Garland’s Moment of Truth: With the Perjury Referral, the Attorney General Faces a Clear Choice Between Principle and Politics

“Conscience doth make cowards of us all.” Those words from Hamlet captured the moral dilemma for many of us as we face the costs of conscience.

For each of us, there often comes a moment when our principles are put to an undeniable and unavoidable test. It may be as simple as cheating on a test, shoplifting a product, or admitting to a wrong. It is natural to want to avoid such moments, particularly when we cannot even admit to ourselves that we may not be the person we have long claimed to be.

For Attorney General Merrick Garland, that moment of truth has finally arrived. Garland has long maintained that he is an apolitical attorney general who does not even consider the political consequences of his actions. Over the last three years, some of us have questioned that commitment in a series of actions or, more importantly, non-actions. Yet, Garland has always been able to evade responsibility by shifting decision-making to others or claiming a lack of knowledge.

Yesterday, Garland ran out of room to maneuver when three House committees (Oversight, Judiciary, and Ways and Means) sent him formal referrals for the perjury prosecution of Hunter Biden and his uncle, James Biden. The evidence of false answers to Congress is overwhelming and Garland’s department has prosecuted Trump associates and others with far less in past cases, including the prosecution of former Trump National Security Adviser Michael Flynn.

Here is the Committee’s summary of the allegations, which I also previously discussed in a column:

During his deposition, Hunter Biden made false statements about holding a position at Rosemont Seneca Bohai (RSB), a corporate entity that received millions of dollars from foreign individuals and entities who met with then-Vice President Biden before and after transmitting money to the RSB account that then transferred funds to Hunter Biden. After deposing Hunter Biden, the Committees obtained documents showing Hunter Biden represented that he was the corporate secretary of RSB.

Additionally, Hunter Biden during his testimony relayed an entirely fictitious account about threatening text messages he sent to his Chinese business partner while invoking his father’s presence with him as he wrote the messages.  Hunter Biden testified he had transmitted this threat to an unrelated individual with the same surname. However, documents released by the Committee on Ways and Means demonstrate conclusively that Hunter Biden made this threat to the intended individual, and bank records prove Hunter Biden’s Chinese business partners wired millions of dollars to his company after his threat.  A portion of the proceeds has been traced to Joe Biden’s bank account.

During James Biden’s transcribed interview, he stated that Joe Biden did not meet with Tony Bobulinski, a business associate of James and Hunter Biden, in 2017 while pursuing a deal with a Chinese entity, CEFC China Energy. His statements were contradicted not only by Mr. Bobulinski, but Hunter Biden.  Mr. Bobulinski also produced text messages that establish the events leading up to and immediately following his meeting with Joe Biden on May 2, 2017.

These are straight-forward questions and answers. More importantly, both men knew and prepared for these questions. They were widely discussed before their testimony. They appear to have knowingly lied. The question is what Garland is now prepared to do about it.

For Garland, a bill has come due. I supported his appointment as Attorney General because I respected his integrity and intellect as a federal judge. I believed his claim that he would not allow political considerations to cloud his judgment. I grew more critical as I saw Garland struggling to avoid decisions that would work against President Biden or his family.

Now, Garland has what appears flagrant perjurious statements made by the President’s son and brother. Given the fact that these were anticipated questions, the false answers appear premeditated and egregious. Hunter and Jim Biden displayed a sense of impunity in denying facts that the committees (and many commentators) believe are well established on the available evidence. Those facts were highly embarrassing to the Biden family and they allegedly chose to lie rather than admit to them.

The fact that such alleged false statements occurred in the midst of an impeachment investigation only magnifies the concerns. This was an effort to establish the President’s knowledge of a massive corrupt influence peddling operation maintained by his family.

The gun charge in Delaware is a relatively minor criminal allegation. This is far more serious and could impose far greater punishment for the President’s son.

In the Trump cases, the Justice Department moved with impressive speed in going to grand juries against figures for false statements or contempt of Congress. There was little handwringing, no hem and hawing.

So Garland’s moment of truth has arrived. He will either have to meet it or shrink from it. Either way, the Attorney General is about to give the full measure of himself and his office.

    DOJ Indicts Doctor Who Exposed the Barbarism of “Gender-Affirming Care”

    A few years ago, Texas Children’s Hospital made no secret of its support for transgender medicine. Its doctors proudly administered puberty blockers, cross-sex hormones, and other medical interventions to children who self-identified as “trans.” Then the tone shifted. In the face of public pressure, CEO Mark Wallace announced that he was shutting down the child gender clinic. But doctors at the hospital, including Richard Ogden Roberts, David Paul, and Kristy Rialon, never stopped. The public would not have known if not for a courageous surgeon, Eithan Haim, who felt morally obligated to expose the subterfuge. He contacted me about how the hospital had lied about terminating the transgender medicine program, and that doctors were, in fact, continuing to perform sex-change procedures on children as young as 11.

    The story rocketed across the world. The hospital immediately went on the defensive. Within a week, Texas legislators passed a bill confirming that transgender medical procedures for minors were illegal.

    But the story also attracted attention from another powerful source: federal prosecutors. The Department of Justice has not shied from targeting political opponents of the Biden administration: former President Trump; conservative school board protesters; persons praying outside of abortion clinics; and now, doctors who dissent from transgender ideology.

  16. Turley Jumps On Retribution Bandwagon

    Speaker Mike Johnson (R-La.) announced a “three-pronged approach” Tuesday to go after the justice system following former President Trump’s conviction.

    The plan, according to Johnson, includes using the appropriations process, legislation brought to the floor and Congress’s oversight authority to take on the Justice Department.

    Last week, House Judiciary Committee Chair Jim Jordan (R-Ohio) announced he would “demand” that Bragg and Matthew Colangelo, another prosecutor on the hush money case, appear for testimony about “the unprecedented political prosecution” of Trump.

    Jordan fired off a letter Monday to House Appropriations Committee Chair Tom Cole (R-Okla.) asking that his panel include a number of “reforms” in the government funding process this year, such as nixing funding for the FBI “that is not essential for the agency to execute its mission,” eliminating federal funding for “state prosecutors or state attorneys general involved in lawfare” and getting rid of federal funding for federal prosecutors taking part “in such abuse.”

    Word has gone out to rightwing media and every MAGA Republican: “Democrats must be prosecuted wherever possible”.

    This call is coming from Donald Trump, of course. It’s essentially an an effort to blow-up the American judicial system. ‘If the system is unfair to Trump, then it has to be taken down completely’.

    Trump has already destroyed many institutions, so Justice is the logical next target.

    Hunter Biden, by the way, is currently on trial. So father Joe failed to put in a fix!

    With regards to AG Garland’s testimony yesterday, Republicans have only proven their case in rightwing media. No mainstream sources believe Comer’s committee produced a criminal case.

      Anyone who believes this statement should consider several facts: 1) Biden and his supporters were able to get the MSM to claim in October 2020 tht the laptop was fake.; 2) Biden’s Special Counsel let the Statute of Limitations to run on serious tax charges; 3) Biden’s Special Counsel agreed to an immunity deal promising to not prosecute Hunter Biden on any charge beyond the false gun application; and 4) it appears tha Biden was able to transfer money to his son for defense of his multiple prosecutions by funnelling money from somewhere via Kevin Morris.

      While Trump has promised that he will not seek revenge – because that is NOT what this country does – the left of course selectively edited the part where he said he would NOT seek revenge and left only the part where he correctly said he would be justified in doing so – another Hoax from the left.

      Regardless, Trump will not seek revenge – but many republicans will.

      I support red State AG’s engaging in the same political prosecutions until the Supreme court steps in and shuts all this down.

      There must be a consequence for this immoral conduct by those of you on the left.

    5. Hunter is not being prosecuted for any of the significant charges that involve Joe Biden.

      While the charges against Hunter are much more serious than those against Trump – they are still not all that serious.

      I personally do not think Hunter will be convicted – despite the fact that the case is a slam dunk – convicting a Biden in Delaware is nearly as hard as acquiting a Trump in Manhattan.

      While the judge is doing her job – and the case is solid, Hunter will be acquitted.

      And politically that may harm Joe nearly as much as the Trump conviction.

      Regardless if Hunter is convicted he will be Pardoned as Joe heads out the door.

      Pardoning Hunter before the election would be political suicide.

      But few will fault Biden for pardoning his son.

  18. In a funny way America is seeing the fallacy of enforcing process crimes when politicians break them. We live in a thicket of overlapping and intertwined and contradictory laws setting the table to charge anyone who rears their head.
