Pennsylvania Police Officer Shoots Man Holding A Pair Of Underwear

mEIAoV8RMVk9qX0sippr3sQJames Weyant could be forgiven for being just a little confused.  Weyant was walking in an alley at 4 am when an Altoona, Pa., police officer pulled up next to him.  Weyant was holding a pair of Guitar Hero shorts in his hand and turned toward Police Officer Mark Sprouse, who promptly shot him. The officer was cleared in the shooting. He is now suing with a 1983 Civil Rights Act complaint.

Weyant said that he went to visit a friend but found no one at home. On the way back, he said that the elastic on his Guitar Hero shorts broke and would not stay up. He decided to take them off to walk across the alley with his large hoodie covering him. According to Weyant, that is when an officer pulled up and exited his car with his gun drawn. The officer said that he mistook the shorts as a weapon, a claim that was accepted by the police review board composed of representatives of the police department and the Fraternal Order of Police.

Weyant is 5 feet 5 inches tall and weighs 135 pounds. The bullet hit Weyant in the right armpit and shoulder area.

The officer is back on patrol.

  4. Guitar hero underware can and should be considered a deadly weapon…. By all means…. What’s wrong with this police board…. The officer should be given an accommodation and vacation for Hesse heroic efforts….and service beyond call of duty….the person should be happy that the officer only shot him in the shoulder…. He should be required to reimburse the officer expenses and the city for the cost of the bullet, transportation o the hospital… The first responders team expenses……… It’s 4 am in Altoona….the guy should have been home….

    Now, if the police board had acted responsible… The officer would have been fired and prosecuted for this criminal act….

  5. Evidently the police procedure today is to exit the car with gun drawn and shoot whoever moves even though there is no evidence of a crime being perpetrated.

  7. Impersonal use of pronouns or whatnot has me to believe that the cop is suing someone not the underwear guy suing someone. But since it requires a state actor to be the defendant I would presume that the underwear guy is suing the cop for violating his civil rights under color of law in the middle of the night in a dark alley with full opportunity to shine his floodlight on all things considered. And if the perp had more than two things then we are talking alien here.
