Below is my column in the New York Post on the indictment of Alexander Smirnov and the use of the charges by Hunter Biden to seek to dismiss his own charges. That dog won’t hunt.
Here is the column:
The Russian comedian Yakov Smirnoff once joked that “in America, you can always find a party. In Soviet Russia, the Party can always find you.”
Alexander Smirnov is no comedian, but he is about to discover the truth of that statement.
Alexander Smirnov is now a defendant in federal court after being charged by special counsel David Weiss for spreading a false story about Hunter Biden receiving $5 million from Burisma, the Ukrainian energy company.
The allegation has produced a stampede of Democrats who view his indictment as a much-needed talking point as the House continues to build the case of influence-peddling by the Biden family.
Some are using the charges to revive a previously debunked story that Hunter Biden’s laptop could be Russian disinformation. But a closer reading of the filing dispels those claims and contradicts a new effort by Hunter Biden to dismiss charges against himself.
The filing itself is actually an argument to keep Smirnov in federal detention.
The government points out Smirnov’s admitted contacts with Russian intelligence officials and previously scheduled meetings with such figures to argue he is a flight risk.
However, there are a couple of aspects to the filing that undermine the claims of a “bombshell” revelation of a Russian disinformation campaign. First, these disclosures were not the result of surveillance or interceptions by American intelligence. Smirnov appears to have been cooperating with the United States and told his US “handler” about all of these contacts.
Second, Smirnov’s contacts were described as “recent” and did not apparently precede 2020. They have nothing to do with the laptop or the evidence of influence-peddling found in emails on that computer. This is solely a claim of a large payment to the Bidens from Burisma.
Third, the Justice Department states that Smirnov had expressed “bias” against Joe Biden and used “his routine and unextraordinary business contacts with Burisma” to make the bribery allegations.
So Smirnov operated off a bias against Biden, made an allegation separate from the laptop, and ultimately disclosed his communications to his U.S. handler. He detailed conversations with the “son of a former high-ranking government official” and “someone with ties to a particular Russian intelligence service.” Reports indicate that Smirnov was not only an asset of American intelligence but on the payroll for roughly a decade as a trusted informant.
That does not mean that the Russians were not eager to spread false claims, though it shows again how low-grade such efforts could be. It does not address hundreds of confirmed emails of Hunter Biden cashing in on an array of foreign contacts.
Hunter Biden’s legal team is citing the filing in seeking to cast doubt on all of the allegations and even the pending charges: “It now seems clear that the Smirnov allegations infected this case.”
They insist that the bribe allegation was key to the loss of the plea agreement that they struck with the president’s son. They argued that “having taken Mr. Smirnov’s bait of grand, sensational charges, the Diversion Agreement that had just been entered into and Plea Agreement that was on the verge of being finalized suddenly became inconvenient for the prosecution, and it reversed course and repudiated those Agreements.”
That is not how it happened.
Hunter Biden had received a sweetheart deal so rich as to put most defendants into hyperglycemic shock. Hunter would have avoided any jail time and been given sweeping immunity from future charges.
The reason that the deal fell apart was not any particular allegation of bribes. The alleged bribe was not part of the case. It fell apart because the judge asked a simple question on the meaning of the immunity. The deal immediately imploded as the prosecutor was forced to admit that he had never seen a deal like this for anyone other than Hunter Biden.
In relation to the influence-peddling investigation, this filing does not change the evidence that the Biden family made millions in shaking down foreign companies and business figures.
On Wednesday, Capitol Hill will witness something that many thought would never come. The House is calling a Biden to actually answer questions under oath about influence-peddling. James Biden, brother of the president, will testify on his long history of leveraging the name and influence of his brother. That includes $200,000 given to him by a collapsing hospital chain company, Americore.
Biden reportedly pitched a percentage deal with his brother and immediately turned over the money to Joe Biden to pay off a prior “loan.”
That was not the creation of a “biased” Russian but the Biden family itself. Smirnov was not at the dinners and meetings where Joe Biden called in to chat. He was not the recipient of messages from Hunter threatening that his father was “sitting next to” him and waiting for transfers of money. He was not the source of gifts and expense accounts to cover Hunter’s lavish lifestyle. .
Most importantly, Smirnov was not the reason that Hunter was indicted by the same prosecutor, David Weiss, who just indicted him.
This is all right out of the Clinton playbook.

Donald Trump is his own worst enemy and he constantly feeds the media with more and more fodder for them to feed on. While he may stretch the truth, he is nowhere close to being a serial liar like Joe Biden. Since 1987 when he first declared candidacy for POTUS, he has filled the airwaves and print media with lie after lie after lie. He was unceremoniously kicked out of the race when his lies and plagiarisms were broadcast for the nation to witness. He has lived a lie all of his life and his Corn Pop allegations are an indication of his dishonesty. Yet, he has remained in office, grown in stature in the Democratic Party, elevated to the position of VPOTUS and now, POTUS, a disaster that seems to have no boundaries of the destruction of the core of this nation fomented by his benefactor, Obama.
Therefore, the ones who wish to bring the Biden family down should abandon the quest and concentrate on legislation that will actually benefit this nation as a whole. The only way Biden changes his(?) message is to don the cloak of concern and attention to the actual problems the majority of citizens of this nation face every day. Evidenced by the fact that it took one year before he made a visit to Palestine to meet with the remaining residents of the town after the derailment disaster.
Instead of trying to extract revenge, the efforts should be to engage in doing what is best for this nation. At this point, given the advantage Democrats, etc., have when it comes to effective messaging, Republicans and conservatives should be concentrating on the issues of immigration, inflation, and issues that directly affect everyone, including the Democrats who still have a modicum of reasoning and critical thinking.

I am not surprised that politicians soften criminal terminology with euphemisms. For example, “influence peddling” is bribery. The bribery payments are “undocumented loans.”
It doesn’t seem to matter to them that there are no structured loan documents that follow IRS guidelines nor any obligation to repay the “loans.”
Foreign countries, oligarchs and shady businessmen don’t give millions of dollars to. Politicians and their families with no expected return.

How about these people who lied to the FBI?…..Andrew McCabe……Christopher Steele. Why no arrests? Why no prosecutions? McCabe’s case was the most outrageous….lying to an internal investigator to cover one’s ass for leaking case info to a sympathetic media ally (Devlin).
We need a backup system to the DOJ when they refuse to prosecute obvious lawbreaking….some kind of civil suit that can obtain a verdict, even if liable for committing an unprosecuted crime.

There are two counts: knowingly and willfully making a materially false statement to the government about Hunter Biden and Burisma, and causing the FBI to create a false 1023 with intent to obstruct an investigation.
And the FBI and DOJ never lies… of course.
Just like they never put the squeeze on someone to change their testimony, or throw anyone under the bus to help cover something up.
A few things on the Smirnov indictment:
1. The 1023 was buried by Weiss and the DOJ/FBI from mid-2020 to Spring 2023. Only then did they begin to investigate it, when it was about to become public. So, for years, DOJ/FBI turned a blind eye to allegations from their own trusted CHS that Biden had been bribed by Zlochevsky. Think about that.
2. Whether the allegations in the indictment are true remains to be seen. If Smirnov disappears or pleads guilty we will never know.
3. The allegations of Smirnov’s contacts with Russian intelligence sources do not relate to his allegations in the 1023.
4. The 1023 forms no basis of the evidence against Biden being assembled by the House committees. They have established that the Bidens were paid millions for access to Joe Biden when he was VP and that Joe Biden himself helped market the “brand.” What they have yet to establish is that Biden used his office to benefit his paymasters. Here, the Shokin firing appears to be the best lead, but the evidence so far, though substantial, is not enough to persuade everyone.
What I love is how the paid shills here, completely ignore whatever Turley writes. I wonder, do they even read what the article says? I suspect not. Turley wrote, above:

The House committees have not used the 1023. How have they done so?
The Ambassador’s testimony was about whether Shokin should be replaced. It was not about conditioning the loan guarantee on that. When Biden imposed that conditionality he violated US policy.
Clearing up the Biden mess this way: subpoena the Senate Sergeant at arms encrypted phones (and the servers) these crooks have been using to run their operations. The first thing the FBI does when they detain someone is to get their phone — that happened to Lindelll last year. If that happened it would bust DC wide open and people would see how corrupt the entire Congress is. Meanwhile we beat around the bush with crack pics and laptop emails. The real story is on those encrypted phones and on the servers.

You DID self-identify on your blog as to why you’re really here earlier commenting on Turley’s column/blog: I hear their baseless arguments and talk about them elsewhere. Unfortunately, these people are largely upper class, many in the legal profession, most would resent being called white trash. Ore man bolstered his racist argument by saying he was a lawyer therefore he is in the position to judge the claims of racism of others as illegitimate.
You’re short on subjects i.e. economics, worth blogging about you need to come here and accuse Turley of lying to Congress. Not a good look for attempting to represent Americans who happen to be black as well as allegedly intelligent.
How about revisiting your blog where you claimed Trump had the White House for sale if you’re short on material worth writing about? That kind of seemed like you were lying to your readers: of all the things Soviet Democrats have attempted to criminalize about Trump, they have yet to figure out a way to tag him with attempting to sell the White House.
Given your interest presidents (and maybe vice presidents?) selling the White House, perhaps you can redeem any shred of honor and credibility you have left by writing about The Big Guy, Bribery Biden, and how he was selling the White House LONG before Trump ever entered office. Remember this ending to that claim of yours? “Government service is supposed to be honorable; serve your country for a few years at a government pay scale and perhaps you go on to make real money afterward”? Despite their claims, this is not a Vampire movie, where Smirnov is the daddy of all the other vampires, and even if they drive a stake thru Smirnov’s heart, the other accusers are not going to go up in a puff of smoke, or whatever.
The big problem is the allegations of bribery which are the ones that Biden can be impeached for are no longer valid. The other allegations are not crimes or illegal. Influence peddling is not a crime. The committee still has no evidence to impeach Biden. Comer has admitted as much still. All that’s left is Hunter’s testimony. It’s very likely there won’t be an impeachment vote at all.

I have noticed some of my comments disappear from time to time. I figured it was me, going over the line. I did not consider that it was the shill comment being disappeared. Thank you for alerting me to that! I will learn my way around in time.
And as far as the shills, it is probably a blessing that they are as bad at their job as they are. They are too simplistic, and simply deny something that is evident to all. Plus, some of them are childish. Goebbels would fire them, and replace them with better-trained mouthpieces.

However, there have been times when I make a comment and it does not go through. I call it a server hic-up. Or the server is taking on a large volume of comments.
I have moderated for a blog on Word Press before. I have seen it happen.
