The Weinstein trial took an unexpected turn today after New York Judge Curtis Farber declared a partial mistrial. The order followed a refusal of the foreperson to return to deliberations due to being bullied.
In the trial, Weinstein faced one charge of rape in the third degree and two charges of criminal sexual act in the first degree. On Wednesday, the 12-person jury found him guilty of one count of a criminal sexual act against former Project Runway assistant Miriam Haley, but not guilty of the other count of a criminal sexual act against former model Kaja Sokola.
That left the rape charge related to aspiring actress Jessica Mann. However, the jury foreperson had sent a note to the judge and said “I feel afraid inside there. I can’t be inside there.” He alleged that jurors were pressuring him to change his mind and threatened him that “Oh we will see you outside.”
Judge Farber spoke with all of the jurors and reported that “They don’t understand why the foreperson bowed out.”
What could be controversial on appeal is the decision to leave the earlier convictions when a jury proved so dysfunctional as to require this extraordinary action. While the jury agreed on the earlier counts, Weinstein’s team may argue that a broken jury to part is a broken jury to the whole.
The prosecutors indicated that they would retry on the remaining count. An effective walkout of the jury suggests a fundamentally flawed jury pool. The order only addressed the most immediate impact of the breakdown, but the defense will argue that this type of problem does not arise in a hermetically sealed fashion. It reflects jurors who were so motivated that they were allegedly willing to cross this line, according to the foreperson.
Whether this was a case of “Twelve Angry Men” or just two, the jury obviously failed to conform to the standards demanded of them under court rules and case law.
It creates a novel appellate issue in a case that has already been retried following challenges.
Yeah, a “partial mistrial,” when a jury is proven 100% corrupt and in violation of the law. But in corrupt, perverted New York’s Marxist Courts, the “jury was only corrupt on one issue, but had full integrity on the other issues.” Such lawless BS. Once a jury is proven corrupt, the entire case must be thrown out, but that’s only in a genuine courtroom, not NY’s Marxist courtroom. The Weinstein case should be held in a venue OUTSIDE of New York’s corrupt, perverted Marxist Courts. It’s impossible to get a fair trial when 94% of the jury pool consist of depraved, disgusting Marxist-brain-washed lowlife scumbags with median IQ’s below 74.

They can howerver be used for other purposes.

I would note with respect to this judges decision – presidential declarations of emergencies are re-viewable by CONGRESS – not the courts.
That is US law. There are litterally hundreds of presidential emergency declarations still in effect because congress has not lifted them dating back to the 60’s

There are none – emergency declarations are not judicially reviewable.
Nor would you ever want them to be.
Depending on the specific law used to declare the emergency it is typical that the administration must bring the emergency declaration to congress – usually the senate within a short period – 30 or 90 days. And Congress can if they chose vote on the emergency and if they vote it down the presidents emergency power for that emergency end.

The very fact that appeals fourst are hearing these cases is proof they are idiotic lawfare.

This is an interesting case. I agree it’s a novel appellate issue: I’ve never come across anything like it. I would think the foreman is telling the truth, the other jurors want to avoid blame for threatening conduct, so they denied it. But that’s just my suspicion based on what Professor Turley has said.
I also think there is a valid argument to be made that the other two convictions are fatally defective in light of the internal dysfunction within the jury. But that’s a close call, I can see an argument on the other side, that there is no evidence any such dysfunction had occurred at the time those verdicts were reached, so they can’t be discarded on that speculative basis.

Seems a bit confusing to me. We have little to go on here other than the foreman felt unsafe yet the other jurors seemed to not understand why the foreman could not continue? Depends. A friend served jury duty. At first chance, three of them wanted to declare the guy guilty without hearing out the whole case so they could go back home to their kids or their jobs. Jury duty does not pay six figures. The rest pushed back, citing it was their civic duty and to follow the judges orders. The three went along begrudgingly and in the end they voted guilty but after they heard the whole case out.
I’ve been on three juries. Nobody ever wanted to be foreman, so I always volunteered, just to get the process started. The first thing I did was to have everyone vote; my theory was that if we all agreed, we were done. If anyone wanted to review the vote (someone always did), we did. I tried to explain that it was not a crime or a sin to return a quick verdict. It indicated a strong or weak case. The worst case scenario was having one or two holdouts; one would always say, “Let’s vote again; if the vote hasn’t changed, I will change my vote.” I said, “No, stick with your belief. If you feel strongly, continue to vote your belief.”
My main takeaway from all three trials was that most lawyers have no idea what they are doing, come in unprepared, and I am usually amazed that the system works as well as it does. I certainly understand the backlog; the process is unbelievably slow and inefficient.

Trump’s approval is 40 percent on the economy, 38 percent on trade, 37 percent on universities, 35 percent on the Israel-Hamas conflict and 34 percent on the Russia-Ukraine war.
“As the Russia – Ukraine war grinds through its third year, Americans make it clear they have little appetite for the way the Trump administration is handling the situation,” Quinnipiac University polling analyst Tim Malloy said in a statement.
Polling averages maintained by Decision Desk HQ show Trump’s job approval rating at 47 percent approval and 49.9 percent disapproval. A poll this week from YouGov/The Economist has Trump’s approval among registered voters at 45 percent and his disapproval at 53 percent.
The latest poll was conducted June 5-9, with 1,265 self-identified registered voters. The margin of error is 2.8 percentage points.”
Then, there’s the nationwide “No King” protests scheduled for Saturday the same day as the multi-million dollar vainglory parade that will cost tens of millions of dollars, Trump’s threats against anyone who dares to “protest”–not just violent protesters. Yeah, things aren’t going so well in MAGAverse.

Rasmussen is well-known to be MAGA–it always skews its polling toward known Trump supporters. It is a joke and has NO credibility. “A new Quinnipiac Poll shows that President Donald Trump and his 2026 budget, which he refers to as the “big, beautiful bill,” are underwater with the American public.
Huffington Post senior politics editor Kevin Robillard posted screen captures of the crosstabs on X, showing that just 27% of Americans support the bill. He also noted that polling specifically looking at attitudes on the GOP tax bill has “been relatively rare.”
Democrats are also “far more likely to have an opinion on the bill than Republicans and Independents,” Robillard added.

Just wait and see what happens when they cut Medicaid and rural hospitals and nursing homes are forced to close, and when 14 million people are left without health insurance, some of whom will die as a result–all to give massive tax breaks to the very wealthiest. If Republicans like Elise Stefanik think they have any chance politically after voting for this monstrosity, they will have a rude awakening.
