McDonald’s Hit with $6.1 Million Award in Hoax Case

A jury awarded $6.1 million in damages in the case of Louise Ogborn who alleged that she was tricked into sexual acts by a caller pretending to be a police officer. Notably, the $1.1 million in compensatory damages were cut in half due to her own negligence under a standard comparative negligence finding. Under the old contributory negligence rule, she would have been barred entirely from recovery due to her own negligence. The $5 million in punitive damages could well be reduced by the court.
