Former Secretary of State and two-time presidential loser Hillary Clinton has triggered yet another question of defamation in the political arena with an attack on President Donald Trump on the fifth anniversary of the January 6 riot. Clinton claimed that Trump “urged” supporters to “attack Congress.” That is untrue. However, Clinton can rely on tort doctrine to shield her from potential defamation liability.
Jan. 6th was a desecration of our constitutional process and one of the most disgraceful days in our history.
However, it was a riot, not an insurrection.
Clinton posted her comment on X, declaring, “Five years ago today, Donald Trump urged his supporters to attack Congress and the Capitol over a proven lie.”
The comments mirror statements made by the J6 committee and others. The difference is that many of those statements were protected by members of Congress under the Speech and Debate Clause.
I previously wrote about how the J6 Committee in Congress routinely edited out Trump’s call to protest “peacefully” despite objections that it was intentionally omitting a material element to his speech.
Trump was never charged with inciting the riot despite pledges of Democratic D.C. Attorney General Karl Racine to investigate Trump for that crime.
The reason is simple. It was not criminal incitement and Trump’s speech was protected under the First Amendment.
The same, however, may be true with regard to Clinton’s posting. Her claim is clearly false. Trump did not urge his followers to attack Congress. He urged them to go to Congress peacefully to protest the certification of the election.
However, American tort law offers robust protections for free speech, particularly when related to political figures.
In New York Times v. Sullivan, the Supreme Court established the actual malice standard, requiring public officials to shoulder the higher burden of proving defamation. Under that standard, an official would have to show either actual knowledge of its falsity or a reckless disregard of the truth. That standard was later extended to public figures.
The court correctly viewed civil liability as creating a chilling effect on the free press, either by draining publications of funds or inducing a type of self-censorship. Imposing a high standard for proof of defamation, Justice William Brennan sought to give the free press “breathing space” to carry out its key function in our system.
The case established a higher standard of proof for defamation than simple negligence for public officials. The court believed that public officials have ample means to rebut false statements, but that it’s essential for democracy for voters and reporters to be able to challenge government officials.
There is also protection for opinion. The issue comes down to the meaning of “urge.” Merriam-Webster defines the word as including “stimulate or provoke” as well as “solicit.”
Clinton would claim that she considers the thrust of his comments as effectively urging the violence even if he did not directly call for violence. Many Democrats obviously share that view.
Many have made unsupported and at times ridiculous claims that are equally protected as opinion. For example, Harvard Law Professor Laurence Tribe has made a litany of such claims, including his declaration on MSNBC that President Donald Trump could be charged (“without any doubt, beyond a reasonable doubt, beyond any doubt”) with the attempted murder of former Vice President Michael Pence.
Ironically, while Clinton has called for crackdowns on people who she deems as spreading disinformation, she has been criticized for such false or misleading statements.
Nevertheless, Clinton’s posting would not make for a strong defamation case, and even if a court did not dismiss the case before trial, it would be challenging to secure a jury verdict on such subjective terms.
It would require a constitutional amendment, but there is a strong argument that government leaders especially presidents, should have higher standards of free speech than private citizens.
The First Amendment’s freedom of speech clause was designed by the Founding Fathers – to primarily protect the association and free speech of private citizens from the federal government (censorship, retaliation, blacklisting, etc). Congress can make no law to penalize or silence freedom of speech.
In the January 6 scenario, using the above standard. Trump is not the “private citizen” needed protection from the “government”. Trump is the federal “government” with hundreds of millions of supporters and Commander-In-Chief of the Executive Branch.
Since on January 6, 2021 Trump was not a “private citizen” seems that his speech should have a higher standard. His speech could be interpreted as a command by the military, police and federal officials.
January 6 was indeed an insurrection (attempting to take away the votes of millions of Americans) and many Americans Trump did indeed incite violence by gaming the First Amendment.

After that point, his continued plotting to derail or mickey the counting on electoral college votes during the Joint Session of Congress on J6th was treasonous, and a violation of his Oath to uphold the Constitution.
Go back and watch his Ellipse speech. It’s very clear what his intent was. No, it wasn’t to incite a mob riot. Generously, it was to have his loyal throngs go to the Capitol to witness a non-violent, lawyerly coup to be led by Mike Pence.

Context and nuance matters. Or should. Just a short four months before the election, Professor Turley along with the rest of America and the world watched this going on over three days, not three hours:

This assault on the White House was committed by the Democrats Antifa and Black Lives Matter – not a red MAGA ball cap in sight, just the trademark black clothing. Like J6 weeks later, there were people away from the rioting that were protesting in a legitimate matter.
But the ones at the front attempting to murder Secret Service and Capitol Police with thrown Molotov Cocktails, an endless supply of bricks accessible in vehicles parked near the assault, were not peaceful.
And during the time this went on, Biden from the basement he was campaigning from, called those attempting to breach the White House, “a courageous group of Americans”. His running mate, then Senator Kamala Harris said “they will not stop, nor should they”. And used her name and organizing to bail out rioters actually arrested as fast as possible to allow them to return to the fighting.
Pelosi, Clinton and other Democrats watched and gloated while at the same time justifying the assault and fighting in the news media. I can’t remember if Obama said anything as his former home was under criminal assault… he was probably sunbathing on one of Richard Branson’s yachts somewhere.
Looking back at the archives from Professor Turley’s for those days of political violence and rage toward the president and his family in the White House – including the news that the President of the USA, his family, and critical Administration staff had been evacuated to a secured nuclear/terrorist bunker – is enlightening in the context it provides.
No columns were posted that the multi-day attack on the White House, causing the President to have to cease normal everyday operations and work from a bunker while his Democrat opponent and other party leaders celebrated, was a horrendous consecration of our constitutional process during an election campaign. No pronouncements of how disgraceful it was. It just wasn’t that bad, apparently.
Days of Biden and Harris encouraging the criminals assaulting police with Molotov Cocktails and attempting to breach the White House was not criticized by the same people who hold stop-watches to time how long it took Trump to start broadcasting appeals for the J6 trespassers and rioters to leave.
Christopher Wray, who demonstrated how incredibly efficient the FBI could be under his leadership tracking down every single trespasser who did nothing more than wander onto the Senate lawn to take a selfie on J6, did not fill the Washington DC cells with those who sent 50 of the FBI’s fellow Secret Service to the hospital in the months between the days of the rioters assaulting the White House and the three hour riot that occurred January 6th.
The cell’s where Wray held the J6’ers in, starting within hours of the end of the riot, were empty rather than already being warmed and awaiting them by the Molotov Cocktail throwing Antifa and Black Lives Matter assaulters of the White House. The rioters wounding Secret Service And Capital Police that Joe Biden celebrated and Kamela Harris defended and promoted walked.
No sentences of years in prison were handed out for attempting to murder Secret Service while attempting to breach the White House and driving the president and his family into a bunker.
Before that, during Justice Kavanaugh’s confirmation, rioters breached the Senate in attempts to halt the Senate completing the voting to confirm Kavanaugh to the Supreme Court.
That confirmation vote is also one of our constitutional processes. And the response to that? Well, not quite crickets, but close enough. No columns of dismay at a disgraceful desecration of that constitutional processes.
And then there were the MONTHS of nationwide rioting, pillaging, looting arson and murder during the months leading up to the election – rioting that suddenly quieted down in the last few weeks. While, again, the Democrat party and it’s candidates did absolutely nothing to get their rioters to stop and go home. Instead they claimed the rioters weren’t from their side of the isle; nothing to do with them.
Had all of this been reversed, and the president under violent murderous assault in the White House been a Democrat and his family, the SCOTUS nominee a Democrat, and the 540+ riots across the country during the election campaign been committed by mobs wearing red MAGA hats, would the response from media legal analysts been the same?
In Professor Turley’s Age Of Rage, there’s a very different standard for what rises to be a disgraceful desecration of our constitutional process. The line for where actions meet Professor Turley’s (and other journalists) standards of desecration of our political process and outrage begins in those daylight hours of January 6th.
American history and politics-based rioting did not exist in Democrat American history and consciousness prior to January 6th. Professor Turley’s consciousness of desecrations of our constitutional processes began that day.
One of the core values of being a Democrat is hypocrisy and double standards. And that’s one reason why this is fed and allowed to continue.
