The Centers for Disease Control and Prevention (CDC) continues to resist disclosing information on claimed side effects and problems with its COVID-19 vaccines, including from healthcare workers. Due to a January order by U.S. District Judge Matthew Kacsmaryk in a Freedom of Information Act case, the CDC is being forced to turn over hundreds of thousands of “free text” entries from V-safe. The court has scolded the CDC for its continuing efforts to withhold information on these complaints.
As the CDC and the Biden White House gear up for another possible pandemic, the case reminds us that we still need to address the conduct of the government — and the reporting of the media — from the last pandemic. Once agency officials were told that they could censor those with opposing views, a culture of speech controls took hold at the CDC and the government narrative was then amplified by the media.
To question such mandates was declared a public health threat. The head of the World Health Organization even supported censorship to combat what he called an “infodemic.”
A lawsuit was filed by Missouri and Louisiana and joined by leading experts, including Drs. Jayanta Bhattacharya (Stanford University) and Martin Kulldorff (Harvard University). Bhattacharya previously objected to the suspension of Dr. Clare Craig after she raised concerns about Pfizer trial documents. Those doctors were the co-authors of the Great Barrington Declaration, which advocated for a more focused Covid response that targeted the most vulnerable population rather than widespread lockdowns and mandates. Many are now questioning the efficacy and cost of the massive lockdown as well as the real value of masks or the rejection of natural immunities as an alternative to vaccination. Yet, these experts and others were attacked for such views just a year ago. Some found themselves censored on social media for challenging claims of Dr. Fauci and others.
The media has quietly acknowledged the science questioning mask efficacy and school closures without addressing its own role in attacking those who raised these objections. Even raising the lab theory on the origin of Covid 19 (a theory now treated as plausible) was denounced as a conspiracy theory. The science and health reporter for the New York Times, Apoorva Mandavilli, even denounced the theory as “racist.” In the meantime, California moved to potentially strip doctors of their licenses for spreading dissenting views on Covid.
It is clear that much still has to be done to create a culture of transparency at the CDC. Judge Kacsmaryk has slammed the agency for withholding the data on the health complaints on spurious grounds. There still appears a culture at CDC in withholding data that could be used to question its decisions or conclusions.
For a year, the CDC has been fighting these efforts. The lawsuit by the Informed Consent Action Network, revealed “nearly 8% of V-safe users said they required medical care, another 12% couldn’t perform normal daily activities and yet another 13% said they missed work or school.” With limited “boxes” supplied by the CDC, people had to write in their complications. The CDC then failed to disclose those reports.
The free-text entries reportedly support one of the most controversial moves by the CDC to downplay heart complications. Litigants say that the new disclosures show a frequency of symptoms associated with myocarditis – inflammation of the the heart muscle myocardium.
Experts raising these concerns were labeled “anti-vaxxers” and conspiracists.
As I have previously testified in Congress, the surest way to combat this culture of censorship is to pass legislation barring a single dime of taxpayer funds from being used to fund censorship efforts, including third-party groups on removing “misinformation, disinformation, and malinformation.”
The government can always speak in its own voice, but we should get the government out of the business of controlling the speech of citizens and groups. It can rebut critics on its ample platforms without using third parties to silence them as surrogates.
Additionally, Congress should demand answers on the failure of the CDC to discuss opposing views and to withhold countervailing data during the last pandemic. The loss of public confidence in both the CDC and the media could prove disastrous if we face another pandemic. The years of barring and throttling opposing views (including many later vindicated by the science) has left many Americans deeply distrustful of both the government and the media. That is a real potential health danger. If we want to prepare for the next pandemic, we need to repair that trust.

I have some anecdotal experience with the virus. At the onset of Covid I took the advice of my doctor and the CDC–got vaccinated with two follow up boosters. After the first booster I tested positive at home. After a week of flu like symptoms and recovered. On a follow up visit with my doctor he told me the vaccines probably saved me from hospitalization or worse.
In contrast I had a neighbor–a big supporter of Trump who followed his advice–tried some quack remedies but refused to get vaccinated–even refused to wear a face mask. At the end of 2020 he tested positive and died a few weeks later on a ventilator in a local hospital.
But you continue to support the pseudo-science–particularly the quackery of the Great Barrington Declaration about “herd immunity” and your false claim Bhattacharya and Kuldorff are “experts”. Who is better than an epidemiologist to discuss the spread and control of disease? Dennis doesn’t know what an epidemiologist is. He also disapproves of Bhattacharya. Maybe Dennis is a racist since Bhattacharya was born in India. Bhattacharya has tremendous insight as an economist and one who wrote a book on healthcare policy. He is also an MD, so the basics we discuss on the blog are in his knowledge base. Bhattacharya knows that we handled things associated with Covid differently than was taught in medical schools. That is why our actions were different when faced with serious viruses in the past. Swine flu, which most of us remember, as mentioned by Young, was treated with an emergency vaccine that was discontinued for side effects. At that time, we didn’t censor people who discussed such side effects, and we were better off.
Imagine, esteemed academics like Bhattacharya and Kulldorff are not allowed to speak, but big-mouth Dennis does despite his demonstrated lack of knowledge on all subjects combined with his stubborn stupidity.

Dennis, on the one hand, you bash pseudo science, while on the other, holding up an anecdote to dispute vaccine concerns. You didn’t even bother to give any medical history of your neighbor. Refusing to wear a face mask made no difference, as studies have totally debunked their use. Why would virtually all medical workers have gotten Covid multiple times if masks prevented it? Worse, bacteria and viruses stick to the outside of the masks, to be breathed in by the wearer over time.
Here’s an anecdote for you. One of my relatives is a nurse. Her employer required her to get all available Covid vaccines and boosters, as soon as they are available. In spite of being vaccinated and boosted, she’s gotten Covid over and over again, seriously getting ill. I don’t think there’s a variant of Covid she’s missed catching, and normally mild variants have made her seriously ill, including a bout of sepsis.
You are also fabricating the claim that the lab leak theory was debunked, unless you mean by Fauci, whose internal emails showed he was advised the lab leak amid gain of function research was the most plausible theory. The US government has acknowledged the lab leak as the most likely source.

Jonathon, you refer to the authors of the Great Barrington Declaration as “doctors”, as if they, like me, are practitioners of the noble profession of medicine. Let me clarify this for you.
Bhattacharya did indeed graduate from Stanford Medical School in 1997. He is entitled to put M.D. after his name, but he has never practiced medicine. He went straight from medical school to do a PhD in economics, awarded in 2000. He never did an internship or residency and therefore has never held a license to practice medicine. He is an academic economist. His medical knowledge is that of a 4th year medical student from 1997. Things have changed in the intervening 27 years. Medicine is a calling that you PRACTICE. He is in no sense a medical practitioner, any more than Jim Jordan is an attorney. Jordan has a law degree but never passed the bar. Would you take legal advice from him? I think not. Likewise I would not give the time of day to any medical advice from Bhattacharya.
Kuldorff is a “doctor” in the sense that he has a PhD. However that PhD is in mathematics. He is a statistician. Would you take medical advice from a mathematician?
The third author of the Barrington Declaration, whom you do not mention, is Sunetra Gupta. She also has a PhD………in Zoology. She holds herself out as a “theoretical epidemiologist”, whatever that may be, specializing in infectious diseases.
Before I went to medical school I did a PhD in Microbiology and Immunology. My research centered on the immune responses to respiratory viral diseases, and improving methods of vaccination. Do you think that may have any relevance to COVID? Do you think I may be qualified to comment in these matters?
I can assure you, beyond any shadow of doubt, that the incoherent ramblings of these three charlatans in their so-called “Declaration” are utter hogwash. If we had allowed them to implement their asinine proposals many more millions of Americans would have died. The idea that herd immunity can be effective holds only in the circumstances that the virus does not mutate and a primary infection confers lasting immunity. This is true for such diseases as measles, mumps, chicken pox and rubella and other viral infections. With these disease it is possible that when a high level of immunity is achieved in the population, either by primary infection or vaccination, then the likelihood of transmission to vulnerable individuals is reduced. It is of absolutely no relevance to respiratory viruses, which almost universally have high rates of mutation. This is why we get coughs and colds and flu every year. This is why patients had repeat infections of COVID as new strains emerged. If these 3 “experts” had any real medical knowledge at all they would realize the absurdity of their position.
The fact that you offer credence to the ramblings of these idiots as evidence of misguided advice from the nation’s leading health experts is almost beyond belief. You imply that there are two sides to the COVID story. I agree, there are two sides. On the one side, we have real experts. If that name sounds familiar it should. Just Monday, Professor Turley wrote about the abortion pill case before the Supreme Court.
Turley worries that anti-abortion forces might bring back the Comstock Act to prevent mifepristone from being mailed to red states with abortion bans. Not that Turley is that concerned about abortion rights. He just fears that Comstock was so broadly worded that it could threaten free speech.
Well that abortion pill case originated at the federal courthouse in Amarillo Texas. There it was first heard by Judge Matthew Kacsmaryk. Though Turley makes no mention of that today. In fact, Turley never mentioned Kacsmaryk on Monday. How odd!
In that abortion pill case, the plaintiffs are a small group of anti-abortion doctors who argued that ‘theoretically’ they might be called upon to treat a woman injured by mifepristone. Though most observers questioned if said doctors had any real standing since their case was only theoretical. Yet Judge Kacsmaryk wasn’t bothered by that void.
But on Monday, the Supreme Court was indeed bothered by the plaintiffs’ lack of standing. Even Trump appointees Gorsuch and Barrett openly questioned the obvious lack of standing. Theoretically, Judge Kacsmaryk should have never heard the case.
Judge Kacsmaryk is a Trump appointee himself whose previous job was at First Liberty, a Texas law firm that specializes in religious freedom cases. Every far-right group in the country with a pro-religeous agenda knows that Kacsmaryk is the go-to Judge for religious agenda cases.
So many far-right groups have gone to Kacsmaryk, that the term ‘Judge Shopping’ has come into vogue. Just Google ‘Judge Shopping’ and watch Matthew Kacsmaryk come up in the sample paragraphs of numerous search results. But again, Turley mentions none of this in today’s column.
The issue of Judge Shopping has, in fact, triggered a minor crisis in the Federal courts. Efforts to rein in this practice were welcomed at first, but now conservatives are pushing back. It seems the far-right ‘wants’ friendly judges who aren’t that concerned with the standing of plaintiffs.
This brings us back to Turley’s column today. Here the plaintiffs are a group known as ‘Freedom Coalition Of Doctors For Choice’. Curiously, Turley refers to them only as ‘the litigants’. What’s more, Google and Bing searches turn up precious little on this group. They are mentioned only as ‘the litigants’ in this CDC case. How mysterious!

This could have been a good essay but for two things. Just because somebody claims they had some sort of symptoms after receiving a vaccine (or eating shrimp, or using perfume) does not prove there is a connection. There’s a danger with putting out “adverse events’ information that haven’t been tested or subjected to scientific methodology to determine whether there could be any cause-and effect, and that danger is exemplified by the comments right here on this blog. Looke at all of the Trumpster geniuses who just “know” that the vaccines are bad and are killing more people than COVID itself. These are the same people who faithfully watch Fox and other pro-Trump media and who believe the lies they pump out. Gigi – while you are correct – in the most abstract way that we do not presume correlation for a few claims – this case is about access to the raw data that IS what gets analyzed to determine both efficacy and safety.
This case is about providing the medical community – rather than merely CDC and FDA with access tot he data THEY need to determine if the assessments of government experts hold up.
I would further note this is the same raw data that we use to make the same decisions about other drugs and vaccines.
Worse still we all already know that CDC/FDA are hiding the ball – there are far more VAR’s reports on the C!( vaccine propotionately than other vaccines and medicines.
There is ZERO reason to beleve that irrelevant reports are more common with the C19 vaccine – that with any other medicine or treatment.
Whether you like it or not – sorting out meaningless reports is something ACTUAL experts – you know the people who GOT most everything about Covid correct – rather than the CDC do all the time.
