Did Comey Violate Laws In Leaking The Trump Memo?

440px-Comey-FBI-PortraitOne of the most interesting new disclosures today in the Comey hearing was the admission by former FBI Director James Comey that he intentionally used a “friend” on the Columbia law faculty to leak his memos to the media.  Comey says that he did so to force the appointment of a Special Counsel. However, those memos could be viewed as a government record and potential evidence in a criminal investigation.

richmanNotably, Columbia Law School Professor Daniel Richman on a faculty webpage reads that he is “currently an adviser to FBI Director James B. Comey.” Richman specializes in criminal law and criminal procedure.

The problem is that Comey’s description of his use of an FBI computer to create memoranda to file suggests that these are arguably government documents.  Comey admitted that he thought he raised the issue with his staff and recognized that they might be needed by the Department or Congress.  They read like a type of field 302 form, which are core investigatory documents.

The admission of leaking the memos is problematic given the overall controversy involving leakers undermining the Administration. Indeed, it creates a curious scene of a former director leaking material against the President after the President repeatedly asked him to crack down on leakers.

Besides being subject to Nondisclosure Agreements, Comey falls under federal laws governing the disclosure of classified and nonclassified information.  Assuming that the memos were not classified (though it seems odd that it would not be classified even on the confidential level), there is 18 U.S.C. § 641 which makes it a crime to steal, sell, or convey “any record, voucher, money, or thing of value of the United States or of any department or agency thereof.”

There are also ethical and departmental rules against the use of material to damage a former represented person or individual or firm related to prior representation. The FBI website states:

Dissemination of FBI information is made strictly in accordance with provisions of the Privacy Act; Title 5, United States Code, Section 552a; FBI policy and procedures regarding discretionary release of information in accordance with the Privacy Act; and other applicable federal orders and directives.”

Lawyers generally ask for clients or employers to release information, particularly when it may be detrimental to the firm or the client or someone associated with your prior representation.

By the way, waking up in the middle of the night (as described by Comey) is not generally the best time to decide to leak damaging memos against a sitting president. There are times when coffee and a full night’s sleep (and even conferral with counsel) is recommended.  Leaking damaging memos is one of those times.  Moreover, if Comey was sure of his right to release the memo, why use a law professor to avoid fingerprints?

I find Comey’s admission to be deeply troubling from a professional and ethical standpoint.  Would Director Comey have approved such a rule for FBI agents?  Thus, an agent can prepare a memo during office hours on an FBI computer about a meeting related to his service . . . but leak that memo to the media.  The Justice Department has long defined what constitutes government documents broadly.  It is not clear if Comey had the documents reviewed for classification at the confidential level or confirmed that they would be treated as entirely private property.  What is clear is that he did not clear the release of the memos with anyone in the government.

Comey’s statement of a good motivation does not negate the concerns over his chosen means of a leak.  Moreover, the timing of the leak most clearly benefited Comey not the cause of a Special Counsel.  It was clear at that time that a Special Counsel was likely.  More importantly, Comey clearly understood that these memos would be sought.  That leads inevitably to the question of both motivation as well as means.

  1. None of this is resolvable. Those who hate Trump are just psychotic enough so that they would convict him of anything or nothing. Those who love Trump are not going to convict him no matter what he does. And there seems to be no middle ground. The ones who hate him are just making up stuff up so the ones who love him are hardening their stance. Which makes the ones who hate Trump even more hysterical and psychotlc. In other words if the left keeps upping the ante on their psychosis this is going to lead to something really bad. The left needs to take a breath and realize that there is a future after Obama and Hillary even though Trump was elected. They really do not want to start something they might not be able to stop.

My suggestion to Trump is that the tweets is his trademark and should never change his approach. We know exactly what he wants and how he thinks by sending us unfiltered tweets. Unlike the LSM who puts out nothing but “fake” news, Trump puts out the truth, and I support everything he does. He shall become the greatest POTUS ever.

      I think a lot of these questions/ accusations hanging in the air are resolvable.
      At some point, the investigations by Mueller and Congress will probably reach some conclusions.
      But I think we’re a year or two away from any investigation(s) wrapping up.
      In the meantime, there will be millions, maybe billions of words commenting on and speculating about every aspect of the investigations and every twist and turn of events.

      1. Rumor is that Mueller will be complete with his investigation in three months. That indicates that they already believe that Trump is innocent of the Democrat claims of Trump-Russia collusion. Only if they come up with findings that rise to the level of “high crimes and misdemeanors” will the investigation go up to a year or two. That’s my take on it.

            Mueller is only realistically reviewing evidence currently in possesion or which may become available during his audit of existing intelligence.

            Until someone is charged he really will not have much power to compel anyone to testify with his investigation who has not already been interviewed.

            Now, if new streams of investigation up, perhaps, but so far there is not much meat on the bone.

My thought is that Mueller, having already heard Comey’s story, would never have allowed him to be questioned, under oath, in a public and uncontrolled(by Mueller) venue if he believed their was ANY possibility of an obstruction of justice charge based on Comey’s dealings with Trump. I don’t know if Mueller’s investigation will end so quickly, but my sense is that if Trump can just remain quiet and not do anything to rock the boat, he is in the clear legally. Of course, knowing Trump, that may not be possible!

The one most common question I got from Europeans was whether we could really take our president seriously. The one things most Europeans I know kept on asking is how someone who just can’t stop speaking in contradictions keeps doing so, often straight-out lying, or simply falling into strange confusions.

          Here, at any rate, it isn’t just hatred of one man.         Paul Sperry, writing for the New York Post, says OFA will fight President Donald Trump at every turn of his presidency and the ex-president “will command them from a bunker less than two miles from the White House.” Sperry writes that the ex-president is setting up a shadow government to sabotage the incoming administration through a network of non-profits led by OFA, which is growing its war chest (more than $40 million) and has some 250 offices nationwide. OFA IRS filings, according to Sperry, indicate OFA has 32,525 volunteers nationwide. The ex-president and his wife will oversee the operation from their home/ office near the White House.

        Think about how this work – for example: Trump issues an immigration executive order; OFA signals for protests and statements from pro-immigrant groups; ACLU lawyers file lawsuits in jurisdictions where activist judges obstruct the laws; volunteers are called to protest at airports and Congressional town hall meetings; the leftist media springs to action; the twitter sphere lights up with social media; violence follows – all emanating from the ex-president’s signal that he is heartened by the protests.

        If Barack Obama did not do enough to destroy this country in the 8 years he was in office, it appears his future plans are to destroy the foundation on which this country has operated on for the last 241 years.

        1. Obama is and always has been bad news for the country. Community organizers do not make good presidents and he’s no leader and no patriot, that’s for sure. As an ex-president, he is flitting around meeting with Angela Merkel in Germany, Prince Harry in England, PM Justin Trudeau in Canada, Silicon Valley execs, billionaires like Oprah and Sir Richard Branson, and who knows who else. He’s keeping up his useful idiots connections with all his celebrity mouth pieces while he builds his army of agitators. Obama is a menace to the country, to democracy and to the rule of law.

    7. If Comey was in Cal. When fired, then a question arises: Were his notes taken on paper he had in his possession? If not, then why did anyone other than the Justice Department have access to them?

      Regarding the notes, the talking heads had spoken of his inclination to take notes, hence they might be considered evidence. Comey had denied taking notes with previous administrations even though he had admitted to having a troubled conversation with Lynch, so unless these notes were made on a government computer, they are very suspicious.

      Did anyone else notice McCain’s almost senile questioning at the hearing? This hearing was too important to have wasted 5 minutes.

      Lastly, I urge those who are pro Trump to call their DC representatives and insist they back this president.

  2. To be honest, the Democrats want the current administration to be mired in all of these ancillary issues. It will keep the administration from honoring its promises.

    Just like Ford had to pardon Nixon to stop the circus Trump needs to just pardon Flynn.

    Flynn has spent his life in service to this country.

    1. For President Trump to pardon Flynn, he must first be charged with a crime, arrested, tried, and found guilty. Then, Trump can pardon him. Why would a person only accused of a crime need to be pardoned? He is not in jail and walks the street freely as you and I do.

      1. Ford pardoned tricky before any action was taken. He hadn’t waited to be impeached and (honorably, sort of) resigned his position as president.

        I think the poster was wrong thinking that it was in the interest of the republic to pardon tricky before a trial. That was another missed opportunity to bring the global elite’s presence and influence into the public eye,

        It would have caused another fuss for sure, but it would have gone a very long way to educate a (willfully) ignorant populace on the depth of influence people who control the CFR have over our elected officials.

          There was talk of Obama pardoning Hillary. However, he didn’t pardon her because everyone thought she was going to be the POTUS, and there’s bad blood between the Clintons and Obamas. Now that Hillary lost and Obama didn’t pardon her, she is at very high risk at being brought to justice under AG Sessions. Of course, that would drag Obama, Holder, Lynch, and all of their cronies into the fray when one of them break and spill the beans for immunity. It will become a feeding frenzy when we start identifying all of the Deep State folks who are attempting to destroy the Trump administration. Should be very interesting to see everything unfold.

  3. It looks like James Comey created, but certainly used his memos not to cover himself, but to get Donald Trump impeached on grounds of obstruction without ever having to say so. That is manipulative and not just being a straight arrow.

    I’m a Bernie fan and am opposed to pretty much everything Donald Trump stands for, but he is our elected president. He should be removed only with another election, or impeachment over something very serious. Anything else would be detrimental to our democracy. All the leaks this year did not happen to help the country but to embarrass the President, insofar he had not embarrassed himself already. If the Deep State really exists, the last 12 months would be a good example of how it manifests itself.

  5. well I think we can all agree that Comey will never be prosecuted for any of the alleged crimes being discussed. We disagree as to why. Option 1: he’ll never be prosecuted because we have a functioning justice system and you can’t prosecute someone like him if he hasn’t actually violated the law. Option 2: he’ll never be prosecuted because we don’t have a functioning justice system and you can’t prosecute someone like him even if he did break the law. If it’s more the latter than the former, then it’s sad that Trump can’t do anything about it. Even from the White House he is as helpless as the rest of us. If it’s more the former than the latter, then it’s awesome that Trump can’t do anything about it. Either way, the point is clear: Trump may be president, but he’s weak. He’s not draining the swamp, he’s being consumed by it

I can see why President Trump wanted to fire him and ultimately did after giving him a chance to prove himself worthy and loyal to the people and country.   8. It’s truly fascinating how many new contributors have weighed in on this discussion. I’m intrigued by what I presume are attorneys at odds with the legal perils Comey may or may not be facing. This really does confirm how the law has been turned into a weapon. I can see now that the attorney class are the ideological warriors of the administrative state. To be fair, I see there are legitimate rule of law comments and that’s really what is important. For those of you working the USC to defend an ideology and not the constitution…I pray you are leaving a trail to be unemployable in public service.
