
Below is a slightly expanded version of my column in the New York Post on the verdict in the Trump trial. The Manhattan case, in my view, was a raw political use of the criminal justice system. It is only the latest example of the use of the justice system for political purposes and harkens back to the Adams Administration at the start of our Republic. I discuss that period in my book, The Indispensable Right: Free Speech in an Age of Rage (which is available this month).
Here is the column:
After years of trying — in the words of the judge — “to get the damned rascal in this court,” it was a conviction that many welcomed.
But those words were not from Manhattan Supreme Court Justice Juan Merchan, and the conviction was not that of former President Donald Trump.
Rather they were from US Supreme Court Justice Samuel Chase, at the end of the 18th century, when America embraced political prosecutions to target critics and opponents.
The man on trial then was James T. Callender, a muckraking writer critical of President John Adams.
For accusing politicians of corruption, Callender was charged with sedition, fined $200 and put in prison.
It was one of the many political prosecutions carried out by the Adams administration.
Undeniable reality
Political prosecutions are something most citizens associate with dictatorships.
But the Trump prosecution has forced many to confront the undeniable reality of the politicization of our legal system.
In many respects, President Biden and Democrats have re-created the Adams era.
Biden has led calls for censorship of political critics and his administration has coordinated the silencing and the blacklisting of those with opposing views.
Democratic politicians have pressured social-media companies to serve as surrogates for the government in banning, throttling and defunding individuals and groups.
Indeed, I have previously written that Biden is now the most anti-free-speech president since Adams.
The Adams era also reflected the same blind loyalty of many media outlets.
Federalist publications supported the crackdowns while echoing charges against political opponents as seditionists and insurrectionists.
Jeffersonian publications, like Callender’s, attacked Adams for his “unbounded thirst for ridiculous pomp, foolish adulation, and selfish avarice.”
The nation was divided down the middle as both sides accused each other of being traitors and insurrectionists. Sound familiar?
A chilling return
Yet, it is the politicization of the legal system that is the most chilling return to the Adams era.
Even liberal legal analysts and figures have admitted that the case against Trump was unprecedented and would not have been brought against anyone other than Trump.
CNN legal analyst Elie Honig recently wrote that there should be concern over a judge being appointed (not randomly selected) who is not just a Biden donor but someone who “has earmarked donations for ‘resisting the Republican Party and Donald Trump’s radical right-wing legacy.’”
Adding to these concerns is the movement of the third-highest official in the Biden Justice Department to the staff of Manhattan District Attorney Alvin Bragg to build the case against Trump.
Before joining the case, Matthew Colangelo was also paid by the Democratic National Committee for “political consulting.”
So Trump was convicted in a trial with a Biden donor judge, who has a daughter who is a major Democratic operative, a lead prosecutor previously paid as a DNC political consultant and a jury selected in a district that voted roughly 90% against Trump.
The trial itself was a travesty.
Even after sitting in the courtroom watching the trial and the verdict, I still have no idea what Trump was convicted of in the case.
The charges were built on a dead misdemeanor barred with the passage of the statute of limitations.
It was zapped back into life by alleging that the falsification of business records occurred to unlawfully influence the 2016 presidential election.
Merchan told the jury members that they did not have to agree on what those unlawful means may have been.
Specifically, he allowed them to base their verdict on any one of three vaguely defined crimes of a federal election violation, falsification of business records or taxation violations.
Thus, the jury could have divided 4-4-4 on what actually occurred but the verdict was still treated as unanimous by Merchan to convict Trump.
Like much else in the case, that didn’t matter in deep-blue Manhattan.
Legal analysts and commentators openly celebrated on MSNBC and CNN — joining many in the streets.
This was a thrill-kill conviction, and the response of many in the media bordered on the indecent.
For many outside of Manhattan, the scene was repulsive and chilling.
You can hate Donald Trump but still be repelled by the use of the criminal justice system for political purposes.
There is, however, one silver lining. We went through political prosecutions under Adams and, to a lesser extent, Thomas Jefferson.
Yet, we survived. Our system corrected such abuses over time.
The Alien and Sedition Acts used to prosecute Callender expired.
Justice Samuel Chase was impeached for his partisanship (though not convicted).
With this case, you feel the weight of history in the conviction of a former president, but also a historical awakening.
Sometimes it takes a great abuse to shock the public into recognizing the need to act.
That was the case when the public finally saw Sen. Joe McCarthy in the first televised hearing of an Un-American Activities hearing. It was enough to stop the Red Scare and the abuses of political dissidents. Back then, the left was the target of such weaponization of the legal process. Today, it is the left pushing such abuses.
In the faces of ecstasy of demonstrators and commentators alike this week, we see the same joyful release from the bounds of legal process. The addictive quality of rage.
For them, it was a cathartic moment that was described by one commentator as a reason to celebrate and a “majestic” moment.
For the rest of us, it was more menacing than majestic.
It could prove to be the moment that galvanized many outside of Manhattan; the moment when citizens saw where our rage has taken us.
Sometimes we have to be forced to see what we have become to better understand who we are.
We are better than this.

Who said anything about “cornholing”? I do think a period of reflection for him, in which he’s not in control of his diet or his activities, and in which he must comply with rules set by others is in order. He has it coming. Since Trump was “Individual 1” in the Cohen indictment and Cohen went to prison, why shouldn’t Trump? America needs validation for the concept that “no one is above the law”, and if Trump gets away with this latest convictions solely because he managed to cheat his way into the White House, and especially if he could get back in power and pardon himself for stealing classified documents and starting the insurrection, that WOULD make America a banana republic where the rule of law and trial by jury are meaningless. And, Trump’s “power” is based on lies, aided and abetted by Republicans who used to stand for family values and respect for law and order. That is, until Trump. In addition to his 34 felony convictions, Trump flagrantly disregarded Judge Merchan’s gag order 11 times, even after getting sanctioned. Anyone else would have gotten hauled off to jail summarily. Why should’t Trump? The latest poll shows that most Americans believe that Trump’s convictions are valid. And really, I’ve yet to hear anyone on MAGA media argue against the testimonies of Hicks, Pecker and the document custodians. How do they explain away the “grossed up” comment by Weisselberg or Trump’s own admission that the payments to Cohen were “reimbursement”? Where’s the contrary evidence to Pecker’s testimony that he paid McDougal $150, 000 to “catch and kill” her story about her 10 month affair with Trump to help his campaign? After the Access Hollywood tape, Trump knew he had a problem with women voters, according to Hicks. Additional revelations about sexual liaisons might have done him in. The entire scheme of falsifying business records to cover up the payoffs and paying $150K, which is way over the legal limit of $12,000 for a campaign donation, was calculated to hide essential facts from American voters about Trump’s character. Turley can claim he doesn’t understand this all he wants to–how disingenuous! How disingenuous for MAGA media to scream “election interference” when Trump hid these facts from voters and accepted help from Russian hackers to spread lies about HIllary Clinton?
Laurence O’Donnell got it perfectly right when he said that Trump is the biggest spoiled brat in the history of American spoiled brats. He’s always behaved like he is better than other people, that he can just do as he pleases and get away with it–to wit: grabbing women he finds “beautiful” by the genitals, lying on financial statements to boost his rating in “Forbes”, lying on loan applications by tripling the size of his apartment to borrow more money and on better terms than if he told the truth, sexually assaulting and defaming E. Jean Carroll because she teased him about wearing womens lingerie, stealing classified documents, lying about returning them, moving them around so his attorney couldn’t comply with the request to return them, and falsifying business records to hide his payoffs to a nude model and porn actress with whom he had sexual liaisons, after getting caught on a hot mic bragging about grabbing womens’ private parts. Then, there’s the Big Lie and the insurrection it caused, resulting in multiple people dying–the most poignant of whom was Ashli Babbitt, who died because of her faith in a chronic, habitual liar. Trump owes that family damages for wrongful death and a heartfelt apology for abusing his position of trust. Add to the list attacking the rule of law because it caught up with him and undermining Americans’ belief in our justice system.
Yes, I do believe that fair is fair and that everyone is subject to the rule of law. Trump should do at least a brief stay in some penal facility and afterwards be on probation. Anyone else would get this.

3). The BEST thing that could happen to Trump now – would be for Bragg/Merchan to do something stupid like try to send Trump to prison.

Trump is an idiot. He put himself in that position. Trump was found guilty in a court law. He got his due process and he had his chance to testify in his defense. If he is as smart as you say he is he should have testified.

Any attempt to jail Trump prior to the election will result in an immediate appeal directly to the supreme court.
It is likely that The justice for the 2nd circuit will just stay the sentence – without granting cert, but if that does not happen – the case will get cert, and the sentence will be suspended immediately – it could occur within hours.
A less likely scenario is that an appeal to SCOTUS over sentencing could get them to look at the entire case.
I doubt they would reverse immediately, but they could suspend sentencing and send the court to the NY appeals court with strong suggestions that there are constitutional problems with this case.
MOSTLY “experts” think it is unlikely that SCOTUS will take a direct appeal on this – absent FURTHER efforts at election interferance.
But many many legal experts on the right are not talking about tit for tat.
THAT could provoke the US supreme court into acting quickly.
They do not want dozens of Political prosecutions headed there way, and the easiest way to stop that is to send a strong message QUICKLY.

The Supreme Court will not get involved. The appeals process will take a while to course thru the system. They are not going to make a special exception just because Trump is a former president. He’s just a regular citizen like anyone else.
It’s all about the sentencing. They will take into account his contempt of court charges his criticism of the judge. Trump will have to watch his mouth and his behavior while on probation. He can go to jail on the first violation. His rights are limited and he has to ask permission to travel anywhere.
When SCOTUS issues their immunity ruling sometime this month. It will very likely get worse for Trump.

My advice to others here is not – “You are not entitled, to do to those on the left what they are doing to you”

There is only one thing that Republicans must avoid right now – that is overplaying their hand.
An attempted assassination of Merchan or Bragg would be a mistake.
I do not think at this moment the Best tactic would be for a TX DA to prosecute Bragg or Merchan for election interferance.
But I am ambivalent – it MIGHT provoke the NY courts to grasp it would be a good idea to try to restore some of the forest of the law – before the devil comes for them.

You would not need to worry about vengeance and retribution if you had behaved lawfully and morally.
My advice to those on the right right now – is that you have been given the moral high ground – use that carefully, it is easily lost.

If TX AG PAxton decided to do something equivalent to what Bragg and James have done – while many likeTurley, and Dershowitz, and even I would advise against fighting lawlessness with lawlessness, about 1/3 of the country would support that, and another 1/3 might see that as wrong – but would not care – as you brought it on yourself.
I’m not sure the partisan attacks on the judge for his contributions to Biden ($35 total) or his daughter’s activities (the sins of the daughter are not those of the father).
What is certain is that the judge consistently made rulings against the defense, denied the defense the ability to put forth its best defense, disallowing exculpatory evidence and testimony, and ultimately the jury instructions were oriented towards a conviction. There are so many things that went in that should make this a slam dunk reversal at appellate court.
The DA ran on getting Trump, which does not seem like the America way. The law was never used against anyone in this fashion before. The 34 counts are just piling on for the only benefit of harsher penalty.
If the state of NY can’t get this right in the end, SCOTUS should.
I’m not a fan of Trump and wouldn’t never consider voting for him. I’m just a fan of blind justice.
Publius – the attacks are not partisan. Judges in NY are barred from making political contributions – this is an ethics issue.
Separately the SPECIFIC contributions that Merchan made were to an ANTI-TRUMP organization – not a generic democrat group or some democrat running for the house.
Even the appearance of Bias REQUIRES that you recuse yourself. Even SMALL evidence of hostility towards a party in court REQUIRES disqualification.
I would note – recusal is NOT punishment. Nor is this the US Supreme court where there are only 9 justices and there are no replacements and it is near certain that every single case will result in some kind of conflict, and where dozens of judges have ruled BEFORE the case gets to them.
This is a trial court where there are many other judges available to hear the same case.
I would note under NY’s ethics rules – the daughters involvement in fundraising off the trial itself is a far more significant issue.
The issue is NOT about “the sins of the daughter” – nothing she is doing is wrong. But it DOES require Merchaun to recuse himself. He did not.
The only thing worse that failing to recuse when there are strong indicators of bias, is subsequently bearing those out with displays of actual bias.

Hundreds of thousands of ballots in FC have no chain of custody. The law requires that ballots without chain fo custody can not be counted.
There were no investigations of anything that occured at the FC counting facilities. While fraud can not be proving – illegal conduct absolutely occcured.
Michigan law allows absentee ballots from senior care fascilities. That law REQUIRES that two election officials – one from each party take ballots to the fascility and oversee the voting – much as is done at the polls. So there is no possibility of fraud.
In 2016 there were about 14,000 ballots from senior fascilities in MI collected in this way.
In 2020 the requirement for election officials to come to fascilities and supervise voting were ignored.
Almost 150,000 ballots were received from MI senior centers in 2020. There is no chain of custody on any of these ballots.
Many came from demensia wings, some came from patients who are on life support, maqny came from seniors who swear they were never provided a ballot.
