Below is my column in The Hill on the applicability of the 25th Amendment to remove President Joe Biden in light of the Special Counsel report detailing his “diminished faculties.” Despite the various calls for using the amendment, it is neither practically likely nor factually warranted on the basis of his report.

The report on President Joe Biden’s retention and mishandling of classified material hit Washington this week with a thunderclap. Yet the finding of Special Counsel Robert Hur that Biden “willfully retained” such material was not as shocking as Hur’s explanation of why he will not be prosecuting.
Hur noted that, even if he prosecuted Biden, a jury would find him a “sympathetic, well-meaning, elderly man with a poor memory.” That was followed by a disastrous press conference at the White House, where a cranky president lashed out at the reporters while exhibiting additional signs of confusion.
Now, some are calling for Biden’s removal from the presidency under the 25th Amendment. However, constitutional removal would require more than just memory lapses and “get off my lawn” press conferences.
The Hur report details alarming gaps in Biden’s memory, and what Hur described as the president’s “diminished faculties.” Given the detailed accounts in the report, Biden’s press conference bordered on self-immolation. On Thursday night, Biden insisted that he was still sharp and not diminished mentally…before confusing the presidents of Mexico and Egypt. This followed a week when Biden repeatedly referenced conversations with long-dead world leaders.
The subsequent calls for Biden to be removed under the 25th Amendment are similar to demands made from Democrats and various law professors and pundits during the Trump administration. At the time, figures such as the University of Chicago’s Eric Posner argued that the “conventional understanding” of the amendment should be “enlarged” to include instances where both parties “lose confidence in the president’s ability to govern.”
The various experts and pundits who called for Trump’s removal under the 25th Amendment are notably silent this week, even after his own Justice Department cited his diminished faculties as a reason for not charging him.
Nevertheless, as I wrote with regard to the Trump demands at the time, calls for Biden’s removal ignore the true purpose and standard for removal.
The issue of “disability” of a president was briefly raised in the Constitutional Convention in 1787. It was a delegate from Biden’s home state of Delaware who asked how they would respond to a disability, “and who is to be the judge of it?” John Dickinson’s question was left unanswered in the final version of the Constitution.
What followed were persistent controversies over succession. This issue came to a head after President Dwight D. Eisenhower suffered a stroke. After the assassination of President John F. Kennedy, Congress finally addressed the issue in the 25th Amendment. The amendment addresses the orderly succession of power as well as temporary disabilities when presidents must undergo medical treatment or surgeries.
It is Section 4 that allows the removal of a president. One option is what I have called the “mutiny option.” It requires a vice president and a majority of the Cabinet to declare that the president is “unable to discharge the powers and duties of his office,” and notify Congress that the vice president intends to take over. If Vice President Kamala Harris could get eight Cabinet officers to go along with a letter to Congress, her status as the “Acting President” would likely be short-lived. Joe Biden (who yesterday declared, “I’m elderly and know what the hell I’m doing”) would only have to declare to Congress that “no inability exists.” Biden would then resume his powers.
Harris would have to send another declaration with the Cabinet members within four days to the president pro tempore of the Senate and the Speaker of the House, rejecting Biden’s claims.
With that second declaration, Congress would have 48 hours to assemble to debate the issue. It would then have 21 days to vote on the removal. However, that would require two-thirds majorities in both houses. If Congress did not vote within 21 days, the president would resume and keep power.
In other words, it is about as likely as François Mitterrand coming forward to say that he faked his death and has indeed been in communication with Biden.
The question on the merits is whether “diminished faculties” constitute an incapacity. While the 25th Amendment was written with physical disabilities in mind, it clearly can apply to mental or cognitive disabilities. Yet if Biden’s decline is viewed as a barrier to prosecution, would it necessarily be a barrier to the presidency?
The answer is complicated. A study in Psychology Today of the first 37 presidents suggests half of them experienced some form of mental illness. They were still able to perform their duties.
Memory problems are not a compelling basis for removal. However, it is a matter of degree. Biden’s cognitive problems are becoming increasingly evident, but the sole question is whether he can carry out the duties of his office. The standard is not whether he can carry out those duties well.
There is a difference between Biden confusing names and actually carrying on conversations with dead people. The latter would clearly be grounds for removal. Of course, it is hard for the public to know the degree of Biden’s decline. The White House staff has clearly shielded Biden from the public and the press for years. Even during the 2020 campaign, many suspected that the staff was hiding Biden’s mental struggles.
In that sense, the concern over Biden’s fitness is legitimate. However, it will take much more of a showing to establish a case for his removal under the 25th Amendment.

There are several issues here.
First, is the fact that American voters would actually vote for a presidential candidate with clear cognitive decline, based on name recognition, and the preferred political designation.
Second, is that it’s become clear that unelected officials are running the country, while Biden obediently shuffles in front of the camera now and then. He needs his wife to take him by the hand and lead him off stage to avoid getting lost. The question is, who’s running the country? An investigative journalist with an unbiased motivation to reveal the truth could perhaps produce the most important story of the past twenty years. What group of people are actually making the decisions on behalf of President Biden, and how did they come to hold that power? No Cabinet or staff who enjoys such behind the scenes power is going to declare their boss unfit for office.

These aren’t “memory lapses”. I’m not sure why you are married to the “polite’ language used by the special counsel but these are clearly and unmistakably the hallmark signs of dementia as outlined by the American Medical Association.
His speech is slurred like a drunk. Words run on together, and he has little “episodes” midsentence where he is unable to form his mouth correctly to articulate the word he is trying to say. This is the documented sign of dementia. Its like dozens of tiny strokes taking place in his brain, and he is losing his ability to focus beyond a few brief seconds at a time.
That’s how the disease functions, I know I am a defacto expert on the disease as I just went through 10 long years of it with my own Dad, and how Biden is now is how my Dad was in the last 8 or 9 months of the disease.
Today he spoke at the American Association of Counties, and every other word was slurred. At one point in the speech, he clearly couldn’t recall the name of his opponent, perhaps the most well known name in the world right now, Donald Trump. He played it off like he meant to, but he continues on mixing up words, and worse almost every 3rd or 4th word he spoke was slurred and for many words he was simply unable to form his lips correctly to say the word.
So I have to disagree with you on this one Mr Turley. Those aren’t memory lapses. You are leaning on polite adjectives and descriptors used by the Special Counsel to avoid coming out and using speech that would equate to an unqualified medical diagnosis.
These are clearly the advanced stages of one of the saddest diseases in the world. We buried my own Dad in 2019 from it, and I saw it up close and personal as it played out month after month, and not that my opinion counts, but its obvious that its not only my opinion, but all over the world its being spoken about right now.

The way I see it, both Trump and Biden, are materially losing their cognitive abilities. Examples of Trump losing it (confusing Haley with Pelosi, bragging about beating Obama, warning Biden could lead the US into WWII, blaming Jeb Bush for starting the Iraq war).
Given that is true of both of our candidates, the prudent voter should next ask, “Which candidate surrounds himself a team of people to assist in leading and governing? Which candidate relies in and trusts the counsel of those surrounding him?”
To me, policy aside, the answer to these questions is clear. Biden may not possess all of his faculties, but he is much more likely to trust the experts with whom he surrounds himself.
On the other hand, Trump’s turnover with respect to senior-level advisers was 92% as of January 2021. He does not respect their decisions and routinely rejects it. Given the limited mental faculties of an elderly man, that, to me, is a huge liability.
Americans are dumb and could not put forward a competent candidate. Therefore, the prudent voter should pick the candidate that relies the most on their senior advisers rather than goes rogue.

I have noticed the DNC shills today harping on what a wonderful job Joe has done, and several have made reference to the CHIP program, and some stupid gun safety act. I think these are their attempt to use the wunderwaffe propaganda technique, from the Nazi Propaganda Machine:

OT: Trump has submitted his request for a stay of the DCCA ruling in his immunity challenge:

He chose not to request a rehearing en banc before the Court of Appeals.
Now it’s up to SCOTUS whether to grant or deny the stay, and even whether they choose to treat the request for a stay as a request for a grant of cert.
The document asks for a stay “pending” the filing of a cert petition. So I imagine Scotus will not treat the stay petition itself as cert petition.
SCOTUS has repeatedly treated a request for a stay as a request to grant cert, especially in the last few years. So I included it as a possibility.
Jonathan: Now to the Q of whether Joe Biden can be removed from office under the 25th Amendment. And in particular whether SC Robert Hur’s over 300 page report adds any credence to the claim of removal.
In his report Hur spends a lot of time discussing how Biden could not recall a lot of details about events and docs going back some 10 or 15 years. As a retired attorney I can tell you I would be hard pressed to remember old case files–any details about witness testimony, exhibits, etc. I can hardly remember what I did on a specific day last week or last month. So it’s unremarkable that Biden would have memory lapses about events going back 15 years. That doesn’t mean he’s senile or unfit for office.
Now you claim the only reason the DOJ is not going to prosecute Biden is because of his “diminished faculties”. That’s not the reason. Hur and AG Garland found Biden fully cooperated in the investigation. Unlike DJT, Biden didn’t hide any docs or tried to impede the investigation. He provided Hur with all his files, including his extensive private notebooks and submitted to a lengthy interview. Now we all know what would happen had DJT been president and on the hot seat for classified material he retained. He would have shut any appointment of a Special Counsel or other DOJ investigation before it even got started!
What is pernicious about Hur’s report is that it lends support for the MAGA Republican’s claim Biden is unfit for office. Hur goes way out his mandate as Special Counsel. His disinclination could have been summed up in 5 pages without any personal opinion that a “sympathetic” jury would not convict Biden because of what amateur psychiatrist Hur thinks are Biden’s age and related mental infirmities.
So Hur’s report is going to provide grist for the MAGA Republicans to keep this controversy going for the entire year. I suspect Jim Jordan, Chair of the Judiciary Committee, will hold hearings and call Hur and AG Garland to testify about their decision not to prosecute Biden. Jordan may even call sympathetic psychiatrists to testify that Joe Biden lacks the mental capacity to govern. And I suspect you will welcome such hearings. Why? Because you say there is concern over “Biden’s fitness is legitimate”. Then you add that “it will take more of a showing to establish a case for his removal under the 25th Amendment.” What might the “showing” be? Well, extensive hearings by Jim Jordan naturally. It’s the same way you framed the impeachment inquiry. At Comer’s first hearing you testified that based on the existing evidence you found no reason for impeachment. But ever since you have endorsed Jim Comer’s continuing investigation hoping he would find the smoking gun. He hasn’t.
But, hey, I understand. It’s election season and the MAGA supporters of DJT are desperate to find anything to deep six Biden’s candidacy. They can’t rely on Jim Comer’s impeachment inquiry because that has gone nowhere. So it’s now Hur’s report that the MAGA republicans, like Jim Jordan, will latch on to as the next gold mine for attacks on Joe Biden. Hur has provided the arrows and the MAGA Republicans in the House will furnish the bow. It’s hunting season and Joe Biden is the target! And it’s not so much about actually impeaching Biden or finding he is unfit to govern under the 25th Amendment. It’s about trying to convince voters that Biden is unfit for the Presidency. But that requires distorting the facts and a lot of innuendo. I just hope voters won’t fall for that ploy.

We are at a point where the alignment between what people say, and reality, has not relevance. IOW, people can just say whatever they want regardless of it being ridiculously false, and they consider that to be just as valid and valuable as telling the truth.
The best evidence of the above is that there are commenters on the blog today who actually have the “face” to deny that Biden is in significant cognitive decline, and they’ll defend that position vigorously. It is not some kind of cognitive impairment and memory loss test that we need to address.
It is what the rest of the world leaders are seeing and how they react.
Just look at the global chaos, instability the Biden admin has produced. Had our enemies have acted with a strong WH admin, not saying it could of been Trump. Could of been Tulsi Gabbard, RFK Jr. even Nikki Haley. Any one with a degree of competence.
But that is not what we got with the Biden admin. We got weakness. Incompetence. It is obvious to our allies, our enemies and even our friendenemies. And they are taking advantage of the situation.
Unfortunately, I am of the opinion that the Biden admin has done such a large degree of damage a Trump admin will not be able to fix it. But it is public knowledge that President Trump worked for months to declassify ALL of the Russia hoax documents. Weeks later they would send back unmarked documents , heavily redacted. Trump would again demand an unredacted set of documents. Again he would get a copy with fewer redactions, but no clean documents. By then he just packed up the marked set he had and moved them to MAL.

I don’t have to. The warrant is overbroad. Its going to be hard for an honest judge to allow the evidence period. But you cant challenge the warrant until the prosecution tries to present evidence. That is the check. You cant challenge a warrent until the product of the warrant show up in trial. Much the same with the determination of classification. Until evidence is presented, it cant be challenged.

The Presidential Records Act was passed as a way to restrict the rights of the outgoing POTUS.
I seem to recall that there was some question as to the Constitutional validity of that Act. It has never been reviewed by SCOTUS.

It depends on whether Democrats actually want Biden gone. If they do, Biden will be removed.
Turley is correct that it is difficult ot remove a sitting president using the 25th amendment if they do not wish to be removed.
It is harder than impeaching them. EXCEPT that it does not have the same stigma as impeachment and removal.
I think it is unlikely that Biden will be removed under the 25th amendment – but all that is necescary to do so is for democrats to decide that want Biden gone.
It is remotely possible that Republicans will balk at a 25th amendment removal, in favor of impeachment, and see if they can get democrats to remove Biden by impeaching him.

The tests can’t be rigged against him, and if Biden fights it, his medical records could be made ‘public’ or rather outside doctors could be brought in to review them.
