Hunter Biden Goes Full Trump in a Flurry of Court Filings

Below is my column in Fox.com on the flurry of recent filings by Hunter Biden who appears to be channeling Donald Trump in his attacks on prosecutors, whistleblowers and the media.

Here is the column:

Last week, some of us were struck by how Fulton County District Attorney Fani Willis seemed to morph into the man she is prosecuting in Georgia. In her mocking, combative testimony February 15, Willis lashed out against the media, the lawyers and many in the public for questioning her ethics in hiring her former lover as lead prosecutor. Where former President Donald Trump was roundly condemned for such testimony in court, Willis was celebrated by many as showing that she is a “great lawyer” and righteous champion.

Now, Hunter Biden also seems to have gone full Trump in court and no one appears to have noticed. In a flurry of motions, Hunter is seeking to dismiss indictments in two states. However, his arguments are strikingly familiar.

He is challenging the appointment of the special counsel, alleging selective prosecution and raising strategic leaks as reasons to strike all of his pending charges. The motions are ripped from the pages of Trump challenges, which were widely panned by the media. No longer.

Hunter has filed a flurry of nine separate motions seeking to dismiss charges against him. His arguments included challenging the authority of special counsel David Weiss as improperly appointed. Hunter maintains that “this prosecution is not legally authorized because David Weiss was unlawfully appointed as Special Counsel and Congress has not appropriated funds for the Special Counsel’s investigation or this prosecution.”

He argues that DOJ regulations instruct the attorney general to appoint a special counsel from outside the government, but Weiss was working as U.S. attorney for Delaware.

During the recent Trump appeal in Washington, there was also a claim that Special Counsel Jack Smith’s work was unconstitutional, though the challenge was based on the absence of an authorizing statute.

Hunter is also arguing selective prosecution and that the Justice Department caved into political pressure to target him despite a lack of criminal evidence. Much like Trump, Hunter is also arguing that leaks showed the bias and hostility of the Justice Department against him.

At the same time, Hunter is pursuing a challenge to the underlying gun law that his father has championed as strengthening gun control laws. Worst yet for many on the left, Hunter is adopting an argument from the National Rifle Association (NRA) and other gun rights groups in calling such laws unconstitutional under the Second Amendment.

Hunter is pursuing the arguments from Bruen v. New York Rifle & Pistol Association, which his father has condemned. He insists that requirements that you not be an actual drug addict run against the history and tradition of the Second Amendment.

If he pushed forward on these claims, Hunter Biden could face opposition from the Biden administration in seeking to expand Second Amendment protections in court. Yet, if successful, he would be the first Biden to be honored by the NRA.

Hunter is also adopting one of the most criticized practices of Trump in attacking the whistleblowers who came forward with allegations against him. Where Trump attacked the whistleblowers in the Ukraine controversy, Hunter has attacked IRS whistleblowers Gary Shapley and Joseph Ziegler.

Hunter is also arguing selective prosecution and that the Justice Department caved into political pressure to target him despite a lack of criminal evidence. Much like Trump, Hunter is also arguing that leaks showed the bias and hostility of the Justice Department against him.

Of course, adopting the same arguments and rhetoric of Trump does not make you Trump. That appears the critical distinction for many in the media, as it was for Willis. These arguments are being soberly analyzed on media platforms where Trump’s prior arguments were categorically rejected.

The only thing that remains is for Hunter to declare that he is only trying to Make America Great Again by nullifying independent counsels and expanding the Second Amendment. Indeed, it could be the start of a Biden MAGA movement.

    1. Viva misses an important point. It is irrelevant WHEN Smirnov met with Burisma executives.
      It is irrelevant that Joe Biden was no longer in public office.

      All that matters is what was said in the meeting with Smirnov.

      Smirnov claims that Zolochevsky told him that he had Bought Joe Biden – PAST TENSE. Not that he was about to Buy Joe Biden.

      If the “lie” is the timing – – that is NOT material to Smirnov’s allegation.

      Over the past year various associates of the Biden have been testifying about what occured IN THE PAST involving Vice President Joe Biden.
      All of this testimoney is AFTER the fact.

      Most of it is about conduct while Joe was president.

      I would note that Viva citing the portion of the indictment that says that the FBI allowed Smirnov to engage in criminal conduct is VERY SIGNIFICANT.

      All executive power int he united states is PRESIDENTIAL POWER. I have no idea whether President Obama signed off on Smirnov’s criminal acts, or whether he delegated the authority to do so to DOJ/FBI – but the FACT is that directly or indirectly this indictment CONFIRMS that presidents have the constitutional power to violate the law – or to authorize others to do so.

      Put more simply – Trump is ABOLUTELY correct in his arguments regarding presidential immunity.

      That immunity does not mean that no indictment is ever possible.
      It DOES mean that neither the president nor anyone authorized by the president, nor someone authorized by an agent of the president can be convicted of a crime committed acting under the authority of the president without FIRST establishing that the alleged criminal act is not a legitimate excercise of the powers of the president.

      To repeat that MUST occur BEFORE any indictment.

      WE can debate precisely how that process of overcoming immunity occurs – the strongest claim is that impeachment by the house and removal by the senate is required PRIOR to indictment.

  4. I find it amazingly laughable that the FBI and DOJ trot out this indictment of their own reliable informant and the Democrat goobers drool on themselves. Do they not have the cognitive ability to see the parallel of the Steele/Clinton dossier? I wonder if this was a set up surprise from day one. Looking at the shell companies, the bank records, the loans and the wealth that Joe and the Biden family has accumulated leaves little doubt in anyone with logical thought of their corruption. I would have to believe there is plenty enough evidence to impeach that demented old tool.

    2. The indictment confirms that the meeting with Zolochevsky took place.

      The indictment alleges that Smirnov lied about the date the meeting occured – which si NOT a material fact.
      Smirnovs reported this to the FBI in 2020 – that is the date of the 1023.

      Smirnov was NOT reporting an attempted bribe – but hearsay evidence of a COMPLETED bribe.

      There appears to be only one place int he indictment that claims that Zmirnov did NOT hear what he reported, – and that provides NO basis for that conclusion. We do not have Zolochevsky testifying that he did not bribe the Bidens – and that would not be credible if they did.

      This indictment is typical of the garbage we see from left wing nut lawyers – gaming timelines.

      NO ONE – including Smirnov is claiming that zolochevsky bribed Joe Biden in 2017.

      Smirnovs claim is that Zolochevsky told him about a bribe to Hunter and Joe AFTER the bribe occured.

      There are enormous questions here – including is the DOJ/FBI engaged in an attempt to obstruct congress by indicting Smirnov.

      It is stuff like this that is why no one trusts you (or FBI or DOJ).

      It is likely that Smirnov is a scurrilous character – the indictment notes that the FBI authorized him to commit crimes in order to get useful intelligence.
      It is likely that he is a liar – most CHS’s are. The FBI does not hire nuns to get information on Putin.
      It is actually fairly normal for CHS’s to lie to the FBI – that is why the FBI assesses them – and TWO different FBI field offices found Smirnov HIGHLY CREDIBLE – one of the highest paid FBI information for over 14 years. That means they found his intelligence to be valuable.
      It also means Smirnov has good reasons to tell the FBI the truth, that reason being the FBI is not likely to pay him if his evidence proves false.
      It is absolutely certain that Smirnov met with Russians – the FBI does not use CHS’s to spy on nuns.
      It would be unusual if Smirnov was NOT meeting with scurilous people – people the FBI can not get information from directly.

      He is saying that the arguments made by the defendants are nearly the same.

      A person can protest their own innocence and argue they are being frame as vigorously when they are guilty as when they are innocent.

    A certain law professor we all know has frequently ridiculed claims that the Hunter Biden laptop story was somehow linked to Russian operatives.

    But it seems the Hunter Biden probe largely rested on testimony by FBI informant Alexander Smirnov who was indeed a tool of Russian Intel. However House Committee Chairman Jim Jordan today vehemently denied that Smirnov’s arrest threatens the Biden case.

    1. BugAnon – please tell us how the “Hunter Biden laptop story was somehow linked to Russian operatives.” Did they buy the laptop for Hunter? Did they tell him to take to MacIsaac’s repair shop? Did they tell him to leave there on purpose? Did they copy the hard drive and give it to Rudy Guiliani? What exactly are they supposed to have done?

      Smirnov is a FBI CHS over the course of 14 years – starting in the late Bush administration.

      I would note that the Indictiment itself CONFIRMS that Smirnov met with Burisma executives.

      As to your idiotic aside regarding the Hunter Biden laptop.
      I would recommend Glenn Greenwalds reporting from Oct 2020 regarding how to know that the contents of the laoptop are NOT russian disinformation – except that we are way past that – the FBI has confirmed the laptop is Hunters, Hunter’s attorney’s have confirmed it is Hunters.
      The media has admitted that it is Hunters.

      Further the various Russia collusion Russia disinformation naratives of the left fail the test of critical thinking.

      Most intelligent people have known from the start that Putin wanted Clinton to win in 2020.
      Over time CIA assessments done in 2016 by the CIA have managed to surface demonstrating that the FBI KNEW that Putin wanted Clinton to win.

      But more recently we have found that BEFORE the Steele Dossier – the FBI contacted foreign intelligence services to conduct active spying – to CONTACT 26 different Trump associate and to make it look like they were colluding with Russia.

      More recently another ATS here – or maybe you gleefully reported that Putin had endorsed Biden as if that was a surprise to anyone.

      I do not think that the engagement of Russia in the 2016 or 2020 election was of any consequence. There is no evidence that Russia engaged in anything of consequence.

      BUT the evidence IS that whatever Russia did it was to aide whoever was running AGAINST TRUMP

      So No, I do not beleive that Russian agents fed Smirnov a damaging story about Joe Biden. That would require beleiving that Putin acvtually wanted Trump to win – which is a beleif only a complete moron could hold.

      Can we be Clear – Burisma was an Energy company run by a Russian Ologarch.
      It was not in Putin’s interest to make Burisma look corrupt – BTW Burisma’s corruption is also something we are way past.
      So Lets be clear
      Burisma is Russian affiliated
      Burisma is corrupt.
      Burisma hired Hunter Biden (as did other Russian oligarchs).
      Shokin was investigating them.
      Hunter was actively working to stop that.
      Hunter and the Biden syndicate were paid to end the investigation.
      VP Joe Biden got Shokin fired.
      Burisma benefitted
      Russia benefitted.
      The Biden’s got paid.
      The US did not.
      Ukraine did not.

      Was Smirnov told any or all of the above by Burisma executives ? You can decide that for yourself.
      Smirnov does NOT make the case that Biden is corrupt.
      He corroborates it.

      Persopnally I suspect that Smirnov has lied to the FBI many times – that is the nature of being a CHS.
      He has also told the FBI enough that was worthwhile to them to pay him well.

      Was he lying about his meetings with Burisma executives ? I doubt it, and the indictment does not make that case.

Abbe Lowell even noted one of her columns in one of his motions, referencing the fact that SC Weiss had falsely presented a photo of sawdust to substantiate a claim that HB was using cocaine on a particular date. It’s a pretty funny mistake. Lowell’s comment about it was that “Mistaking sawdust for cocaine sounds more like a storyline from one of the 1980’s Police Academy comedies than what should be expected in a high-profile prosecution by the U.S. Department of Justice.”

        Myriads of people have protested elections and claimed fraud int he past almost all of them democrats. Democrats have tried – and even succeeded in “finding votes” – see Coleman Franken – it took over a year for Franken to “find” enough votes to overturn the election.
        In my lifetime EVERY SINGLE ELECTION that was won by a republican had its certification challenged in congress BY DEMOCRATS – including alleging voting machine fraud. Hillary sought to and succeeded in getting a few electors to change their votes. Alternate s;ates of electors have been offered by democrats in numerous elections.
        NONE of this has ever resulted in a criminal prosecution before.

Once this election is over, win or lose, Hunter’s Dad will still be President for a period of time and can pardon him and nothing Turley can do about that. Really, who is going to complain about a pardon now that the central whistleblower has been shown to be a Russian propagandist.

      Smirnov was an FBI rated highly reliable CHS since 2007. His report on the Biden’s was received by the FBI in 2020. But it did not reach the Senate until a few weeks ago.

      The investigation of the Biden’s started LONG before that.
      Smirnov is not central to anything. He was a strong corroborating evidence.
      He remains that as the indictment spends most of its time trying to defend Joe Biden – rather than prove a crime by Sminov.

      The allegations against Smirnov are that he got the date of the meeting with Burisma wrong – if True that is immaterial.
      That he did not hear what he reported – as there is no recording of the meeting and none of the others we know are present could be trusted to admit they were part of a bribery scheme DOJ is unlikely to succeed in this claim anywhere but DC.
      That Smirnov met with Russian intelligence … DUH ? pretty much a no brainer. He IS a CHS. The FBI did not pay him to meet with nuns.
