I have previously written how President Joe Biden is the most anti-free speech president since John Adams. For his part, Biden has continued to double down on his anti-free speech policies with the appointment of figures who have long supported bans and other speech controls. The latest such appointment is Andy Volosky, who was made deputy director of platforms for the White House’s Office of Digital Strategy. Volosky has been outspoken in support of banning former president Donald Trump from social media platforms.
In my new book, The Indispensable Right: Free Speech in an Age of Rage, I lay out the chilling comparisons between the Adams and Biden Administrations in the crackdown of free speech. For Adams, that led to defeat in 1800 when Jefferson ran in part on restoring free speech. To my surprise, Trump and his fellow challengers in this election have not made free speech a central issue to force Biden to defend the massive censorship system supported by his Administration.
The public does not support censorship. This is a movement that originated in higher education and has been pushed by the political and media establishment, not the voters.
Volosky will now help direct digital strategies for the White House. He previously praised the banning of Trump, asking “What took them so long?” in a 2021 blog post.
In Volosky’s blog post, titled “A New, and Hopefully Welcome, Standard,” he warned that “Twitter still allows the accounts of various world leaders, governments, and spokespeople, who use Twitter for what one can only describe as propaganda as cover for autocracy, to continue to use their platform.”
He praised how Democrats have “long advocated for regulating the [social media] platforms” and emphasized how active social media users like himself and others can “keep the platforms honest.”
He added that
“we can play a role in keeping the platforms honest and improving the positive role of social in people’s lives…It’s past time for the platforms to take content moderation and user safety seriously; as social media professionals, we should be ready and eager to make that happen, and we hope that [banning Trump] can be a small step in getting that ball rolling.”
Again, with the White House doubling down on censorship, Trump and others need to force him to defend his overwhelmingly anti-free speech record. The 2024 election can give voters the same choice that they faced in 1800. Democracy is not on the ballot, but free speech is.
So Biden’s crack marketing campaign team hires, Andy Volosky, a 27 year old obese kid fresh out of college with his degree in social media and texting, and they believe this strategy will work just dandy. Standing has ZERO to do with whether you can prove your case – and the supreme court ABSOLUTELY did not say the case was not proven. They almost NEVER do. Appelate courts – of which the supreme court is almost always, only address issues of fact when the lower courts have unbeleiveably egregiously erred in their findings of fact.
I am sure there is one somewhere sometime in history, but I can not recall a single supreme court case EVER where scotus has challenged the findings of fact of a lower court.

NARA BTW is forbidden from sharing the former presidents documents without either the permission of the former president or an order of the courts. Even the current president does not have access to the former presidents papers without going to court.

Regardless, even as you described it – within the constraints of civil service laws – that would be legal.
I would not that civil service laws protect government employees who have no policy making role. That means they may not as part of their employment have an opinion on those policies. They are free to criticize outside of work – inside of work involving themselves beyond enforcing and implimenting policies is verbotten – and they could be terminated.
Government employees who ARE in a policy making role – have no civil service protection.
The media is free to criticise Trump’s policies. Private citizens or non-policy making government employees are free to do so on their own time. Coingress and the courts are free to evaluate the policies of any presidency – the courts verify they are constitutional and conform with the law. Congress is free to conduct whatever oversight they want, and if they are unhappy with a policy that otherwise conforms to the constitution and the law – they can change the law.

People like me who support Mr. Trump simply want to be energy independent, have our taxes lowered, the government less intrusive in our lives, secure the boarders, end abortion, end lawfare, respect the 3 branches of our government, and let the police do their work. It seems to me that both free speech and Democracy are threatened by the current “progressive”/democratic party/leadership and their supporters. Trying to correct the un-constitutional executive orders, policies and actions being made by the current administration through the courts is like trying to bail out the Titanic with a few buckets. The only other practical, constitutional way to keep those mis-deeds in check involves electing better leaders.

Meanwhile, entire segments of the population are under attack by Republicans attempting to strip them of their right to vote.
As you know, it has been a fact of criminal law for centuries that it is a crime to vote in a federal elections if not a US citizen. And yet, despite that, the Republicans are pushing this with their deliberately mis-named SAVE act, making it mandatory to prove citizenship in order to vote. The Republicans want to reduce the unquestionable right to vote to a voting requiring a permission slip issued by Republicans. Why? Clearly, this is just a Republican dog whistle and an attempt to disenfranchise people of color, specifically black and Hispanic Americans. As President Biden pointed out early in his presidency, it is extremely difficult for marginalized black and Hispanic Americans to obtain the documents accepted as voter ID.
If Trump can manage to avoid being sent to jail until after the election, he will no doubt use the dictatorial powers SCOTUS has given him immunity from using to continue his racist attacks on black and Hispanic voters as well as our new migrant population. Perhaps it will be an inventive new version of a poll tax, but it will be coming just as certainly as his public endorsement and support for neo-Nazis at Charlottesville and statements that all migrants are vicious criminals or mental health patients.
Republicans, as we have expected, are fully on board with Trump’s race baiting and attempts to ethnically cleanse state voter lists of black and Hispanic voters. Beyond the FACT that you can be ineligable to vote – such as because you are not a citizen and NOTHING will prevent you from registering to vote, and once registered nothing will prevent you from voting.
In fact if you vote by mail – no one will check your signature or your voter registration information in many states.
And as of a week ago – in Wisconsin – and a number of other states. ballots can be dropped of at unattended ballot boxes by the hundreds with no verification that the person whose name is on the ballot envelope actually cast that vote.
It is illegal to vote as a non-citizen.
It is illegal to vote for another person.
In all states except California it is illegal to drop a ballot off at a ballot box if you are not the voter – with some states having exceptions for immediate family or people with a power of attorney to do so.
All these and many many other things are illegal to do.
And yet there is no verification or enforcement mechanism for any of them in much of the country.
It is like we passed laws saying you can not drive drunk, but prevent the police from pulling people over who are weaving on the highway and breathalyzing them.
Any law with absolutely no means of enforcing is no law at all.

Actually, the worst president in terms of being anti-free-speech was Lincoln. He had no respect whatsoever for the rights described in the Bill of Rights, or for habeas corpus for that matter. John Adams was way behind in 2d place in that category.

Many of today’s Soviet Democrats long for those heady days when the original Confederate Democrats ran the slave states and started a war on the free Union states.
Lincoln was terribly wrong to censor any free speech during that existential war. Censoring US Mail and telegraph communications that carried any information about troop movements, strength, concentrations, etc. Similarly censoring messages with information on the location of strategic war supplies, it’s transportation and destination, etc.

Similarly, of all the newspapers in the Union side, only TWO were shut down. Not every single newspaper critical of Lincoln and the Union prosecution of the war. Not every newspaper publishing sympathetically on behalf of the Confederacy. Just two – and those two were publishing more as the propaganda arm of the Confederacy, rather than a normal news agency also critical of the Union, at a time when the outcome of the war was in doubt.
Should that have been allowed to continue in the name of free speech while those newspapers were publishing in support of Confederacy that started the war and wanted to keep blacks enslaved – where Confederate President Jefferson Davis was unilaterally committing unconstitutional acts?
That’s not a rhetorical question – it’s a question for which I don’t know the answer.
After 30 years in combat arms, I do know that it is logistics that win wars and not tactics – but they don’t make war movies about logistics and winning the war through logistics, so few who have lived their lives in the civilian world know that, nor consider that perspective. I don’t see Lincoln’s censorship as personal vindictiveness when it appears that was primarily focused on intercepting and preventing transmission of military information that would end up in Confederate hands.
During that existential Civil War, is there another way that Lincoln at that time should have known he could use? One which would have 100% achieved the same protection of information of critical military importance that would be more constitutionally acceptable to Americans at peace today that are critical that his actions were unconstitutional?
Perhaps – if so, then how. This was an existential war – when facing the prospect of being in error, you make sure you make your choices with an abundance of caution.
As a final thought regarding your final comment regarding FDR’s internment of Americans who committed the crime of being born Japanese in America. Can we consider it a violation of the First Amendment rights of a free press if they collude with FDR to hide the ongoing Holocaust, giving FDR cover while he pulls out the stops to deny Jewish refugees seeking asylum in America. One account I read said that roughly 2.5 MILLION Jews were murdered who would have escaped slaughter if not for FDR blocking all attempts to get them to America and asylum.
Do we assume the free press is given the extremely generous exemption from prosecution for publishing classified information, happily being co-conspirators giving gratuities to FBI agents involved in the Trump investigation to “leak”, etc. in exchange for having a duty to faithfully publish ALL the news? Not hiding information that is detrimental to one party’s presidents or that party’s agendas. If that is the reason for why the media has been given a long standing pass on what would be criminal if a citizen without free press protection would be jailed for – the media has also unconstitutionally censored free speech.
I find it rather telling that the very same Free Press Media that raced to be the first to file to get to court to sue Trump when he threw Jim Acosta out of the White House Press corps for commandeering a microphone and shoving a staff member trying to get it, is the very same media that were silent as a tomb when FBI and other government bureaucrats were inserted into social media to shut down the New York Post reporting on the contents of the Biden Bribery Laptop.
