Below is my column in The Hill on the recent controversies over enhanced images of Alex Pretti and his shooting in Minnesota. As seen throughout our history, Pretti has achieved mythic status — even having an ice cream invented after him by one of the founders of Ben & Jerry’s. Reality recedes when politics demand the perfect hero.
Here is the column:
“Show me a hero, and I will write you a tragedy.”
That statement, from F. Scott Fitzgerald, has never been truer than with the posthumous treatment of Alex Pretti, killed in a confrontation with federal officers in Minneapolis. He has been called a “hero” and a “martyr” by the left as a rallying cry for protests around the country. In the process, many have “enhanced” both his story and his image.
MS NOW has admitted that it used an AI-enhanced photo of Pretti that made him look more handsome. Sen. Dick Durbin (D-Ill.) was criticized for bringing to the Senate floor an altered image, featuring a headless immigration agent, that made it look like officers executed a kneeling Pretti with a shot to the head.
Pretti needs to be be inviolate to make the government seem vile in the eyes of the public. He is being described as the combination of Florence Nightingale and Crispus Attucks.
A CNN panelist and co-host of “The View,” Ana Navarro, voiced the new orthodoxy that Pretti was the “perfect guy … the guy you’d want to date your daughter, the guy you want your son to grow up to be, a decent human being who was serving humanity.” She added that he was so perfect that “there is nothing that has been said about that man that isn’t wonderful. And so they can’t malign him.”
The point is that any skepticism, let alone criticism, is no longer acceptable.
In fairness, Pretti was vilified before he was canonized. Many of us objected that the videotape evidence did not support the original description of Pretti’s conduct. Pretti did not threaten officers or approach them brandishing a weapon.
But he did disobey police orders and he did resist arrest. Indeed, eleven days earlier, he had spat at officers, damaged a police vehicle by kicking out its taillight, and again resisted officers.
The remaking of Alex Pretti by both sides is strikingly familiar. On Tuesday, my book on the 250th anniversary of the American Revolution will be released. “Rage and the Republic” looks at both the American and French Revolutions to explore why one became the world’s oldest democracy and the other became a blood-soaked terror.
At the height of the social unrest of the French Revolution, the Jacobins also “enhanced” the images of their martyrs. One of the most famous paintings by Jacques-Louis David was called The Death of Marat, the depiction of the murder of one of the architects of the Reign of Terror. David was an ardent supporter of the radical faction that carried out the mass executions of the period.
Marat was a vile human being who had delighted in his summary executions. Covered by painful sores from a rare skin condition, he was stabbed in his bathtub by a young woman who gained access by promising him a list of new traitors to be executed. David portrayed the slain Marat as a flawless martyr with alabaster skin, laid out like a religious Pieta.
Pretti was no Marat. He was described as a caring nurse at the Veterans’ hospital. He also vehemently opposed immigration enforcement and was a member of a group committed to filming and disrupting ICE operations.
What occurred on that day will be resolved in the ongoing investigations. However, few are waiting for such findings. He is now a figure to be enhanced while dehumanizing law enforcement.
As with the French Revolution, establishment figures are fueling the mob to ride the rage wave to the midterm elections. Walz even repeated the debunked story of the “bait boy” and said that undocumented persons being sought for removal were like Anne Frank, an assertion that drew a rebuke from the Holocaust museum.
Protesters responded to such rhetoric with signs reading, “Kill Nazis.”
Deification and demonization have long been methods used to push a populace to embrace radical action, or even revolution. As we celebrate our Declaration of Independence, “Rage and the Republic” asks whether the American Republic can survive the 21st Century with the pressures of civil unrest and economic upheaval.
Yet, when I wrote the book, I never anticipated how we would hear many of the same voices calling for revolution and resistance in the U.S. Walz has even referred to this as a Fort Sumter moment, a reference to the fight that led to our civil war that cost hundreds of thousands of lives.
The history of the American and French Revolutions shows that heroes can be discovered or created for political purposes. They can produce true tragedies when they are used to radicalize some and dehumanize others.
Pretti needs no enhancement. Neither he nor the officers on that day were “perfect” beings. The facts of what happened on January 24, 2026, are likely to be as conflicted and subjective as the political environment itself. Any shooting of this kind is imperfect — events that could have been changed by a myriad of different actions or movements. That is the true tragedy.

The nursing profession has several different education, training and skill levels; ranging from a few months of education to 4+ years. Nurses who have earned a 4 year Bachelors degree in nursing are highly educated and presumably trained. So I don’t think the above⬆description of job duties is accurate, at least with that subset. And some highly skilled nurses deserve what the open market will pay them, whatever that amount is. If the open market will pay (or is that COMPENSATE, with fringes>???) $250K, with or without striking, then that is what it will pay. So I say let them strike- if it works and the employer buckles under, due to lost revenue, reputation or whatever, more power to them. BUT, if the employer says FAFO, and it turns out bad for a purple shirted SEIU loser, then the open market has also spoken, loud and clear.

There is a very good argument against unions for public employees.
There is a good argument that government should stay out of strikes, and contract negotiations – beyond preventing violence.
Beyond that a union is just a group of people deciding to negotiate a contract together.
No company has tghe right to your labor,

Companies are free to negotiate with labor as they please.
Labor is free to negotiate with employers as they please.
It is called the free market.
No company has a right to your labor, and you have no right to work for that company, but I suspect that if a company fired all of the strikers, the government would overrule the decision. So, it is not really a fair fight if the government is on the strikers side.
In a free market, companies pay in wages and benefits what it takes to attract and keep workers, and workers are free to move to whatever employer pays them what they think they are worth. Some outside authority that forces a company to pay workers more than they are worth to the company is why a 2% inflation rate, at best, is what we have to live with.

Anyone that has any common sense knows you would not take a gun to the middle of a police action and expect to come out of it safe. This Pretti person was doing what his group wanted – to become another death for his group to use for PR against ICE and the the Trump Admin. Assuming that was a serious question, no. Furthermore, all carry permits with which I am familiar (I hold six of them) are accompanied by laws prohibited certain kinds of conduct while carrying. So, not only could your hypothetical robber be charged with armed robbery,that could be enhanced with a charge of brandishing a weapon, and probably several other charges specific to violating conduct demanded of a firearms carrier.
Poor Turley–he has to earn that MAGA media paycheck, so he craps on a dead man, who is of higher quality than any of the losers in the Trump administration. Turley claims that “skepticism” and “criticism” are not tolerated, so he tries to make the case that Pretti disregarded police orders and was therefore not a perfect hero–WHAT “orders”? There were NO ‘illegal aliens” being apprehended. Pretti was exercising his Constitutionally-protected right of freedom of speech. Turley also complains that Pretti kicked out a taillight and spat at the loser trash wearing ICE insignia days before he was murdered. So what? We don’t summarily execute people for spitting at a vehicle or for vandalism–Turley tried, in a previous post, to make the case that Pretti committed a felony by kicking out the taillight–but he was NOT arrested. Again I say–so what? Only MAGA media thinks the taillight incident has any relevance. In fact, it does not–just another lame MAGA media excuse to try to defend a clear-cut case of law enforcement misconduct and murder. Bear in mind that Trump had previously said, out loud, that anyone protesting him should be shot in the legs. He meant it.
Here’s the overarching problem–Pretti was RIGHTFULLY ANGRY over the ICE occupation of the city he calls home, where he cares for our critically-ill American hero veterans and where these ICE losers murdered Renee Good the week before. ICE Barbie, Trump and others in the most-corrupt and unqualified administration in US history LIED about Good’s murder, they announced, before her body even made it to the mortuary, that there would be NO criminal investigation, no civil rights investigation, Jonathan Ross was NOT put on administrative leave, and local law enforcement was barred from access to the evidence. They took her car, her body, Ross’s weapon and told everyone to shut up and go away. So, what is a patriotic citizen of Minneapolis supposed to do? Capitulate? Not Alex Pretti, RN.
Pretti had EVERY RIGHT to be angry, to take to the streets and to express his anger. When Pretti was murdered, he was trying to help up a woman shoved to the ground by ICE agents, and was pepper sprayed. After they knocked him to the pavement, they kicked him and beat him with an empty pepper spray container. His unholstered weapon was grabbed by an ICE loser BEFORE he was shot in the head. Then, the ignoramus losers pumped 10 bullets into his back–he had not been moving before they did this. This is the caliber of murderous trash whose conduct Turley is trying to defend. It’s not working, Turley. Just take a look at all of the protests, all over the United States, including in red states and cities. There IS NO “counterbalance” to what happened. We don’t send masked troops in unmarked vehicles to the streets of our cities. We don’t summarily execute people for exercising their right of freedom of speech.

Ever wonder how that gun got out of the holster so that Brown could grab it? How a cop in a car that could drive at over 100 mph was unable to escape? How the confrontation began that placed the cop car across the road to block Brown when there had not been a report of an assault made at the time? About why a cop would engage in a foot chase when simply following Brown in the car would not only save on running, but also put the car that he would detain Brown in closer to Brown and allow the cop to call for aid on the radio? Why the cop shot his own car?
Oh, he says he was being overpowered by Brown and needed the gun? The answer to having a strong attacker is not to hand them a weapon. You put the car in gear and drag the guy reaching into the window until you can scrape him off on a power pole or he falls off.
The cop screwed up and threatened to kill Brown with the gun. Brown believed the threat and pushed the gun down. The cop panicked and shot his own car – with the window down the bullet went through it, doing damage that could not be covered up. The cop couldn’t just slap a patch over the small hole, he would have to explain how the gun discharged. After that, he needed to eliminate the only witness – and couldn’t shoot left handed from the driver’s seat if he drove after Brown. He had to get out to get a clear shot. Then all he needed was to wait for Brown to turn so as to not shoot him in the back. Witness dead, he had weeks and access to evidence to make a story that almost fit the evidence.
What triggered the cop? Per an interview the cop gave after he was clear from indictment, it was that Brown called him a “pussy.” All the rest was road rage.

The ICE officers who shot Alex Pretti will use the Lt. Michael Byrd defense, which claims that, while no crime was committed by the deceased, the “threat” presented was so great that lethal force was justified.
In fact, little Ashli Babbitt (5’2″, 115 lbs.), while aggressive, possessed no weapon and no physical force sufficient to cause serious damage.
Alex Pretti was aggressive, armed, and dangerous on the day he lost his life, and he was armed and dangerous 10 days previously when he committed aggravated felonies while in possession of a firearm against federal ICE agents.
What is the threat imposed by someone holding a cellphone, helping a woman maimed by offers on an icy curb, and with his back to a horde of armed officers?
Saying he was “aggressive” simply due to his legally possessed and holstered firearm is a gross miscalculation of the situation and an affront to our Second Amendment.

You do not “help” someone who is interacting with Law Enforcement – that is called OBSTRUCTION.
The woman should have stayed off the street.

You should be aware at this point that if you have a carry permit, you are obligated to have it and ID on you whenever you are carrying.
Pretti did not.
But there are other obligations that vary from state to state.
Generally you are obligated in any encounter with law enforcement to inform them you are armed.
Pretti did no – MN law may not require that – most states do.
You are usually obligated to get training.
The training is NOT in the use of the firearm – it is in the law, such as the law of self defense, and the laws regarding carrying.
Most states impose additional duries to AVOID confrontation if you are armed.
Do you not understand WHY ?
This specific instance is why.
If you are armed what you are supposed to do in a “violent” situation, is to retreat if possible – NOT engage.
Law enforcement engages when armed – that is their job.
You rant because the ICE officer appears to be “agressive – because he is leaning heavily forward.
That is likely because he is armed. It is extremely common for police to have their gun taken from them in a conflict.
That is one of many reasons they are very sensitive to people getting close to them.
That is one of many reasons why merely intentionally contacting a police officer is assault.
Do not get Physical – not even a little with a LEO – armed or not.
They WILL treat you as an aggressive threat.
If you are going to carry – learn the rules AND learn good conduct.
Absolutely DO NOT rush into a physical conflict with others.
Frankly you should not do that if you are unarmed,
and you should not do that if one of the parties is a LEO.
The assumptions regarding Defending yourself or defending others
ALWAYS favor the LEOs.
Put differently you do NOT have the right to self defense or defense of others against a LEO unless it is crystal clear THEY are committing a FELONY.
You can not step in because you perceive them as aggressive.

With a few exceptions immigration law is CIVIL law, it is like parking tickets or traffic violations.
This is actually EXTREMELY important.
Illegal aliens are entitled to VERY LITTLE due process because they are not being prosecuted for violating criminal law.
Some are criminals, and they are being deported for being criminals. But they are not being prosecuted for Crimes, they are not facing loss of life, freedom or property. They are not facing a loss of anything that is theirs by RIGHT.
And that is why they are not entitled to much due process.
If you elevate Chuma’s conduct from the equivalent of a rolling stop at a stop sign, then you increase the due process he is entitled to.

There are now atleast half a dozen Pretti videos – and likely more to come.
Each one tells a SLIGHTLY different story -a PART of the whole, not the whole thing.
There are MANY things that are known now that were NOT know the day of – either from additional videos or very careful analysis of the existing videos.
Several FACTS that were not initially obvious.
1). Pretti was reaching for his gun – or atleast behind his back where they gun was a second before.
2). Pretti was not only resisting arrest he was trying to stand up when shot.
3). ONE officer successfully removed Pretti’s gun prior to the shooting. Pretti did not know that, nor is it likely the other 3 officers did.
4). There was a single shot more than a second before the officers fired at Pretti.
It is likely that was a misfire from Pretti’s junk gun, but that is not yet certain – though it is absolutely certain ICE knows if Pretti’s gun fired.
5). Someone shouted “Gun Gun Gun” all the officers backed away from Pretti two drew weapons and fired.

ICE can not use the arrest as a justification for shutting down the protest, but they CAN constrain the protest to ensure the safety of the arrest.
They can tell protestors to stand back, to get off the streets, to stay away from the officers making the arrest, to provide a clear area for the arrest.
Even at a pure protest like J6 protestors are OBLIGATED to obey the orders of law enforcement.
Any debate over the lawfulness of those orders takes place AFTERWARDS in court – not on the street.
On the street officers give you command, and you obey. PERIOD.
If you beleive the instructions are unlawful – you must obey, and you get to take it to court LATER.

What video coverage I could review looks as though there are 4 agents trying to wrangle Pretti while he resists. Pretti looks to be what 6’2” or so, maybe 180lb+ and physical fit, the 4 agent’s maybe 170lb+ max, my question why 4 agents could not contain this individual? Conclusion: recommended types of constraints of an individual by the agency, has limited the officers to types of force allowed. Since Floyd, neck restraint has been eliminated though it was effective to obtain acquiescence. That being said there is only one individual responsible for his death and that is Mr. Pretti himself. During his resistance he was flailing about until much confusion ensued, causing the dire end.

Pretty sure there was a recent ruling that hamstrung these district court judges in regard to implementation of established federal laws. I would believe that it did specifically speak to the authority of a district court judge in regard to nation wide uniform authority. As an example, how can a district judge rule what a law enforcement means and methods are when nationally they have been used and deemed unconstitutional? That would give every district court judge the authority to impose what THEY believe acceptable in their unique jurisdiction. Doesn’t or shouldn’t work like that, federal laws as in nationwide as in the same throughput, uniform code of justice.

Nearly universally SCOTUS has told the lower courts they have overstepped.

When you hear of an immigration case outside of TX or FL – the judge probably does not have jurisdiction.
But the location is just ONE of the jurisdiction issues.
SCOTUS has properly told courts, The APA does not apply when there is another remedy – because the APA says that it does nto apply when there is another remedy.
That has denied jurisdiction in both immigration and other cases.
SCoTUS has also said again restating centuries of law, that you can not issue a TRO or PI on an issue of Equity – i.e. an issue where no matter how the cases is decided the result will be money changing hands.
What is really really disturbing about most of these scotus emergency appeal shadow docket decisions is that the supreme court did NOT issue some NEW ruling. They merely ruled following well established constitutional, statutory and case law.

The giant issue in the immigration is Jurisdiction.
The supreme court specifically, and the lower article III courts gennerally,
have jurisdiction over all constitutional claims.
The constitution does permit congress to place all kins of constraints on all article III courts EXCEPT the supreme court.
Only the supreme court is a creation of the constitution. All other courts are creations of law.
Congress has given jurisdiction over immigration claims to Article II immigration courts – NOT Article III courts.
Therefore Article III courts only have jurisdiction in immigration matters on constitutional grounds, or Habeus grounds,
and habeaus is limited to the physical jurisdiction in which the person is detained – in most cases that is TX or FL.
So if you see an article III immigration case outside of TX or FL you can be 90% certain the judge has no jurisdiction
I would separately note that there is really no way for an illegal immigrant to avoid deportation.
The only question is how long and drawn out the process will be – not what the final result will be.

Trying to FORCE law enforcement to NOT enforce the law, whether that is immigration law, or organized crime law, is lawlessness.
