I just returned from Berlin this morning and wanted to share a few pictures and recommendations for those on the blog who may want to visit this extraordinary city. This is a city that has something for everyone from food to music to art to history.
Speaking at the World Forum on free speech was hardly an inviting prospect. As expected, many of the leading anti-free speech figures, including Hillary Clinton, gathered with their European allies in Berlin. I heard other Americans fueling the common narrative that democracy is dying in the United States and that we are now an autocracy. However, I had one key ally here, my friend and great civil libertarian Nadine Strossen. We both spoke on the need for Europe to increase protections for free speech:
Former President Bill Clinton received the top award at the World Forum. Ironically, at the dinner, I was seated virtually next to the Clintons at the adjoining table. It was a curious spot since I testified in favor of his impeachment and have been arguably the most vocal critic of Hillary Clinton over her pronounced anti-free speech views. Surrounded by world leaders who praised his record as president, Clinton gave a short but very personal speech in accepting the award.
Once the business end of the trip was satisfied, I was able to explore this extraordinary and vibrant city. I have found Germans to be unfailingly friendly and helpful. It is also easy to be an American tourist in Berlin. Many Germans speak English, and you will find it easy to navigate. If there was one disappointing aspect, it was the level of graffiti throughout the city. No site or surface seems spared anywhere in the city.
One of the highlights was visiting the Berlin Cathedral on the famed Museum Island. Initially built in 1894 by order of Emperor William II, the cathedral was heavily damaged in World War II but lovingly restored. It is magnificent.
The pipe organ, built by Wilhelm Sauer, towers above the space with its massive dome.
It also contains the dynastic tomb (House of Hohenzollern).
I then ventured to the top of the dome. This may be a challenge for many of our viewers and you should not start if you have doubts (they emphasize that you can only go forward on the hundreds of steps on the narrowing series of stone and wooden steps:
However, if you can manage it, the payoff is considerable with a panoramic view of this lovely city:
That view is a great start to any exploration of the city. What you find is a city with large parks, public art, and beautiful buildings along its gentle rivers:
One nice thing about Berlin is that you always have a reference point in the Fernsehturm next to the Alexanderplatz. The tallest structure in the city, the television tower offers an instant locational point:
As you walk through the city, you will see an abundance of pubs and restaurants, including many cafes. The food in Berlin is wonderful from the traditional goulash (like the deer goulash below) to the Schnitzel. However, it is the beer that is a particular joy. Every restaurant has different beers, and you cannot go wrong. While I am a bit wimpy in preferring the lighter beer, it was fun to try a range of options.
You can visit World War II and Cold War sites. One popular start is the iconic Checkpoint Charlie, the crossing point between East and West Berlin featured in every spy movie of the period. I am afraid that the visit may prove underwhelming. All that remains is the famous guard house, though an assortment of American fast-food restaurants now guards the checkpoint:
A visit to the Berlin Wall Memorial is more substantive and memorable. A display shows the hundreds of those killed trying to escape communism, including jumping from windows to land in West Berlin. You can ascend a nearby tower to oversee the wall area. Portions of the wall are preserved as is a guard tower:
Some of these victims jumped from homes that bordered the line. These homes were largely in East Berlin, but they extended a few feet into West Berlin. Before the East Germans tore down the homes, they were an irresistible temptation. Indeed, the first victim was an older woman who followed the practice of attaching a note to a rock and dropping it out the window. The idea was for the local firefighters to wait below to catch you, but on this occasion, an actual fire had to be put out.
As the police came knocking as part of the sweep of the area on her apartment building at Bernauer Strasse 48 , nurse Ida Siekmann decided that there was no turning back. She threw a mattress out the window and tried to land on it. She suffered broken bones and died on the way to the Lazarus Hospital.

One can also visit World War II sites including the Soviet monument to the thousands of Soviet soldiers who died in the battle for Berlin. Ironically, Stalin’s obsession with capturing Berlin led to a vastly increased number of casualties. Indeed, some historians believe that the Soviets killed more of their own soldiers than did the collapsing Wehrmacht. For many Berliners, the memorial must have brought painful memories, particularly in light of the systemic raping of German women by Soviet troops as retaliation for the German atrocities committed in Russia.
The memorial is guarded by T-32 tanks and the famed Russian ML-20 152mm gun-howitzer artillery pieces:
Of course, the iconic image of Berlin remains the 18th Century Brandenburg Gate.

Berlin is a truly unique city and well worth an extended visit. Berlin’s history is inextricably linked to our own from the defeat of the Nazis to the Berlin airlift to the Cold War to fall of the Berlin Wall.

Returning to Berlin is high on my bucket list. I was last there in 1975 when it was the GDR (DDR) and Berlin was a split city inside a communist country. Soviet troops were having military operations along the roadside. West Berlin was in the American Sector and crossing to East Berlin was a big deal. We spent all of the day and well into the night on the East side. There were still bombed out neighborhoods from World War 2. It was a memorial experience and one I cannot forget.
We drove in from Hamburg. Now, the scars of war are replaced with new construction. The separation was not just a wall but a complex of barbed wire guard towers, and an array of impediments for those who would dare cross. Sad days and a reminder that there are always those forces that wish to control people’s lives.

Right now this fight is really over whether Trump can use the AEA to expedite the process, and that is all.
He noted that the national security issue is getting really tense – the government often uses but never allows the national security claim to actually get litigated in court.
I expect there will be an agreement between Boasberg and DOJ over what information they provide.
Someone in state department confirmed there was over a months worth of high level negotiations over these flights and there is absolutely no way that State wants the broad discovery that Boasberg is demanding – it would undermine our foreign relationships if high level communications with the representatives of foreign governments were made public.
Further Boasberg has major problems with this case – here is nosuch think as a class action habeaus claim, further habeus claims must be filed in the district court where the person being deported is or was – NOT DC. Boasberg has massive problems with jurisdiction over this case.
The Plantiffs at the ACLU waived habeus to get the claim into Boasberg’s court – that poses serious problems, because many of the claims you are hearing on the news about allegedly deporting the wrong person – those are habeaus claims.
The 5 plantifs in the case were removed from the planes and are still in the US.
Again Boasbergs jurisdiction is limited to the plantiffs – not anyone who Might have been on the plane.
At the same time – even the AEA allows an actual Habeus claim – this case is NOT a habeaus case.
It is near certain that some court somewhere has atleast sufficient authority to demand the names of those on the planes.
Then we have a recent poll that has 63% of americans supporting the immediate deportation of ALL illegal aliens – my gfuess is support for deporting Tren De ARugua to El Salvador is far higher than that.
Boasberg and State/DOJ are playing a game of chicken with each other.
My prediction is there is going to be some kind of face saving agreement with Boasberg.
DOJ/State have a risk that higher courts toss their national security claim, and/or reject the application of the AEA.
I do not think either of those are likely, but they are a high risk roll of the dice.
Conversely Boasberg does not have a plantiff anymore – it would be trivial for an appelate court – or SCOTUS to tell him that his case is confined to the 5 people who the ACLU is representing.
Boasbergs case gets worse the more I learn.
The ACLU filed the case and asked for a temporary injunction BEFORE Trump issued the EO and findings required to invoke the AEA – as a result many of their initial claims were both speculative and wrong.
The Judge should have dismissed the case and asked the ACLU to refile when they were capable of making an actual claim.
Next the case was filed on behalf of 5 plantiffs none of whom were on these planes.
When the judge learned that he converted the case into a class action case.
Again a way out over his skis legal maneuver. Because they did not have the EO and presidential finding when they filed the case – the class action is for a class hat is different from those that the the EO and presidential finding invoking the AEA apply to.
We heard all this nonsense about Trump having crappy legal representation during his first term. Either Trump has brought in better people or more likely the legal teams here – knowing what they are up against are working hard to assure that the unforced errors are on the part of the left. This BTW has been true of many of the cases thus far – the left suess making ill informed claims – the Judges issue TRO’s based on false claims, The court then has to revise its TRO – it does so badly with bad results, has to reissue the TRO and in the process discovers by the time it is dealing with reality there is little or nothing left to order.
Regardless, it is Boasberg and the ACLU that are trying to game the system.
There is no legitimate basis for this case to the tried by this judge – we have a system of court specifically for immigration matters. where a case has an issue that warrants review by a federal district court – it is the district court in the region in which the person being deported is currently – which would have been Texas.
There is already rulings by Boasberg that the presidents power to declare war is not reviewable by the courts – I do not understand that ruling – because it is the presidents war powers that are unreviewable. the power to declare war rests with congress. But the president can assert that an act of war has occured and excerise some war powers on that basis. That is SORT of what has occured.
ARegardless Boasberg has accepted that the AEA is not reviewable – except as a habeus matter, with respect to a foreign war.
He is claiming that the other clauses of the AEA are cases of first impression – that is arguably correct. But absent a constitutional violation, of a specific clause of the AEA the legal presumption is that if one application of the law was found non-reviewable the others are presumptively non-reviewable. That does NOT preclude a Marbury vs. Madison decision – which essentially – the courts have final authority to decide what the constitution says and in this case we decided that the constitution say we do not have power. Regardless the presumptions are against issuing a TRO, and the courts only certain is in determining that each of the individual deportees actually is who the administration claims and that they meed the requirements of the EO and AEA.
There are other issues – because while Boasberg is having issues ranting that his order may have been violated – it CLEARLY was not.
He is now demanding to know why the planes did not return to the US – but his order – both the verbal and written one was that the planes could not take off. They took off before either order was issued, the written order is significantly different from the oral order – it is more clear and and narrow – which is why outside of actions inside the courtroom oral orders are NOT generally binding. Boasberg’s written order issued approx 2hrs later is more clear and more narrowly and closer to correctly written. And DOJ/State complied with it – no planes took off with Tren De Araugua members for El Salvador after the order was issued. By the time the written order was issued the planes were within minutes of landing.
I do not think Boasberg has jursidiction over this case at all – it must be removed to a federal judge in TX.
At that point the court would have legitimate grounds to demand the identities of all those deported for the purpose of determining if they were properly deported under the AEA or other deportation authorities. But those are individual cases – there is no possible class here.
The only proper class would be people legally in the US that were denied due process in deportation.

Jonathan: Yes, visiting Germany is a treat–the history, the historic buildings, the rivers and, of course, the beer. I have never visited Berlin but my wife and I have close German friends. They live in a small village outside Stuttgart. Some of the buildings there date back 800 years. We enjoy the smaller towns and driving through the beautiful country sides.
At the Tucson Festival of Books you were on a panel in which you said you expected a “battle royal” at the World Forum in Berlin. Why did you expect that? Probably because Germans, with the history of WWII, have a different view of “free speech”. They do not tolerate neo-Nazi hate speech or displays of the Nazi flag. Germans rejected the neo-Nazi NfD party in the last election.
And Germans have a poor view of DJT and Elon Musk. The latter because he came to Germany and backed the NfD. Musk is now persona non grata in Germany. A poll in the last few days shows 94% of Germans say they won’t buy a Tesla. Tesla sales have plummeted 70% in the first two months of this year–although EV sales generally in Germany are up. The son of our friends outside Stuttgart bought a Tesla about 3-4 yrs ago. He now regrets that decision. He has tried to sell his car but he can’t find a buyer!
I suspect you got somewhat of a cold reception in Berlin. And it’s not just because you were seated next to the Clinton’s. It’s probably because you back Musk’s form of “free speech” that considers Social Security a “ponzi scheme”, who was never elected to any office but fired thousands of federal workers–taking away their “free speech” rights because they represent the “deep state”–and that this same person supports right-wing fascist parties in Europe. In the name of “free speech” you continue to support Musk. No wonder you expected to get into a “battle royal” in Berlin!

I went through Checkpoint Charlie in the 1970s when visiting West Berlin, and ended up spending an afternoon in East Berlin. Very interesting experience: very quiet, gray, dark, almost nobody out on the street. Wide boulevards with maybe two cars as far as the eye could see. However, the trams went by every so often and they were packed as tight as sardines with working-age people, all looking downward with a frown, nobody talking or smiling.
West Berlin by contrast was colorful, noisy, and lively, kind of like Midtown Manhattan with its party atmosphere, albeit the buildings were not quite as tall as in NYC. Interesting train ride in and out of West Berlin too. Some people don’t know but you had to go through East Germany to get to West Berlin. Change of country, passports out, German Shepard dogs outside the train sniffing underneath, gruff scary looking East German border guards walking through the train with weapons and checking the passports of the passengers. Ironically, as soon as we entered East Germany from the west, the sky grew dark and foreboding. I thought that was appropriate – nature seemed to know and want to imitate the authoritarian traits of the communist government.
East Berlin was like a slave city. Those people going to work were paying damages to the UK, France, Soviets for the wars. How many years? 60? 80?
No, they were not. They were slaves of the Communist government, which was not paying anything to the Allies. You may be getting mixed up with the reparations after WWI, which were not repeated after WWII.

I don’t honestly know if this is still the case, perhaps someone can confirm, but for friends I had from Germany in the past, minimal military service was still a requirement after school, you didn’t get out of it.
Can you imagine if our American young people had no choice but to serve in the military for at least a year? Just read that the Ukrainian military are deploying wheeled, armed with a machine gun, remotely controlled vehicles to the front lines as their manpower problem persist. The Ukrainian government is also considering lowering the draft age from 25 to 18 and older. So there is another large group of military aged men who are also likely hoping for Trump to get a peace deal and soon.
I recall when during the Biden admin and as he escalated the conflict, getting us that much more closer to WWIII, all of a sudden, it was a trending search on Google for “can I be drafted?” Another trending Google search was “how can I get out of a draft?” Our American young having no choice but to serve in the military? Something tells me we, as a country, would be a lot less inclined to get into any kind of conflict. And I think bringing back the draft would be a good idea. About a year or so ago, the US Army War College wrote a paper suggesting the all volunteer fighting force we have now has become obsolete and conscription/draft may be required if the US was to get into a major, long term conflict.

That is not an attack on Roberts.
It is however a correct statement.
As Turley noted elsewhere – the courts have lost legitimacy and credibility – with BOTH the right and the left.
That is EXTREMELY dangerous.
Roberts recent remarks decrying criticism of judges and decrying impeachment are both recognition by Roberts that the judiciary faces a serious credibility problem.
But they are an effort to fix the problem by blaming those who have lost faith in judges. It should be no shock that fell flat.
The left repeatedly advised Biden to ignore the supreme court – during his term.
Contra the MSM Trump has repeatedly stated that he will obey bogus court orders and appeal them.
But the message that the courts are way out over their skis is

It is the left that caused this by politicizing the law over the past 20+ years.
Politics has absolutely no place in the judicial system.
While it has always been present, it was also always recognized as a flaw

Judges are required to make decision –
only on the cases before them,
only on the issues before them,
only on the parties legitimately before them,
only on the law and constitution.
It is not the courts role to decide the right answer to political questions.
Only to decide whether political decisions are lawful or constitutional – nothing more.
Conservatives like to talk about “originalism” – which is just another term for following the centuries old rules for statutory interpretation.
The critical aspect of “originalism” is that when those rules for statutory interpretation are applied scrupulously by two different judges with two different political biases they still should produce the same outcome.
It is a REQUIREMENT that courts decide the same issue the same way regardless of politics, and that they do so this year and 20 years from now – unless the law or constitution are changed.
People are free to change – and a true living constitution means when we believe the constitution is no longer working as it is – judges and the courts do NOT change it – the people change it – by amending or replacing it.
We can not acheive that perfectly. But it is still the only legitimate goal.
The problem is that is NOT what law schools are teaching anymore, that is not how fudges on the left are acting anymore.
And that creates a mess.
It is bad enough that prosecutors do not apply the law uniformly.
That different administrations have their own spin on he law,
That congress has its spin too.
We have complete and total chaos when the courts no longer function as the anchor.
it is NOT the job of the courts to advance the political goals of anyone.
it is not their job to decide what is right and what is wrong.
It is their job to decide what the constitution says and what the law says – and to do so in an essentially ROTE fashion that will consistently produce the same results.
This is critical because it means that if we change the law or constitution – that future decisions of he courts will reflect those changes.
The politicized courts we have are the ACTUAL cause of chaos even anarchy.
