Bleed on a Ferguson police officer? Get charged with destruction of public property. Oh My!

We should have seen this coming. I believe it is going to get worse before it gets better, if ever. At some point there is going to be a “pitchforks and torches” backlash.

Ferguson MO logoIt may be starting in Ferguson, MO. Take a look at one of the latest stories to come out of there. It’s sad that we have to look overseas to get reliable and up to date news about what is happening in the good ol’ US of A. Because of the great sucking sound that is the US corporate mainstream media, people who want to get a more balanced read on the news check sites such as Al Jazerra, The Guardian, RT, The Epoch Times, and Der Spiegel.

This is a brief clip from a story posted yesterday on RT (Russia Today). Emphasis is mine:

Nearly four years to the day before Ferguson Police Officer Darren Wilson opened fire and killed Brown, 18, a complaint filed in federal court accused the same law enforcement agency of violating the civil rights of a man who says he was badly beaten after being wrongly arrested, then later charged with “destruction of property” for bleeding on the uniforms of the cops alleged to have injured him.

It gets better. Reading the court filings, we learn that on September 20, 2010, Henry Davis missed his exit and found himself in the the St. Louis County community of Ferguson at 3:00 AM. As it happened, there was a warrant was out for a Henry Davis, but the wanted man has a different middle initial, different birth date, and different Social Security number.

However, Davis, a 54 year old African-American welder was assaulted by four officers (one of them female). The records show that he was thrown forcefully into a one-person cell, but the one-person cell already had an occupant. He would have had to sleep on the concrete floor, because the one bunk was already occupied. There was a pile of sleeping mats near the cell, so Davis asked for a sleeping mat. Because he asked for something to sleep on, he was called disobedient. At that point, Davis was thrown to the floor, and put in restraints. During this assault in the jail, one of the officers kicked Davis in the head.

After being restrained and kicked in the jail cell, paramedics took Henry Davis to the hospital where he insisted that his picture be taken before he was treated (photo and story at the link). The Emergency Room doctor diagnosed him with a concussion and stitched him up before releasing Davis back to custody of the Ferguson PD.

He was released 3 days later on a $1500 bond for “destruction of public property.” If they kick and beat you, you better not dare bleed on their uniforms.

Davis sued. When the four officers were deposed, all four denied that they had blood on their uniforms as they had signed on their affidavit of complaints. What does this mean? They either perjured themselves at trial or had falsified affidavit. That level of perjury is a felony. The county prosecutor declined to prosecute because he claimed Davis’, injuries were de minimus.

Let’s take a look at the prosecutor. The St. Louis County Prosecutor is a man named Bob McCulloch. He has a reputation of being extremely harsh in his prosecution of offenders. However, McCulloch has some personal baggage which calls both his judgement and racial neutrality into question. You see, Bob McCulloch is the son of St. Louis Metropolitan Police Department officer Paul McCullouch. Officer Paul McCullough was killed in the line of duty on July 2, 1964. Officer McCullouch was 37 years old at the time. His son, current prosecutor Bob McCulloch was 12 years old in 1964. I remember that cop killing, because we lived in St. Louis, and it happened not far from where I was working at the time. Officer McCullouch was responding to a kidnapping call at the infamous Pruett-Igoe Housing Project when he was shot in the head by the fleeing kidnapper. His killer was a black man.

Bob McCullouch wanted to become a police officer like his father, but lost a leg as a teenager. That eliminated him from joining the police force, so he went to law school and became a prosecutor, a position he has held for the past twenty years. His tenure as a prosecuting attorney has been marked by controversy. He has a reputation as being almost fanatical about prosecuting alleged perpetrators, but turns a blind eye to even the grossest misconduct by law enforcement officers. The St. Louis Post-Dispatch has a story about him.

Mr. Davis’ injuries were de minimus, and according to McCullouch, not worth pursuing, yet Davis’ spattered blood on the officer’s uniforms did warrant charges. Maybe somebody smarter than me can explain that logic.

Henry Davis sued the city for civil rights violations, but late last year Magistrate Judge Nannette A. Baker ruled in favor the city. His attorneys filed a notice of appeal in March, and the case is currently slated to be considered later this year by the Eight Circuit Court of Appeals.

    Ku Klux Klan (KKK) members from three different states are reportedly traveling to Ohio to hold a two-day fundraiser for the officer who shot unarmed teen Michael Brown, and to “guard white businesses.”

    The Southern Poverty Law Center (SPLC) first reported last week that that the New Empire Knights of the Ku Klux Klan had begun raising money in support of the Ferguson police officer who killed Brown.

    On Friday, the New Empire Knights announced that it would be holding a fundraiser on August 23-24 in Sullivan, about 60 miles from Ferguson.

    “At a deposition, Ferguson’s former police chief revealed that his staff did not keep records of incidents in which officers used force against citizens, so long as no one died; in other words, there was no way of telling how often incidents like Davis’ happened. Surveillance video of the jail was destroyed before the trial. Davis pleaded guilty to two of the four destruction-of-property counts and a handful of traffic violations. He paid $3,000 in damages. He also sued the officers, in a case that was dismissed but is being appealed.

    Davis moved to Mississippi after the alleged assault and says he still struggles with his memory—a condition he blames on what happened that night at the Ferguson jail. “Kim Tihen—she was the one that was holding me up,” he said when I reached him Monday. “I was handcuffed laying on my stomach and she lifted me up like three-quarters off the ground.”

    “They’re doing like they did me,” he said of the protests he’s watched from afar. “For the wrongdoing they’ve done, they’re trying to say that it’s the victim’s fault.”

    Tihen did not respond to requests for comment. According to her official bio, her focus on the city council has been “crime prevention, fiscal responsibility, and increased communication between city officials and residents.””

It is unusual for Egypt to criticize such a major donor. Ties between Washington and Cairo were strained after Egyptian security forces killed hundreds of Muslim Brotherhood supporters following the army’s ousting of freely elected President Mohamed Morsi in July 2013.

    The Egyptian Foreign Ministry’s statement Tuesday on the unrest in Ferguson read similarly to one issued by the U.S. in July 2013, when the White House “urged security forces to exercise maximum restraint and caution” in dealing with demonstrations by Morsi supporters. The ministry added it was “closely following the escalation of protests” in Ferguson, unleashed by the fatal shooting of unarmed black teenager Michael Brown by a white police officer on Aug. 9. Human Rights Watch said in a report last week Egyptian security forces systematically used excessive force against Islamist protesters after Morsi was ousted.

  5. This Ferguson case does have analogies to the White Klan South of not too long ago. A guy gets accused of a crime and a mob forms outside the courthouse, the jail, the saloon, and the mob demands justice. The mob demands that the Sheriff go arrest the perp. The mob demands that the Grand Jury files an indictment. The mob might kill the perp if they get their hands and noose upon him. The only difference here is the national media is part of the mob.

  8. Several days ago, Ferguson PD signed an agreement to NOT arrest reporters. Since then nearly a dozen have been arrested, four yesterday alone.

Black suspect robs store, assaults store manager, jaywalks and assaults and batters police officer in police car where suspect attempts to take police officer’s gun when gun inadvertently is fired after police officer attempted to detain suspect. Black suspect flees scene as officer orders him to stop and get down on the pavement. 6’4″ black suspect turns back toward the officer in a “bull rush” and officer fires 6 rounds in 2 seconds in his own defense. Wounds are on the front and crown of the head of the suspect. Suspect’s hands were elevated in an assault position, not in a position of surrender.

    This narrative is supported by 12 eyewitnesses.

    How many times have the likes of Jesse Jackson, Bill Cosby, Tawana Brawley, the accuser and DA in the Duke La Crosse case, etc., ad nauseam, lied to obtain some perverse political gain at the expense of the nation?

    How does a nation counter the lies, the liars and the profiteers in the race industry.

    What is the fundamental, essential component that drives the differences and the campaign? What was it that Lincoln grasped as axiomatic?

    WHY DON’T OIL AND WATER MIX???

    There are two main reasons why don’t oil and water mix even if they are put in the same container, both of which deal with these two substances on a very small scale. Everything around us is made up of tiny particles known as molecules. The way in which two substances interact depends on the molecules that make up the substances.

    The first reason that water and oil don’t mix is because their molecules are packed differently. The molecules of water are packed very densely. This means if we take equal parts of water and oil, there will be more molecules of water than oil. This also means that it will always sink underneath the oil.

    There is one more reason why they cannot dissolve with each other. Water molecules are positively charged. Since only opposites attract and oil has no charge at all, there is no force between the substances that allow them to mix. Therefore even if you stir a container with oil and water, they will eventually separate into two distinct layers.

  11. bettykath, You’re beating a dead horse. Brown’s associate has already admitted that Brown took the cigarillos without paying for them. Perhaps you should get some information from some place other than Lazy Freddy’s.

  12. Yes I understand that there are 2 different cameras one focusing on the counter and one on the door. But what I’m asking is where does it show him paying for anything. It looks like he is getting (or has been given) merchandise from behind the counter but I don’t see where he hands over anything to the clerk behind the counter.

    At best it looks inconclusive that he paid.

    I have better things to do than educate you on the details of what is taking place in Ferguson, but here goes.

    “the agency who trained automatic weapons on them while peacefully assembled” -Every law enforcement agency in the area is participating in the response. Why would they point weapons at protesters? A. Because some of those protesting in the area had thrown Molotov cocktails at the police.

    “who assaulted journalists” -Journalists are not above the law. When given a lawful order and failing to comply, They were helped along and arrested.

    “dismissed by the governor for that tyranny” -The governor exceeded his authority in the name of politics. Instead the governor put Capt. “Kumbaya” Johnson in charge. Johnson was so effective that he and his men stood by while the Ferguson Market was looted. Yet we hear no screams of sympathy for the injury sustained by that completely innocent party.

    “It was Ferguson police who released the video from the store.” -The strong-arm robbery at the Ferguson Market is a concluded investigation. The perpetrator of that crime is deceased. The perpetrator was identified to be Michael Brown by Brown’s parents and Brown’s associate Dorrian. Was it relevant? A. Yes. It demonstrated the acts taken by Brown minutes before the encounter with Officer Wilson.

    “Sr Louis county Chief Belmar already passed judgment on the case the day after the incident claiming the officer was assaulted.” -The officer sustained a broken orbital socket after being punched in the face by Brown. Belmar’s statement is no more a conclusion of the case than it is to admit that Officer Wilson shot Brown. (But you don’t complain about that bit of information.)
