Time to Apologize, Rush

Submitted by Lawrence Rafferty, (rafflaw), Guest Blogger

Since Professor Turley is snowbound in the Winter Wonderland, the weekend warriors are back to bring your blood pressure up!

I have been critical of the Right Wing Mass Media for its continual banging of the drum of hate towards President Obama and the Democrats in general. Now, there are times that the Democrats and President Obama should be called on the carpet.  For instance, for not confronting the Bush torture crowd and for claiming that the President has the authority to kill American citizens without due process, just to name a couple. However, the civility that President Obama has asked for in his latest speeches, have gone unheeded by many on the Right and some on the Left.

We all succumb to the emotion at times and say things that we shouldn’t, but the Right seems to carry these statements to an extreme and they are unapologetic for it. Yesterday, fans of Rush Limbaugh faxed death threats to California State Representative and San Francisco Mayoral candidate, Leland Yee, because Lee had requested Rush to apologize for Rush’s ill-tempered and racially charged comments about the Chinese President during his recent visit to the United States. Rush mocked President Hu Jintao’s speech and Mr. Yee “..said Limbaugh owes the Chinese community an apology for his “pointless and ugly offense.” ‘. http://www.sfexaminer.com/local/crime/2011/01/leland-yee-receives-racist-death-threat

You can guess the result of State Rep. Lee’s request for an apology from Rush Limbaugh. He continued his rant and mocked Rep. Lee on the next program. I know some of you will want to know why the authorities believe that Rush’s fans are behind the death threats. Take a look at one of the faxes on the link below and you will understand.  Rep. Lee received similar threats in April of last year that are also being investigated.

I would put the fax on here, but the language is a bit “rough”.   See below for a link to the faxes in question.  Those who continue to voice their ugly rhetoric in the mass media have a responsibility for the result of that rhetoric. I for one think they are getting the response that they are looking for. What do you think?

  1. raff,

He’ll have until he’s 26 before he has to find his own… (unless he refuses the benefits of ‘Obamacare’).

  2. Buddha,
One correction, it is Chan’s parents who are probably paying the inflated prices for his insurance, at the moment. He will have a rude awakening when and if he gets a job and has to pay for his own medical insurance.

  3. You’re all for “charity” if it doesn’t cost you anything, eh, ya greedy lil’ peckerwood?

You truly have no grasp on human nature.

If people get hungry enough? They’ll come steal your food.

Cold enough? They’ll come kill you and take your house.

    Sick enough and without insurance?

You’ll be working all by your lonesome with no one to exploit but yourself. But hey, you ought to be used to exploiting yourself by now. Buy some reading glasses and get to it!

Ignore basic social support mechanisms at your own risk, but don’t assume to share the cost of that risk by shirking your load in supporting society. If you don’t want to pay for the social systems that benefit all of society with your tax dollars? Tough shit. Man up. Quit acting like a wuss and stop paying your taxes or move to the Sudan. Being part of a country is like being part of a team – you’re responsible for the whole team whether you like it or not.

The bottom line is you want the benefits these systems provide in the form of healthy workers to exploit, but you don’t want to bear your share of the cost because you’re a greedy lil’ piggy. Greed is stupid. So stupid in fact that you can’t distinguish between “Utopian” and “good business”.

Single payer not-for-profit health care insurance is a practical cost reduction measure by streamlining billing processes from from the provider end, increased savings in provision by spreading the risk across the greatest size risk pool possible and improvement of service provision to make it universal – which lowers costs by removing the incentive for private hospitals from to pass on the cost of treating the uninsured by selling you $45 aspirin when you go to in for a stay, a common practice now. Universal single payer not-for-profit health care insurance would save most companies money. More importantly, it would save lives.

All because some insurance company shitheel would have to give up his multi-million dollar bonuses for doing a job a clerk could do and start earning an honest living instead of playing golf three days a week and jerking off the shareholders? You can’t see the business and economic rationale for such a move? All because you love your rationale for being greedy at any cost to society as long as you don’t have to pay for it. Bad news, junior. You’re already paying for it at an inflated rate directly related to the greed and systemic inefficiencies you want to defend so badly.

If you had the sense to run your own business or the experience of running your own business? You’d know this is the economic reality: private for-profit health care insurance costs are killing small and medium sized businesses and even some large ones. The only people benefiting from the status quo are executives who provide nothing of medical value to the systems at great cost, siphoning off monies for bonuses and perks that could be spent on patient care. Get a job working for someone else? You aren’t smart enough to hire.

    Greed is truly stupid.

You two make a perfect couple.

“at least where there is enough, and as good left in common for others.”

We are talking about the state of nature. Not what happens after.

I would agree that some members of society need to be taken care of. Certainly those with mental and physical disabilities which would prevent them from working.

But anyway, I am a greedy sociopathic dick and I am sticking to my contention that people shouldn’t be forced to pay for other people to live. That is what charity is for, not government.

I am all for giving everyone free medical and dental care and free food and housing if it is done through charity and the people understand they are getting charity.

Government shouldn’t be in the charity business. You and Buddha want to insure people go start a company and do it. Don’t make the rest of us pay for your Utopian ideal.

  5. Arizona nullification bill SB 1433 sets up a joint legislative committee which “shall recommend, propose and call for a vote by simple majority to nullify in its entirety a specific federal law or regulation that is outside the scope of the powers delegated by the People to the federal government in the United States Constitution. The committee shall make its recommendation within thirty days after receiving the federal legislation for consideration and process.”

The bill is unconstitutional on its face.

The Supremacy clause in Art VI makes the Constitution the supreme law of the land.

Article III established the federal courts, including the Supreme Court, and extended the judicial power to all cases arising under the constitution.

When Arizona joined the Union, it agreed to abide by the Supremacy Clause and to Supreme Court adjudication of questions arising under it.

So this bill is just another pathetic publicity stunt based on yet another crank constitutional theory.

Andy Jackson knew how to handle this sort of thing.

  6. SY, The state legislatures under the Articles kept discharging debtors. No one in Europe would invest in such jurisdictions. The framers made bankruptcy an exclusive federal power and banned the states from impairing the obligation of contracts.

The people ratified the Constitution in conventions.

The new nation grew and thrived on foreign investment.

  7. Chan,

Of course that’s how you read it. That’s what you thought anyway. The problem is, that you’re ignoring the part that you don’t agree with. Locke Guards against the Tragedy of the Commons in his statement; ‘at least’ is a very powerful phrase.

  8. SY,

Vince was much more elegant than I…..He probably has argued before the Sct….I am more of a street fighter…taking cases and punching hard so I can make sure I build a good record….just in case there is the need to appeal…..

  9. Vince:

I feel a little smarter now that I wasn’t too far off on my thinking :). Many thanks for the summary and I will go to the link you provided!

    AY:

Many thanks to you as well! I appreciate the background of the bankruptcy clause. I am familiar with current bankruptcy law – I’m a paralegal working with a firm that specializes in bankruptcy. We have many instances where we’ve gone after creditors for ignoring the automatic stay.

Contrary to “popular” belief, there are legitimate needs for filing … but then we get the clueless. Those clients who call, like one did today and whose petition we are filing at the end of the month, and asked if it was okay to take an early withdrawal from the husband’s 401(k) so the family can go to Disney World. It’s moments like this that all I can do is shake my head and ask, “WTF??”

  10. Dancing Greed Monkey,

“Damn straight I intend to exploit the shit out of anyone I can. If I can make a buck off someone elses labor, I will be all over it. That is what they teach us here, exploit the commie workers and make them buy their work gloves at the company store.”

Spoken like a true sociopath and a real testament to the “quality” of education you get at Hillsdale. Oh, and your parent’s parenting skills, or lack thereof. I’d say you were raised by wolves but I don’t want to give wolves a bad name. They are, after all, social animals.

Good luck on compensating for your tiny . . . brain.

    Enjoy your Corvette.

  11. Is the wind blowing….I hear a hollow void of what could be a human species…

  12. Gyges:

the way I read it is that if you find an apple tree in a state of nature then you must share and share alike because that tree was given to all. I don’t have any problem with that at all.

But when you take your apple from nature and plant the seeds on land that you split with those around you and grow an orchard, that orchard ceases to be held in common in a state of nature.

Everyone has an equal opportunity to turn a few apples into an orchard in this example. Some will and some wont and some will not be able to. Why should the people who are not able to grow apples be entitled to the apples of others without giving anything in return? Why is the person who is able to grow apples responsible for those who cannot? The person who grows the apples is entitled to something in return if he is going to give his apples to those who do not have any.

It seems pretty simple to me.

Does someone owe me a job? I will probably end up working for someone because I don’t want to become a business owner, but the owner of the company wont owe me anything, I must earn it. It is not his duty to provide me with a job. Furthermore he has not prevented me from going into business, the opportunity is available to all who wish to.

  13. Vince,

I don’t use an annotated version of the Constitution on a regular basis, but thanks for that link. Good notes. It’ll come in handy at some point I’m sure.

  14. SY,

Where the Federal Government has spoken then it is exclusive to them….they set the floor and the state sets the ceiling..such as in Civil Rights….Those are codes…not covered by the Constitution…

In areas of immigration…bankruptcy….these are Constitutional…the state may not act in these areas without the consent of the Federal Government…

You have Jefferson to thank for the Bankruptcy Clause…he lost his entire fortune…to a shift in the real estate market…a creditor foreclose on his main home….there was pleading by many wealthy folks that offered to purchase his property back for him…the creditor (reminds me of Chan) would not sell it back….well…now…it is a Automatic Stay that better not be fucked with…you can go to the big house and fined a lot of money…

If anyone disagrees with my analysis…oh well…do so…lol

Last evening some poster said that a state legislature is trying to limit then courts ability to act…well…they do…its called severbility of an act….if one part is held void it does not affect the rest of the legislation…but a blanket act that says they can’t would be most likely struck down by a court….of the lowest jurisdiction….and if appealed…I am sure sanctions would be had against the offending party…

  15. Article VI, US Constitution:

“This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwith-standing.”

For a detailed discussion, go to the Constitution Annotated, beginning page 959:

    http://www.gpoaccess.gov/constitution/pdf2002/016.pdf

In general, a federal law that is a constitutional exercise of a power entrusted to the Federal Government by the Constitution will supersede a conflicting state law, if the federal law so provides.

But it is complicated. Read the above link.

    Chan:

    …..

No skin off my nose – as I’ve stated before, karma’s a bitch, son. It may happen tomorrow, it may happen 20 years from now but she’ll find you. LOL.

    ============================================

    Chan,

You can take that to the bank ’cause it is pure, unvarnished truth!

  17. I need help from the resident lawyers, particularly in regards to constitutional law.

I just got off the phone with my sister who lives in Phoenix. She is, like me, a liberal and is very in-tune to the state legislature. She said that the state GOP is drafting legislation which would nullify federal law in Arizona.

My understanding is that federal law supercedes state law – am I right in this, or does state law supercede federal law in certain areas, ie, immigration, civil rights and the like? I’m looking into this now but was curious if anyone here knows the specifics … gracias!

  18. Chan L.,

You are screwed….what you sow you shall reap….ever heard that…

I cannot tell if you are stupid or illiterate….ill-informed is now taken for granted…does the housing crash…stock-market crash of 08′ ring any bells….Greed….

Did I forget to mention Greed…oh yeah…then when they were tanking they held their hands out just for the taking…ring any bells?

Foolish indeed…knowledge is wasted when wisdom does not follow…..

I wish we had Mike Spindell’s take on this….

  19. Chan:

One would need to understand and have morals in order to know how to define them. You, obviously, don’t understand morals, nor do you have morals, thus lack the capacity to define morals.

No skin off my nose – as I’ve stated before, karma’s a bitch, son. It may happen tomorrow, it may happen 20 years from now but she’ll find you. LOL.
