Succession by Defenestration: How Biden’s Withdrawal May Trigger a 25th Amendment Fight

Below is my column in the Hill on the withdrawal of President Joe Biden from the 2024 election. After weeks of Democrats and the media raising the alarm of his mental capacity, Biden finally gave up his public refusal to step aside. Harris will now be the nominee through succession by defenestration, or being tossed from a window. Yet, there remains a lingering question of Biden’s capacity to serve for another six months as president.

Here is the column:

President Joe Biden’s decision to withdraw as the Democratic Party’s nominee solved an immediate problem for his party. Biden has plummeted in the polls as the vast majority of voters concluded that he is too diminished by age to serve another term. Yet, it has now created several new problems, including the obvious problem of a president who is viewed as incapable of running for an office that he continues to hold.

The Democratic Party essentially created its own political version of the 25th Amendment in forcing Biden off the ticket. This decision was about as voluntary as leaving a building by way of a window on the 46th floor. That is particularly the case when you are thrown out of the window by your closest friends.

The unseemly image of succession by defenestration will soon be whitewashed by a media that will praise Biden after weeks of declaring him incompetent and enfeebled.

That, however, leaves the lingering question after the fall. How can Biden remain in office when he is incapable of running for the office?

Biden is notably vague about the reason for his withdrawal after maintaining for days that he will be the party’s nominee. He simply says that it is in the best interests of the country.

The Democratic establishment has two equally unappealing options.

First, it could argue that Biden was withdrawing out of recognition that he is no longer politically viable. But that makes a mockery out of the democratic process. Millions of people went through the primary elections to select him as their nominee. Now he would be set aside and replaced by a vote of the party establishment like a shift in the Russian politburo.

Second, it could admit that Biden was, as stated for weeks in the media and by figures like Special Counsel Robert Hur, greatly diminished both mentally and physically. However, that makes this withdrawal an admission that could trigger a fight under the 25th Amendment.

The development could create a new constitutional controversy. The 25th Amendment was written with largely physical disabilities in mind. If a president is comatose, the incapacity is obvious and Section 4 allows the vice president and a majority of the Cabinet to sign a declaration to Congress that a president is incapable of holding office.

However, Harris is eager to avoid the image of Brutus in the dispatching of the president. To support such a declaration would risk Biden proclaiming “Et tu, Kamala?” to the nation. The key to succession by defenestration is not to be seen as the hand that pushes the president out the windowPolitics follows the same rules as the mafia for capo di tutti i capi: Kill a don, never be a don. While sometimes honored in the breach in the mob, it is hardly an auspicious path for a politician.

There is, however, another intriguing possibility.

Section 4 provides that a president’s fitness can be put before Congress when the “Vice President and a majority of either the principal officers of the executive departments or such other body as Congress may by law provide.”

Previously Democrats have cited that language to suggest that they could create their own body to force former President Donald Trump out of office. Indeed, Rep. Jaime Raskin (D-Md.) sponsored legislation called the Oversight Commission on Presidential Capacity Act to create a commission empowered to examine a president to Congress on the president’s capacity. It would circumvent the necessity of getting Harris to be the primary hand that dispatched a president.

The question is whether Congress will now make this decision to warrant an investigation or even a Raskin-like bill.

This is different than President Lyndon Johnson’s decision on March 31, 1968, that “I shall not seek, and I will not accept the nomination of my party for another term as your president.”

That was before the end of the primaries. In this case, Biden won a primary in which the Democratic Party obstructed anyone who would challenge him and barred any debate.

Millions voted for him, and tens of millions of dollars were contributed to his campaign. He is now withdrawing weeks before accepting the nomination. That unprecedented decision alone would warrant a House investigation into Biden’s continuing capacity to serve in an office that he no longer believes he can run to occupy after January 2025.

Before this decision, a special counsel cited President Biden’s diminished faculties as a reason not to indict him for unlawfully retaining and handling classified material. Now, the president is effectively saying that, in addition to being allegedly too diminished to be prosecuted, he is too diminished to run for the office that he currently holds.

The question is whether Biden has ended the fight to retain his nomination only to trigger a fight to retain his office.

While the world knew and commented about Biden’s mental status did any Democrat act on behalf of the citizens and ask Biden to step down? No, instead he was lauded as a political Einstein. As soon as those on the down ballot were at risk out came the long knives. Today the knives will be put away and once again he will be hailed as a great political hero and he’ll go into hiding.

  4. Trump will now be able to set just about any terms he wants for any future debates, and that’s assuming he’s even going to offer any. What’s Kamala going to do, refuse her one and only chance? The take away would be that he is scared and weak. Or he could take the position that she’s the VP and should be treated as the VP nominee on the ’24 ticket. I mean anything less would be disenfranchising millions of voters…

    1. He should wait until she makes a few public appearances first, to see just how badly she manages to screw up on her own. If she does reasonable well at those, then he should challenge her to a debate. My suspicion is that it won’t be necessary.

He’s bound to nothing at all going forward. She has about two months to make her case to the public that’s she’s capable of doing the job. She has a high mountain to climb and the first one will be convincing her own party

If she holds some press conferences, interviews, rally appearances etc., miraculously manages to speak coherently to issues, avoids cackling attacks, and begins to make serious in-roads on Trump’s polling lead in battleground states, then, and only then, should he debate her.

  5. Democratic convention is August 19-22

    These four state cut-off dates could be problematic for the Democrats if they wait for the convention to nominate the Presidential candidate.

    August 7-
    Candidates must complete by August 7 all paperwork and filings to appear on the ballot in Ohio.
    August 9-
    In Georgia the last day for local jurisdiction to provide information for the November 5 general election ballot is on August 9 but the deadline for ballot printing isn’t until early September.
    August 15-
    Alabama requires parties to submit the names of their certified candidates 82 days prior to the general election – meaning they would need to be sent on August 15.
    August 20-
    The Secretary of State of South Dakota must certify names of all candidates for the ballot by 5:00 p.m. the third Tuesday in August, which falls on the 20th this year – two days before the end of the Democratic Convention.

  9. I would suggest they dangled a bunch of cash in front of him. Strange also that the White House Staff and Campaign knew nothing of the decision until a tweet went out to them, reportedly.
    If I were the republicans I would state the case for him to resign and argue for it and then proceed on with their campaign. I would do nothing to help the democrats get out of this conundrum. They created it by supporting his incompetency for 3 1/2 years, failed to convince him not to run, closed the primaries so it was just a game show that rang up numbers every Tuesday or so and eliminated every other competitor. And they obviously read only their own media since they were so “surprised” by his sudden deterioration. I would also not debate Harris, to suggest that this is illegitimate and she was a part of the fraud perpetrated on the country. Besides the debate was a Biden-Trump deal.
    Lastly Biden’s personal physician should face the medical licensing board for fraud and malpractice. He has a duty to not endanger the public and gave fraudulent reports that allowed a mental incompetent to access the nuclear codes. He sort of failed the Biggest Red Flag Law on the planet. You would not put a firearm in this person’s hand so why would you allow him access to firepower that could destroy life on this planet.

  10. Biden dropping out is not evidence that he is incapable of being president. It frees him up from the rigors of campaigning and the extra stresses. He’s obviously old, but so is Trump. He has his own string of age related problems like constantly rambling on and on going off script. Now he will have to content with a much younger and sharper political opponent whoever that may be. It is not guaranteed if Kamala Harris will win the nomination at the Democratic convention. It could be someone else.

    Nobody has really seen Kamala Harris being free of supporting President Biden. She could be much more difficult for Trump to attack. There are already hints of questioning her ability to be president since her parents were not born here. Another birther movement?

    Harris was polling a little better than Biden and that may change once she goes on full campaign mode. Trump can’t afford to look misogynistic or racist. Already 17% of. Republicans will not vote for Trump. That’s a sizable block of voters that Trump cannot afford to lose. Alienating women will further diminish his chances.

    1. Trump already previewed his “attack” during the debate when he criticized Biden’s policies and only indirectly and infrequently went ad hominem. Since those policies are Biden-Harris policies, Harris inherited them whether she likes it or not. Trump may come up with a nickname like Cacklin’ Kamala as he did with Crooked Hillary in 2016, but that will be the extent of his ad hominems. Trump has gained a lot of common sense since 2016 and fully understands his limitations and license to demean others.

Harris has the benefit of being more energetic and articulate than Trump. Trump still has his misogyny problem. Women will be paying attention on how he treats her in her attacks. Trump will have to tread carefully, but we all know Trump not disciplined enough to stop himself from going on misogynist tropes. Also, Kamala Harris is a former prosecutor and she is better equipped to debate Trump and I suspect he will avoid her at all costs because he cannot compete with a much younger and sharper political opponent.

Now, the drumbeat is for an immediate resignation and passing the torch to Harris. But, some big donors and incumbent democrats in the House and Senate who are running for reelection don’t want this and may blow up the DNC convention next month to get their way.

    The result cannot be good, especially after Biden exercises his final presidential pardon action before leaving office to pardon himself and his family. He also may try to get back at Trump, the person he blames for his ignominious downfall, by pardoning 16 million illegal aliens so Trump cannot deport them.

    In one fell swoop, as he departs, Biden may destroy his legacy, administration, and the Democrat party for generations to come. Remember, behind that Joker-like smirk lies a demented and dangerous mind filled with hatred and resentment for those he feels have stabbed him in the back.

      He said that, then the other day, it was announced that he tested positive for COVID. Strongly suggests that the fix was already in when he made that disclaimer about dropping out because of a “medical problem”, but less certain that his puppeteers informed him of what was going on.

  14. Section 4, as quoted by Prof. Turley, seems to require the concurrence of the Vice President to the majority decision of EITHER the Cabinet or “any other body” created by Congress. Turley seems to suggest that Congress can do an end-around the VP.

    1. I think that is highly uncertain. The language there isn’t clear whether that has to be an alternative body already established by Congress for that purpose, or whether they can just make it up as they go along. Any move of that nature is likely to be contested, first in Congress, and then in the courts, all the way up to SCOTUS. IMO, the implications of a finding that Congress can indeed make it up as they go along could be extremely hazardous to the Republic. Imagine how the concept of an “inability to serve” could be distorted in the future if a President was facing a rebellion from his VP, Cabinet, and Congress for purely political reasons. Again, imo, that seems to potentially set a significantly lower bar than impeachment.

    1. You are correct – but I had to look it up. March 12, Johnson got 48% in New Hampshire, McCarthy 42%. On March 16, RFK announced his candidacy. Faced with those challenges, and his low popularity, he bowed out. He might have won the nomination, but would likely have been so damaged that Nixon would have beaten him anyway.
