We previously discussed the controversy over the FBI granting immunity to former State Department staffer, Bryan Pagliano, who set up a server in Mrs. Clinton’s home in Chappaqua, N.Y., and worked for her at the State Department. Pagliano had refused to cooperate after invoking his Fifth Amendment right against self-incrimination. He was an obvious target of potential criminal charges if he knew that the server was meant to circumvent federal laws, including the mishandling of classified information. The granting of immunity removed the threat for his cooperation, a leverage often used to implication others who may be higher up in the chain of command. Now, as the record appears to confirm that email records were knowingly destroyed after the issuing of a congressional subpoena to preserve such record, it also appears that the Justice Department gave immunity to the other person most at risk of a criminal charge — and the person some are likely to argue would have been the most likely to be able to implicate others. He is computer specialist, Paul Combetta.
The Clinton campaign is now putting all blame of Combetta, who of course is now beyond the reach of prosecutors and pressure. Brian Fallon, a spokesman for Mrs. Clinton’s presidential campaign, said that Combetta, who worked for a Colorado company called Platte River Networks, acted alone and “neither Hillary Clinton nor her attorneys had knowledge of the Platte River Network employee’s actions. It appears he acted on his own and against guidance given by both Clinton’s and Platte River’s attorneys to retain all data in compliance with a congressional preservation request.”
Many are likely to view this defense with suspicion as a constructed scapegoat. Having given immunity to both of the most likely targets for indictment, both specialists are the perfect fire walls for anyone who had knowledge or failed to move to preserve the material. In fairness to the Clinton camp, the account of the FBI could support a claim that the specialist realized on his own that the final record had not been scrubbed and took this action unilaterally in what is described as an “Oh Shit” moment. Indeed, that conversation with unnamed Clinton aides could be exonerating rather than incriminating if they stressed that all records should be preserved. Most investigators however would be curious why a contractor, if expressly told by a client to preserve any emails, would unilaterally destroy them.
What is particularly interesting is that Combetta reportedly changed his testimony on critical elements but ultimately acknowledged knowing about the subpoena. Combetta reportedly told the bureau in February that he did not recall deleting the emails, but then changed that account in May. He added to speaking with unidentified Clinton aides in March 2015 and then decided on his own to use BleachBit to delete the messages. While he denied knowing about the preservation order in February, he reversed that critical fact in May and said that “he was aware of the existence of the preservation request and the fact that it meant he should not disturb Clinton’s email data” on the Platte River server.
Some might argue that the Justice Department would most likely move to charge him and then offer a plea bargain if he could implicated others and remember names like those on the telephone call. Instead he was given immunity.
The House appears to be moving to seek his testimony and he may not be out of the legal woods. Witnesses are generally given “use and derivative use” immunity rather than the broader form of transactional immunity. If so, Combetta would be protected from the use of his statements or any evidence derived from those statements against him. If testifying in Congress, he would face the risk of perjury as well as other collateral crimes. It would create a messy situation with a previously immunized witness. Generally, the prior grant of immunity does not roll over to separate investigations by another branch, though he would remain protected from the use of his statements in the prior proceedings. Thus, he could carefully repeat those answers and try to stay within the scope of his prior statements. If he does not want to risk the uncertainty, he could invoke his privilege against self-incrimination and refuse to testify absent a granting of immunity from Congress.

Last night I attended an event at the local college featuring Killer Mike – a black rap artist from Atlanta who did several videos with Bernie Sanders. Over the past year I have seen a lot of ugly Hillary photos on this blog. Someone mentioned this above. To be fair and balanced the blog should show some ugly Trump photos. Ugly photos turn voters off from voting for a candidate. These days that fruit FDR would not make it with those photos of him smoking his cigarette with a cig holder and a snide face.

This was an example of destruction of subpeonaed material during the 1972-1974 Watergate saga.
I think it was the only known example of subpoenaed material “disappearing” during the Watergate investigation.
There may have been a few
blindly partisan hacks who’d claim that “there’s nothing to see here, folks”.
But there was an overwhelming belief that those erased 18 1/2 minutes of deleted tape contained incriminating evidence, and that was a logical conclusion.
(The deleted material was part of a recorded conversation between Nixon and Haldeman, a few days after the Watergate breakin).
It was never determined for sure who erased those 18 1/2 minutes, but I don’t think it likely that the FBI would have granted immunity to anybody known to have destroyed part of those subpoenaed tapes.
Under the standards that existed 40+ years ago, the American public was not likely to let the the issue of the missing 18 1/2 minutes “slide”.
Had the FBI positively identified the responsible party, a grant of immunity would have been like pouring gasoline on the fire.
We are in a different environment today. It’s an environment where you have a large group of partisan apologists who are dismissive of these “minor matters”, like destruction of subpeonaed material.
I’m not convinced that bringing up the issue of pedophile priests or unflattering photos of Hillary have much to do with the central issues addressed in this column.

The Association of American Physicians and Surgeons just surveyed their very own members and a LARGE majority of them believe that Hillary Clinton has or may have serious health issues that might could should prevent her from being President. Honest!

You need to run with this. Probably very few of your conservative readers will take the time to look up and find out that this association, not to be confused with the AMA, or the AAP or the AAPS or any group of REAL doctors and that they believe that vaccines cause autism and that HIV does not cause AIDS and that there is in fact a link between abortion and breast cancer (there isn’t) and so on. They are an ultra-conservative group founded i 1943 to fight socialized medicine. But never mind that.

The speculation is whether her condition is concerning and requires any disclosure. Speculation by a medical doctor has always been preceded by the disclaimer that they do not treat her, and can only guess at what’s wrong without a full examination.
She seems to have a debilitating coughing attack every time she speaks now. It may be a minor annoyance, or it may be cancer. Since it interferes with her ability to speak regularly, and she seems to have trouble catching her breath, it warrants an investigation.
Since she has not released a believable reason for it, we are left with speculation.
If you fail to give the facts, do not blame the people for speculating what’s wrong.
Plus, since she has a decades history of lying, over 70% of Americans wouldn’t take her at her word on any issue.
I do not agree with her politics, and am disgusted by her lies and corruption. That said, I would not wish a serious disease on anyone, except for people like Jeffrey Dahmer. I also believe that a medical condition does not preclude someone from being President, as it’s pretty rare for someone not to have some medical issues by the time they reach 65. The question is whether it will impact her ability to do her job, and her longevity during the term of office.
It is also just an item on a long list of concerns, such as the fact that the vast majority of people polled believe she’s a liar. Then there are the emails proving she sold access to State to donors. Then there was the washing money through a foundation that paid herself and her cronies and sold access to government to foreign nations and dictators. So, it’s just a line item among many.
But, again, how incredibly…odd…that there is this rush to protect her from all inquiries, including about a debilitating chronic cough. It’s like people just don’t want to know anything negative about her so it will be easier for them to close their eyes, hold their noses, and pull the lever in November.

Oh My God. For the millionth time, I agree. I supported Bernie Sanders. Hillary Clinton is too much in bed with the banks and the military industrial complex. She has exercised bad judgement time after time.

This is literally the FIRST presidential election where we have had the information, thanks to whistleblowers and otherwise singlehandedly, Wikilieaks, that we need to conclusively identify the two major parties as corrupt, morally bankrupt, and fighting endless wars of destabilization to prop up the central banks and pursue a new world order controlled by them. If the 2008 financial collapse and why it happened hadn’t sunk in by November of that year, it should have by now.

If she is rotten to the core, then you will work overtime to characterize Trump as far, far worse so that you can justify to yourself why you are voting for her. How could they prove perjury in a House investigation? They have thrown away all leverage.
Past predicts future. She has squirmed out of what should have been career ending scandals before by pinning it on others. In this case, it seems clear at the DOJ is working to protect her.
This is how dictators rise. People are quite eager to overlook everything they would have screamed bloody murder about if it was the Koch Brothers – the pay to play, emails showing the sale of access to the State department to political donors, avoiding subpoenas and FOIAs through the use of private servers, using BleachBit after getting subpoenaed, the lying, using the FBI to target employees she wanted to replace with her own people, using the FBI to illegally obtain background info on her political rivals, FileGate, refusing 600 written requests for additional security in Benghazi and then claiming she’d never received a single one of them, lying about a bloody video to the families of the deceased and then claiming they lied, telling the FBI “I do not recall” dozens of times, including claiming no memory of her training in handling classified information and blaming memory loss on a concussion… It’s fatiguing, all the evidence of corruption. But her people will not be swayed. Nor will they admit breathtaking hypocrisy.
Is she seriously the best candidate the Democrats can produce? This…entrenched establishment candidate who is so terrified of answering questions to the press she’s gone over 2/3 of a year without a single press conference? I have a lot of problems with Trump, but I have to give the man credit. He sits his butt in the hot seat of interview after interview, clearly not a polished, smooth talking, career politician. He sticks his foot so far in his mouth you need a medical device to extract it. But he shows up.
And has she damaged her vocal chords from speaking improperly at all the rallies? A chronic cough usually indicates asthma, other respiratory disease like COPD, or other serious conditions. Nodes on the vocal chord would hoarsen the voice, but would it irritate the throat? A cough that lasts more than a year, rendering her consistently speechless and gasping, is a problem. And yet she’s just as secretive about that as anything else. If she has asthma, is it not well controlled? Does she need surgery on some issue with her throat? Is she suffering a side effect from one of her medications which is irritating her throat? I feel awkward mentioning this, but I have wondered if Bill gave her any STDs. He’s been quite promiscuous over the years, which is irresponsible behavior, and cruel if that person has a spouse he still sleeps with. Could she have HPV or some other STD in her throat? It must be embarrassing for her that people speculate. But the fact remains that when someone stays with a serial cheater, one may wonder what he’s brought home. That’s just the medical reality when someone in the public eye stays married to a prolific cheater. This wasn’t an affair or two that their marriage survived. He seems to be literally incapable of restraining himself. Kind of like Anthony Weiner.
I think a medical disability does not automatically preclude someone from becoming an effective President. We have had Presidents before who overcame difficulty. But the American people deserve to know what obstacles she faces (asides from honesty.)
Your boy Trump is another Bill Clinton or worse. Did you see the pictures of the two of them posing with the models? i don’t blame Trump’s wives for his behavior nor do I blame Bill Clinton’s family.
