“Conscience doth make cowards of us all.” Those words from Hamlet captured the moral dilemma for many of us as we face the costs of conscience.
For each of us, there often comes a moment when our principles are put to an undeniable and unavoidable test. It may be as simple as cheating on a test, shoplifting a product, or admitting to a wrong. It is natural to want to avoid such moments, particularly when we cannot even admit to ourselves that we may not be the person we have long claimed to be.
For Attorney General Merrick Garland, that moment of truth has finally arrived. Garland has long maintained that he is an apolitical attorney general who does not even consider the political consequences of his actions. Over the last three years, some of us have questioned that commitment in a series of actions or, more importantly, non-actions. Yet, Garland has always been able to evade responsibility by shifting decision-making to others or claiming a lack of knowledge.
Yesterday, Garland ran out of room to maneuver when three House committees (Oversight, Judiciary, and Ways and Means) sent him formal referrals for the perjury prosecution of Hunter Biden and his uncle, James Biden. The evidence of false answers to Congress is overwhelming and Garland’s department has prosecuted Trump associates and others with far less in past cases, including the prosecution of former Trump National Security Adviser Michael Flynn.
Here is the Committee’s summary of the allegations, which I also previously discussed in a column:
During his deposition, Hunter Biden made false statements about holding a position at Rosemont Seneca Bohai (RSB), a corporate entity that received millions of dollars from foreign individuals and entities who met with then-Vice President Biden before and after transmitting money to the RSB account that then transferred funds to Hunter Biden. After deposing Hunter Biden, the Committees obtained documents showing Hunter Biden represented that he was the corporate secretary of RSB.
Additionally, Hunter Biden during his testimony relayed an entirely fictitious account about threatening text messages he sent to his Chinese business partner while invoking his father’s presence with him as he wrote the messages. Hunter Biden testified he had transmitted this threat to an unrelated individual with the same surname. However, documents released by the Committee on Ways and Means demonstrate conclusively that Hunter Biden made this threat to the intended individual, and bank records prove Hunter Biden’s Chinese business partners wired millions of dollars to his company after his threat. A portion of the proceeds has been traced to Joe Biden’s bank account.
During James Biden’s transcribed interview, he stated that Joe Biden did not meet with Tony Bobulinski, a business associate of James and Hunter Biden, in 2017 while pursuing a deal with a Chinese entity, CEFC China Energy. His statements were contradicted not only by Mr. Bobulinski, but Hunter Biden. Mr. Bobulinski also produced text messages that establish the events leading up to and immediately following his meeting with Joe Biden on May 2, 2017.
These are straight-forward questions and answers. More importantly, both men knew and prepared for these questions. They were widely discussed before their testimony. They appear to have knowingly lied. The question is what Garland is now prepared to do about it.
For Garland, a bill has come due. I supported his appointment as Attorney General because I respected his integrity and intellect as a federal judge. I believed his claim that he would not allow political considerations to cloud his judgment. I grew more critical as I saw Garland struggling to avoid decisions that would work against President Biden or his family.
Now, Garland has what appears flagrant perjurious statements made by the President’s son and brother. Given the fact that these were anticipated questions, the false answers appear premeditated and egregious. Hunter and Jim Biden displayed a sense of impunity in denying facts that the committees (and many commentators) believe are well established on the available evidence. Those facts were highly embarrassing to the Biden family and they allegedly chose to lie rather than admit to them.
The fact that such alleged false statements occurred in the midst of an impeachment investigation only magnifies the concerns. This was an effort to establish the President’s knowledge of a massive corrupt influence peddling operation maintained by his family.
The gun charge in Delaware is a relatively minor criminal allegation. This is far more serious and could impose far greater punishment for the President’s son.
In the Trump cases, the Justice Department moved with impressive speed in going to grand juries against figures for false statements or contempt of Congress. There was little handwringing, no hem and hawing.
So Garland’s moment of truth has arrived. He will either have to meet it or shrink from it. Either way, the Attorney General is about to give the full measure of himself and his office.

Dear Mr. Turley, I would like to give a “Shout-out” to S. Meyer and to my favorite, GEB. As much as I appreciate your articles, I learn so much more form the folks who respond. Thank you for providing a platform for people to communicate with others over the current daily topics.
Ask your hero for a constitutional citation prohibiting secession.
If secession is not prohibited and fully constitutional, everything Lincoln did must be repealed and extirpated, starting with the “Reconstruction Amendments” of Karl Marx and moving on to his many other invalid, illegitimate, illicit, and unconstitutional acts, just as Dobbs repealed Roe v. Wade 50 years retroactively.
I too had a glimmer of hope when Garland became the A/G as did some of the others writing here. In the back of my mind, at least, was the possibility of him siding with President Biden, but I thought perhaps he would be above the politics raging there. I did not think Mr. Garland would out right tell falsehoods. That was wishful thinking. I blame Democrats and their leaders for the poison that makes up the atmosphere in Washington, D.C. They are always attacking the person instead of the policy, interrupting witnesses giving testimony and shouting down anyone who opposes them. It is my hope that the Democrats lose big this November. They deserve it for all of the nonsense they have unleashed upon the Nation over the last 8 years, plus.
Garland is without honor, integrity, courage, and proves himself unfit for the office he holds and is without doubt a malignant cancer that threatens our very system of Justice.
That is beyond dispute.
He has proven that clearly and without remorse during the recent past.
One thing that can be done to remedy the problem is to see Trump elected for a second term in Office and the replacement of Garland with a genuine Man of Principle for the Attorney General’s job……and I would see Professor Turley as a very good and qualified Candidate. There are others that would be a very good fit as well. Trump must be very careful in his selection of his AG upon his being elected and pick one that will play it right straight down the middle without favor or bias towards either political party or ideology beyond that of restoring the faith of the American People in the American Judicial System.
Or, he can appoint someone who will help him crush his enemies and make them both accountable and sorry. I’d watch that mini-series!
👍🏽
Why does Marjorie Taylor Greene hate Ukrainians so much?
Was she once jilted by her Ukrainian boyfriend?
Her hatred of them is so irrational.
I never asked her to protect me from the Ukrainians.
What are you referring to? That she doesn’t want to send billions more in American taxpayer dollars to be squandered on a pointless war that involves no American vital interests and risks plunging the world into WWIII and nuclear annihilation?
Anonymous, as a good conservative and someone who supports the great conservative voices on this site, people like Upstate, Lin, Estovir, Oldmankansas, Mespo, Lawyer, S. Meyer, GEB, Diogenes and many others, I have to disagree on this point. When Russia is aligned with Chine, our gravest threat, Iran and North Korea, anyone that fights them without our guys is doing us a service.
As a REAGAN REPUBLICAN I support weakening our enemies without our guys getting killed and Russia, by being aligned with China and Iran, is our enemy. It is too bad that the left loved the Soviets but then decided that Russia somehow equaled Trump and therefore turned them into enemy number 1.
Nixon turned China and Russia (the Soviets) against each other which made the US much stronger in comparison but now the left loves China and Biden/Obama and the progressives loves Iran and by extension hamas and hezbollah…but since Trump they also incongruously and hypocritically also now hate Russia.
When was the last time that Biden, the media, any progressive has been critical of China? When has any climate lunatic been critical of China? Why hasn’t there been a movement towards nuclear power? It is because the fools being played by China only want to hurt America and the west.
Dont feed the troll
Failing to help Ukraine is what would far more likely plunge the world into WWIII because Putin has clearly said that he intends to go after all of the former USSR countries, like Poland and the Baltic countries–they are all NATO allies that we are treaty-bound to defend. Of course, Trump, if he cheats his way back into power again would eschew our treaty because he owes Putin a favor. He would bloviate about “forcing” NATO countries to pay more for their defense–but that’s just more Trump BS. MTG is mentally ill and a disgrace to her state and Congress. But, the real reason is that Trump owes a favor to Putin for helping him cheat in 2016–just like Trump tried to pressure the G-7 to take Russia back and just like Trump sided with Putin over his own intelligence agencies at Helsinki. The delay in getting aid to Ukraine that Republicans caused has already caused a set back in the progress Ukraine made.
It has taken Russia over two years and they taken limited Ukrainian territory. You really think Putin could expand past that against other NATO countries? You clearly have no understanding of logistics and economics of warfare.
Trump did get NATO counties to increase their defense spending and actually strengthen NATO.
The Ukraine’s problem is not aid from NATO countries, but lack of manpower. We can send them all the aid as we have but without boots on the ground, men to take up arms and on the front line no amount of aid is going to amount to any difference. It is so bad, Zelensky signed a decree to allow foreigners to enlist in the Ukraine military. It is so bad, Zelensky lower the draft age from 27 to 25. It is so bad, Poland has offered to deport all military aged Ukrainian refugees back to the Ukraine. It is so bad, the average age of a Ukrainian solider is 43. There are even reports of men in their 50s and 60s fighting. It is so bad, Zelensky is canceling waivers of exempt military service and using press gangs for conscription. It is so bad, the recruits that do show up to fighting units after boot camp, dont even know how to disassemble and reassemble their rifles.
Despite US and other NATO countries training of combined arms warfare, the Ukrainians have resorted to WWII style tactics. So have the Russians. That amounts to a war of attrition. And Russia is winning. If you understood military tactics, strategy, the economics and logistics of warfare you would know that.
So. When are you going to fly over to the Ukraine and enlist? If you are too old, see again the above about 50 and 60 year olds fighting, when are you going to send your children or grandchildren to enlist? This is the problem with people like you. You are all about war as long as it is poor minorities who do the fighting and dying but you wont man up and do it yourself.
I know from experience. I was one of those poor minorities.

Poland was never part of the USSR. It was part of the Warsaw Pact. The word “Warsaw” is the big clue there.
She is trying to stop Biden’s proxy war with Russia that looks like it is heading for a real WWIII. It is the only sensible thing to do.
If you are so hell bent on war, you should fly over to the Ukraine and enlist. Zelensky signed a decree allowing for foreigners to enlist in the Ukrainian military. The average age of a Ukrainian solider is 43. There are even reports of men in their 50s and 60s fighting.
If you have real physical disability, like wheelchair bound, do you have children or grandchildren between the ages of 18 and 50 who could enlist?
I’m glad I was sitting down when I clicked on this piece. So Turley is discussing what he calls Garland’s “clear choice” between “principle and politics”? Is he kidding?
Since he went on the Fox payroll, in addition to appearances on the network, he publishes daily pieces echoing Fox talking points, selling himself as a vaunted “law professor “. Turley spins the Fox narrative—like pretending that no one knows what Trump was convicted of; harping about Cohen being a liar, while ignoring Trump’s endless lies—on and on— all part of the plan to undermine confidence in the rule of law and our judicial system—how outrageous for a “professor of law “ to sow distrust of the very system that he boasts about being a professor of.
The worst thing he published was a direct accusation that Judge Merchan was dishonest—Turley knows that if an attorney sincerely believes that a judge is dishonest he has a duty to report the judge to the Commission on Judicial Qualifications. Disagreeing with a judge’s rulings is not proof of dishonesty.
The there’s Republicans who endlessly waste time and resources with their committee hearings trying to get dirt on Biden—without success, who refused to bring the bipartisan Border Security Bill to the floor for a vote because their convicted felon candidate told them he needed something to attack Biden for, and then they harp about border security and Fentanyl coming in?
Republicans have promised not to pass any more legislation this year—solely to deny Biden any more legislative victories. Is that what they were elected for? Republicans voted down a bill yesterday to protect the right to contraception— something supported by about 90% of Americans, and something at risk thanks to the Dobbs decision.
How about Alito flying pro- MAGA flags on January 6th and thereafter and refusing to recuse himself from the Trump immunity case? Or, Thomas similarly refusing to recuse on that case even though his wife was directly involved?
How about Aileen Cannon allowing amici curiae to do oral argument on settled issues like the constitutionality of Jack Smith being appointed as Special Prosecutor—something literally unheard of for a district court? And she set aside an entire day to argue this motion —when any other judge would have summarily denied the motion. She is either in over her head or is deliberately dragging her feet to avoid a trial before Election Day—either way, she needs to recuse herself.
The only “principles versus politics “ dilemma Turley sees fit to opine on involves Garland and the Biden family—none of which has anywhere near the implications for the majority of Americans and the future of democracy that the antics of Republicans have.
So your attacks on Turley contain no denial of Turley’s points. Interesting and informative.
Gigi lays another steaming turd. Her mom would be so proud.
Here Gigi attempts to shame Turley for conduct EXACTLY like hers.
Right before she impugns the integrity of Supreme Court Justices, she says this
how outrageous for a “professor of law “ to sow distrust of the very system that he boasts about being a professor of.
She claims to be an attorney, which of course we all know is a fantasy. Nevertheless, the sheer irony and lack of self awareness is staggering.
In almost every one of her methamphetamine fueled rants, she takes time to “sow distrust” in the justice system.
I ask sincerely, if you have ever known or know of, a dumber kunt than Gigi, I want to hear about it.
Has anyone else noticed that Gigi is an expert on every single subject, yet she didnt know

Gigi, why do you even come to this site every day?
To ‘poke holes’ like your alter-ego ‘Dennis’ admitted? It’s not working.
To get your own blood pressure up, using your TDS whataboutism?
You certainly don’t show any respect for ‘Turley’ as you always refer to him.
You’re either being paid to come here and spew partisan BS

Its a strange illness. Look at the behavior of Elvis Bug lately. He has gone off the deep end. I almost think she and lawn boy could be one and the same.
Interesting interaction last night. The post was in lawn boys words, but with Gigi’s avatar and name. Almost like the person forgot which one they logged in under.
“So Garland’s moment of truth has arrived. He will either have to meet it or shrink from it. Either way, the Attorney General is about to give the full measure of himself and his office.”
***********************************
My prediction:
The moment of truth for Republicans came in 2019 when a jury convicted Roger Stone of making flagrant perjurious statements during House & Senate Intelligence Committees hearings on Russian election interference. The jury also convicted Stone of witness tampering & obstructing a Congressional hearing.
Turley is exactly right that the American public should be justifiably outraged when anyone makes false statements while testifying under oath at a Congressional hearing. We’ll soon see whether there’s equal justice when flagrant perjurious statements are made to Congress by relatives of a Democratic President or by a longtime associate of a Republican President.
In Stone’s case, the jury found the evidence was overwhelming for a perjury prosecution, yet Stone escaped punishment when Trump commuted Stone’s 40 month prison sentence.
“The jury found that the evidence was overwhelming” How did they indicate that?
edwardmahl, the federal jury indicated the evidence was overwhelming by ruling that Stone was guilty. Here’s a news report: “The panel of nine women and three men deliberated for less than two days before finding Stone guilty on all seven counts resulting from his September 2017 testimony to the House Intelligence Committee, which was investigating Russian interference in the 2016 election.”
A finding of guilt does not require “overwhelming” evidence. Jurors often make up their minds after opening statements, before any evidence is even presented. In a political case, they make up their minds when they find out who the defendants are.
“Jurors often make up their minds after opening statements, before any evidence is even presented.” The evidence included Roger Stone’s own text messages & emails which directly contradicted his sworn testimony. What evidence are you citing which leads you to conclude Roger Stone didn’t make multiple false statements to Congress?
Garland Meritless: A corrupt big-eared dwarf. Thank heaven this inept clown never made the SCOTUS….there are more than enough left-wing nut bags on the court as it is!
The referrals are useless. Professor Turley knows the AG has on obligation to act on the referrals. James Comer and Jim Jordan could not find anything impeachable about Biden. So they are now rummaging through the bottom of the barrel looking to anything to salvage their inquiry’s abysmal failure.
A congressional criminal referral is a non-binding communication to the DOJ. A congressional criminal referral does not require the DOJ initiate a prosecution.
Garland has no real obligation to answer to the referral at all.
Yeah, why would the head of the justice system want to
do his job and look into very obvious crimes?
Wow George, you’re so convincing!
His name is Svelaz
Then why does Garland answer to referrals only when it’s against conservatives? There’s plenty of evidence that the Biden family received money from China & Russia., you just don’t want to admit it and Garland does not want to prosecute it.
Those referrals were for contempt of congress and ignoring subpoenas. Congress has authority to issue citations for contempt of congress by committees or specific legislators. THEN the citation must be voted on by the FULL house and pass before the DOJ can prosecute. A criminal referral has no binding authority without a full vote from either chamber. Perjury is not a crime congress can issue a citation in order for the DOJ to prosecute.
This is why this criminal referral toothless and non-binding. Garland knows this and he is not obligated or required by law to do anything about it. Perjury is extremely difficult to prove if it was alleged to have been committed in a congressional hearing. The burden of proof would be on congress to prove that the person committing penury did so willingly and knowingly. Jordan and Comer can’t prove that and Garland knows that. So it’s pointless to pursue it when the law does not require him to.
Sad to say but if Garland’s legal actions can indeed be politically compromised, the Senate rejection he received when Obama nominated him for Supreme Court was the right thing to do.
The last 3.5 years have proved there’s no “if” about it. It’s now beyond doubt that the Senate saved us from a terrible Scotus pick.
When the entire US DOJ, together with POTUS himself, becomes a criminal enterprise involved in election interference, who is left to prosecute?

TDS is lethal, Sicko . Seek help….although it maybe way too late.
‘So Garland’s moment of truth has arrived. He will either have to meet it or shrink from it. Either way, the Attorney General is about to give the full measure of himself and his office.’
He’d have to believe he did something wrong, first. I admire our host’s optimism, but it just isn’t so. To the modern left, laws are tools of control, only to be taken seriously when it is to their benefit. The destruction they have wrought is incalculable, and they’ve gone too far, they are a regime; they couldn’t walk it back now if they tried. I do not expect anything different from what we’ve already witnessed over the past number of years when they still exacerbate their misdeeds weekly.
If any modern liberals still possess the ethics they claim, it’s time to jump ship from the DNC and prove it – that would actually be more meaningful. I’m not holding my breath on that front, either. I’d love to be wrong, as this is madness.
“To the modern left, laws are tools of control, only to be taken seriously when it is to their benefit. “
James, that is all one needs to know. Excellent statement.
Garland has been so incredibly partisan since taking his position, and we all know why.
He will continue to seek vengeance against Republicans, because they blocked his seat on the SCOTUS.
He can try to deny that, but it’s clear with every lie he tells Congress, and every time he ignores a
Democrat crime, while dispatching DOJ operatives to help prosecute the most minor Republican crimes.
This claim is likely not true:
“Additionally, Hunter Biden during his testimony relayed an entirely fictitious account about threatening text messages he sent to his Chinese business partner while invoking his father’s presence with him as he wrote the messages. A portion of the proceeds has been traced to Joe Biden’s bank account.”
The other Zhao is not fictitious. It is Henry Zhao of Harvest Financial Group.
In the July 30, 2017, WhatsApp message from Hunter Biden to Henry Zhao, Biden wrote: “I am sitting here with my father and we would like to understand why the commitment made has not been fulfilled. Tell the director that I would like to resolve this now before it gets out of hand, and now means tonight,” Biden continued in the message. “And, Z, if I get a call or text from anyone involved in this other than you, Zhang, or the chairman, I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direction. I am sitting here waiting for the call with my father.”
Biden said the message was sent to the wrong person. Biden said the message went to “Henry Zhao who had no involvement, who had no understanding or even remotely knew what the hell I was even goddamn talking about” rather than Raymond Zhao who was “connected to CEFC,” the Chinese energy company for which Hunter Biden was doing business.
And so when Raymond Zhao called Hunter Biden the next day, he said, it was “not related to the message that was sent. I speak to him the next day. They’re two completely different sets of messages. One goes a number because, I made the goddamn — excuse my language again — because I made like an idiot, and I was drunk and probably high, sent a — this ridiculous message to a Zhao, to a Henry Zhao. But then the next day, I speak to a Raymond Zhao, who has never received the message that Henry Zhao got.”
This is a problem with authentication. If HB had access to the Whatsapp message threads (rather than a curated list of messages put together by the committee), this would be easily sorted out.
Well we all make mistakes and the Professor has surely noted to himself that he has made a few. I did vote for Carter twice (he was a very good governor) but then came around to the right side of things consistently. 2008 I neither voted for Obama or McCain. Simply could not stomach either one. Still can’t.
On the other Hand I did visit Normandy within the past 20 years and it still is one of the greatest things I ever did. To look at Pointe Du Hoc, and know that Rangers climbed up that precipice and took the position is daunting to almost unbelievable. The entire coast and the towns back from the coast and the cemetery evoke the semblance of a shrine and a feeling of awe, pain and thankfulness. “The Last full measure of devotion” is brought home in searing clarity. Thats when you stand there and wonder to yourself, “could I have done that?” Certainly makes you feel small and almost inconsequential. They did it but could I? You simply have to think that while you are there, if you’re honest with yourself.
Those Stark Crosses and Stars of David silently answer that question for those lying there.
A little know fact of D-Day was that the 28th Inf division had trained to be one of the assault divisions that day but was pulled out of the lineup because Patton wanted a trained amphibious assault division available when 3rd Army was being set up for the breakout phase. Patton was unsure that the initial assault would succeed and he wanted to make sure he had a division that could fight its way ashore if necessary. As history shows, D-Day was successful and the 28th came across Omaha Beach in mid July.
My Dad was in the 28th Inf Div. So he was not in the cemetery at Normandy. But I did get to follow some of the movements of the 28th through France as they progressed through St Lo and Avranches and then made the turn to the east and arrived in Paris and marched down the Champs-Elysees on liberation.
One of the most emotional sentences in Literature about sacrifice is at the end of the “The Bridges at Toko Ri” by James Michener. The Film was also not bad. I would rec both.
GEB – thanks for that. I enjoyed reading it.
GEB,
Thank you for sharing that.
Watching Garland and Mayorkas answer, or not answer, questions is one of the most maddening and frustrating things anyone with an ounce of logic and intelligence can stand. They look right at the questioner and either lie, obfuscate or filibuster until the person asking moves on out of desperation.
Mayorkas is a true believing lunatic, you can see it in his eyes, and Garland is just a weak, petty little apparatchik doing the party’s bidding. This is Goebbels, Hiss, Bormann type of guy or any of the Iranian “leaders’ following the ayatollah or the men doing Xi’s or Kim Jong Un’s bidding. They are all bureaucrats of no morals and Garland and Mayorkas are no different.
I can also add Peter Strozk and all of the little FBI goons that went after Trump in order to appease Obama.
You do the Nazis a disservice aligning them with the likes of democrats.
hullbobby: Agree, agree, and agree.
(On a different plane, I add all the faithful little (partisan) media twits, like ABC’s George Stephanopoulos and NBC’s Kristen Welker (who furthers Chuck Todd’s partisan tactics).
True fact.
Good old weenie boy George dated his sister. (This is a factual statement btw)
The facts:
His younger sister wanted to go to her prom, but didn’t have a date.
George came back from college and took his sister to her prom.
(Note: If I told you how I know this… I’d be outing my real identity. )
Now in truth, George is a mama’s boy and did a good thing.
Yet it is also true that taking his sister to her prom is a date, so that its not a stretch to say he ‘dated’ his sister.
Its all a question of how you spin the facts and allow the reader to draw a conclusion. I mean I could have joked about the after prom party… but that would be in poor taste.
This is something the MSM routinely does, including George.
As to George… he’s one of those kids who in their senior year… joined the clubs that would look good on a college application.
For example… George joined the Debate team only in his senior year. Personally I’d consider that being a poser.
Another fact about George. Napoleon complex. You saw it in the videos of him on a phone threatening someone while he worked for the Clintons.
In High School most hit their growth spurts. George stayed little.

Post Election/Post Inauguration in 5 to 7 months – He’s resigning. An Administration change is just the excuse to exit gracefully. When one is looking for “crack anytime, anywhere,” of course one would want a handgun. That’s in the nature of dangerous enterprises.
The handgun wasn’t for duck hunting. The verdict writes itself, but corrupt Democrats don’t convict corrupt Democrats. It will be a hung jury.
My strong advice for honest folks: stay out of Delaware. And run Delaware types out of your territory, too. What goes around comes around; otherwise, how do the learn?
Some would argue that FDR should have fought in Normandy himself.
From a wheelchair?
Yes. There a some who operate on a rule that, if you think war is the best course of action to take, you must participate in the war yourself. This includes the wives and childen who want their husbands and fathers to fight on their behalf. Gear up, Junior. You’re in the army, now.
