The Odor of Mendacity: 2024 Could Turn on Smell of Selective Prosecution from Georgia to New York

Below is my column in the Hill on the recent decision in Georgia and the “odor of mendacity” rising out of various courtrooms across the country.  It is the smell of not just selective prosecution but political bias in our legal system. It is becoming harder to deny the existence of a two-track system of justice in the country as commentators and even a few courts raise concerns over the role of politics in prosecutions.

Here is the column:

The removal of lead special prosecutor Nathan Wade from Donald Trump’s prosecution had the feel of a Southern Gothic.

Fulton County, Ga. District Attorney Fani Willis had described Wade as “a Southern gentleman. Me, not so much.” For weeks, the public has been enthralled by accounts of Wade’s illicit affair with Willis. Then there was the roughly three-quarters of a million dollars paid to Wade before he was booted from the case this week.

Channeling Tennessee Williams in his play “Cat on a Hot Tin Roof,” Judge Scott McAfee wrote that, after their testimony, there remained “an odor of mendacity.”

That odor was particularly strong after the hearings indicated that Wade may have committed perjury in his earlier divorce case, and that both Willis and Wade were credibly accused of lying on the stand about when their relationship began.

They are prosecuting defendants in the Trump case accused of the same underlying conduct, including  19 individual counts of false statements, false filings or perjury.

Yet, that distinct odor noted by Judge McAfee goes beyond the sordid affairs of Willis and Wade.

For many citizens, mendacity, or dishonesty, is wafting from various courtrooms around the country. The odor is becoming intolerable for many Americans as selective prosecution is being raised in a wide array of cases.

The problem is that courts have made it virtually impossible to use this claim to dismiss counts. Yet there is a disturbing level of merit to some of these underlying objections.

For years, conservatives have objected that there is a two-tier system of justice in this country. I have long resisted such claims, but it has become increasingly difficult to deny the obvious selective prosecution in a variety of recent cases and opinions.

I have long stated that the charges against Trump over documents at Mar-a-Lago are strong and based on established precedent. However, the recent decision of Special Counsel Robert Hur not to bring criminal charges against President Joe Biden has undermined even that case.

Hur described four decades of Biden serially violating laws governing classified documents. The evidence included Biden telling a third party that he had classified material in his house and actually reading from a classified document to his non-cleared ghostwriter. There is evidence of an effort to destroy evidence and later an effort of the White House to change the report. There is also Biden’s repeated denial of any knowledge or memory of the documents found in nine locations where he worked or lived.

Hur ultimately had to justify the lack of charges based on a belief that he could not secure a conviction from a D.C. jury with an elderly defendant with diminished mental faculties.

Although Special Counsel Jack Smith could still proceed on obstruction counts, his prosecution of Trump for the retention and mishandling of national security documents is absurdly in conflict with the treatment Biden is receiving.

In New York, the legislature changed the statute of limitations to allow Trump to be sued while New York Attorney General Letitia James effectively ran on a pledge of selectively prosecuting him. She never specified any particular crime, just promising to bag Trump.

Ultimately, James used a law in an unprecedented way to secure an absurd penalty of roughly half a billion dollars, even though no one lost a dime because of the Trump loans.

Manhattan District Attorney Alvin Bragg has also come up with an unprecedented way of using a state law to effectively prosecute Trump for a federal offense that the Justice Department has already rejected.

The same odor has been lingering in the Hunter Biden cases. The Justice Department had reached a ridiculous plea agreement with Hunter Biden that would have allowed for no jail time and a sweeping immunity agreement that would have protected him from all of his other alleged crimes.

As the plea agreement fell apart in court, the prosecutor admitted that he had never seen a defendant given such a deal over his long career. This came after the Justice Department had allowed the statute of limitations to run out on major felonies and scuttled efforts to conduct searches and interviews. Even after that embarrassing hearing, the Justice Department was still trying to preserve the agreement.

It is not just the Trump and Biden cases where there is a stench of selective prosecution. Consider a few other recent cases.

In California, U.S. District Court Judge Cormac J. Carney issued an opinion that found such evidence of selective prosecution against conservative groups. In considering a far-right group, Carney noted that the Justice Department has had sharply different approaches based on the political views of the defendants. Antifa and other leftist groups often see charges dropped, whereas federal prosecutors seek draconian sentences against conservative defendants.

“Such selective prosecution leaves the troubling impression that the government believes speech on the left more deserving of protection than speech on the right. The government remains free to prosecute those, like Defendants, who allegedly use violence to suppress First Amendment rights. But it cannot ignore others, equally culpable, because Defendants’ speech and beliefs are more offensive. The Constitution forbids such selective prosecution,” Carney noted.

That treatment was equally glaring when federal prosecutors convicted an Antifa supporter who took an ax to the door of Sen. John Hoeven’s office in Fargo. He was given no jail time, and the FBI even returned his ax.

He later mocked the government by posting on social media “Look what the FBI were kind enough to give back to me!

Likewise, this week, former U.S. Attorney Rachael Rollins was disbarred after being found to have lied to investigators about leaking material to the press for political purposes. Rollins had allegedly made a clear and knowingly false statement to federal investigators, but the Justice Department just shrugged it off and refused to indict.

FBI Director James Comey received similar gentle treatment after removing FBI material and arranging for information to be leaked to the media. Meanwhile, defendants such as Trump’s National Security Adviser Michael Flynn were pursued relentlessly for making false statements to investigators under Comey’s watch.

These and other cases have fulfilled Trump’s narrative about a politically weaponized legal system. The fact is that many in cities like New York are thrilled by selective prosecution and biased sentencing decisions directed at locally unpopular figures.

The rest of us are left in courtrooms, from Georgia to Washington to New York, asking the same question of Tennessee Williams’ “Big Daddy” Pollitt: “What’s that smell in this room? …Didn’t you notice a powerful and obnoxious odor of mendacity in this room? There ain’t nothin’ more powerful than the odor of mendacity.”

    1. Justice Jackson, Uh, that is, quite literally, the entire point of the First Amendment—of the entire Bill of Rights.

  2. The modern left have mendacity as their first rule. Another poster shared that communists do not willingly give up power and I tend to agree. I do not know what we do or where we go from here in the West. Trump is going to win, just as he did in 2020, and this time I am not convinced people will just accept the mendacity, and it remains to be seen what means; and that is professing January 6th was an orchestrated farceto the nth degree.

    One thing is for certain: had Hillary taken office in 2016, we would have already lost our rights, the courts would already be packed, and we’d be whistling in the dark like the people in Canada or the UK. most of us posters here would likely be in jail. And that is real, happening right now. Thank the gods for the interruption Trump brought, if nothing else. I am voting for him in 2024. The modern left has got to go. Vote for everything, folks, and if you live in a state with mail-in ballots, go in person and actually watch your ballot being fed into the machine, because we have no way of knowing what people just throw into the trash otherwise.

I know that we have a wide, wide variety of folks here, from lawyers, to government employees, to veterans (and thank you ALL for your service), to people like me that have just dipped into those environments but care; stop being afraid.   3. Jonathan: From GA to NY you now fall back on the false claim we now have a “two-tier system of justice in this country” and DJT is the victim of “selective prosecution”. A close scrutiny of some of the cases you cite shows just the opposite.

    1. The RICO case in Ga: You first start with a spurious claim about the Willis/Wade relationship–falsely claiming it was an “illicit” and “sordid” affair. These descriptions usually refer to incestuous or affairs between married people. Cambridge defines sordid” as “unpleasant, dirty or immoral”. Neither applies to Wade or Willis. Wade was in the middle of a messy divorce and had not lived with his wife when he and Willis got romantically involved. Willis was single. Their was nothing “illicit” or “sordid” in their affair!

    Then, as to Wade’s compensation he earned every penny when he was hired by Willis to prosecute the RICO case DJT and his co-defendants. The recommendation by the special grand jury and the indictments by the grand jury are proof positive of Wade’s hard and long work. Wade even successfully prevented Mark Meadows and other defendants from removing their cases to federal court. That shows the professionalism of Wade’s work.

    And Wade made only $250 an hour–far less than he could have earned in private practice. That shows Wade’s commitment to public service. Wade’s only misstep was to get involved in a romantic relationship with his boss. But that affair did not distract from Wade’s diligent prosecution of the cases against the RICO defendants–and why Willis profusely commended Wade for his hard work when he was forced to resign.

    2. Hur report: You strike out on this one too. This was not a case of “selective” non-prosecution. In his report Hur found there was no basis to charge Biden because, unlike the DJT, the President did not hide docs or obstruction Hur’s investigation. Biden even sat down for a long interview and answered all of Hur’s Qs. In his report Hur says prosecuting Biden would be difficult because Biden’s advanced age and memory lapses would make him a “sympathetic” defendant. But Hur had to admit in his Congressional testimony that Biden had a “photographic” memory. Kind of contradicts Hur’s claims in his report. Now as a Republican appointee, I think Hur would have liked to prosecute Biden but, bottom line, there was no legal basis for a prosecution.

    This also puts the lie to your claim that Jack Smith’s case against DJT “is absurdly in conflict with the treatment Biden is receiving”. DJT was charged because he refused to turn over all the classified in his possession, stalled for over a year before he turned just 38 of those docs, moving the rest around Mar-a-Lago and other places to avoid detection and then tried to delete the video tape that showed what he was doing. Biden didn’t do any of that!

    3. NY AG Letitia James case: This is the most ludicrous of your assertions of “selective prosecution”. James charged DJT and his companies under NY’s CIVIL fraud statute. The was no “crime” charged! And there was no “selective prosecution” of DJT. James routinely files cases against other NY companies that engage in systematic financial fraud. DJT was the most visible because his financial fraud was so vast and covered many years.

    And why do you echo DJT’s main defense in the case that “no one lost a dime [the banks] because of the Trump loans”? That defense went nowhere with Judge Engoron. Why? Because James brought her case on behalf of the PEOPLE of NY who were defrauded when DJT got favorable loans, using false financial statements, that other customers could not get because they played by the rules.

    And how do you explain the criminal prosecutions of Hunter and Dem. Senator Melendez? No “selective prosecutions” there. If DJT was President do you think he would allow his AG to bring criminal prosecutions against either Eric or Don Jr.? DJT would shut them down before they saw the light of day! In his campaign swings DJT says he is going to prosecute Liz Chaney and the rest of J.6 Committee for their report. It’s all about vengeance. And DJT says he will put reporters in jail if they don’t reveal the sources of their unfavorable stories about him. Now that would be “selective prosecution” in spades!

    If you believe DJT version he is the victim of “selective prosecution” by “racist” prosecutors–like Fani Willis, Letitia James and Alvin Bragg–all BLACK prosecutors. DJT knows how to play the race card when it serves his purposes. In the end, when all else fails defendants frequently claim “selective prosecution” as a defense. It rarely works and it won’t work for DJT. And it won’t work for you either!

Trump inherited his wealth then put it to work in real estate, many business ventures, and so forth. But the Clintons and Obamas are everything Karl Marx decried about the bourgeois and yet here we are.

Sometimes, the things Turley writes are so absurd as to be laughable–to wit: calling the relationship between Wade and Willis “illicit”–what about Trump’s sexual liaisons with Stormy Daniels and others and the affairs that ended his marriages to Ivana and Marla (in fact his affair with Marla ended his marriage to Ivana, and his love child, named “Tiffany” attended her parents’ wedding). He nailed Daniels by luring her to his hotel room on the pretext that he would discuss financing a film she wanted to produce, because she wanted to move from in front of the camera to behind the camera by being a producer instead of a performer. This happened when Melania was giving birth to Baron. Wade testified that he and his his wife agreed that their marriage was over emotionally, if not yet legally, because his wife had been having an affair with another man. Wade and Willis’s relationship was far less “illicit” than the behavior of Trump, who, in addition to his extra-marital affairs and lying to get Stormy Daniels to his hotel room on a false pretext, was found to have sexually assaulted E. Jean Carroll because she teased him about trying on womens’ lingerie. Then, there’s the bragging about “puxxy grabbing” and kissing women he finds “beautiful” because he believes himself to be entitled.

      Turley also tries to claim that the State of New York changed the statute of limitations for sexual assaults just to bag Trump. The window allowing for formerly stale claims to be brought applies to anyone and everyone who might have sexually assaulted someone–not just Trump.

      Talk about the powerful odor of mendacity, how about Turley’s claim that Willis and Wade were “credibly accused of lying”, and Turley’s feeble attempt to compare whatever “lying” Willis and Wade engaged in is the same as what Trump is charged with–trying to rig the vote and falsifying Electoral College documents–implying, for the benefit of the gullible, that Willis is a hypocrite. Trump knew he lost–he had to know–he was behind in the polls, and as the votes were counted, it became clear that the polls were right. He tried to bully Fox News into retracting their projection that he lost Arizona. He was told before election day, by experienced campaign people, that the in-person votes would favor him, but mail and absentee ballots would favor Biden, and that he should expect to initially be ahead, but that this lead would be lost as absenteee and mail ballots were counted. He tried to stop states from counting mail and absentee ballots, and to this day, he and Republicans try to cast doubt on the validity of mail and absentee ballots–all without any proof of fraud–and solely because they tend to benefit Democratic candidates, even though some states only use mail ballots, and Trump and Pence both voted absentee He took a victory lap at 2:00 a.m., claiming he won–knowing this wasn’t tru.e He decided he wasn’t going to go away quietly, and began planning for the Big Lie before election day. We all know the rest–the “Stop the Steal” tours, calls to Secretaries of State, bullying of Pence and Secretaries of State, and planning for and inciting the insurrection. Turley’s pathetic effort to compare Trump’s attempts to undermine the will of the American people by cheating to stay in office with Willis and Wade allegedly lying about an affair–something that could not possibly prejudice Trump–is the epitome of mendacity.

      Turley is an attorney–in fact, he sells his punditry under the banner of the University for which he works and his law license. He whines about the size of the civil judgment against Trump and repeats the lame arguments that “nobody lost a dime”. Turley knows better–he knows that actual default and loss to the lender is not an element of proof for bringing a fraud case based on misrepresentations on loan applications. He also knows that Judge Engoron based the damage award on the amount of money Trump benefitted from as a direct result of his lying on financial statements and loan applications. Talk about trading in mendacity……

        1. The trier of fact did NOT rule that she had. Period. End of report. Whether he thinks people could be suspicious about when their relationship started is irrelevant. Trump’s blondie lawyer tried to prove that Willis plotted all along to hire her boyfriend as Special Counsel, pay him an unreasonably large hourly rate, and the both would benefit by lavish dinners and luxury vacations paid for by the taxpayers of GA. None of those things were proven–and it’s not because of “selective prosecution”. Willis first approached the former GA governor to be Special Prosecutor–he declined. Wade’s hourly rate was $250, which is low. Wade did a lot of work for which he billed–and there’s no proof that he padded the bill. She testified that she paid for her half of expenses in cash, in keeping with her family’s practice of paying for things in cash. There’s no proof to the contrary. So, no matter how many paid pundits claim she’s a liar–that was not found by the trier of fact.

Tell me what does the TIMING of their relationship have to do with Trump trying to bully Raffensberger, lying about winning, and getting fake electors to falsify campaign documents, all to defeat the will of the people of the State of Georgia? The woman who claimed that she KNEW they had a relationship earlier was a disgruntled former employee who was fired by Willis. Wade’s law partner backed off of prior statements about an earlier onset of their affair, declaring that he was “speculating”—all of which amounts to “so what’? All just a side show to deflect away from Trump’s effort to steal the Electoral College votes in Georgia.

              1. Because it is reasonable to assume that members of the public would look at her relationship with Wade and assume that her ‘coitus’ with him just might ‘interuptus’ her ability to exercise her independent judgment as the supervising District Attorney on the case.

The case was presented to a Grand Jury–they returned a true bill–finding that there was probable cause that Trump, and the other Defendants, committed the various crimes with which they are charged. And, this true bill was based on evidence, much of which we’ve all seen and heard–like the call to Raffensberger and the fake Electoral College documents. Willis didn’t make up the charges. Your efforts at “coitus interruptus” jokes are lame BTW. Just like everything else with Trump when he gets caught doing wrong–he attacks the accuser, he lies and engages in delay and diversionary tactics because he can’t defend on the actual facts.

She’s right–she’s not on trial–Trump is–and the crimes of which he is accused undermine the very core of American democracy. He cannot be allowed to get away with trying to steal votes in Georgia. The judge did NOT find “misconduct”–so “her misconducdt” was NOT put on trial. His blondie lawyer trired to prove that Willis plotted to enjoy luxury vacations and lavish meals paid for by Georgia taxpayers by hiring her boyfriend and overpaying him–she failed to prove this. That’s the end of it. Trump still did what he is accused of–trying to rig the vote in Georgia.

      It is near universally immoral for a boss to have an affair with a subordinate.
      It is a violation of the rules of legal ethics for such things to occur involving lawyers on a case without disclosure.
      It is always immoral and improper for someone in govenrment to have an affair with a subordinate.

      Trump and lendors had a very explicit contract – likely many many pages long. There are no “implied” duties.

      Again the text of the US constitution forbids govenrment from interfering in contracts.

      But James/Engoron have raised the risk of doing business in NY. Some will leave, others will raise their costs.
      A state that is already russing towards bankruptcy will see lower revenue and higher costs.

        In Biden’s case his documents issue is largely related to the time he was a senator which isn’t bound by the presidential records act.           A crime is an act.
          The passage of time without any action can not make you a criminal.

  8. Whenever someone says ‘But Biden cooperated’, you can remind them that he had illegal documents for many years. That he and his people knew he had, and didn’t step up at the time to hand them over. They had many years to go through his stuff and remove incriminating evidence. That there was still so much to find seems to show there was very likely a lot more to the story than he’s admitting to. There are people who went to jail for having only one document they weren’t allowed by law to have. Biden had, well, who knows the real amount. Enough to have been prosecuted, if the justice system was being used fairly/properly.

    1. I beleive there is a list of the numbers of documents found with Biden with subtotals for each level of classification.
      Someone else compared those numbers and they were very very close tot he numbers for Trump.

      They were also two orders of magnitude lower than Hillary.

    Remember when Trump was shot in the mouth (by the left-wing) for saying that there were “good people on both sides?” I regret that he was criticized for his truthfulness.
    That said, I join him in believing there are many good people on both sides of political ideology. The selective prosecutions of those whose political ideas challenge the controlling party (or ideology) is indeed a danger to all.
    But we must ask ourselves, why are certain persons/parties so interested in taking other certain persons/parties down?

      1. As the SC conceeded in FL – Never has NARA, DOJ, FBI, … even SOUGHT posession of documents.

        There are a number of cases that ex-presidents have LOST – every single one is for ACCESS to an expresidents documents – not possession.

        The quick highlights of that hearing are:

        The president is NOT covered by the espionage act – if he was it would be unconstitutional.
        The SC ceded that the documents were transfered to MAL at Trump’s direction LEGALLY.

        The SC’s theory is that the moment Biden was sworn in and Trump was no longer president at that instant the mere passage of time made possession into a crime.

        Also revealed was there is NO history to support Smith’s indictment.
        There is LOTS of history DOJ/OLC opinions court decisions to support Trump’s argument that the docs are his property.

    5. You conflate a small part of Hur’s report which did NOT say what you claim – with Hur replys to questions where Hur made clear he did NOT investigate Trump, and could not speak authoritatively about Trump.

      If as the SC investigating the Biden case Hur said anything of substance about the Trump case or did comparisons – that would be unethical – it is NOT his case. I beleive Hur is quite ethical.

      You are reading far to much into the very little that Hur has said regarding Trump – all of which he has been clear is not based on actual knowledge of the Trump matter.

Today SCOTUS hears a case.  It may be one of the most important cases SCOTUS considers this year where a Federal Judge ruled that Biden’s Government (Deep State, DOJ, FBI, MSM)  violated the 1A, and was upheld unanimously by an appellate court. Biden’s disregard for the US Constitution re: COVID, arguably caused more deaths and injury on Americans because of his government’s spread of disinformation LIES. No wonder no one is reporting on it since it is implicates MSM in the most nefarious light. 
    Biden’s lies re: COVID make the Feds handling of Tuskegee Syphilis fiasco look insignificant.

    America may never recover from the harm the Feds unleashed on Americans c. 2020-2023.
