The press conference held by the Trump legal team was not for the faint of heart. The team alleged a global, Communist-backed conspiracy to “inject” and “change” votes through the use of the Dominion computer system. It was exhausting and breathtaking. I was critical of the press conference as being long on heated rhetoric and short on hard evidence. Dominion issued a statement categorically denying the allegations. The question is whether Dominion itself will now sue. The company denied the allegations but I often measure such denials by whether anyone actually sues. Dominion could do so and force the Trump team to reveal the evidence supporting their allegations or face potentially significant liability. These are not just colorful but criminal allegations against named companies and by implication corporate officials and political allies.
Trump campaign counsel repeatedly accused Dominion and its officers of criminal conduct and business improprieties. Those are categories of “per se defamation” under the common law. No special damages must be shown in such per se cases. Individual officers could bring defamation claims and the company itself could bring a business disparagement action.

(a) if the corporation is one for profit, and the matter tends to prejudice it in the conduct of its business or to deter others from dealing with it, or

Dominion appears to be a company with a Colorado headquarters.
There could be lawsuits in Colorado or the place of the alleged defamation. The lawsuit would likely be filed under state law but moved to federal court under diversity jurisdiction arguments.
The press conference was an explosion of potentially defamatory claims by individuals or companies. The only clear defense is truth. The team insists that it can prove these allegations. It may have to do so. Not only can the individual lawyers face such lawsuits but the Trump campaign itself could be liable under the principle of respondeat superior, where an employer is liable for the conduct of his employees when they are acting within the scope of their employment. Ironically, the Latin term means “let the master speak.” The President or his campaign could be forced to speak in a defamation case if they have not spoken in the promised court filings.
There is a question of privilege for legal claims. There is an absolute privilege for lawyers in making statements in court. That is important because we often voice allegations that impute the veracity or character of parties, particularly in criminal cases. However, that privilege is more limited outside of court. It can still apply but some courts have refused to protect statements made to the press or the public. World Wresting Fed Entertainment, Inc v Bozell, 142 F Supp 2d 514, 534 (SDNY 2001); Kennedy v Cannon, 229 Md 92, 97, 182 A2d 54, 58 (1962).
In other words, if the Trump team does not put forward this evidence in its case challenging the election, it could now be forced to produce it in a case brought by Dominion or its officers.
Georgia Federal Court just denied the motion by Lin Wood to block certification of GA election results.
Trump and his allies are now 1-32 (wins-losses) in post-election litigation.
For the past 2 weeks, Turley relentlessly admonished Biden, Democrats & the media for declaring any challenges to the election to be “conspiracy theories.” Today, Michael Flynn’s attorney Sidney Powell, who has now joined Trump’s legal team, proclaimed “We have no idea how many Democratic officials paid to have the election rigged in their favor. This is a massive, well-coordinated effort.”
Anyone watching today’s Team Trump press conference might well wonder whether Turley had dispensed with any sense of neutrality as he repeatedly held Biden, Democrats & the media solely responsible for undermining the confidence of voters. Suddenly Turley is forced to concede Trump’s legal team hasn’t presented any credible evidence to back up an endless series of “potentially defamatory claims.” Sidney Powell definitely took center stage by boldly proclaiming that Trump’s landslide victory can be proven beyond a reasonable doubt in a court of law.
And 52% of Republicans believe Powell & Giuliani are right that Trump won & Democrats rigged the election. Yep, the only clear defense is the truth.

Later when reading the prof’s post above and some of the comments I thought “why own a voting machine business if you are not including options in the software for very rich people to steal elections?”. Surely there is a market for such software as there is for encryption software with Trojan trapdoors built in, like that of the European encryption business owned jointly by the CIA and Germany’s equivalent. Of course there exists a potential market and surely at least one voting machine company is working on exploiting it.

He said the continued use of these implements would vitiate confidence in the balloting. And here we have it. I’ve read several of the numerous complaints filed by the Trump campaign. It was a slog. They are truly embarrassing examples of poor pleading. The press conference today I regard as more of the same. The legal team will produce no evidence because they have none. They will, however, generate millions of dollars in legal fees, which will be paid (if they are paid at all) from contributions by those whose imaginations are of insufficient breadth to conceive of the possibility that a significant majority of voters prefer a change in direction. Whether Dominion files a lawsuit will likely depend upon whether its board of directors determines that it makes sense to leap into a legal pig sty. I doubt that it is greatly concerned over its corporate reputation given the sources of the claims.

Affidavits are used on motions for summary judgment. They are more than sufficient to alert a hostile media that the team has evidence in hand to proceed. It’s a tough deal in a limited time frame to handle so many different types of problems in various states where the laws are not the same, and most of the people involved want to stop any investigation or any legal action. The lawyers don’t even know the landscape since they come from other areas of the country.

Mathematically, things do not look correct, and the ability to obtain the needed evidence in such a short time frame is extremely difficult. If the evidence cannot be produced, that doesn’t change the mathematics which frequently in fraud cases rings ture even if the case cannot be proven.
I understand you are an attorney but not sure what type you are. If you ever handled a complex fraud case involving numerous jurisdictions I’d like to know how long it took you to gather all the evidence, plan the legal action and then take the legal action to court. Wall Street Journal doesn’t spin but they wait until the timing is right to put something out there. Just like there is a time that is right for the attorneys to release information there is a time for a journalist to strike. He’s a real journalist mind you not the people that you’ve gotten used to seeing
It follows from your logic “In 2016, the smart people told us that the notion of the Dems using the secret FISA courts to spy on the Trump campaign was absurd. And that Administration would never engage in a malicious prosecution of the National Security Advisor Michael Flynn. We guess what, they did.”
That the right is correct in their assertion that Sydney Powell presented, but the left has to put up some version of thss, so they say that all her assertions, followed by reasonable law, and false. That is where the discovery process. comes in. I’m not an attorney, but in the discovery process you don’t share you evidence with a media, especially a media who is so intent upon proving that you haven’t a case. Well, I don’t support that attorneys the caliber of Sydney Powell and Jay Sekulow aren’t known for being on the wrong side of the facts. Especially this kind of a case which smacks of media derangement.
@Annie- There’s a huge chasm between the WSJ ‘news’ side and the editorial opinion side. The news people have the same political outlook as the NYT. They went to the same prestigious journo schools, hang in the same crowds, same career aspirations, political outlook.
If they were really independent investigative reporters in the old Woodward/Bernstein sense, they’d be digging into the trails exposed by the Trump team to see where they lead. That’s what investigative reporters do. But they don’t. Like many of the commenters here, they lay back and say that Trump didn’t show us anything, or they try to disprove it.
Remember what happened with Biden influence peddling scandal? The WSJ news people’s investigation was to say that Joe Biden’s name didn’t appear on any corporate records and there was no evidence. It took Kimberly Strassel to really report on it from the opinion side. Except hers wasn’t opinion- she is a strong investigative reporter who reported facts, which is hard. Then they all buried it as if it never happened Its as if the WSJ news and opinion side have switched roles when it comes to politics.
I think the same dynamic is at play here.
Really respect Glenn Greenwald, someone on the far left who really dug into the Biden scandal. Cost him his role at the Intercept, which he founded. But he followed the trail anyway.
Probably the NYT and WSJ are covering the actual cases Team Trump is losing in court right now and for the last two weeks rather than this press conference where no actual evidence is presented and no cross examination permitted.
