
Below is my column in the Hill on the approaching closing arguments in the Trump trial. Manhattan District Attorney Alvin Bragg appears to be launching his own school of abstract legal work in the Trump indictment. The key is to avoid any objective meaning.
Here is the column:
Abstract artist Jackson Pollock once said that his paintings have no objective meaning, so the best way for people to enjoy them is to stop looking for it.
For many of us, Manhattan District Attorney Alvin Bragg has created a new school of abstract law where there is no need for objective meaning. The jury is simply supposed to enjoy it for what it is: a chance to convict Donald Trump.
Pollock was famous for his painting drips on large canvases. Bragg has achieved the same effect by regenerating a dead misdemeanor on falsifying business records as 34 felony counts. To achieve that extraordinary goal, he has alleged that the document violations (which expired long ago under the statute of limitations) were committed to hide some other crime.
Originally, Bragg vaguely referenced four crimes and there have been months of confusion as to what he was specifically alleging as his criminal theories. Even legal analysts on CNN and MSNBC have continued to question the specific allegations against Trump as we head into closing arguments.
As it stands, there are three crimes that have been referenced by prosecutors: state and federal election violations and taxation violations.
Bragg’s legal vision for non-objective indictments was greatly advanced by Judge Juan Merchan, who will allow the jury to reach different rulings on what crime is actually evident in Bragg’s paint splatters.
Merchan has ruled that the jurors can disagree on what actually occurred in terms of the second crime. This means there could be three groups of four jurors, with one believing that there was a conspiracy to conceal a state election violation, another believing there was a federal election violation (which Bragg cannot enforce), and a third believing there was a tax violation, respectively. Nonetheless, Merchan will treat that as a unanimous verdict.
In other words, they could look at the indictment and see vastly different shapes, but still send Trump to prison on their interpretations.
Moreover, Michael Cohen is the sole witness even to address the elements of any of these crimes. Cohen is a convicted serial perjurer and disbarred attorney who appears to have lied again during the trial. Even if they consider his testimony, there is no direct corroboration in evidence on Trump’s intent or knowledge. As a result, the prosecutors will rely on circumstantial evidence to support whichever interpretation the jurors will buy.
Faced with charges that can mean different things to different jurors, Trump’s team will have to focus on the spaces between the paint drips; the canvas itself.
All of this case is based on the payment for a non-disclosure agreement that is perfectly legal and indeed common in business and politics. The Trump team needs to stop dancing around the NDA.
The jury likely believes that Trump knew of the NDA and supported it. The defense has to emphasize the testimony of David Pecker, the former publisher of the National Inquirer, that he killed stories for a variety of celebrities and politicians, including Rahm Emmanuel and Arnold Schwarzenegger. He also said that he killed stories for Trump for years before he even thought of running for president.
They need to emphasize the testimony of multiple witnesses that Trump seemed to want to avoid embarrassment to his family. He was also the host of a popular television show and an international businessman. The payment of a couple hundred thousand to kill stories is considered a cost of doing business for most celebrities, particularly those who have television contracts with provisions allowing cancellation for scandals.
In the instructions, the court will tell the jurors that payments cannot be campaign contributions if they would have been made anyway regardless of the campaign.
They also need to point out other gaps. It was not Trump who listed payments as legal expenses or retainer payments. Witnesses said that payments to lawyers are routinely recorded as legal expenses. Indeed, it is not clear how the money should have been denominated but the decision was being made by others in the Trump organization and by Cohen himself.
Moreover, on the characterization of payments as part of a “retainer,” the other party to that characterization was former Trump Organization CFO Allen Weisselberg. He is currently in prison in New York, but was not called by the prosecution. The prosecutors elected to rely entirely on Michael Cohen with various witnesses, including Cohen, referencing Weisselberg’s decision on how to pay the money.
That made the canvas itself largely Michael Cohen. All of this is held together by a witness who admitted that he has lied to banks, Congress, prosecutors, business associates, and virtually every creature that has ever walked or crawled on the face of the Earth. He also lied in front of the jury about the critical call where he said that he told Trump about the NDA payment.
The defense showed that that 96-second-long call was to Trump’s bodyguard, Keith Schiller, in late October 2016. It was preceded and followed by text messages that indicated that their conversation was actually about a teenager harassing Cohen.
Moreover, Cohen admitted to making millions by bashing Trump, and that he has a personal interest in his conviction.
You can throw paint on Cohen all day, but it will not cover up the fact that he is a pathological liar and grifter.
That is why I still believe that a hung jury might even be the most likely possibility. That may change when we see Judge Merchan’s final instructions. However, the only thing worse in New York than being a Trump supporter is being a chump. To rely solely on Cohen and not even call someone like Weisselberg is to play these jurors as chumps.
Pollock was doing more than just throwing paint at a canvas. As Pablo Picasso said, “there is no abstract art. You must always start with something. Afterward you can remove all traces of reality.” Bragg started with nothing and sold it as a legal abstraction.

It definitely did not go well for DJT at the Libertarian Party presidential nominating convention on Saturday night. It started with Sen. MAGA Mike Lee, who tried to introduce DJT, but practically got shouted off the stage.
Over the boos DJT tried to convince the unruly crowd “You have to vote for me”. Kind of weird because DJT is the presumptive nominee of the GOP. But by his speech you would think DJT was running on the Libertarian Party ticket. You can’t be the nominee of two different parties!
When the results were in on the first round of voting DJT got ONLY 6 votes as a write-in candidate–10 less than a guy named “Toad”! Even Stormy Daniels got 1 vote. It’s pretty clear the Libertarian Party does not like DJT. So why subject yourself to such abuse? DJT is one desperate dude!
Why would DJT show up, offer them a seat at the table, and ask for their vote?

Regardless there is no commentary during the speeches. Just What Trump said and how the crowd reacted. So that we all can weight the truthfulness of your remarks.
With respect to the FACTS in your post – they are completely False. Several people spoke – including RFK jr. Sen. Lee, Vivek, and Trump.
ALL got mixed receptions. Pretty much NO ONE – including other libertarians gets the wholehearted support of libertarians at their convention.
Libertarians most notable attribute is their independence.
Regardless, Sen Lee was relatively well received, and did NOT introduce Trump.
No one was “practically shouted off the stage”. They all spoke for their allotted time. They all got booed and cheered.
Trump was introduced by the current chairwoman of the Libertarian party who gave him a glowing and well received into.
She noted the historic nature of his appearance, AND that of RFK jr. and specifically noted that Pres. Biden had ALSO been invited.
but did not respond.
The primaring boing and catcalls directed at Trump were for his responsibility in instituting the COVID policies that F’d up the country.
While Biden doubled down on all of these going far further than Trump long after it was well known these were a hoax.
It is a FACT that bad COVID policies STARTED With Trump – and libertarians do not forget that.
That is one of many reasons Trump is not likely to win the libertarian nomination – though he did have the courage to ask for it.
But those libertarians who will not vote for Trump over covid, are not voting for Biden for any reason at all.
Many of Trump’s remarks got significant cheers – you would not likely understand them as you have no clue about the politic values and issues of conservatives, libertarians or anyone not on the far Left.
Regardless, Trump promised to commute the conviction of Ross Ulbricht on Day one.
I doubt you know who Ulbricht is, but I can assure you every single libertarain at the convention did – and they cheered.
Tramp also promised that he would prevent regulations that interfered with bitcoin owners from actually possessing their Crypto Wallets.
Again something that I doubt you understand, but it is the difference between Crypto being actually able to function as money and being more similar to a stock market short on the dollar. Regardless libertarians understood and cheered.
Trump also promised there would never be a Government backed crypto currency – no “FedCoin”.
Again to the cheers of libertarians.
Trump practically read an editorial in the Spectator by Libertarian Dereck Mullroy laying out the libertarian case for Trump.

Further – the Moderators – should NOT be asking the questions – the Candidates should be asking each other questions.

Democrats want to hear Trump answer Democrats questions and Republicans want to hear Biden answer Republican questions – and I as a libertarian want them both to answer Questions that are important to me.

But if you want my vote – address what I care about.
Do my issues deserve to dominate – absolutely not. But this election is going to be decided by people who are not republicans and not democrats, the candidates need toi address voters outside their party – Trump is doing that.

Trump has no sense of decorum. He has absolutely no sense of appropriate behavior. He has to be the center of attention at all times. This is the nature of malignant narcissism.
I realize Trump is far from perfect but I don’t see him as negatively as you. He is oafish but an effective body guard and he got into politics not for money but for love of country. (He could have stayed in the private sector and made tons more money and avoided the insane persecution.) Although he can be self centered at times he genuinely loves the American people. His insults are directed at specific very powerful people, not the electorate. In this he is the polar opposite of Biden, Obama, and Hillary all of whom insulted and showed contempt for the non-liberal electorate. He also concentrates on merit and getting the job done, and has little use for identity politics and tired old race or class grievances.
If you truly want insight into why Trump’s supporters are devoted to him (perhaps a big “if”), I suggest you see the movie Green Book. It portrays a true story of a friendship between a refined Black concert pianist and the body guard, Frank Villalonga, he selects to accompany him on a tour of the south in the early 1960s. Villalonga is uncouth and oafish but the pianist selects him anyway because he’s the right man for the job. Anyone not blinded by hatred of Trump can see that the country has been severely damaged by Biden and Trump is probably the only person who can repair that damage and set us on a better course.
Finally, a MAGA follower willing to admit Trump is not perfect. I can respect that.

It is quite possible that his debts exceed the value of his properties leaving him with negative equity. He has cash flow from the properties but that is not equity. He has had multiple bankruptcies because of his poor business skills. He lost money running a casino. I live in Nevada. A casino is basically a license to print money. In Nevada we do not have personal or business income taxes. We tax the casinos on their gross receipts and get enough to run the state. The casinos make huge profits on the out of state suckers who come here, even after we have siphoned off enough money from them to run the state.
Trump is a loser and a con-man.

You can “beleive that Trump has a negative net worth, but the odds of that are below zero.
First the DJT stock is NOT leveraged. It has a value and no liabilities against it. Currently that is about 2/3 of Trump’s wealth which Fortune now rates as $7.1B. Could the value of that stock decline ? Certainly. But it is near 50/sh right now,
Unless it drops to $2.share Trump will be worth more than he was in 2023.
As to properties – the likely actual value of all the properties are known publicly.
As there a property whose value you want to challenge ?
We know which properties have mortgages, and we know when those mortgages were written. This is all things you can find publicly if you wish to bother. The maximum a bank will lend is 80% of the value of the property at the time the mortgage is written – So we can determine using public information what Trump’s debt to equity ration is. I have not personally done that – but Forbes and Fortune have. Fortune is doing so essentially in real time and values Trump at 7.1B
If Trump’s assets were ENTIRELY commercial realestate in NYC – and it was middling at best comercial real estate – Trump would be facing a problem. Middling commercial real estate in Manhattan and other large cities is taking a bath.
We have the equivalent to the 2006 housing bubble happening in commercial real estate.
But Trump is NOT exclusively in locations that are in trouble, and not exclusively in commercial real estate.
With respect to Nevada. The profit margins of casinos are quite literally determined by the laws of probability.
Those laws dictate that over the long run the Casinos will ALWAYS win about 10% more than they lose – that is GROSS.
Your states tax is on the GROSS. That means subtract the tax rate from the statistical profit margin add in overhead costs, and that will determine if a casino is profitable – and the answer is pretty easy – the larger it is the better – because overhead scales less than linearly.
Therefore a gross receipts tax – essentially a sales tax is a regressive tax on the smallest gambling organizations it applies to.

Trump should hold a rally in Chicago. As with NJ, he’ll draw 100,000 enthusiastic supporters, many of them African Americans who are reeling from FJB’s having invited in millions of illegal aliens, who wind up displacing poor Chicago citizens. They are waking up to the reality that only Trump is willing and able to solve that problem. They will turn out in force for Trump.
Partly as a result of the trial, but partly because of the polls we are seeing a change in Trump/Republican strategy.
Trump’s lead in swing states right now is HUGE. Biden outspent Trump 15:1 in swing states in the past 2 months and did not budge the needle.
Trump needs two things to guarantee this election – he MUST win the popular vote.
While that is NOT a requirement to win the election, as evidenced by the 2020 election – it is a requirement to constrain the lawfare and the fraud.
If Trump wins the popular vote – there is NOTHING democrats can do.
Without a popular vote victory the scale of fraud that democrats can get away with is much smaller.
There was with certainty significant Fraud in the CA recall race. But there is also no doubt that Fraud or not, Newsome had way more than enough votes to win. As a result – no one looked into the fraud
No one cares about Fraud except in close elections.
And election fraud only effects close elections.
Trump’s and republicans strategy will be to hold the swing states and grow their lead outside those states. To bring every possible state into play. First to run up the popular vote – because that is necescary to prevent Fraud. And 2nd to make Biden and Democrats have to defend Everywhere.
NY, NJ, VA, WA, NB, NM, ME, NH all appear to be in play. Trump is not going to win all of those too.
He may not win any of them. But he will force Biden and democrats to waste effort defending them.
And he WILL bring up his popular vote numbers.
Next this significantly helps republicans downballot.
And that is a win-win.
Trump went into 2017 with tepid support from the GOP.

” The defense has to emphasize the testimony of David Pecker, the former publisher of the National Inquirer, that he killed stories for a variety of celebrities and politicians, including Rahm Emmanuel and Arnold Schwarzenegger. He also said that he killed stories for Trump for years before he even thought of running for president.” The problem is Pecker explicitly testified that in this case, he paid to kill the story solely because Trump asked him to so so to help the campaign. And again pecker testified that this was him committing a felony.
“The payment of a couple hundred thousand to kill stories is considered a cost of doing business for most celebrities, particularly those who have television contracts with provisions allowing cancellation for scandals.” There is no dispute that if he had used his own money it wouldn;t have been a crime. But he didn’t, instead using the money of people who have admitted they paid the women solely to help the campaign.
“He also lied in front of the jury about the critical call where he said that he told Trump about the NDA payment.” Contrary to Turley’s deliberate and intentional lie, no evidence was introduced showing Cohen lied about this call.
“Moreover, Cohen admitted to making millions by bashing Trump, and that he has a personal interest in his conviction.” Again, Turley is intentionally lying. Cohen would be much better off financially if Trump is found innocent. If Trump is president the gravy train keeps rolling around IF he is found guilty, the gravy train ends.
“To rely solely on Cohen and not even call someone like Weisselberg is to play these jurors as chumps.” Why didn’t Trump call Weisselberg? Why didn’t Trump call the bodyguard if Cohen lied about that phonecall?
And for that matter, why hasn’t Turley pointed out that as Trump’s lawyer he is ethically obligated to tell the stupidest lies imaginable to bolster Trump’s case.

Given that the FEC found that Hillary funneling millions through a law firm to fund a Russian fabricating a hoax and shilling it to the FBI was a minor violation of federal election law only meriting a small fine, you now want to argue that paying hush money to a porn star is actually much worse ? Trump made these comments at a private meeting with Jewish donors in New York. The whole pitch seemed to be that Jews would be crazy ‘not’ to vote for him! ‘Because only Trump can help Jews retain their political influence in the U.S.’
Interestingly the article notes that Trump stop talking to Netanyahu after the latter recognized Joe Biden’s 2020 victory. As though foreign leaders must parrot Trump’s election lies in order to stay in good standing.
