Below is my column in the New York Post on the vicious attacks being directed at Judge Aileen Cannon as she addresses pre-trial motions in the Florida prosecution of former president Donald Trump. The sheer hypocrisy in the media is overwhelming after denouncing any criticism of Judge Juan Merchan in the Manhattan prosecution. For Cannon, it is nothing short of a press pile-on.
Here is the column:
The politicians, the press, and pundits are in a feeding frenzy around Judge Aileen Cannon, the federal judge presiding in the Florida case against former President Donald Trump. There is a torrent of hit pieces and petty attacks on virtually every media platform.
What is impressive is the complete lack of self-awareness over the hypocrisy of these attacks. Just a few weeks ago, the New York Times and other media outlets went into vapors when anyone uttered criticism of Manhattan Justice Juan Merchan in another Trump case.
In 2020, Judge Cannon was confirmed in a bipartisan vote, with the support of liberals such as Senator Patrick Leahy (D-Vt.) and Dianne Feinstein (D-Cal.).
Now she is being denounced as a “partisan, petty prima donna, “wacko, crazy, loony, nutty, ridiculous, and outlandish,” and a “right-wing hack.” From the descriptions in the Washington Post, New York Times and virtually every mainstream media outlet, you would think that Cannon was a freak in the courtroom, raving uncontrollably at any passerby.
These critics often stress that she is an appointee of Trump, even though many Trump appointees have ruled against the former president on 2020 election issues. And these same figures denounced Trump for attacking the perceived political bias of Democratic nominees in some of his cases.
Cannon was randomly selected, as opposed to Merchan, who was hand-picked to try Trump even though he is a political donor to President Joe Biden and has a daughter who is a major Democratic operative.
Yet these same figures denounced those who questioned Merchan’s refusal to step aside or criticized his rulings against Trump throughout the trial.
In reality, the “loose Cannon” spin is utterly disconnected with her actual rulings.
She has ruled for and against both parties on major issues. That includes the rejection of major motions filed by the Trump team and most recently challenged Trump counsel on their claims that the Special Counsel is part of “a shadow government.”
Notably, when Cannon recently rejected the main motion for dismissal by the Trump team, the Washington Post buried that fact in an article titled “Judge Cannon Strikes Paragraph in Trump Classified Document Indictment.” The suggestion was that the striking of a single paragraph was more newsworthy than insisting that Trump go to trial on these counts. (Also buried in the article is a recognition that the removal of this one paragraph “does not have a substantive effect on the case.”)
Most recently, the left expressed nothing short of horror that Judge Cannon allowed the Trump team to argue a point of constitutional law in a hearing.
Scholars and former prosecutors (including former attorneys general) have argued that the appointment of special counsels like Smith are unconstitutional.
This is a novel and intriguing constitutional objection that is based on the text of the Constitution, which requires that high-ranking executive officers like U.S. Attorneys be appointed under statute or nominated by the president (and confirmed by the Senate).
Yet after the expiration of the Independent Counsel Act in Jun 1999, the Justice Department asserts the right to take any private citizen like Smith and effectively give him greater authority than a U.S. Attorney.
This glaring inconsistency has led to a number of challenges. Thus far, they have been unsuccessful, but none have gone to the Supreme Court. Cannon wanted to hear oral arguments before ruling on the question.
That decision has sent the politicians and reporters into another frenzy of faux outrage and indignation.
MSNBC legal analyst and NYU law professor Melissa Murray went on with host Chris Hayes to tell Judge Cannon to “stay in her lane” and mock her consideration of constitutional claim:
“Girl, stay in your lane. Stay. In. Your. Lane. So, yes, not only has the issue of whether the special counsel comports with the structures of constitutional law, that’s been settled. That’s been addressed in multiple courts. Settled. We don’t have to rehash that … If this were an actual issue it would ultimately be decided by the Supreme Court, not by a district court judge in Fort Pierce, Florida.”
It is a baffling lecture. Cannon is precisely in her lane in hearing a claim without controlling authority. The fact is that the Supreme Court has not ruled on the issue and many lawyers have objected to the summary treatment given the claim by other courts. The point of creating a record is to allow a full review that could well end up at the Supreme Court.
Who isn’t staying in their lane? Cannon’s colleagues.
The New York Times recently reported that two judges attempted to get Cannon to hand off the case when it was randomly assigned to her. So the suggestion is that two of her colleagues breached any sense of collegiality and confidentiality to contribute to a hit piece on Cannon.
It is worth noting that there was no reason for Cannon to decline the selection, particularly not due to her appointment by Trump. A variety of Trump appointees have ruled against Trump on matters without a hint of objection from the left.
While it is true that Cannon was just put on the bench a couple years ago, that did not seem to bother these same pundits in the Georgia case. Fulton County Superior Court Judge Scott McAfee was put on the bench only shortly before being assigned the Georgia case against Trump and associates.
Cannon is a true American success story and, if she were only to rule in favor of the left, she would certainly be the subject of glowing stories of how she went from being born in Cali, Colombia to joining the federal bench. Her mother escaped Cuba after the revolution and she grew up with a deep-seated faith in the rule of law. She graduated from Duke University and, after a stint as a journalist, graduated from Michigan Law School magna cum laude.
Yet there will be no “American dream” stories for Cannon like the ones that ran for Sonia Sotomayor after her nomination.
Cannon is a Republican and has the temerity to follow a conservative jurisprudence. For the media, that makes her unworthy (much like the lack of coverage on Justice Clarence Thomas’ incredible life story).
There is little chance that the scorched Earth campaign against Cannon will work. When your family escapes Communist Cuba and then the drug-ravaged city of Cali, partisan media hit pieces are hardly intimidating.
That may be frustrating for many in the media, but she is fulfilling the purpose of Article III of the Framers. She will rule and she will not yield.

A few points of clarification. The “partisan, petty prima donna” comment is a quote from a June 21, 2024 statement by former Trump White House attorney Ty Cobb.
The “wacko, crazy, loony, nutty, ridiculous, and outlandish” comment is a quote from a March, 2024 statement by Bennett Gershman, a Pace University law professor.
The “right-wing hack” comment is from the title of a September, 2022 article published by newrepublic.
None of those comments were actually published by the two news outlets being criticized. Criticizing these comments while only mentioning news outlets that did not make those comments is misleading in my view. I am left wondering what descriptions, if any, in Washington Post and New York Times make it seem like Cannon was “a freak in the courtroom, raving uncontrollably at any passerby.” The article doesn’t say.
I also wouldn’t characterize any of those comments as being “now.” Neither March 2024 nor September 2022 are reasonably close enough in time to be described as “now.” The June 21, 2024 statement is only a few days ago, but it still predates the hearings that Judge Cannon presided over through yesterday, and which seem to be the reason Mr. Turley published this column now. I am left wondering how the media reacted to the hearings. The article doesn’t say.

They felt she was in way over her head on this case. The facts of this case are pretty simple. trump even agrees with them. Classified documents were in mar a logo. Did trump have the right to have them there? The government says no trump says yes.

She can always overrule him, but if not then it would save her time and effort and move the case along more efficiently. She could delegate more routine and/or tedious matters to the magistrate while she focuses on more substantive matters such as, for example, constitutionality questions.

Everyone on this column should have heard the presentations about the Affordable Care Act at the Harvard School of Public Health where it really originated. That was in 2009-2010. Was at John Hopkins yesterday morning to mid-afternoon, and the train wreck from Obamacare is everywhere on site. To think JH was an illustrious medical center at one time. Now, the administrative burden has made physicians look like zombies, eye to eye interactions between front line staff and patients was the exception, staff computer screen time was de rigueur, patients were barely noticed except for the mandated EHR questions, and the patients were overflowing in the lobbies, it was just madness. I could leave the clinic areas fast enough.
Like America, I barely recognize medicine anymore. Patient-care for me is a top priority, as is med research, but from my vantage point, the health care system is being supported by a broken ventilator. Pull the plug. I also am impressed by Judge Cannon’s CV. That is quite a story. As I learned long ago, young does not translate to inexperienced. I would bet she could give many of those news hogs some real lessons about life and the law and the lack of it. Of course I think we established a few columns ago that the East of the Hudson Syndrome is not an entirely geographic finding but more a state of mind or mindlessness.
Her other transgressions are that she went to Duke Univ (as good as any in the Ivy League) and the Univ of Michigan Law School. Although I am a Boilermaker, since my wife and daughter graduated from there, I have no problem with recognizing that the Univ of Michigan is a world class university that many in the Ivy League would and should envy. I think history has put her right where she needs to be, irrespective of how she rules. She has seemed to really follow and know the law. I thought the progressives loved immigrants right up until they vote Republican.

Yet, George, with her so-called lack of experience, she remains one of the few judges in the news who maintains moral and ethical clarity. She will rule both ways based on the facts, while Judge Merchan will rule not based on fact but on what his masters want. Judge Merchan should be removed from the bench to make more room for more judges like Judge Cannon.

She’s inexperienced. She’s also way in over her head. The CHEIF judge in her district and countless legal experts are pointing out that her inexperience is causing problems. She got admonished by the appeals court for her poor decisions.
If she had any “ethical clarity” as you say she would have recused herself from the case long ago. She has presided over a grand total of FOUR criminal cases before this one. None as complicated as this one. Other far more experienced judges would have been better qualified than her. Her loyalty to Trump because he appointed her is a problem. The WSJ also ran a hit piece on Cannon. A few hours later, the WSJ had an opinion piece on her that was quite different. It compared this “controversy” to the statement of the 51 former intelligence operatives in that while both may be fact-free, the purpose is to get Joe elected.

The Times story comes in the wake of an order by Chief Judge William Pryor of the 11th U.S. Circuit Court of Appeals in Atlanta that cited an “orchestrated campaign” of more than 1,000 complaints to the court to have Judge Cannon forced from the case. Many of the complaints say she had an “improper motive” for delaying the trial. But Judge Pryor said “the allegations are speculative and unsupported by any evidence.”
The WSJ news and opinion sections often differ in their views. One thing I didn’t realize until reading a comment in the WSJ was that one of the “moderators” of the CNN debate is married to one of the 51 signatories to the above-referenced statement, so she’s known that it was all bs for at least 4 years.

Attacks? No. Criticisms are not “attacks”. Turley loves to characterize genuine criticisms as “attacks” because it adds a maliciousness to the characterization that is simply criticism.
Cannon is inexperienced AND way in over her head. Turley left out the scolding she got from the appeals court for her sloppy handling on a previous ruling. Cannon is clearly slow-walking the case as much as she can and she is entertaining all kinds of motions just to prolong the inevitable trial as much as possible. Criticism of Cannon’s handling of the case is warranted and earned. She’s been accused of showing bias towards trump as a trump appointee and even the appearance of being biased is a problem which Turley conveniently ignores. He “attacks” other judges for the same reasons he won’t “attack” Cannon. Turley has admitted early on that this case is the one that will get Trump in serious trouble due to the overwhelming evidence against him. Smith’s latest motion is a plethora of detailed evidence and witness testimony using Trump’s own co-defendants showing exactly why Trump’s lawyers latest motion is worthless and he’s made is so clear that even Cannon would be forced to acknowledge the defense’s argument is without merit. Cannon is precariously close to being removed if she continues granting these motions that more experienced judges would have dispensed with long ago.
Cannon is favoring Trump. That much is clear. But she’s doing it right up to the line where she can still preside without being accused of outright bias. Even her fellow judges have “attacked” her handling of the case. Judges far more experienced than her. She’s way in over her head and she has a pall of loyalty for Trump because he appointed her. Trump has already made statements praising her and reminding her that he appointed her and how she should be “grateful” for his…’wisdom’ for choosing her. She should have never, been handed the case.
Cannon is favoring Trump. That much is clear. But she’s doing it right up to the line where she can still preside without being accused of outright bias.
Speaking of being in way over her head, Nutchacha/Gigi/George calls ruling within unbiased, reasonable limits as favoring Trump.
For comparison, Merchon was criticized for extreme bias and ruling outside the reasonable limits of the law, all favoring the tyrannical state. The grounds for appeal are far and wide.
So yes you dolt, true justice favors the victims of tyrants. That much is clear.

The only reason Merchan was criticized as biased is because Trump whined about it constantly. Turley offered ‘support’ for those claims with legally questionable reasoning, as expected. Turley, who has a tendency to tell half truths and mischaracterize for the benefit of his more gullible and naive readers relies on that gullibility and naïveté to maintain some semblance of “credibility” as a legal scholar.
His job as a Fox News ‘contributor’ is to peddle the Fox News narrative. He’s not going to criticize Trump unless there’s zero excuse and even then he will treat it with kid gloves as much as possible.
Merchan ran his court professionally and according to NY law. Turley attacks judges like Merchan purely for the benefit of Trump’s supporters and Fox News narrative.

What is being done to Judge Cannon is nothing short of intimidation, much like the treatment being given to Justices Thomas and Alito (to force them to recuse from any J6 cases). CNN and MSNBC are practicing the pesonal destruction of conservative judges to guarantee a desired (Democrat) outcome. I think Judge Cannon was called a “Prima Donna judge” on one of these neworks, for holding a hearing on the appointment of Jack Smith as a special prosecutor.
Thank you Professor Turley for this column. I did not know about Judge Cannon’s background but it does explain why she is not easily intimidated. Your comparison to Justice Thomas is so apt!! His story is incredible and it is worth noting that Joe Biden was the one who tried with every dirty trick in the book to derail his confirmation. Judge Cannon will make an excellent SCOTUS justice someday. May God bless her and continue to guide and watch over her.
Turley didn’t mention the fact that prior to her appointment by Trump she had a grand total of four criminal Trials under her belt. Four. And they were nowhere near as complex as this case. Which is why the CHEIF judge in her district urged her to reconsider taking this case. A more experienced judge was telling her that this was not a case for an inexperienced judge like Cannon. But her apparent loyalty to Trump was greater than her ability to be rational.

Joe Biden has not figured out that inflation is cumulative. He still thinks wages automatically rise with costs. A typical democratic / progressive error. Obviously the classes in progressive thinking skip market forces and economics in general.
The greatest laugh I recently had was seeing someone rank Karl Marx as an economist. I think they were watching “Dark Matter” on AppleTV and got confused with the concept of multiple universes and saw Karl in another universe.

Ah, yes. They like to/have to ignore the fact inflation is in fact cumulative. So, they resort to using the current inflation numbers and try to then spin it as wages are higher, again, ignoring that pesky cumulative fact. Or, they try to use Core CPI which strips out the costs of food and energy to make things look better. A few months ago, economist Paul Kurgman tried to spin the economy is doing well . . . if you strip out food, energy, housing, and utilities. Yeah, try to tell that to that single mother of two who has to work a full time job and a part time one to make ends meet. Think she can afford to just “strip” those things out of her budget?
Then there is the Establishment survey vs the Household survey. One measures payrolls, the other measures actual jobs worked by people. But MSM will not talk about that.
