Turley To Speak At Penn Law On Presidential Power

I will have the pleasure of speaking today at the University of Pennsylvania Law School on the evolution of presidential power in the United States. I will participate in a distinguished panel entitled “Presidential Power and the Current Crisis of Executive Authority” at 4:00 to 6:00 pm at Fitts Auditorium (3501 Sansom Street, Philadelphia). The event will be open to the public.

The topic is described as follows:

“Since 9/11, the growth of the national security state has brought with it an increasing struggle to maintain the legal and ethical boundaries surrounding executive authority, boundaries that help to define and protect democratic governance. In today’s political landscape, debates about the scope of presidential power have intensified, and they are likely to accelerate even more this year, as a divided Congress does battle over fundamental aspects of civilian leadership and the president continues to press an unprecedented vision of the powers of his office. Questions such as whether a sitting president may be indicted, whether the president’s pardon power under the U.S. Constitution allows the president to pardon himself, whether the president may use emergency powers to fund and build a border wall, will be contentiously debated and may even find their way to the U.S. Supreme Court this year.”

The panel will be moderated by Professor Claire Finkelstein, Algernon Biddle Professor of Law and Professor of Philosophy and Director of the Center for Ethics and the Rule of Law. The panelists will be:

    The singular American failure has been the Supreme Court.

    The entire communistic American welfare state** is irrefutably unconstitutional and has not been struck down by the Supreme Court of the judicial branch. Obamacare is eminently unconstitutional and the Supreme Court upheld it. The definitions of the words “state” and “federal” were commingled by Roberts in support of the Obamacare “exchanges.” Obama, for the benefit of the “deep state,” is conducting a coup d’etat in America against a duly elected president completely bereft of adjudication. Hillary Clinton and Obama (using a pseudonymous account) were complicit in a crime of illegal server and e-mail exchanges and mishandling classified material. The entire 7th floor of the FBI was lopped off and no criminal adjudication has occurred. And how did President Lincoln violate the Constitution repeatedly, including suspending Habeas Corpus, without immediately being sent to prison?

Can republican Presidents just name people to positions and not have Senate confirmation and just let them have power as “Acting”? Can only republican Presidents make money with government assets and disregard the Emolument Clause? Can only republican Presidents children have family businesses that get waivers on trade deals? And still be “special advisers” to the President? Can only republican Presidents be batshit crazy?

      Does someone have to sit you down and read you chapter and verse from the federal statute under which auspices Mr. Whitaker was appointed? Do you need a recitation of the name of every interim cabinet appointment made over the last 50 years?

  8. A Commander In Chief has some powers to protect the nation from acts of war, terror, and invasion. A border is part of his duty. It is a breach of duty to allow a breach in the border which lets terrorists in.
