1407331554000-pot-watermark1Justin Goodloe (right), 20, and Allen Thomas Barnes (left), 19, are probably not going to be top candidates for the next year’s draft picks for the Sinaloa Cartel. Barnes was driving a car in the early morning of July 24th when it was pulled over the police near a burglary scene — purportedly because of the lack of headlights. As police approached the vehicle, they saw a rather curious sight: a marijuana plant sticking out of the window of the vehicle.

1407341623001-goodloe-11407341623000-barnes According to police, Goodloe insisted that they had stolen the potted pot from a friend who owed him a $100 drug debt. That is a curious defense where you add theft to a possession charge.

The police appear not to buy the defense anyway. Both of the men were charged with manufacturing of marijuana.

  2. And the assumption that most pot smokers are cigarette smokers is ludicrous, and contrary to fact, but is typical of the all too common assumptions made about many illegal drugs.

    1. wrxdave – some studies have shown that tobacco, not cannabis, is a gateway drug. Although cannabis has its downsides as well.

  3. Why outlaw heroin specifically? It is just another case of rather arbitrary good drug vs bad drug hypocrisy by the Feds. Heroin is an opiate pain reliever not much different than any other opiate pain reliever available by prescription. In equigesic terms it is about 5 times stronger than Morphine, about 1/2 the strength of Dilaudid (Hydromorphone), and about 1/20 the strength of Fentanyl, which is currently the strongest commonly prescribed opiate available, although much stronger ones are in use by Anesthesiologists.

    In my quite humble opinion the arbitrary scheduling of drugs into good drug vs. bad drug is a holdover from when these laws were originally created, often in hysteria, and due to the perception that they were disproportionally used or abused by certain undesirable ethnic or social groups (Mexicans, “Negroes”, “Hippies”). Most of these drugs would have legitimate applications in the proper hands of Doctors & Psychiatrists, but Doctors and Patients are denied the right to select the best possible medication for their condition and circumstances. Cannabis being a case in and on point.

    Decriminalization of these substances by immediate descheduling of all if them would allow them to be distributed, legally, through our current system of Physician/Pharmacy, would allow legitimate treatment of addiction without fear of legal repercussions, and would go far in derailing the power of the Hugely Powerful criminal drug cartels which are not only destroying whole countries, fueling an immigration nightmare, but which are also perverting our Border Patrol and many parts of our political process through huge influxes of cash contributions through their enormous networks in this country.
    (In addition to exercising control over many criminal street gangs in major cities in the US).

    So, tell me again why Heroin should be more illegal than Dilaudid? It is no less addictive.

  4. The difference between heroin and a heron is huge. The difference between pot and heroin is huge. The government should have laws prohibiting heroin. Maybe not pot. But tobacco? Outlaw it for sure. Don’t gloss over the fact that all your grandpas, grandmas, and uncle joes died from smoking Oh, I know that the death certificate said some cause like heart attach or cancer. Cut to the chase. Cigarette smoking is dangerous, a hazard to your health. Does that not mean anything to you? (Bob Marley) And you pot smokers are probably cigarette addicts too. Went in dumb, come out dumb too. Hustlin round Atlanta in your alligator shoes.

  5. The hallmark of a “free-society” detaining/arresting/caging people because they have the audacity to grow/synthesize/possess/ingest substances the government has arbitrarily pronounced verboten.

    Let freedom reign.

  8. Since they have stated their defense, taking the plant hostage, I think they have a shot at getting off on the manufacturing charge, the possession is another matter. That admitted to possessing the plant.

    City Withdraws Stop-and-Frisk Appeal; Plaintiffs Join Request

    August 6, 2014, New York – Today, the City of New York and plaintiffs jointly filed a motion with the Second Circuit Court of Appeals to withdraw the City’s appeal of Floyd v. City of New York. Floyd is the landmark stop-and-frisk class action lawsuit, filed by the Center for Constitutional Rights (CCR) and co-counsel Beldock, Levine & Hoffman and Covington & Burling, that found the NYPD’s stop-and-frisk practices racially discriminatory and otherwise unconstitutional. The joint request follows a ruling last week by Judge Analisa Torres, rejecting attempts by several police unions to intervene in the case. Dismissal of the appeal is the last step before the joint reform process begins.

    At a guess, cultivation is shoehorned into “manufacturing” in the statute.

    That is bad nomenclature isn’t it?

    Does one manufacture vegetables in a garden, or do those veggies grow naturally?

    The law would read better if it was written as “cultivation of marijuana” wouldn’t it?
