The Washington Post is reporting that Special Counsel Jack Smith may try to convict former president Donald Trump all the way through the election and up to 11:59 am on January 20th. After the oath, the Justice Department has long maintained that it will not prosecute a sitting president.
There is also a long-standing policy of the Justice Department to abstain from criminal proceedings before an election to avoid the appearance of trying to influence the outcome. Smith has signaled that he will discard that policy and that he is prepared to try Trump not only up to the election but through the election.
He is now reportedly willing to try Trump up to January 20th.
Smith has made trying Trump before the election the overriding priority in his two cases against the former president. He failed repeatedly to force a shorter schedule on appeal before the Supreme Court. His arguments were revealing. He suggested that the public should have a possible conviction before they cast their votes. It flipped the DOJ policy on its head in openly seeking to influence the election.
The Supreme Court was not persuaded, though Smith did succeed in effectively cutting the appellate process a bit shorter. He then lost in spectacular fashion before the Court on presidential immunity.
According to the Post, he is not giving up the ghost and is now committed to a trial running up to Inauguration Day: “Current officials, speaking on the condition of anonymity, expressed … that if Trump wins the election, the clock on the two federal cases against him would keep ticking until Jan. 20, when he would be sworn in as the 47th president.”
Even with Smith’s continued push to try Trump at all costs before the Inauguration, it could be a challenge. There is a 30-day period before the Supreme Court case is effectively returned to district court.
Judge Tanya Chutkan has been highly favorable for Smith and highly motivated in seeking a trial before the election. That led to problems highlighted in the recent opinion. Chutkan was so motivated that she failed to create an adequate record on these issues. That record will now have to be established.
If Chutkan rules as she did earlier, she is expected to be hostile to Trump’s claims on his conduct falling within official functions. However, she will need to make the record and her decision could again be appealed. The Court left clear guidelines that will make it difficult for Chutkan to, again, dismiss such claims.
Moreover, the pre-trial motions were stopped with the latest appeal. They must now be addressed. Finally, she pledged to give the Trump team over 80 days for preparation after the appeal, which will be added to the 30 days, the period for the remand record, and the pre-trial motions.
There is also the need for the court and Smith to deal with the Fischer decision limiting the use of the obstruction charges — impacting two of the four counts against Trump. As I have previously written, Smith has various options but could trigger a new reversal on appeal if he follows his signature inclination to resist legal limits.
In other words, Smith’s appetite for a trial before the Inauguration may exceed his ability to force that expedited schedule.

Biden would have dearly loved to have the economy, low inflation, record low black unemployment, and affordability of groceries, rent, fuel, and basic goods we all enjoyed under Trump’s presidency. Since this happened under Trump’s stewardship, Democrats simply cannot believe the prosperity they experienced was real.
Democrats colluded with the media to denounce critics who pointed to Joe Biden’s obvious cognitive decline in his 2020 presidential campaign. He’d call someone the name of someone who’d died, forgot how his own son died, made wild false claims about getting arrested with Nelson Mandela, lost his train of thought, forgot where he was. It was the early stages of when dementia becomes noticeably apparent. Democrats and the media told us to disbelieve our own eyes and ears, and helped get a man in cognitive decline elected president of the United States. Then they continued to run interference, as more people in frustration argued that his decline was worsening. Joe Biden had flash cards with directions to sit down, where to exit, and photos of journalists he was allowed to call on who would have vetted questions for his printed answers. He couldn’t function without a teleprompter, and even then made errors, such as reading the teleprompter directions. After having gaslit us for 4 years, the debate performance made the lie untenable. The media now acts as if Joe Biden suddenly exhibited dementia at the debate, without any prior signs at all. Previous desperate calls to look at his mental capacity failing were brushed off as total lies, that have nothing to do with the befuddled man at that debate.
Karine Jean Pierre has stood in front of reporters for days, flatly denied Biden had any dementia, and said he only had a “bad night”, because he was tired, and had a cold. Members of the Biden Administration and staff are colluding to hide the severe cognitive decline, that has now reached free fall, for a sitting American president, which prevents the application of the 25th Amendment. By their perfidy, they have propped up a man who is medically and neurologically unfit for office, and incapable of responding to any crisis that may arise. Whoever is actually running the country, be it FLOTUS or a group of people, refuse to relinquish power, and seek to get this poor, failing man reelected.
The world is heading towards WWIII, and Democrats are gaslighting voters, in the hopes they will reelect a dementia patient whose son traveled the world collecting millions from foreign actors in exchange for political favors.
If Trump does win the election, Democrat activists will resume efforts to sabotage his presidency, regardless of the risk that puts the country in.

It’s clear the best news reporters in Washington have failed in the first duty of journalism: to hold power accountable. It is our duty to poke through White House smoke screens and find out the truth. The Biden White House clearly succeeded in a massive cover-up of the degree of the President’s feebleness and his serious physical decline, which may be simply the result of old age. Shame on the White House press corps for not to have pierced the veil of secrecy surrounding the President.
Obviously, the President’s decline was a super hard story to report, even by those who wanted to get it, like the WSJ. Their story did not deliver, using mostly named GOP sources.
But I do think if enough reporters had pushed, the story was reportable. I worry that too many journalists didn’t try to get the story because they did not want to be accused of helping elect Donald Trump. I get that.
But this is no excuse for abandoning our first duty, which is to report the truth and hold power accountable. President Biden should be held accountable for his obvious lapses of mental acuity, even if there are periods of lucidity.
It is simply astounding for the entire country, including its most seasoned reporters, to be as shocked as everyone was by the ugly and painful reality of Biden’s debate performance.
And it is laughable and immoral for Democrats to blame the press now for over-reacting to that reality. The reports of how bad Biden was are certainly not exaggerated. Nor are the reports of Democrats in panic.

Who the heck does Jack Smith think he is to upend the justice system? He’s rogue and must be stopped, he has no mandate, and his persecution of Trump is beyond illegal, it’s treason.
My guess: Thomas gave Cannon the green light to declare Smith illegitimate. She rules he’s out. Eleventh Circuit agrees, Chutcan puts case on hold until the Supremes say yeah or nay. Trump gets inaugurated and this ends.
I doubt Cannon is going to find Smith illegitimate – though he is. But she may require radically more oversight by DOJ – as Smith is only legitimate if he is INFERIOR to a US attorney. I suspect she will also require DOJ to copntrol his budget.
But the immunity decision does open up a new way for Cannon to kill the case.
