The Deepfake Privilege? The Justice Department Makes Startling Claim to Withhold the Biden-Hur Audiotape

We have been discussing the dubious constitutional basis for President Joe Biden withholding the audio tapes of his interview with special counsel Robert Hur. I have previously written that the claim of privilege makes little sense when the transcript of the interview has already been released. It seems curious that Biden is claiming to be the president “who cannot be heard” in withholding the audio version. It just got wackier as the Justice Department seeks to create a new type of “Deepfake privilege” that would effectively blow away all existing limits on the use of the privilege when it comes to audio or visual records of a president.

Multiple committees are investigating Biden for possible impeachment and conducting oversight on the handling of the investigation into his retention and mishandling of classified material over decades. Classified documents were found in various locations where Biden lived or worked, including his garage. The mishandling of classified material is uncontestable. Broken boxes, unprotected areas and lack of tracking are all obvious from the photos.

Biden made the situation even worse with a disastrous press conference in which he attacked Hur and misrepresented his findings.

Hur’s ultimate conclusion that Biden’s diminished cognitive abilities would undermine any prosecution left many dumbfounded. After all, the man who is too feeble to prosecute is not only running a superpower with a massive nuclear arsenal but running for reelection to add four more years in office.

From impeachment to oversight to the 25th Amendment (allowing the removal of a president for incapacities), there are ample reasons for Congress to demand information and evidence from the government on these questions. Congress is also interested in looking at repeated omissions for “inaudible” statements. Under this sweeping theory that Biden can legitimately withhold these recordings under executive privilege, any president could withhold any evidence of incapacity or criminality.

As previously explained, the claim that the audiotape but not the transcript remains privileged is hard to square with precedent or logic. However, now the Justice Department appears to be pivoting with a new claim with a late Friday filing.  The filing obtained by Politico states that the audiotape must be withheld due to the risk that it could be altered by artificial intelligence and passed off as authentic in a deepfake release: “The passage of time and advancements in audio, artificial intelligence, and ‘deep fake’ technologies only amplify concerns about malicious manipulation of audio files.”

Consider the implications of that argument for a second. It would mean that any visual or audio recording of the President could be withheld due to the danger of digital or other manipulation. It would eviscerate any existing limits on privilege assertions.

It is also absurd since you could create such fake recordings using the transcript and Biden’s voice from countless interviews through AI programs. The Justice Department acknowledges that obvious logical disconnect by noting that the release would make any fake version more credible.

“To be sure, other raw material to create a deepfake of President Biden’s voice is already available, but release of the audio recording presents unique risks: if it were public knowledge that the audio recording has been released, it becomes easier for malicious actors to pass off an altered file as the true recording,.”

The filing is logically and legally absurd. It is also dangerous.

For a president who is already carefully insulated from questions and controlled in public appearances, the argument would allow staff to completely control any public or, more importantly, congressional review of his actual speech and discourse.

In seeking to prevent “malicious actors” from altering reality, the government is claiming the right to frame reality as an inherent constitutional prerogative.

The argument ignores that, if an audiotape is released, it is harder to pass off a fake as genuine. As it stands, actors can claim tapes as leaked or derived from other sources. In the absence of an official tape, such arguments can be difficult to refute.

The fact that this spurious argument is being made by Merrick Garland’s Justice Department is another disappointing sign that he has abandoned his pledge to remain apolitical in office. This litigation is clearly designed for one overriding purpose: to delay any release until after the election when it cannot harm the President.

It is the legal version of a deepfake — misrepresenting the law to mislead citizens into believing that they are better off with less information on the credibility and competence of their president.

    Here Turley presents a seemingly logical concern. If the special counsel honestly thought Biden appeared befuddled, throughout the deposition, then Congress should learn how lucid Biden sounded.

    But Trump’s short attention span renders him totally unfit. Presidents ‘need’ the ability to absorb information!

    Yet only fools would think Joe Biden could stay awake for hours of testimony. Especially if Robert Hur was even half-sincere in ‘his’ evaluation.

    The truth is this election is totally ridiculous! In a normal America neither Biden nor Trump would be seriously considered for the presidency.

    1. You talk as if we haven’t already experienced the results of Trump being president. We have, and we got good results regardless of any alleged deficiency in his attention span (see below). Apparently other leadership qualities more than made up for any alleged weak attention span.

      What did we get with Trump’s short attention span which was compensated for by other leadership qualities:

      – secure southern border
      – violent crime under control
      – energy independence and energy exporting
      – affordable gas and groceries
      – low inflation
      – historically low unemployment especially for minorities
      – highest real wages in half a century
      – high property values
      – high stock market
      – Title 42 and remain-in-Mexico enforced, thus reducing human sex trafficking and deadly fentanyl infiltration into U.S. communities, as well as drowning and heat deaths of the migrants themselves (mostly children)
      – no defunding of police
      – no war in Europe
      – criminal justice reform
      – trade deals benefiting America, and American industry competitive vis-à-vis China
      – reduction of regulatory burden on small businesses
      – no being beholden to globalist elites (e.g., Davos crowd) who despise free markets and America’s economic system
      – no political weaponization of the Justice Department or FBI
      – no labeling of concerned parents as domestic terrorists
      – no wokeness in the military
      – no catastrophic Afghanistan withdrawal weakening America’s position in the world
      – China and Russia don’t dare act aggressively
      – no being in thrall to the green cultism and waging war on our best energy sources thereby depressing civilization into a state of poverty
      – no slandering half of the American electorate as alleged fascists (odd that fascist now means someone who wants to *reduce* size and power of the central government and to *oppose* state-corporate joint action to suppress dissent — the exact opposite of what fascism previously meant)

I was juror in a trial that lasted from Thanksgiving to Easter. All the jurors complained about boredom while the lawyers pumped up their charges. The court clerk fell asleep and his tie started playing Christmas carols as he fell forward against his desk. If Trump really fell asleep or has a short attention span the 90% of the main stream media would be playing it to its hillt.

      You seem to think that the Judge and the Jury were entitled to Trump’s rapt attention. They were not.
      Trump’s defense did an excellent job of tearing apart a fraudulent case. Many on the right rant that the prosecutors and the judge illegally and unconstitutionally stacked the deck, and they did, and Trump should thank them for doing so as that is what will get this easily overturned.

      But the verdict in this case was for-ordained. Only a few people on the far left beleive that those on the left are cabable of separating political differences from crimes.

      All the ranting about star chambers, and third world countries and banana republics is entirely about those other places in the world where the wrong political views is a crime. Where trying to win an election to defeat those with power is a crime.

      This Jury was going to convict Trump of whatever they were asked to, because Trump beat Hillary in 2016.

      The overwhelming majority of us new that from the start.

      An honest prosecutor never would have brought this case – there is no crime.
      An honest judge would have dismissed it immediately,
      and an honest Jury would have voted not guilty unanimously in the first 30sec of deliberations.

      What those of you on the left do not understand is that the REAL trial was occurring OUTSIDE the courtroom in Manhattan.
      And it was those of you on the left who were on trial. It is Trump who was the prosecutor and it is voters who are the judge and jury.

      We are only starting to see the verdict, but it appears to be the left is guilty of abuse of power on all counts.

      Trump is not going to win NY or WA – but he has sliced Biden’s lead in those states by more than half.

      Trump is going to win the popular vote – possibly by 10M votes.
      Regardless he is going to win it by more than enough to make democratic election fraud both impossible and irrelevant.

      States like MN, ME, NH, NJ, VA and NM are in play. Trump will not win all of those or even most of those – But Biden is going to have to waste lots of money and political effort to avoid losing them – and Biden’s only road to victorty requires winning all of them.

      Biden is at serious risk of losing the Democratic EC votes of the two weird states – NV and ME – and losing either of those makes Biden’s route to an EC victory nearly impossible.

      In the midst of orchestrating this massive political turn around – Trump has managed an enormous business empire, nearly tripled his own net worthy, united his political party, and fought off endless weaponized political lawfare.

      I hope to be 1/10th as capable when I am Trump’s age.

      The events in the courtroom in NYC were inconsequential.

      As someone else pointed out – the voting public has already spoken on this issue.

      Bill Clinton lied under oath TWICE about sex, and engaged in obstruction of justice – about sex TWICE.

      After having done so his polls were higher then Ever.

      The crimes for which Clinton was impeached for, and which he was forced to surrender has law license, and publicly admitted were far more serious than that alleged regarding Trump.

      If Democrats are actually right and this tanks Trump’s political chances – that would prove that the left half of this country is deeply hypocritical.
      That they think a democrat lying under oath about Sex is inconsequential, but a republican allegedly lying about sex in private business documents is disqualifying.

      The Trial that mattered occured outside the courtroom, and Trump appears to have won that.

      He was definitely paying attention to what mattered.

      I share the commonly held opinion that the Great Lockdown of 2020 was the worst policy decision ever in the history of the planet. Vaccine development was rushed.

        The “Right” approach was to do even more to encourage the rapid development of the vaccine.
        To grant actual immunity from liability for a limited time, in return for FULL public disclosure.

        I do not KNOW this, but I beleive that a successful and less dangerous covid vaccine was and is possible.

  7. Jonathan: There has been a lot of Monday morning quarterbacking about DJT’s conviction on all 34 criminal counts. You call the verdict a “travesty”. So does House Speaker MAGA Mike Johnson. He is bizarrely asking SCOTUS to intervene. Johnson says he has met with conservative members of the Court (no doubt Thomas and Alito) and they share his concerns. Johnson says: “I think the justices on the court—I know many of them personally—I think they are deeply concerned about that, as we are. So I think they’ll set that straight”. Really?

    When was the last time a Speaker of the House asked the SC to intervene in an ordinary state conviction of a criminal defendant? Never has happened. But Johnson and the MAGA crowd seem to think the right-wing conservative majority on the Court can do anything–find a way to overturn DJT’s conviction. That’s not how the court system works. DJT will have to go through the normal appellate process in NY. After DJT likely loses all his appeals in NY he might try to appeal to the SC–arguing his federal “due process” rights were violated. That’s a slim reed because there does not appear to be any federal Q in this case–no violation of DJT’s Constitutional rights of due process because he did get a fair trial.

    And what is DJT’s campaign doing in response to the NY jury verdict? They are trying to out the jurors so they can be doxed or worse. Lara Trump, DJT’s head of the RNC and his daughter-in-law, was on right-wing Newsmax endorsing the “X” post of right-wing commentator Dinesh D’Souza saying that MAGA supporters should not respect the jury verdict. The Newsmax host Carl Higbis told Lara Trump: “These jurors are going to be…they’re going to find out who these people are”.

    So there will be continued attacks by DJT and his supporters in the right-wing media to out the jurors and the prosecutors. On “X” one person put out the home address of Alvin Bragg. Another said: “1,000,000 men (armed) need to go to Washington and hang everyone. That’s the only solution!”. No wonder you probably won’t find any juror who will agree to an interview. They were all “Anonymous” for a reason. They know what the head of a criminal syndicate is capable of–revenge! If I was one of the jurors I would want to take a long cruise and keep my head down.

      Many other consequential republicans have noted that whether Trump has disavowed Revenge as president – that does not mean his appointments will feel the same.

      It is very likely that Republicans take the house, the senate and the WH in 2024.

      I would be very surprised if one of the first orders of business for republicans would be to end a few of the remaining Fillibuster options – such as Presidential apointments. as well as ending blue cards on judicial appointments.

      I do not expect Trump to go after his enemies in 2025.
      I fully expect that Trump will clean house at DOJ and FBI and that those he brings in are going to be much more interested in Revenge.

      Regardless, this nonsense is going to get to SCOTUS one way or another soon enough,
