“Where You At?”: California Vice Mayor Under Investigation After Calling on Gangs to Protect Their “Turf” Against ICE

The Vice Mayor of Cudahy, Cynthia Gonzalez, is reportedly being investigated by the FBI after she posted a video urging criminal organizations like the 18th Street and Florencia 13 gangs to protect their “turf” against ICE. The call for gang action is disgraceful, particularly as ICE reports a 500 percent increase in attacks on its officers. However,  I do not believe that the comments can be the basis for a criminal charge and would be considered protected speech.

Gonzalez has now taken down the video below, but she earlier called for these gangs to move against ICE:

“Not for nothing, but I wanna know where all the cholos are at in Los Angeles? Eighteenth street, Florencia, where’s the leadership at? Because you guys are all about territory, and this is 18th Street and this is Florencia, you guys tag everything up — claiming hood, and now that your hoods being invaded, by the biggest gang there is, there ain’t a peep out of you…It’s everyone else who’s not about the gang life that’s out there protesting and speaking up, we’re out there like fighting our turf, protecting our turf, protecting our people, and like where you at?”

 

This is not the first time that Democratic politicians have enlisted violent groups as political allies.

Some Democrats have played a dangerous game in supporting or excusing the work of Antifa. Former Democratic National Committee deputy chair Keith Ellison, now the Minnesota attorney general, once said Antifa would “strike fear in the heart” of Trump. This was after Antifa had been involved in numerous acts of violence, and its website was banned in Germany.

Ellison’s son, Minneapolis City Council member Jeremiah Ellison, declared his allegiance to Antifa in the heat of the protests this summer. During a prior hearing, Democratic senators refused to clearly denounce Antifa and falsely suggested that the far right was the primary cause of recent violence.

The problem with being a free speech advocate is that you are often compelled to defend speech that you find grotesque and reprehensible. Gonzalez would shake the faith of any free speech champion. However, her speech would be considered protected under the First Amendment. First, it is sufficiently vague on what she is suggesting to counter a charge of a call for imminent violence. Second, the Supreme Court held that even violent speech is protected.

Indeed, in Brandenburg v. Ohio, a 1969 case involving “violent speech,” the court struck down an Ohio law prohibiting public speech that was deemed as promoting illegal conduct. It supported the right of the Ku Klux Klan to speak out, even though it is a hateful organization. Likewise, in RAV v. City of St. Paul in 2011, it struck down a ban on any symbol that “arouses anger, alarm or resentment in others on the basis of race, color, creed, religion or gender.” In Snyder v. Phelps, also in 2011, the court said the hateful protests of Westboro Baptist Church were protected.

The video may not be criminal, but it is still an indictment of how some Democratic politicians continue to pander to violent groups for political purposes. It is a dangerous game. History has shown that those who fuel extreme groups often find themselves later targets as mob rule takes hold. Gonzalez may find that she is also unwelcomed on their “turf.”

  1. If any gang members assault ICE, I believe her speech could easily be construed as aiding and abetting. Possibly incitement to riot.

Cudahy Vice Mayor Cynthia Gonzalez was perfectly in her rights of free expression to call for the “cholos” to be “protesting and speaking up” for the innocent immigrants who are being snatched off the streets of LA by masked ICE agents and put in detention centers. There were no calls by Gonzalez for violence. You admit as much. But then you deflect by trying to blame Antifa for all the violence in LA. No doubt you could not identify a single person arrested by LAPD as being an Antifa adherent. That’s the problem with your crazy theory.

    There is no “mob rule” in LA. The streets are peaceful. The only “violent groups” in LA these days are the ICE and other government agents who are roaming the streets and brutalizing the residents. Take the case of Narisco Barranco. His encounter with ICE has gotten a lot of press coverage. Barranco is 48, a landscaper from Tustin who is undocumented. He is the father of 3 US marines. He was working at an IHop last Saturday when several masked men approached him. He ran because he didn’t know who they were and suspected they might be criminals. It turns out the masked men were CBP agents. They chased Barranco down, threw him to the ground and beat him severely. He was hit in the head 6 times, thrusting his face into the concrete, kneeling on his neck and dislocating his shoulder. Barranco was then pushed into an unmarked SUV.

    Alejandro Barranco, who is Narisco’s oldest son and served tours in Afghanistan, says “I don’t really know what to say. I do believe my father was racially profiled–they didn’t ask him anything. They just started chasing him, and he ran because he was scared. He didn’t know who was after him.” Alejandro says his father was in the process of establishing US citizenship when he was grabbed by government agents. Alejandro also says his father was a peaceful man who always paid his taxes on time and was well liked by everyone in the community.

    The case of Barranco is just the tip of the iceberg when it comes to violence by the DHT regime. We have seen the violence that Senator Alex Padilla and Brad Lerner, NY City Controller have been subjected to in the course of their official duties. So now we have packs of masked and armed agents of the DJT regime roaming the streets of our cities picking of immigrants with no criminal records, detaining them and then sending them to third world gulags. This is what Hitler’s Gestapo did in getting rid of the “undesirables” in areas controlled by the Third Reich. It’s deja vu all over again but you think Antifa is the big problem. Really!?

  8. Growing up I encountered many clubs, so I was curious why a group would call themselves a Gang? Looking for definition I received back from the net Wikipedia’s definition: “A gang is a group or society of associates, friends, or members of a family with a defined leadership and internal organization that identifies with or claims control over territory in a community and engages, either individually or collectively, in illegal, and possibly violent, behavior, with such behavior often constituting a form of organized crime.” Then it became clear the Gangs are hegemonies with militarist dominance and as such the Vice Mayor should be charged for incitement and the gangs broken apart.

Scotus has held that the First Amendment does “not permit a State to forbid or proscribe advocacy of the use of force or of law violation except where such advocacy is directed to inciting or producing imminent lawless action and is likely to incite or produce such action.” Brandenburg v. Ohio, 395 U.S. 444, 447 (1969)

      Under that ruling, the prosecution would have to show that the video was either intended to produce “imminent lawlessness” or it was “likely to” produce lawlessness. There would have to be some evidence besides the video to prove it, since I don’t think the video in and of itself proves that. But such additional evidence might exist in this case, who knows?

        1. It may be that the “imminent” qualifier is where prosecutions can get hung up. That may be seen as being limiting allowable prosecutions situations where the speaker incites violence “right now” as opposed to at some speculative future time. I haven’t really handled a case on exactly this topic, I’m just going by what Scotus said.

    Haven’t folks on the Left been saying, for a while now, that words are equivalent to violence?

    Didn’t those same people try to have Trump imprisoned for, allegedly, telling the mob that stormed the Capitol on January 6th to do just that?

    Wasn’t that case dismissed, without prejudice? If I’m not mistaken, doesn’t that mean it can be revived once he leavs office?

    If so, than what goes around comes around. Sure, her speech is protected, but aught there not be some sort of consequences? Not sure what those consequences should look like, but unless, or until there is something, this is just gonna repeat, over and over again. Eventually, lots of innocent people are gonna get hurt, or worse.

    We’ve got a “people problem” in this country. Until we deal with that, we’re gonna keep sliding further towards the abyss.

No: she should be allowed to show precisely how awful and corrupt she is. That gives the rest of us the opportunity to respond in kind. One has to know that madness exists in the first place to repel the madness; that is why speech controls are so important to the modern left. They know no sane and free person is on board with what they are proposing, and this is how they deal with that fact. It’s tyranny, plain and simple. We do not have to go along with tyranny in this country.

        I used to listen to Rush, I listen to Mark Levin and Joe Pags, but I feel, more often than not, all these guys are preaching to the choir.

        Not suggesting she shouldn’t be allowed to speak, but unless she’s de-platformed, loses her job because of what she said, etc, there’s nothing to act as a disincentive to say such things publicly in the future.

        All I know for sure is we can’t keep going down this road as it won’t end well for any of us.

      Yes – WHILE DENYING THAT Trump SPECIFICALLY TOLD THE ASSEMBLED CROWD – NOT “THE MOB” TO PEACEFULLY PROTEST. Which is the complete opposite of what this Democrat skank asked murderous street thugs to do.

      I’m in the camp that says she hasn’t gone far enough to be charged, (which could be changed if those criminal gangs DO obstruct law enforcement).

      But attempting to make what they claim Trump said with what she actually did so is beyond disingenuous to the point of being deceitful.
