New Filing Accuses Fani Willis of Misrepresenting the Date of her Affair with Nathan Wade

There was a notable filing in the ongoing scandal in Georgia over the intimate relationship between Fulton County District Attorney Fani T. Willis and her subordinate special prosecutor Nathan J. Wade. Defense lawyer, Ashleigh Merchant, claims to have an affidavit that Willis lied about when the relationship began — a critical fact in her defense against ethical allegations.

Willis and Wade insisted that the relationship had not begun until 2022, after she hired him (in November 2021) to serve as special counsel to prosecute former president Donald Trump.

Ms. Merchant identifies the witness as Terrance Bradley, who served previously as Wade’s divorce lawyer and worked in his law firm. That itself is quite irregular given the strong protections for attorney-client privilege. However, Merchant told the court that “Bradley has non-privileged, personal knowledge that the romantic relationship between Wade and Willis began prior to Willis being sworn as the district attorney for Fulton County, Georgia in 2021.”

In this sworn affidavit filed with the court, Wade states “[i]n 2022, District Attorney Willis and I developed a personal relationship in addition to our professional association and friendship.”

As a sworn statement filed with the court, a materially false statement would pose a very serious violation for both lawyers. This was the key determinative element cited by both Willis and Wade to show that there was no ethical breach in the hiring of Wade.

We obviously need to hear from Willis and Wade — and learn more of the details. The key date is November 2021 in terms of the hiring of Wade. There is also the question of how his information was “non-privileged, personal knowledge.” If the affiant is suggesting that there were public displays or confirmation of this relationship, there could be other witnesses who could be called to give accounts.

The filing also suggests that there may have been other trips taken by the lawyers.

Merchant states “[s]ince Willis and Wade were not forthright about their relationship in the first instance, there is no reason to believe they are telling the truth now,”

Notably, the defendants in the Georgia case include those charged with making false statements and filing false documents.  If Willis or Wade has now done so, the political and legal impact on the case would be devastating. Once again, the only thing more troubling than the relationship itself has been the response of Willis and Wade to the scandal. They have consistently put their own interests before that of the case and the office in my view.

      1. The presumption of innocence is something that alleged criminals are entitled to at trial.

        It is NOT something at law enforcement is entitled to prior to being charged and tried for their own criminal conduct.

        Willis appears to have Targeted Trump as a means of getting votes, and political donations,
        Then when in office she used a high profile prosecution to hire her paramour and receive personal kickbacks.
        Further we have evidence of “collusion” between Willis and Smith and DOJ and the WH.

        The standard of proof to convict willis and wade is high – beyond a reasonable doubt.
        They standard to toss them off the case and/or to dismiss the case entirely is not very high.

    2. If it is not obvious to you at this point that all of these prosecutions of Trump and his associates are corrupt banana republic style attacks against Biden’s chief political rival, then there is no hope for you.

They could never win in a truthful election in an America wherein the “manifest tenor” of the Constitution is implemented because everything they do is unconstitutional.     2. Anything Bradley personally witnessed is not likely protected by priviledge.

      Regardless, if the allegation is true – there is with near certainty evidence beyond Bradley

  9. Turkey doesn’t explain that it could be a serious ethical breach to have a romantic relationship with the special prosecutor even after his appointment.

    1. Its implied…pretty much common sense ethics…but ethics , common sense in a democrat ?…not gonna happen.

      Think of this in a different context – would it be legal for a government purchasing agent to receive vacations from a supplier ?

      White men are for Trump and black men are even starting to go against the Democrats, but it is the women, black and white, that will vote for Biden no matter what happens to our country. Open border…they hate it…but will vote Dem. Crime in the cities and suburbs…hate it…but will vote Dem. Trans lunacy in sports…hate it (for their kids)…but will vote Dem. Inflation at the store and gas station…hate it…but will vote Dem.

      We have a female problem in this country. They get about 60% of the seats at our colleges…and how is that going for academia?

        There is also a mental illness thing that affects men too, and in fact, I have named it after a man, Bill Maher. Just like we have Lou Gehrig’s Disease, I call this Maher’s Syndrome. It occurs when a person recognizes the inherent stupidity of their political party, yet continue to vote for them. Maher is a perfect example. He realizes that Democrats are nuts on border policy, nuts on gender ideology, but dang it, he is going to vote for them anyway. This was very evident when he was press by some dude, Bet David or something, on what Gavin Newsome has accomplished, and Maher replied, he made it rain. This is why I despair about the fate of the country. Maher is intelligent, well-informed, and astute. But he is as stuck in a rut as any bitter clinger Bible-thumper.

  12. This is why Americans see the legal system as a skeleton of dry bones covered with an image of reality. Justice is as dead as those bones. The pallbearers are judges in black robes who see themselves as the gatekeepers of the Law, yet are nothing more than participants in a macabre ritual that nobody believes. The only solution to the degradation of society’s confidence in justice and the law is to see a cessation of legal gamesmanship, clear evidence of fairness, and results that are driven by Justice, not agenda.

          In the Constitutional Convention, the Framers kept the Law of Nations, Vattel, 1758, in their pockets, read the letter from Ben Franklin to Dumas, “I am much obliged by the kind present you have made us of your edition of Vattel.” A “natural born citizen” requires two parents who were citizens at the time of the candidate’s birth, and, simultaneously, requires a father who was a citizen at the time of the candidate’s birth. Obama had one parent who was a citizen and a father who was a citizen of a foreign country. All presidents before Obama had two parents who were citizens at the time of the candidate’s birth. Obama will never be a “natural born citizen” and Obama will never be eligible for the office of president.

  14. Another one of those goose and gander cases. I always thought it was always the democrats who pulled out the sexual charges, often from decades in the past such as against Justice Thomas, Justice Kavanaugh, Justice Moore in Alabama when he dared to run for the senate, and of course the recent case in New York of the stealth accusation of sexual assault against President Trump (that sat on a secret shelf for, was it 23-24 or 25 yrs, she kept changing the date and dress). These cases are literal skeletons in the closet because the participants are verging on being skeletons soon. Why this case in Georgia is relatively fresh meat and seems to be unraveling almost as fast aa the trysts occur, so to speak.
    It’s nice to see Georgia Politics have changed little since I lived there in the 1950’s-1970’s. The colors and races may change in the power structure but the activities seem to be exactly the same. But then why not since we are all equal opportunity offenders.

    1. This is not about sexual assault. It is about a relationship that constitutes a conflict of interests.
      It is also about the fact that Wade and willis failed to disclose and appeared to lie about it.

      Wade and Willis are free to date and engage in anything they wish privately.
      The core issue is NOT their private relationship. It is that their private relationship limits their public relationship.

      Public officers with the ability to hire and fire may not hire those they have an intimate relationship with.

      It is frowned on privately, but it is barred when public funds are involved.

      There are many reasons for that – but this case highlights one of those.

      There is lots of evidence that Willis benefited personally financially from government funds that she authorized to wade.
      That is public corruption.

      1. Under sexual harassment laws it would also lay foundation for claims. Office workers, spouses and coworkers subjected to their sexual behavior could file harassment claims. Lived a similar incident without pursuing it.

  15. I’m shocked, shocked!

    Wade’s divorce was filed in 2021 supposedly right after he was hired by Fani, so I figured that there was something going on before that and it would just be a matter of time before it came out. I’m sure that his wife has some information but the divorce was “settled” a couple of weeks ago; neither Wade nor Willis had to testify in that civil case. The terms of that settlement and who paid how much would be of interest.

    Now that it’s a criminal matter, there will be more witnesses.

    Since they met with the WH, it will also be interesting to learn more about the coordination of all of these anti-Trump cases. I’m not a Trump fan, but this is just wrong.

Wills/Wade should suffer the consequences of their false comments/spending spree on the tax payers/profiting etc. but they are DEM’s and right now untouchable?
