Woman Admits That She Falsely Accused Convicted High School Student of Rape After He Serves His Time In Jail . . . Woman Keeps $1.5 Million Award As Rape Victim

Brian Banks was a former high school football star when he was accused of rape by Wanetta Gibson. Gibson’s name was sealed as a rape victim while Banks was publicly accused as a rapist despite his insistence that it was consensual sex. It was his word against hers and prosecutors threatened him with life imprisonment if he went to trial, so he pleaded guilty to a rape that he did not commit. He spent five years in jail. When he was released he was surprised when his “victim” asked to befriend him on Facebook. She later admitted that she made the whole thing up but did not want to give back the $1.5 million that she won in a judgment against the school district for her alleged rape. She retains the money despite admitting to lying about the rape.

Banks was 16 and a student at Long Beach Poly High School when he said that he made out with Gibson but did not go beyond groping and kissing. He was a talented football star being scouted by colleges for possible scholarships. The ended the same day when Gibson accused him of rape. Prosecutors pushed forward with the case despite an absence of critical forensic evidence and the fact that Gibson’s account changed over time. Banks’ mother sold her condo and her car to pay for his defense.

After his release, Gibson met Banks and agreed to speak in front of an investigator. She is quoted as saying “I will go through with helping you but it’s like at the same time all that money they gave us, I mean gave me, I don’t want to have to pay it back.”

Since this case occurred ten years ago, it is not clear if Gibson will even be investigated, let alone charged for her false statements. In the meantime, she is keeping the money . . . what she has not already spent.

There is also no response from prosecutors on why they pushed forward with the case given the conflicts in the account of the alleged victim and absence of forensic evidence establishing guilt.

A judge has finally expunged the conviction of Banks so that he does not have to remain on parole. He already served the jail time.

  1. Anon, false accusations of rape that make it to prosecutions are actually rare. More common by far is police AND prosecutors assuming the allegations are false.

More horrible yet by far are cases in which children are molested and then not only disbelieved, but handed over to their molesters. From that there is no escape and it is not uncommon and not remediable.

Still, this woman has done unimaginable harm and I hate what she did, hate THAT she did it, and hate the possibility that she will escape punishment.

I’m not going to do a bunch of research on which feminist websites say things you object to. I’m stating my position. Nobody pays my salary.

  2. That LIAR should have to do the 5 years that poor man had to do. The school district should sue for the $$ back as well as Brian suing her for stealing his youth & dreams. Time he will never get back. How do you go on with your daily life, put your head on your pillow knowing you put an innocent man in jail? Not knowing if at that given moment he could have been gettin abused himself. Shame on you. It’s because of low class, money hungry disgusting pigs like you that when women are truly raped they are not believed. Karma is a bitch and I truly hope you get yours 100 times over. Remember if you have children the sins of the parents pass on to your kids. SHAME ON YOU!!!!

  3. Malisha,

    Thank you for your words,

The problem though is a survey of feminists sites brings out the “false rapes are so low as to be ignorable” meme time and time again.

    http://www.safercampus.org/blog/2009/09/apparently-we-need-to-discuss-false-reporting-again/

That’s a typical example of a feminist site that says:

    1. Oh yes, false rapes are bad and damaging and of course we care about them of course we do, we do of course, and we shouldn’t ignore them, except, in fact,

    2. They occur so rarely we really should ignore them because only women haters bring up the problem of false rape accusations, and

    3. In fact, whenever we examine why a woman makes a false rape accusation, it really is the patriarchy that is to blame.

  4. “For those pushing jail time for Wanetta Gibson, consider that it would be at the taxpayer expense, just like her $1.5M “award” for the lies she so convincingly created. If she were shunned by the vast majority of people with whom she came in contact, she couldn’t manage very well at all. Shun means NO voluntary association – no sales, no service, no camaraderie, no anything including violence: ostracism from society.”

Yeah, that’s a great excuse to never imprison anyone.

But we mostly hear that excuse when referring to women that sexually predate on men or otherwise perpetrate hate crimes against men:

    Here’s another example:

    http://www.mysanantonio.com/news/local_news/article/Woman-gets-probation-for-sex-with-underage-3558020.php

Woman gets probation for sex with underage neighbor

A San Antonio woman who admitted to Child Protective Services investigators that she left her children unsupervised to go have sex with a 13-year-old neighbor was ordered Monday to serve deferred adjudication probation for aggravated sexual assault of a child.
Prosecutors had recommended prison for Amanda Ann Nabers, 26, who will have to register as a sex offender for life.
But she gave a full confession, she has already lost her children, her house and her job, and the victim’s family was in favor of probation, defense attorney Carlos Martinez told state District Judge Juanita Vasquez-Gardner.
Nabers told authorities the trysts took place four or five times from February to August 2011 while she was high on marijuana and Xanax.
Had Nabers been a man, she would more than likely be prison bound, but the wishes of the victim and his family play a large roll in determining the sentence, the judge said.

    These stories are just endless.

As I said, some bitch making a false rape accusation is not news (nor is noting it bigotry). What is news is when feminists like Lottakatz and kittyantonikwakfer stop defending and encouraging this sort of bitch behavior.

  5. Anon, that stuff about feminists being either in favor of false allegations or promulgating the myth that there is no such thing is absolutely WRONG. The fact is that every single false allegation hurts not only feminists and women in general, but SPECIFICALLY hurts each and every woman who has ever been raped. EVER!

I feel more rage and indignation toward this female who has derogated an innocent man’s life and who has, also, hurt the cause of women who do not want real rapists to have excuses for their abuse than you can possibly imagine. And I am not just a feminist; I am an anti-misogynist. I believe that the hatred of women, and woman-blaming and woman-victimizing actually are the core problems that have led to a host of other problems from which our entire society suffers!

Just as, as a Jew I hold Jews to a higher standard than other people, as a woman I hold women to a higher standard than men. When a woman does something like false accusing a man of rape, getting him imprisoned and his life destroyed to the max she can manage, profiting from it, etc., I personally feel like killing her! I would never act on that just as I would never act on personally wanting to kill men who do similar things to women, but the feeling is there, and I recognize it. I do not, however, enlarge it to conclude that other women, other than this rotten female killer-instinct-psychopath, are guilty of her crime.

And my rage at this woman is, I feel, a rage on behalf of my sisters, especially those who have been raped.

  6. Hey LK, we reclaimed the word bitch, don’t you remember?

But what I find funny is how many women are writing in to articles about this woman all over the net and calling her a bitch.

There is nothing inherently misogynistic about my language. I didn’t say all women are bitches. I said “some bitch” referring to a specific woman who committed an act of violence against ALL MEN as can be seen by her eagerness to portray one man, falsely as a rapist, a sexual crime often attributed by feminists to all men. “Remember gals, all men are rapists” “All sex is rape”, “you will probably know your rapist”, “1 out of 4 women are raped”.

So she commits a hate crime against men, I state this one woman is a bitch, you apologize for her, and yet, somehow, I am a misogynist, and her and your misandry just get a pass.

Anyway, no bigotry here, but you might check your panties, to see what resides in them.

  7. For those pushing jail time for Wanetta Gibson, consider that it would be at the taxpayer expense, just like her $1.5M “award” for the lies she so convincingly created. If she were shunned by the vast majority of people with whom she came in contact, she couldn’t manage very well at all. Shun means NO voluntary association – no sales, no service, no camaraderie, no anything including violence: ostracism from society.

Until Wanetta demonstrates wilingness to and arranges to restitute Brain Banks – in the manner/amount he decides – AND the taxpayers of Long Beach Unified School District this is what she deserves. In a proper society – not the current one – this is what justice looks like. And in such a society everyone knows what are the social consequences – shunning and ostracism by those who assess their behavior as unacceptable. And when it’s public, everyone else is assessed for their own acts of shunning (and restitution requirements too). Kind of like the old small towns of generations past; the Internet makes it all possible.

  8. I agree, lottakatz. Wanetta needs to spend a little time in the pokey.

  9. Vagina-boy: “It’s not news that some bitch lied…”
    ***

You know, if you’re not selling you misogynistic commenting to the far right you should be, may as well make some money off your bigotry if you can stop playing with yourself long enough. The opportunity for a last sentence like that must really get you hot, such a *powerful* statement…. LOL.

  10. I’m not one for putting folks in jail for every little thing but srsly, why isn’t she in jail yet?

  11. @puzzling, I listened from 1:45 to 2:30, and I am not sure I am hearing anything that says “incompetent counsel”. What I heard seems to be similar to what I’ve often heard in these circumstances.

Anyway, I have it on good authority from feminists that false accusations of rape occur so infrequently that they are ignorable.

Regardless of how false accusations of rape are a necessary Type II Error implication of what happens when you try to decrease Type I Errors down to 0 without considering the Type II Errors.

It’s not news that some bitch lied about rape charges, it will be news when feminists start giving a damn about the rights of other people on the planet.

  12. “Good to see that the UK Daily Mail article carries photos of her so that others can recognize and negatively Social Preference her:”

Something’s not adding up here. The Daily Mail has a photo of a black woman as being the alleged accuser, but Banks trial attorney told him to take the plea bargain because the jury would be less inclined to believe the word of a black man over a white girl.

  13. I wonder if this state has a law that allows for compenstion for wrongful conviction. At least it would offer a small measure of restitution for him to begin to start over.

  14. I personally have never seen the wisdom in a society that so readily allows the “deep pockets” to be fleeced.

An individual is wronged, so lets gouge the taxpayer.

That’s about as ugly as any other aspect of this case, except for the reality that this woman likely will not end up in prison, which she certainly should.

  15. “She retains the money despite admitting to lying about the rape.”

I suspect that will be a temporary state of affairs. Speaking of states, I also suspect that the prosecutors and the State of California will be getting out their checkbooks too. I hope the meanest attorney in the state steps up and takes Banks’ case pro bono.

  16. Brian Banks was the victim of incompetent counsel and a government that forced him to plea or risk 41 years to life. Watch Banks’ account of his conversation with his attorney (1:45)

Also, Gibson has since claimed that she was lying when she recanted her story. She states that she only did that because Banks’ has offered her a $10,000 bribe to do so (4:35)

  17. Does he have some legal basis to sue this viperous woman? He should at least take everything that is left from that settlement.

    What a horrible tale.

  18. So the “victim” of a never-happened rape not only is not restituting the guy her lies sent to prison for 5 years (and severely damaged his reputation), she is continuing on as a thief of $1.5M from the Long Beach school district taxpayers – monetary “award” she was “given”.

Until Wanetta Gibson restitutes Brian Banks – and he decides what would return him to or approximate the state of lifetime Happiness he was before her lies – and also begins paying back the money she has stolen, she properly should be shunned by others.
Good to see that the UK Daily Mail article carries photos of her so that others can recognize and negatively Social Preference her: http://www.dailymail.co.uk/news/article-2149462/Brian-Banks-One-time-football-star-rape-charge-dismissed-years-prison-accuser-contacts-Facebook-say-happened.html
