The New Republic’s contributing editor and Guardian columnist Osita Nwanevu had a curious posting this week as he offered a new definition of socialism for the public: socialism is simply cheaper products. Even Dell apparently is a socialist enterprise under Nwanevu’s new take. Capitalism? Anything that is too expensive. In other words, voters should elect socialists if they like sales.
There is a rising number of Democratic Socialists in Congress and in the Democratic party. Many are seeking to push this trend by getting young voters to identify as socialists. It may be working. Polls show that socialism is now as popular as capitalism with young voters.
Hopefully, they have a better handle on the subject than Nwanevu, who has also written for the New Yorker, Slate, and Harper’s.

It is not clear where Marx laid out that socialism is like a never-ending Black Friday sale. He did say that “a commodity appears, at first sight, a very trivial thing, and easily understood. Its analysis shows that it is, in reality, a very queer thing, abounding in metaphysical subtleties and theological niceties. ”
However, Marx was not exactly keen on the capitalist production system, even at a discount. He declared “Accumulate, accumulate! This is Moses and the Prophets!” He also noted “Just as man is governed, in religion, by the products of his own brain, so, in capitalist production, he is governed by the products of his own hand.”
Putting that aside, socialist and communist systems historically have resulted in cheaper but fewer products. The old Soviet joke: A man walks into a shop. He asks the clerk, “You don’t have any meat?” The clerk says, “No, here we don’t have any fish. The shop that doesn’t have any meat is across the street.”
The infamous five-year plans of the Soviet Union led to widespread starvation and reduction of goods. What was produced was cheap but shoddy:
“For example, in the 1970s the Soviet Union produced 800 million shoes every year—enough to provide every citizen with three new pairs. But the quality, design, and fit were often so poor that many residents had to spend hours looking for a perfect pair, or buy imported shoes at vastly higher prices.”
Under no interpretation of Marx would Dell undercutting the market be viewed as socialism at work. To the contrary, such supply and demand decisions are more in line with Adam Smith than Karl Marx. The invisible hand of Smith favors certain goods and price points.
You can clearly have soft socialist systems that centralize economies and force the redistribution of wealth without the authoritarianism of communist. They are not synonymous. There are also variations of socialism from command economies to “market socialism.”
However, socialism also has not been shown to reduce prices as much as reducing products. Indeed, systems in countries like Venezuela often trigger rampant inflation and other collateral crippling economic problems.

Socialism: If you have two cows, the Government takes one and gives it to your neighbor.
Communism: If you have two cows, Government takes both and then gives you some milk.

Jonathan: There was a huge earthquake in Colorado! The SC there just ruled DJT is not qualified for office and will not appear on the primary ballot in that state. This is the first state to rule DJT is disqualified under Section 3 of the 14th Amendment. DJT will appeal to his SCOTUS supporters to overturn Colorado’s decision. And he may well prevail. But at least one high state court has agreed with the lower court that DJT engaged in insurrection or rebellion. That will be important in other cases going forward.
Then in another case we have some important developments. Jack Smith appealed to the SC for an expedited hearing on whether DJT is immune from criminal prosecution. The Court gave DJT until today to reply to Smith’s request for a writ of cert. Today DJT replied with his own brief telling the SC stop the presses! He doesn’t want an expedited appeal on the issue. DJT says “Haste makes waste”. I’m not make it up. Those were the very words in DJT’s reply brief. He wants the DC Court of Appeals to first rule and then he will decide whether to appeal. Strange position to take since weeks ago Alina Habba, speaking on behalf of her client, demanded the SC immediately decide the issue of presidential immunity. Seems Alina has once again been left out to dry!
So why doesn’t DJT want the SC to decide the case immediately? If DJT thought he had a solid claim of presidential immunity why wouldn’t he want the Supremes to decide the issue now rather then later? He has a solid majority on the Court. He appointed three members to the Court. I suspect it’s because DJT’s lawyers know the immunity defense is week and the DC Court of Appeals will so find. That leaves going back to the SC after an adverse ruling. Both cases cases or on a fast track. The DC Court of Appeals could rule by sometime next month. And it’s more than likely the Appeals Court will find DJT cannot claim criminal immunity. That leaves the SC to make a final decision. And the betting line among legal pundits is that even the SC conservative majority will find it hard not to uphold the DC Circuit.
That means Judge Chutkan can lift her temporary stay and her trial will be back to its original trial schedule of early March. It is clear what is going on. Jack smith is playing three-dimension chess while DJT is playing one- dimensional chess. We’re in the big leagues now!

The next problem is that the plain text of the 14th amendment does not apply to the president.
The next problem is that the languiage says “shall hold office” – not can run for election. Again – the past enforcement of the 14th amendment was done by congress – not the states and had nothing to do with ballots or elections.
The next problem they have is that Trump was impeached for J6 and NOT convicted in the senate. This BTW will also be a problem for Smith in DC. But it is worse for ballot issues. Though this also touches on presidential immunity.
Essentially the OLC oppinion regarding indicting a sitting president is that they must be impeached first.
They can noteven be indicted unless they are impeached and removed.
It is an open question whether a president can be prosecuted after they leave office for acts as president if they are NOT impeached and removed. No one has tried before.
Whether DM or the left likes it Presidents Do have immunity – it is not absolute – because they can be impeached, removed, indicted and convicted. THAT is the correct mechanism to overcome presidential immunity.
What is less certain is can they be indicted if they are impeached and not convicted – as occured with Trump. Or can they leave office without being impeached and then be indicted.
House democrats may well have screwed themselves by impeaching Trump and failing to convict in the senate – and worse still continuing the trial AFTER Trump left office.
It would be easy at this point for SCOTUS to decide that the correct process is impeach, convict, and then indict.
AND that applies to former presidents too.
I do not know what SCOTUS is going to do.
But I would bet heavily regarding what they will NOT do – they will NOT decide in Smith’s favor quickly.

They also directed that if it is appealed to the supreme court it will be stayed indefinitely.
That is actually outside their power to do, but it really does not matter.

I am not sure if Trump can appeal directly to the supreme court. But he certainly will appeal it into federal court.

As to the Jack Smith’s appeal to the SC – The SC was very nearly required to take it. They nearly always take DOJ requests when DOJ begs them.
But that does not mean they will not kick Smith back to the DC appelate court.
Which is the highest probability for what SCOTUS is likely to do.
The lowest probability is that they will accept the case and decide it on an expedited basis. There is very near a zero chance they will do that.
Alina Habba is a civil attorney on Trump’s case before “nipple judge” engron. She is not Trump’s attorney in any criminal case.

As to Trump’s claim of presidential immunity – this is a case of first impression – because no one has ever been so stupid as to pull a stunt like Jack Smith has before.
While I doubt that the Supreme court will decide that the president has complete blanket immunity. It is even more certaint hat they will not decide that the president has no criminal immunity. The courts have already decided – both in other cases and in Trump cases that the president has significant civil immunity.
I would note that the immunity claim is not at all unusual – Meadows made the same claim in GA, and that claim is working through the apelate courts. It will get to SCOTUS eventually.
All government employees and actors have some form of immunity. There is no question that Trump has immunity as president – only how extensive it is.
If you are expecting SCOTUS to jump in to decide a very complicated issue of first impression in a few seconds – you are likely to be disappointed.
The DC court of appeals has not ruled. I do not beleive they have even heard arguments. It is highly unlikely they will move quickly. Moving quickly invites the Supreme court to nit pick some minor issue and remand the case back to them for reconsideration – wasting even more of your precisious time.
I would further note that the immunity issue effects EVERY Criminal case against Trump – not just the
DC case. It is likely that Trump’s attorney’s will move for stays in GA and FL shortly – especially if SCOTUS does not decide this instantly.
And those stays will be granted. It is required. The likelyhood of the immunity decision being settled quickly is near zero.
Several Actual pundits beleive this was a form of legal suicide on the part of Smith. That he specifically asked SCOTUS to jump the queue to F#$K up his own case as much as possible.
Regardless, unless the Supreme court decides to decide the case without hearing it – which has almost zero possibility of happening – there is almost no chance that DC/GA/FL will procede until after the election. Even if Trump loses every single immunity claim – so long as SCOTUS schedules the case this will delay everything until well after the primaries start and after that DOJ rules will preclude moving forward.
You also missed the more significant case. SCOTUS has agreed to hear the J6 1512(C) free speech/obstruction of a proceeding case.
That pretty much means there are already 4 votes to tell DOJ that 1512(c) can not constitutionally be used against protestors.
Further the biggest hurdle for the 1512C case is was getting cert which it now has. The supreme court does not have to take every case it thinks is decided wrongly. And usually does not. There was no circuit split on the 1512C case – because no one has charged anything this stupid ever before. Even the DC courts had problems with this – the first judge tossed this application fo 1512(C). The DC court of appeals split 3 ways.
After which DOJ quit charging people with 1512C violations. 2 of Smith’s 4 counts in DC are 1512C based. SCOTUS can obliterate half of Smith’s case in a single decision. And they fact they have taken this case strongly suggests they are likely to.
This is a first amendment case. This application fo 1512C violates every single part of the first amendment except freedom of religion.
The odds of DOJ prevailing are very slim. That could toss 300 or the longest sentences for J6 defendants.
And the decision is guaranteed to come by late June at the latest.
Why doesn’t Trump want Scotus to decide immediately ?
That is easy – this is a complex case of first impression. And Trump is best served by delaying this as long as possible – no matter what scotus decides.
I actually doubt SCOTUS will give Trump everything he wants – though there are excellent constitutional arguments for doing so.
But SCOTUS does NOT have to decide everything, or everything in Trumps favor to stop this idiocy.
All they have to do is sit on their hands for a while, kick it back to the DC court of appeals and then kick it into next years docket when it comes back. Then later decide the issue is moot.
Courts generally – when not run by left wing loons avoid controversial decisions they do not have to reach.

He has repeatedly claimed that Trump is subject to the law in the same way as everyone else.
That his status as former president will not effect the proceedings.

Yet, here is Smith at the supreme court asking SCOTUS to on an emergency basis because Trump was president and because he is running as president to on an empergency basis treat trump special.

Let me understand a bit better the notion that socialism can be equated with lower prices. When President Carter deregulated the airline industry resulting in significantly lower airfares, then was governmental deregulation an act of socialism because of the resultant lower prices? If so, I am beginning to like that type of socialism more and more but I suspect that governmental deregulation is the opposite of what socialists generally propose. Thus we come to a contradiction and have to conclude that the above premise (socialism always results in lower prices) is flawed.

Jonathan: I doubt many, even on this blog, have actually read Das Kapital–I mean the whole thing. It’s a tough read in the English version–dense with complex ideas. It’s not for bedtime reading. But I don’t think either Osita Nwanevir or you have captured the real significance of Marx’s work. He was the first economist to unravel the mystery of how capitalism actually works. It is remarkable that Das Kapital has survived and has been continuously in print for the past century and a half. Economists and political writers still use Marx as a starting point in describing modern day capitalism.
This probably explains why many in this country, especially by young people, are attracted to socialist theory and practice. Recent polls confirm this shift–even among young Republicans. In 2019, 81% of young Republicans perceived capitalism positively but that figure plummeted to only 66% in 2021. The Q is why socialism has become an attractive alternative to capitalism?
I think the answer is that we are facing an economic and political crisis in this country. Mass protests over racism, climate change, foreign wars. Then voter concerns about the rising cost of living, stagnant wages, another Covid-19 pandemic, unaffordable health care, the cost of higher education–and other issues that voters don’t think our economic system and politicians are either equipped or prepared to address. And the county is sharply divided over these issues. A perfect storm for an authoritarian figure to step in an offer simple solutions–close the borders, “drill, drill, drill!” and “Make America Great Again!
If history is any guide we could see fascism in this country. It happened in Italy and Germany, countries that had parliamentary democracies, in the 1930s when both countries were reeling from depression after WW1–workers were striking against unfair economic systems. Communist parties were gaining in voter support. So what did the capitalists in Europe do when their whole system was staring to unravel. They turned to authoritarian figures like Hitler and Mussolini. The rest is history.
We see this scenario now repeated here. Wealthy capitalists are pouring money into DJT’s campaign because he offers a way out– a way to preserve the system by using the military to crack down on dissent–not only in the streets but in the press and in the government–anyone who might challenge the status quo. So DJT struts around claiming he and he alone can solve the problems. He has now resorted to the tried and true scapegoats–the migrants who are “poisoning our blood”–echoes of Hitler’s Mein Kampf. Fascism depends on divide and rule. Divide people by race, religion and ethnicity. Anti-semitism is on the rise–being pushed by the far-right that wants to make Jews the problem. Never thought we would see this state of affairs in this country. But it’s here and we have to deal with it before we lose our Democracy!

American consumers have about 40 automobile manufacturers to choose from, resulting in over 100 choices in purchasing an automobile. Today Ford and Chevy make great autos largely due to healthy competition from Toyota and other competitors.
During the Cold War, in some communist block nations, citizens of communist regimes could only buy a car from 1 or 2 auto manufacturers. These cars routinely broke down due to lack of healthy competition.
Healthy competition with some rules of the road (common sense regulation) is what reduces prices for consumers and improves products and services.
I’m not aware of any American politician supporting a Cold War communist model. Democrats don’t support the communist model.

Socialism isn’t what we are dealing with. Several cohorts that are susceptible to socialism is what we are dealing with. So the question is: how did we create these cohorts who are susceptible to socialism, and how do we prevent it going forward? The answer may very well end up being parenting, and it may require that you, yes, you, were an absolute s*** parent. Total s***. That is the conversation we all seem to not want to have. It’s the only one that will fix it, this isn’t the fault of schools. Kids should show up to school ALREADY prepared, basic human functioning is not a teacher’s job to impart. That goes for blue and red, they are equally deficient today, red states are no better. If you had kids at any time over the past 20 years, than you likely bear a great deal of this burden.
