“That is not the judgment of the press.” Those words from President Joe Biden were a telling moment after a reporter noted that there is widespread concern that he is mentally diminished. Biden’s cranky response was overshadowed by his confusion on other points during the press conference, including mixing up the presidents of Egypt and Mexico. However, it captured the sense of license and expectation of the Biden White House that the press is supposed to toe the line, as it has for three years.
In the disastrous press conference, CNN correspondent MJ Lee reminded Biden that he had urged Americans to “watch me” when he was confronted over his age: “Many [of the] American people have been watching, and they have expressed concerns about your age.”
The President angrily responded: “That is your judgment!. That is your judgment! That is not the judgment of the press.”
The next day, many in the media came to Biden’s defense and attacked the Special Counsel report which detailed his “diminished faculties.” Others cleaned up the remark about the press. Biden clearly stated “That is your judgment! That is your judgment. That is not the judgment of the press.”
NBC did not include the line in articles on the press conference despite showing it on the live coverage. Roll Call actually edited the President’s remarks to insert “for” in the key line: “That is not the judgment [for] the press.” That changed the line from questioning the right of the press to make such judgments to telling a reporter what the press view should be. Even if it was a Freudian slip, it was a telling slip. Other media inserted or suggested “public” rather than the press in the line.
The obvious exasperation of the President reflects years of a passive, enabling media that shielded Biden from difficult questions on various scandals, including the corruption scandal.
What was striking, however, was the degree to which President Biden and his staff spent this week putting out clearly false statements. In an administration that has pushed for the censorship of citizens accused of disinformation, misinformation, and malinformation, the President openly lied about his conduct and the report.
President Biden, for example, stated that the Special Counsel report found that he did not willfully retain material. It found the opposite . . . repeatedly.
He stated that he did not disclose classified material to his ghostwriter. Special Counsel Hur found precisely the opposite.
Biden stated that the material was not highly classified with “that red stuff…around the corners.” In fact, Hur found that the material was “highly sensitive,” including an Afghanistan-related memo from the National Security Adviser to President Barack Obama in 2009 marked “TOP SECRET/SCI” (Sensitive Compartmented Information).
Biden stated that all of the material was kept in locked or lockable filing cabinets. That was a lie. As the pictures vividly demonstrated, Hur found material in unlocked areas and virtually spilling out of torn boxes in his garage.
What is notable is that Biden works almost entirely off teleprompters, reading statements clearly crafted by his staff. That would indicate that some of these comments were promulgated by staff.
Even in the press conference on Friday, Ian Sams, spokesman for the White House Counsel’s Office ran into a skeptical reporter in the form of Jon Decker, the White House correspondent for Gray Television. Decker is the former head of the White House Correspondents Association and one of my former students. Decker is the gold standard for reporters and has always been objective, tough, and fair. His approach has not changed from the Trump to the Biden Administration.
Decker challenged Sam on coming to the podium to address the President’s statements and proceeding to make a false claim that this is the first Special Counsel to end his investigation without charges.
So why would the White House risk looking like it is going full “Baghdad Bob” in denying readily observable facts? Because this is no real risk.
The reason was evident the day after the report. While usually supportive outlets had to acknowledge the President’s false claims, media figures from MSNBC and CNN quickly fell into line and launched a full attack on Hur, often repeating identical words used by the White House about his observations being “gratuitous.” The problem is Hur, not a President who not only appeared confused in the press conference but openly lied about various established facts.
We have previously written how the level of advocacy and bias in the press has created a danger of a de facto state media in the United States. It is possible to have such a system by consent rather than coercion. The Biden White House has become more open in its marching orders to media, including a letter drafted by the Biden White House Legal Counsel’s Office calling for major media to “ramp up their scrutiny” of House Republicans.
The Decker-Sams exchange is key in this regard. I have previously noted that Sams is now actively managing a media campaign to blunt investigations into the President’s conduct and the alleged corruption by his family. As Decker noted, he is not a lawyer but has used that office to put an official imprimatur on these false statements. That could prove precarious in the weeks to come as the House explores impeachment allegations against the President. The use of White House staff for such purposes has been cited in past impeachment articles.
My opinion is that neither Mr. Biden nor anyone else should be prosecuted under the espionage act for mishandling of classified documents. The leaking of classified documents has been a cottage industry in D.C. for decades. Too much stuff is classified, and materials seem to remain classified far longer than they should. But then why is Trump almost exclusive being prosecuted?
Trump refused to return all of the documents after being asked. He refused to return all of the documents after being subpoenaed. He had Nauta move the documents after being subpoenaed. The FBI had to get a warrant to search for the missing docs. Trump had Nauta and de Oliveira attempt to erase security tapes. Trump engaged in obstruction. That’s why he’s being charged. If he’d returned them when asked and not engaged in obstruction, he wouldn’t have been charged.
Trump didn’t refuse. He was never served with a court order.
Get things right for a change.

A citizen, even Trump, has the right to contest a subpoena. An ex-President also has to think of the powers and perogatives of his office. When there is a contest, lawyers should negotiate the dispute, at least before a court becomes involved. Hunter Biden was not thrown in jail when he defied a subpoena from the Comer committee. Fani Willis will be contesting a subpoena from Jim Jordan’s committee.
Trump didn’t contest the subpoena, he simply defied a valid subpoena.
HB’s lawyer noted that the original subpoena wasn’t valid because no impeachment inquiry had been approved at that point. The current subpoena is valid and HB will be showing up to testify.
The Comer committee was not prevented from issuing a subpoena by the absence of approval of an impeachment inquiry. A Congressional committee always has subpoena power. As for Trump, he did not simply ignore the FBI subpoena. If memory serves, I believe he sent a letter claiming that some of the records were personal in nature.

As a rare observer of the Washington Post, I usually run into a paywall. This article had none, and neither did another article on Biden. Anyone out there, Is this an indication the WP is turning against Biden, or today, the lack of a paywall is a usual occurrence?
S. Meyer: Paywalls are a big problem if you want to get information. The Washington Post is not the biggest offender. I pay just a few bucks a month to get their online sub. But it’s the only I subscribe to because I refuse to pay what, for example, the NT times charges.
Dennis, I have no problems with paywalls, as these companies need to be paid for what they produce. I pay for some, but there is so much I don’t want to add more to add to my general knowledge. After a couple of days here, it is pretty easy to figure out who the trolls/paid DNC shills and disinformation agents are. I actually feel sorry for them on this one. Dear Attorney General Garland:
I write to you today with grave concerns regarding the confidential report provided to you by Special Counsel Robert K. Hur. After concluding that President Biden knowingly and willfully removed, mishandled, and disclosed classified documents repeatedly over a period of decades, Mr. Hur nevertheless recommended that charges not be brought against him.
Special Counsel’s reasoning was alarming. He recited numerous instances in which President Biden exhibited dramatically compromised mental faculties and concluded that a jury would be likely to perceive President Biden as a sympathetic and forgetful old man.
I need not tell you that selective prosecution is morally, ethically, and legally prohibited. We don’t prosecute or decline to prosecute people based on their personalities, or on the public’s anticipated perception of them. If Special Counsel finds that the evidence forms a reasonable basis to bring charges, he must do so. The Department of Justice cannot ethically bring charges against former president Trump because he has mental acuity and a forceful personality and decline to bring charges against President Biden because of his cognitive decline. President Biden needs to be charged.
Unless he is not mentally competent to stand trial.
Candidly, the Special Counsel’s report makes a reasonable case that he is not. Being unable to remember what position he held, and when, is exceptionally concerning. Being unable to remember when one’s child died – even within a time frame of several years – is perhaps more frightening. He may not be competent to stand trial.
And he most assuredly lacks the ability to execute his presidential responsibilities. Accordingly, it is incumbent upon you to begin proceedings to remove the President pursuant to the 25 th Amendment of the United States Constitution.
President Biden needs to be charged, or he needs to be removed. There is no middle ground.

Several posters below mentioned that they don’t know who is really running the country. I’ve felt the same way for at least a couple of years. Biden was supposed to be this “normal” guy who was going to restore sanity and he has done everything but that. No one mentioned senility or dementia. Age was occasionally brought up but it’s not an age problem — at nearly 20 years older, Warren Buffet can run mental circles around Biden. Rather than being a firefighter, Biden has been an arsonist, setting fire to our borders, economy, ignoring SC rulings, and inflaming the whole world. I have a family member who has Alzheimer’s, a former CEO who is now in memory care. He can no longer run his company. Anybody who needs an Easter Bunny escort cannot run this country. Who really is in charge? Did we vote for them? How does the constitution apply to this situation?
I think that they hope to continue gaslighting us.
My fear is that even the people running the country do not know who is running the country. In other words, there are no clear lines of authority and decisions as re made haphazardly on an ad hoc basis.

Special Counsel Hur’s report is certainly the most bizarre I’ve read. How could SC Hur possibly know Biden is a “well meaning” doddering old fool? Do they teach that @ Harvard Law?

One can be sure SC Smith (nor the ‘media’) needs no sodium pentothal to determine Trump’s malicious intent and ‘willful’ retention of classified docs. .. not to mention the Trump-Judge overseeing the case!

For example, evidently the National Archives/Records people were unaware Biden had retained classified docs for over 50 years (it was just an accident his ‘staff’ found them.). Yet knew the subject matter, scope and scale of classified docs stored in Trump’s Florida estate.
One can only hope the subject matter, scope and scale of all these highly classified docs are fully vetted and examined – if not by Biden/Trump Special Counsels then by the U.S. Congress.

The rule is that they were completely competent when they committed the crimes in years past, and they’re still competent enough to function outside of an old age home, so they’re competent enough to stand trial. Actually, Biden did a LOT wrong. The investigation found that Biden “willfully”committed numerous, blatant, felony crimes — that almost anyone else, at a lower level, would be fully prosecuted for, and do prison time.

Jonathan: I seriously doubt many on this blog have actually taken the time to read SC Counsel Robert Hur’s report. And it has nothing to do whether Joe Biden “lied” and that the press has covered up for the President. It’s about what Hur actually said in his report and why it falls apart upon close examination.
Although Hur concluded that Biden could not be criminally charged for the “willful” retention of classified material, he spent a lot of time in his report taking gratuitous and unwarranted potshots at Biden’s fitness for office by describing him as a “sympathetic well meaning elderly man with a poor memory” who a jury would be unlikely to convict. What does Biden’s age or mental acuity have to do with whether he should or should not be prosecuted?
Hur opens his report that invites a lot of misrepresentation by stating that he “uncovered evidence that President Biden willfully retained and disclosed classified materials”. “Uncovered” is one of the operative words. Hur didn’t have to “uncover” anything. Biden and his lawyers didn’t hide anything. They readily provided access to all of Biden’s material. “Disclosed” is another operative word. In the process of writing his memoirs Biden showed classified material to his ghostwriter. But Hur also decided not to charge the ghostwriter.
What Hur also did in his report was to compare Biden’s actions with those of DJT in his “willful” retention and hiding of classified docs. On page 10 of his report Hur says: “With one exception, there is no record of the Department of Justice prosecuting a former president or vice president for mishandling classified documents from his own administration. The exception is President Trump”. Beside the fact that DJT is no longer “President Trump”, under DOJ regulations it is improper to comment on a different, pending prosecution of a different person in a case over which Hur has no authority.
Hur should have written his report in a factual, non-pejorative way without commenting on Biden’s mental acuity or comparing Biden’s actions with those of DJT. But Hur was appointed by DJT and seems to go out of his way to suggest that his former boss should not be prosecuted when he can find no factual basis to charge Biden. Such a suggestion is not within the bounds of Hur’s authority as Special Counsel. His only authority was to investigate Joe Biden.
Hur tries to make excuses for not charging Biden. He tries to play the role of amateur psychiatrist, a role for which he is not qualified. He suggests that a “sympathetic” jury would not convict Biden because of his lack of memory, his age and supposed related mental infirmities. That’s not the reason Hur did not charge Biden. The reason is that Hur, after over a year of investigation, could come up with no evidence that Biden intentionally hid or withheld classified material. Everything was voluntarily turned over to the government or was discovered by the FBI in a consensual search. That’s makes the Biden and Trump cases completely different and Hur had no business trying to compare them.
Except for clearing Biden, Hur’s report will be compared with the Durham report. Two lessons on how not to write a report!

You claim the report in Biased – Hur could just as easily ignored Biden’s incapacity. Hur found – what was obvious.
That Sen. Biden and VP Biden willfully removed classified information from government control and then willfully disclosed it.
None of this occurred while Biden was president. There is no actual innocence defense.
You call Hur biased for concluding that Biden can not be prosecuted because he was unfit to stand trial.
The alternative is that Biden is mentally competent and should be indicted as soon as he is no longer president.
I happen to agree that Hur should NOT have included the assessment of Biden’s mental competence.
That is not a prosecutors determination. That is a claim that must be made by the defense to a judge.
Hur’s report should have ended with his findings that Sen. Biden and VP Biden repeatedly violated the law and that Biden can be prosecuted when he is no longer president.
I would further note that Garland could easily have directed Hur to remove the material regarding Biden’s competence.
The law requires that the SC provide a report to the AG. It does not require a public report, it does not prohibit the AG from constraining the report to the facts, and the law.
This report and the damning “biased” assertions regarding Joe Biden’s competence appear to me to be Garland’s – not Hur’s efforts to get Biden to remove his hat from the presidential ring. To send a message to Biden that he can allow his presidency to end on Jan 20,2025 and walk away without fear of prosecution.
This report apears to me to be damage control on the part of the “deep state”. Pushing Biden out of the 2024 race gives democrats and the “deep state” a tiny bit more hope of defeating Trump in 2024.
Almost the entire country knows that Trump is going through the deep state in 2025 like a hot knife through butter.
Trump has promised that he will not be seeking revenge in 2025. He has not promised that he is going to leave the corrupt in power.

The single statement in Hur’s report regarding Trump is a meaningless throw away line.
Hur is not prosecuting Trump, he admits he is dealing with allegations not facts.
Hur’s investigation of Biden does not involve any consideration of the national security powers of presidents, of declassification authority, of the ownership by presidents of the WH documents of their presidency.

Hur’s observations regarding Trump have no more relevance than his oppinions on the superbowl.

The WC did an excellent job of proving historical precedents for presidents and ex-presidents keeping classified information and for disclosing it to the press.
There was only one flaw in the WC’s argument – Biden was not president or ex-president during the time this conduct occured.
The WC did an excellent job of proving that presidents are different regarding classified information.
But he expected that no one would notice – that Biden’s handling of classified information was not done while president or expresident.

But Garland had to approve this report and Garland had to chose to make it public, and Garland almost certainly was aware that Hur’s investigation was examining Biden’s competence.
My guess is this report would have been quite different had Biden withdrawn from the 2024 presidential race.
My read of the Tea leaves is that this is the Biden DOJ’s last ditch effort to get Biden out of the 2024 election in the remote hope of blocking the tsunami that will hit in November.
This report is NOT intended as fodder from Trump or MAGA or republicans. It is intended as providing the way out for democrats in the Batan Death march that is Biden’s re-election efforts.
Hur came up with PLENTY of evidence of willful mishandling and willful disclosure of classified documents.
I would note that is a higher standard than Hur needed to meet to charge crimes.
Under the espionage act reckless handling of classified documents and unintentional disclosure is a crime for a secretary of state, for a Senator, for a vice president. But not for the president.
Hur found that Biden removed classified information from the Senate SCIF as Senator.
That he removed substantial classified information as VP and that he stored it recklessly. That it was often not locked up, That it was not even in closed boxes and/or closed closests, that it was sitting in an often unlocked garage with easily defeated locks in open boxes haphazardly scattered about the garage. That he left classified materials all over the place – pretty much everywhere he went. In officers in Biden center, in his garage in his guest home, in his home, in his library. In places that were protected by secret service and many many places that were entirely unprotected.
Hur found that Sen. Biden and VP Biden’s handling was not merely reckless, but willful. That he acted deliberately to remove classified information from government control without the authority to do so.
Hur also found that on ATLEAST 3-4 occasions that Biden willfully and knowingly disclosed classified information to the press as a private citizen.

I mostly agree with you that the mental capacity information did not belong in this report. Just as it was not Comey’s job to make a determination based on the likely hood of a DC jury convicting.
SOME of the information regarding Trump DOES belong in this report.
It is Hurs job to determine how the law was applied in the past – because recommendations that match with similar fact patters from the past are presumptive correct. While the analysis of unprecedented use of the law requires a much higher standard of proof that deviating from past practices is lawful.

Jonathan: I seriously doubt many on this blog have actually taken the time to read SC Counsel Robert Hur’s report. And it has nothing to do whether Joe Biden “lied” and that the press has covered up for the President. It’s about what Hur actually said in his report and why it falls apart upon close examination.
And everybody believes that Professor Turley and Dennis McIntyre/Baghdad Bob are not only on a first name basis, but also believe that Dennis/Baghdad Bob actually read the entire report himself? Seriously… we’re supposed to believe either of those claims from this noted pathological Soviet Democrat liar? The one who assured us the Russia Dossier was all verified fact – and if a hunter used an AR-15, it “would completely destroy a deer, leaving nothing to eat”?

SC Hur gave Biden a gift by finding him unfit. The alternative was recomending that he be indicted.
The report found Willful mishandling of classified information. It found Willful disclosure of classified information.
It found reckless handling of classified information. It found lying to the public and to the press about classified information.
All of this was done while Biden was NOT president and therefore did not have the constitutional perogatives regarding national security information that he has now as president.
Hur had little choice – either Biden was unprosecutable due to incompetence, or Hur was obligated to recomend ciminal prosecution when Biden’s term expires.
The more Biden and his supporters say he is competent, the more it must be asked why he is not facing prosecution ?
SC Hur’s report did not – because it could not, leave room for competent, but not criminal.
