Sperm Bank Sued After Disclosure That Donor Responsible for 36 Had An Undisclosed History of Schizophrenia

sperm11n-2-webThere is an interesting lawsuit against a US sperm bank Xytex and its Ontario distributor, Outreach Health. At the center of the case is Donor 9623, James Christian Aggeles of Georgia, who claimed an IQ of 160, an undergraduate degree in neuroscience and a master’s degree in artificial intelligence. He also claimed that he was pursuing a PhD in neuroscience engineering. In reality, he was a formal mental patient with a felony conviction. His sperm was used to conceive at least 36 children in Canada, the US and Britain. The result is a $12 million lawsuit against the companies.


The truth about Aggeles was discovered in 2014 after an inadvertent disclosure by Xytex that included his email. The later Google search revealed the true identity and his past diagnosis for schizophrenia, narcissistic personality disorder, drug-induced psychotic disorder and significant grandiose delusions. It also revealed a conviction for a 2005 residential burglary resulting in eight months in jail.

Xytex’s President Kevin M. O’Brien insisted: “In this case, the donor underwent a standard medical exam and provided extensive personal and health information. He reported a good health history and stated in his application that he had no physical or medical impairments.”

However, the families insist that Xytex and Outreach Health continued to promote and sell the donor’s sperm even after the sperm bank was informed of the disclosures.

This is a horrific situation for these women and liability could produce a needed incentive for these companies to better screen donors. It hardly seems reasonable to rely on the representations of donors without further investigation. This is not eHarmony from a sperm bank with lasting implications for women.

  1. Ren. Born of “desparate” situation is not the same as shopping in the sears catalog. They are suing …saying they didn’t get their money worth or false advertising. My dad was an orphan cuz his dad died…not because his mom picked a false advertised. Huge difference.

    1. J – did your dad’s die or did his mom die? Either way he was not an orphan. He was a foundling. An abandoned child.

    The mom was 100 percent normal. Because normal people go to a sperm bank and “pick” the father.

    What do i think? Turley asks….well the mom will be raising the kid so there is 100 percent chance the kid will be crazy. Who tells a kid we bought you at a sperm bank and kid be “ok” with that?

      The same people who adopt children born in desperate situations. Or have surrogates. At least nearly all those parents are showing they actually wanted the kids. My dad’s mother died following his birth and his dad dropped him off at the local orphanage as a newborn. He wasn’t adopted until he was 7…and able to work.

  11. Bank of America has the same problem as the bank in this article. People make deposits of cash which is phony and customers take out withdrawals of cash which is phony (counterfeit). But the FDIC will not hold the Bank of America accountable. The B of A says that they did an accounting and all was well.
    Don’t take a $20 or a $100 bill from B of A this week. Next week look out for the $50s.

    You’re very mistaken. Prof Turley does not trifle with Drudge or the Inquirer (sic). He goes for the prize winning Daily Mail, who, along with investigative journalism like this, also covers side boobs and red carpets faux pas.

    1. I just reread the original posting and all of the emphasis was on women being the victims. How about their male partners? Are they not victims as well? Or the partners they will meet later?

  14. @mstfd – I didn’t see any profile of the women to indicate they had either male or female partners. Quite a few women have elected to get pregnant without the benefit of a father (or even same-sex partner) in the child’s life.
