialists, who, looking at a nation like the US recognize that we will never be a socialist nation. However, a way to transfer wealth from affluent to poor is to move migrants from poorer countries into richer ones. That was the “breakthrough” in strategy these labor unions adopted 40 years ago. And, the consequences are no different from socialism — incentives to work hard and improve systems are weakened, and crime and dependency increase.

      Article 1, Section 8, provides Congress the power to tax for ONLY debt, defense, and “general Welfare” – ALL or THE WHOLE WELL PROCEED through governmental provision of security and basic infrastructure – omitting and, thereby, excluding any power to tax for individual Welfare, specific Welfare, particular Welfare, favor or charity. The same Article enumerates and provides Congress the power to regulate ONLY the Value of money, Commerce with foreign Nations, and among the several states, and with the Indian Tribes, and land and naval Forces.

      Further, the 5th Amendment right to private property was initially qualified by the Framers and is, therefore, absolute, allowing no further qualification, and allowing ONLY the owner the power to “claim and exercise” dominion over private property.

      Government exists, under the Constitution and Bill of Rights, to provide maximal freedom to individuals while government is severely limited and restricted to facilitating that maximal freedom of individuals through the provision of security and infrastructure.

  2. Jonathan: Does it really make sense why DJT would impose 25% tariffs on Canada when most undocumented immigrants and fentanyl come across our southern border? In January only 13.6 grams of fentanyl were seized at the Canadian border and our northern neighbor has invested $900 million to enhance their border security.

    I have friends in Canada who think DJT may have more PERSONAL reasons for the same tariffs on Canada as on Mexico. For starters, DJT does no like Trudeau on a personal level. Like the fact that Trudeau has stood up to DJT saying things like “Perhaps what [Trump] wants is to see a total collapse of the Canadian economy because that will make it easier to annex us. That’s never going to happen. We will never be the 51st state”. But other world leaders have said some nasty things about DJT and he hasn’t imposed tariffs on them. So that can’t be the only reason.

    Then DJT was mad that Trudeau, age 53, was famously photographed giving Melania a European-style kiss on the cheek at the 2019 Group of 7 meeting in France. But then DJT likes to kiss and fondle the wives of other men so that can’t be the only reason. But what about DJT calling Trudeau “two-faced” for appearing to mock DJT at a meeting of NATO leaders. But, again, European leaders mock DJT all the time without repercussions.

    Canadians say DJT is mad, not because of all those perceived slights but something more visceral and more personal. In 2016 DJT had a deal for a 65-story hotel and condos in Toronto. Instead the deal went to other investors who didn’t want the “Trump” brand on the building. Canadian investors also sued DJT over being misled about the deal. Then another DJT branded hotel in Vancouver failed in 2017–partly due to massive public protests. Vancouver’s mayor said at the time: “Trump’s name and brand have no more place on Vancouver’s skyline than his ignorant ideas have in the modern world”.

    Could these bad real estate experiences be the real reason DJT is pissed off at Canadians? Same reason DJT wants to take back the Panama Canal–a bad real estate adventure in Panama City when DJT got kicked out by new investors? Makes perfect sense. DJT is a sociopath and narcissist. He holds personal grudges forever and that drives many of his otherwise unfathomable actions. It’s all about retribution and vengeance for his real estate ventures that failed.

    Any one have a better explanation for why DJT is going after Canada with tariffs?

      My best guess is they will make a deal to kick China out and have Canada-USA-Mexico tariffs against the PRC. That will help weaken the PRC encroachment of our country and our waters. That is also why Trump named it the Gulf of America. It gives notice to adversaries that they are too close to us.

  11. On another topic, last night somebody commented on another thread, about trannies in the military, and how it wasn’t a good idea. Somebody else replied that the IDF was okay with it, and would pay for surgeries and hormone treatments. Just came across this story, on Free Republic, about how the IDF is investigating some of its failures on Oct.7. I wonder if the DEI push had anything to do with it???

    On the morning of October 7, 2023, some 215 Hamas terrorists stormed into the Israel Defense Forces’ Nahal Oz base, located just 850 meters from the border with the Gaza Strip. The troops stationed there were unable to defend the facility, and it quickly fell to the terrorists, who murdered dozens and abducted others.

    Military investigators described the battle at the Nahal Oz base as one of the IDF’s biggest failures on October 7, as it highlighted that even a site where 162 soldiers — 90 of them armed, though only 81 were combat soldiers — were deployed was unprotected.

    The base served as an army post for combat soldiers, due to its proximity to Gaza, as well as a command center for the Border Defense Corps’ 414th Combat Intelligence Collection Unit, whose female members operate surveillance cameras looking toward the Strip.

    The base — unlike an actual IDF border post — was not built to defend against a ground attack: The perimeter wall had gaps and holes in it; and the shelters, as well as the war room from which the surveillance soldiers operated, were designed to withstand rocket fire but not a ground attack.

    The base had one soldier on guard duty that morning, at the entrance to the base facing away from Gaza. Two guard posts in the base facing toward the Strip were not manned and rarely were.

    Hamas knew all of this.

    The terror group had collected intelligence on the Nahal Oz base over the years, using drones, soldiers’ social media posts, and IDF publications in the news media.

    A document from early 2023 with Hamas’s information on the Nahal Oz base was found by the IDF in Gaza during the ground offensive. The level of detail in the document could compete with IDF special operation dossiers, the IDF’s probe found.

    Hamas knew how many troops were deployed at the Nahal Oz base normally, and that on weekends there would be half that number, the document showed. The terror group understood when the best time to attack was, how long it would take for the IDF to send backup troops to the base, and what the best routes to take to reach the base were.

    1. Floyd look at the 1973 war, where the young soldiers defended the area until the reserve forces could get there. Syria has 1,400 tanks, and Israel has 180 tanks. Syria has 30,000- 40,000 troops, and Israel has 6,000, primarily young raw recruits.

      Those kids held the heights for four days. In an earlier comment today, I, too, wondered whether the strength of the Israeli military was diminished. I am sure you know, but in Israel, conscripts ~18 and a few more years make up the Israeli army. Israel counts on its seasoned reservists to leave their jobs and fight.

      1. There was a story about one neighborhood, where three Hamas paraglided in. There were 25 security people there already, and then 12 IDF showed up. The terrorists killed 17 people because of snafus between the security people and the IDF. Two terrorists got away. Almost like a Uvalde situation. Same with the base attack – no practice runs. I am sure the IDF will get to the bottom of it all. Something like 40 investigations going on.

  14. Jonathan: Well, DJT’s tariffs on Canada, Mexico and China finally kicked in today and the effects were immediate. The DOW dropped 600points. The Fed Bank in Atlanta predicts GDP will go down -2.8% in the first quarter.

    And what are the long term effects of DJT’s tariffs? 63% of our vegetable imports come from Mexico. 60% of our crude oil comes from Canada. And a lot of US new cars are made in Mexico and Canada. Economists predict a $2,920 increase in the price of a new car here if the tariffs continue. So from groceries to gas and new cars Americans are going to feel the impact from DJT’s insane tariffs. The University of Michigan indicates consumer sentiment dropped 10% in February. A WP/Ipsos poll shows shows Americans oppose DJT’s tariffs on Canada–64% to 31%.

    And our three largest trading partners are not taking DJT’s tariffs lying down. They are standing up to DJT’s bullying. China is putting tariffs on a variety of US made products. Mexico says it will put steep tariffs on cars made in their country and destined for the US market. Canada is not only hitting back with a boycott of US products but it is also making cuts to crude oil and lumber exports to the US. Chrystia Freeland, who is running to replace Justin Trudeau as the next PM, says she will put 100% tariffs on Teslas. That should get Elon Musk’s attention!

    Speaking of “Defamiliarizing” did you see the latest personality who is ditching her Tesla? Its “Elvira, the Mistress of the Dark”. In a bold move with a lot of publicity Cassandra Peterson is donating her Tesla to NPR–but not before giving it a new paint job. Her car now has a sign on the side that reads “Elon Sux”. Peterson posted a photo of her Tesla up on a car carrier with her standing in front holding a chain saw. Priceless! So Peterson now joins a long list of former Tesla owners who have ditched their “Swasticars”.

    P.S. Tesla sales in Europe dropped 59.3 % in January. Couldn’t happen to a more deserving guy!
