“Partisan Mischief”: North Carolina Democrats Vote to Block Third-Party Candidates from Ballots

Months ago, I wrote a column about how Democrats have continued to try to block voters from being able to vote for candidates while claiming the mantle of the defenders of Democracy. This effort not only included Democratic Secretaries of State attempting to remove former president Donald Trump from the ballots, but efforts in the primary from the ballot. Many of these Democrats now calling for a “blitz primary” previously said nothing as voters were barred from having a choice in the primary. Now, in North Carolina, Democrats are seeking to bar third-party candidates from the general election . . . all in the name of perfecting democracy.

The Democratically controlled North Carolina’s Board of Elections voted against giving ballot access to new parties supporting presidential candidates Robert F. Kennedy Jr. and Cornel West. All three Democrats (Alan Hirsch, Jefferson Carmon, and Siobhan Millen) voted to prevent voters from being able to vote for Kennedy and West, though the decision will have to be reconsidered. Yet, even if reversed, they are preserving uncertainty as to whether they will be viable candidates in the minds of voters.

The excuses for this action are superficial and manufactured.

Chairman Alan Hirsch insisted that their organizations were “problematic” in how they gathered signatures and how Republicans may be supporting their efforts to allegedly “take away votes from Joe Biden.”

They also said that they were concerned that the third-party candidates were using the new party rules to gain an easier path to ballots. That is a bizarre objection. They are opting for the best approach under the existing rules. It seems openly partisan for these three Democrats to suddenly raise concerns over the existing rules when it could harm Joe Biden or the Democratic Party.

Yet, Democratic commissioner Siobhan Millen worked hard to rationalize what is a raw political muscle play to prevent voters from having a choice:

“If this board keeps rubber-stamping thinly veiled so-called parties, national operatives are going to continue to come in and keep manipulating our system. Allowing unaffiliated candidates to follow the more lenient new-party rules is allowing a blind eye to partisan mischief, potentially.”

If Millen wants to see partisan mischief, she does not have to look far. She and her colleagues are engaging in precisely such mischief to deny voters choices this election to try to bolster the chances of Biden in a swing state.

Democrats continue to claim to defend Democracy while resisting democratic choice and abusing the legal process. This glaring disconnect was evident when President Joe Biden spoke on the top of the Point-du-Hoc in Normandy on the 80th anniversary of D-Day. Biden again used the event to suggest that democracy was in danger in the United States with the upcoming election.

Yet, Biden has overseen widespread government censorship with federal agencies targeting those with opposing views on everything from elections and climate change to COVID-19 and transgender policies.

As Democratic secretaries of state sought to bar Trump from ballots, Biden refused to oppose the efforts. When liberal law professors and members demanded to pack the Supreme Court to guarantee a liberal majority, Biden refused to denounce it during the last campaign.

This is why some in the country may view Biden and the Democrats as existential threats not just to Democracy, but to themselves. They see a party that is engaged in efforts to cleanse ballots (of Republicans), censor dissenting voices and prosecute political opponents.

The effort in North Carolina continues this hypocritical and cynical narrative. These three Democratic board members just voted to prevent their fellow citizens from being able to cast votes for third-party candidates who are attracting increasing support among disgruntled voters.

    Nothing says defending democracy like banning candidates that follow the rules. What’s next, banning voters that followed the rules to vote?

        Everything Lincoln did subsequently, is illicit and unconstitutional, with emphasis on the failure to deport illegal aliens and the unconstitutional “Reconstruction Amendments.”

        America must be repealed back to the Constitution and Bill of Rights.

    In NC, political parties only need 13,865 signatures for recognition, while independent candidates need 83,188 signatures. In the petition script used by We the People to sign up voters, Kennedy is referred to as “an independent” rather than the representative of a new political party.

    We the People did not secure 83K signatures but it did meet the lower political party threshold. The legal challenge to their ballot access stems from whether the party was formed for the sole purpose of allowing Kennedy to circumvent NC’s tighter rules for independent candidates.

    While I think the difference in signature requirement is rather dumb, it was the GOP that enacted this requirement over Democratic Governor Roy Cooper’s veto in 2017 (SB 656).

    Before you delve into topics like this, please make sure you check your facts. This process would have been entirely avoidable had the GOP not created a different threshold for independent candidates with SB 656.

      1. You missed the point. My post was a response to Turley’s misguided blame on “Democrats” writ large for trying to prohibit block voters from the right to choose a third party candidate.

        Based on the letter of the law that the GOP drafted, voters will not be able to vote for a third party candidate.

        If you believe a suit that seeks to protect the arbitrary difference between independent and third party candidates is wrong, then Turley should be advocating that the GOP-controlled legislature change the law!

        As required by N.C.G.S. § 163-96(b), the organizers and petition circulators for the new party are required to inform the signers of the petition of the general purpose and intent of the new party.

        Despite this context, Turley writes: “If Millen wants to see partisan mischief, she does not have to look far. She and her colleagues are engaging in precisely such mischief to deny voters choices this election to try to bolster the chances of Biden in a swing state.”

        There is no “mischief” here. This is the way the statute was written. Allowing a new party to openly describe itself as “independent” would reduce this distinction to a nullity.

        Of course, none of this was discussed above because Turley did not appeal to statutory text. The only possible reasons for this omission are either (a) he was too lazy to conduct the research; or (b) he intentionally omitted the statutory language to make a misleading partisan claim.

  5. Ballot cleansing is the Democrats’ starting point for rigging elections.
    For example, in 2022, Gov. Gretchen Whitmer was facing a tough re-election challenge from James Craig, a former successful Detroit Police Chief (and, incidentally, African-American). Democrats were able to remove him and other GOP candidates from the ballot by challenging signatures on nominating petitions. (Challenging signatures on absentee ballots is called “election denial” and possibly “racism” if done by Republicans.)
    So, instead of being a political has-been, Whitmer is now in the running to be a Presidential candidate.

  7. Jonathan: What is more interesting is the farcical attempts by Republicans that would mandate their obsession with a requirement to prove citizenship in order to vote in federal elections. You are writing about your concerns about candidates being deprived of their right to run for office. Meanwhile, entire segments of the population are under attack by Republicans attempting to strip them of their right to vote.

    As you know, it has been a fact of criminal law for centuries that it is a crime to vote in a federal elections if not a US citizen. And yet, despite that, the Republicans are pushing this. Why? Clearly, this is just a Republican dog whistle and an attempt to disenfranchise people of color, specifically black and Hispanic Americans. As President Biden pointed out early in his presidency, it is extremely difficult for marginalized black and Hispanic Americans to obtain the documents accepted as voter ID.

    If Trump can manage to avoid being sent to jail until after the election, he will no doubt use the dictatorial powers SCOTUS has given him immunity from using to continue his racist attacks on black and Hispanic voters as well as our new migrant population. Perhaps it will be an inventive new version of a poll tax, but it will be coming just as certainly as his public endorsement and support for neo-Nazis at Charlottesville and statements that all migrants are vicious criminals or mental health patients.

    Republicans, as we have expected, are fully on board with Trump’s race baiting and attempts to ethnically cleanse state voter lists of black and Hispanic voters. This is one of Trump and the GOP’s threats to democracy that President Biden and Senator Schumer have been repeatedly warning the American people about for years. It is time that we as American people rejected Trump’s attempts to take America back to the 1800’s where there the rich like him owned and profited from slaves and those slaves were adjudicated as not having any civil rights.

      No, it's not. Furthermore, most polls have it at around a 70% issue. Democrat pollster Monmouth did a poll showing 80% support it. Meaning most normal people, including many blacks, Hispanics and the handful of Democrats who remain sane, want photo voter IDs to vote. Why? Because normal people have common sense.

      President Carter, a Democrat, and SoS James Baker, a Republican, chaired the BI-PARTISAN Commission on Federal Election Reform. Among the recommendations in their report was to require a photo ID to vote. They followed up with letters to the editor in the New York Times. In one letter, they cited a study which found that in several states with a disproportionately high black population, only about 1% of registered voters lacked a valid photo ID. All the states that have enacted the laws provide YEARS notice before the law goes into effect. That you think black and Hispanic Americans can't figure out how to get a photo ID to vote with YEARS notice suggests you don't think much of their ambition or intelligence.

      In addition, most of the states, if not all of them, provide the photo IDs for free. South Carolina's law even provided free transportation for people to get to and from where they needed to go to get the free photo IDs. With a state population of about 5 million people, a grand total of about 20ish people had used the free transportation option in the first year after the law was enacted.

      Puking up your party's propaganda just proves your brain has been poisoned by partisanship – or you lack the drive, ability or skill to do the most basic research.

      I am Hispanic and have zero problem with showing a government ID when voting.

      I was a victim of ID theft 15 years ago by some illegal immigrant because I have a Spanish name and my SS # works. I went out of my way to make sure he was prosecuted and deported. Guess I should been more “understanding” of his plight.

      I wonder if that makes me an “uncle tom” of this Hispanics? I need some upper middle class suburban white liberal to school me on this.

      Wonder if Mexico allows individuals to vote without an official ID? Or any other western country. Spoiler alert, they don’t.

    4. Every other voting democracy in the world requires a valid ID. Some also require a government issued letter stating that the potential voter is in the correct voting precinct. In the state I live in, California, anyone can register to vote. It is totally on the honor system and illegally registered individuals turn up all of the time, not by any government investigation (California is a one party oligarchy) but by a non-citizen wanting to be removed from the voting rolls who complains to media who then exposes this situation. With Democrats having been caught cheating in Bridgeport, CT, Paterson, NJ and Arizona and are clearly conducting rampant illegal vote harvesting in California it is obvious that individuals shouting about racist voter ID’s are merely trying to protect an illegal racketeering scheme.

    The board does have legitimate concerns about RFK’s party and how to obtained the signatures. I thought Republicans were all about election integrity and all that jazz.

    What Turley didn’t tell you,

    “ Both Kennedy and West’s parties were denied in June because of concerns that signature gatherers were misleading voters while asking for signatures. Staff for the Board of Elections contacted voters who signed petitions for both parties and then later signed affidavits to have their signatures removed. These voters were a very small minority of those who signed; West’s Justice for All party has over 17,000 validated signatures, and Kennedy’s We the People Party has more than 18,000, but there are fewer than 100 affidavits.

    Only nine voters who revoked their signature for Kennedy’s party were able to be reached, and none could explain the purpose of the political party, said Lindsey Wakely, acting general counsel for the State Board of Elections, during the meeting Tuesday. For West’s party, staff made contact with 22 voters, 12 of whom said they did not sign or did not remember signing the petitions.

    All of the organizations involved in obtaining signatures were subpoenaed by the Board of Elections, which is still waiting on responses. Staff members are continuing to verify if the unconfirmed parties communicated the “purpose and intent” of creating new political parties to petition signers, which they are legally required to do.

    Board member Siobhan O’Duffy Millen said that the current numbers may be indicative that voters did not know what they were signing. ‘

    Turley also “neglected” to mention the two Republicans on the board ALSO wanted to deny the constitution party a place on the ballot for the same reason the democrat majority wanted to deny the RFK’s.

    “ Both of the Republicans on the Board, Stacy Eggers IV and Kevin Lewis, voiced opposition to authorizing the Constitution Party, which would divide Republican votes, but ultimately voted in favor of it.”

        Nothing that drastic needs to be inferred of the professor. But it does point to the glaring problem of republicans suddenly forgetting the all important “election integrity” rhetoric and how it is necessary to fully vet the applicants. Right? If some voters who allegedly signed on the petition are saying they never signed or were not aware what they were signing it runs contrary to the rules.

        Here we have Turley being nonchalant about a valid issue regarding the legitimacy of the signatures and the sketchy methods the party used to get people to sign. Voter fraud was a big issue with republicans in 2020. Now, not so much? They are not outright denying the party to be on the ballot. They are doing their due diligence in following the rules and the investigation into some of the affidavits and interviews with some of the voters for RFK’s party showing some were not aware of what they were signing and some that stated they never signed for it raises suspicion. The party shouldn’t be granted certification until a full investigation is conducted. Voter fraud is a serious issue for republicans, right?

    Unless something changes and soon, she is voting third party. She is even considering ditching the Democrat party and registering as Independent.

      That’s good to hear. That’s tough information to come by when the dem narrative is so tightly controlled; it’s encouraging that many are waking up. Wish it had been after the 2008 election (I got duped that year too, in 2012, not so much), but I’ll take it!
