Joe Biden: Nostradamus or Nut?

Nostradamus_by_Cesar23495344445_cb01041aeaThat seems to be the choice if you read accounts after President Donald Trump’s reckless tweet referring to a delay of the election.  While Trump last night stated that he is not seeking a delay in the election in his tweet, the tweet set off a firestorm. I was one of those who within minutes denounced the tweet as fueling a baseless conspiracy theory that Trump could delay the election. However, some writers claimed that Biden was right all along when he “predicted” that Trump would move to delay the election and noted that I made fun of him for warning voters of a move against the election.  I certainly did make fun of him, but it is worth noting that the column was not about whether Trump might suggest a delay but how such a delay could not happen. It is no “conspiracy theory” that Trump might suggest something outrageous on Twitter.  That is an established fact that occupies this blog on a daily basis. The theory was whether the election could be delayed by Trump unilaterally and it was alarming voters for no reason. I explained that the theory that the election would be canceled or stopped was “all the rage on the Internet” for months before Biden unwisely repeated it.

The April column, which I admit was caustic, expressed my frustration with the coverage over whether Trump was going to delay the election despite the lack of a factual or constitutional foundation.  I was equally caustic with Trump‘s reference to a delay. Notably, at the time of Biden’s sensational statement, other experts agreed that this was not a real possibility.  Yet, it served to send the media into a frenzy over a theory despite being as likely as Trump staying in office by adopting a Venusian calendar.

I later criticized Jared Kushner is equally harsh terms for suggesting that such a delay was a possibility.  Again, the criticism was focused on the constitutional impediments to such a delay and how it is not in the realm of possibilities with today’s Congress.

Critics have omitted that the April column was actually about an array of conspiracy theories on the Internet that have been given credence by the media.  It also clearly stated that I was not arguing that Trump would never adopt such conspiracy theories. To the contrary, I said that if he tried to do what Biden was suggesting and “tried to stay in office past noon on January 20 if he loses, he would have to join Biden on the subway and whisper to people that he is still the president.” The column was not on what Trump might claim but the realities of the law governing the election.

What is also striking is that the effort to claim that Biden is a seer  or Trump whisperer ignores what he actually said.  Biden was suggesting that Trump might unilaterally stop the election and was warning voters” “Mark my words, I think he is going to try to kick back the election somehow, and come up with some rationale why it cannot be held.”  He also however added the additional claim that the election might be stolen by the Postal Service: “Imagine threatening not to fund the post office. Other than trying to let the word out that he is going to do all he can to make it very hard for people to vote, that is the only way he thinks he can possibly win.” No one is mentioning that part.

As I explained:

“Let us address the mail connection. For years, Trump has been a critic of the Postal Service as being an institution that repeatedly required bailouts due to running huge deficits. He wants the Postal Service to agree to raise fees for mass shippers like Amazon before it can ask for another federal subsidy. That would have no impact on voting, including mail voting, in the election. Any change in its operations would not impact such things as regular mail this year.”

As an aside, this does not mean that we should not be focusing on the Postal Service. Trump is right that there will likely be an increase in challenges and problems as we move toward such a massive increase in mail in voting. I have covered presidential elections for the media for many years and every one has involved legal challenges on some level, including the traumatic and lingering challenges in 2000. The shift to mail in voting adds a new layer of possible problems and challenges and we need to be prepared for them. Trump is also right that counting all of the votes could be a problem and we need to clearly establish how the Postal Service will be handling these ballots. This includes a review of current changes in this Administration that could delay receipt of ballots. However, any sinister role of the Postal Service would immediately be subject to challenge. Moreover, even a delay of days will not prevent the counting of ballots so long as they are properly postmarked. Additionally, Trump predication of massive voter fraud is not supported by past uses of alternative mailing systems.

The main problem addressed in the April column was Biden repeating the Internet theory that the election might not be held.  Such sensational statements focuses people on a nonexistent threat and undermines the faith in our election process.  It is also simply wrong. There is no such possibility.

Trump’s tweet was worthy of condemnation and I was one of the first in line. He ended a tirade with “It will be a great embarrassment to the USA. Delay the Election until people can properly, securely and safely vote???”  While he said later that he was only pointing out the likely delays and challenges to come from massive mail in voting, it was another reckless tweet that sent the country into a frenzy.  I wrote yet another blog column, again, pointing out that this is a baseless conspiracy theory and that our election will be held on November 3rd. Period.

So, to sum up. Biden did not just claim that Trump would raise a delay. As shown by the coverage in response to his statement, he was warning that Trump might unilaterally stop the election or steal it with the help of the Postal Service. Even before he denied wanting to move the election date hours later, Trump did not say that he was even contemplating a unilateral decision to halt the election. As my Biden column stated, Trump does not have that authority.  That is the conspiracy theory.

Thus, if Biden was merely predicting that Trump would say an outrageous thing, he is a Nostradamus but so is everyone else in the country. If he was really predicting that the election would be halted by Trump, he is a nut.  In my view, he is really neither. He is a politician who was fueling a conspiracy theory that was already all the rage on the Web.

    1. According to Trump himself, adversary nations will use mail in voting to screw with the election. If he wins, will Trump change his tune and deny that happened and call it a Dem conspiracy? We already know any nation wanting to see the US weakened will try to help Trump.

  2. JT, don’t fall so hard into the ego games about what your past columns may, or may not have said. It’s not conspiracy theory that Biden predicted Trump will try to challenge the election in any way he can. Trump’s own past confidants predicted the same months before…, as it stands, just that I personally know of, his biographer and Scaramucci are long on record saying the same.

    Not that I don’t recognize you’re in a tough spot as a Trump placater/influencer/surrogate.

    But I think we all know Trump will try everything he can possibly pull off to interfere with the election. He’s actively leaned on the Ukrainians and Chinese to step in on his behalf. And clearly the Russians have been grooming him for years so they could step in on his behalf.

    And Trump just sues people, it’s been his M.O. forever.

    You are correct in pointing out the legal and constitutional restrictions to him trying to interfere because they’re clearly the reality…, but only if the Senate is willing to hold him accountable, something they’ve shown zero motivation to do, let alone actually do it. We’re in a tough spot. Trump yesterday at his presser actively threatened/alluded to ‘keeping things tied up for years’. To think he’s joking is sheer lunacy.

    Turley, I could’ve told you years ago it just gets worse with Trump, always. My guess is that by stepping on the surrogacy train there were dreams of candy cane SCOTUS dancing in your head. But it’s well past time to step off the train. Focus on damage control from backing and defending a guy who has shown complete lack of moral and philosophical boundaries. It’ll be a tough sell because you’re marked forever by the amount of support you’ve thrown Trump’s way. Take a vacation. Turn down the ALEC money you may get for writing this blog. It really is in that make or break zone for you right now. Time to focus on the higher part of your nature.

      I don’t agree that this should be done at all. I do agree w/Trump that the post office needs to charge more for the last-mile delivery it does for UPS and FedEx. But post office still needs to be there, especially in smaller and rural communities and if there’s more voting being done by mail.

      1. DV, the post office wouldn’t have gotten to where it is now if it wasn’t for congress meddling in its financial affairs. The post office has always been a self supported entity within government. It was after congress mandated the post office set aside billions for future pension funds that suddenly robbed them of their self sustaining operation. The mandate to set aside funding for future pension payments was not necessary. If congress didn’t do that the post office would have been very competitive against higher priced companies such as fed ex and ups. All congress needs to do is repeal that stupid mandate.

      The postmaster-general is appointed by a multi-member board. It’s supposed to be a self-supporting corporation, so it doesn’t have the luxury of maintaining hours that aren’t bringing in business.

    Jared Kushner doesn’t make policy and isn’t always as sharp as he should be. If one wants to make news they trap an unsuspecting WH official into saying something that they want to hear. That doesn’t mean it is official WH policy. That provides a story but that story is not news.

    Trump knew that and knew that the law was so clear that he could use this as the bait for the press.

    Trump was intent on highlighting all the bad things that come from mail in voting. He didn’t want a delay. He wanted to stop the idea of mail in voting providing the alternative of absentee ballots. He also might have timed this Tweet as a diversion to some numbers that weren’t good. He knows that the election will occur in November and that he had no power to change it.

    This is a problem with our electronic reporting of events where the events are in real time. People don’t stop to think or wait to understand what is really happening.

    Trump doesn’t get positive press nor can he inform the public of his viewpoints. He has continuously used Twitter to bait the press into discussing those things they refused to discuss earlier. I am sorry professor but one should know better because Trump has been doing this over and over again. He also uses Twitter to divert the press. While the press was hammering at him about a bunch of tweets early in his Presidency Trump was busy deregulating the nation. The press was too busy to notice.

After all, Trump is on record saying, “I just make stuff up.” If so, then how does one recognize what’s serious? Quite a conundrum involving the most powerful and potentially dangerous nation on earth and its main oligarch.

    However, Trump has time and time again maintained that he is not joking, that he is serious, and is the only one who can fix this mess; the mess he created. It goes without saying that if Trump gets in for another four years he will not spend his time cleaning up the mess he created but worsening it. Biden in a coma is preferable. Just about anyone of the Democrat contenders is a far better choice. An ounce of sanity and stability is preferable to this disgrace.

        So, yes Pelosi made a gaff, Biden made a gaff or two, etc. But, Trump; he’s nothing more than a blithering idiot. Listen sometime. Listen carefully.

You’ll notice that Jerry Brown is the only one on the list who has been elected to public office in the years since 1990. Brown was a working politicians until quite recently and Hart had a diplomatic post for a time. The rest of them have been out of office for 20 years or more. They are between 75 and 96 years of age.

                1. I accept reasonable alternative rationals for comments made by both Biden and Trump. The problem is that you cannot back up your negative statements about Trump but there are plenty of statements and things Biden did that you cannot explain.

                  If you wish to provide the lies (not errors, not preumptions, not taken out of context, not further explained etc.) I am glad to listen to the significant ones involving his Presidential duties. Start with the most significant and work your way down.

                Trump’s children are not being enriched through bribery like hunter in the millions of dollars. There is a rational pay for the work done by any receiving a check originating from the taxpayers. My bet is the Trump family wealth has declined by at least $1Billion because Trump is President and the family has been deprived of earning money in many different ways. This is because they are trying to keep their business separate from the Presidency.

                Biden’s actions have promoted use of his VP status for bribes and other things.

If he believes this was a “conspiracy theory” when Biden literally made a prediction that turned out to be true. He proceeds to split hairs on the issue. That’s pretty typical of people who are in willful denial of the very facts before their eyes.

    Trump is floating the idea of delaying the election. Just the mention of delaying it is exactly what Biden predicted. Once trump confirmed it with his tweet it is no longer a theory.
