Below is my column in the Hill on the withdrawal of President Joe Biden from the 2024 election. After weeks of Democrats and the media raising the alarm of his mental capacity, Biden finally gave up his public refusal to step aside. Harris will now be the nominee through succession by defenestration, or being tossed from a window. Yet, there remains a lingering question of Biden’s capacity to serve for another six months as president.
Here is the column:
President Joe Biden’s decision to withdraw as the Democratic Party’s nominee solved an immediate problem for his party. Biden has plummeted in the polls as the vast majority of voters concluded that he is too diminished by age to serve another term. Yet, it has now created several new problems, including the obvious problem of a president who is viewed as incapable of running for an office that he continues to hold.
The Democratic Party essentially created its own political version of the 25th Amendment in forcing Biden off the ticket. This decision was about as voluntary as leaving a building by way of a window on the 46th floor. That is particularly the case when you are thrown out of the window by your closest friends.
The unseemly image of succession by defenestration will soon be whitewashed by a media that will praise Biden after weeks of declaring him incompetent and enfeebled.
That, however, leaves the lingering question after the fall. How can Biden remain in office when he is incapable of running for the office?
Biden is notably vague about the reason for his withdrawal after maintaining for days that he will be the party’s nominee. He simply says that it is in the best interests of the country.
The Democratic establishment has two equally unappealing options.
First, it could argue that Biden was withdrawing out of recognition that he is no longer politically viable. But that makes a mockery out of the democratic process. Millions of people went through the primary elections to select him as their nominee. Now he would be set aside and replaced by a vote of the party establishment like a shift in the Russian politburo.
Second, it could admit that Biden was, as stated for weeks in the media and by figures like Special Counsel Robert Hur, greatly diminished both mentally and physically. However, that makes this withdrawal an admission that could trigger a fight under the 25th Amendment.
The development could create a new constitutional controversy. The 25th Amendment was written with largely physical disabilities in mind. If a president is comatose, the incapacity is obvious and Section 4 allows the vice president and a majority of the Cabinet to sign a declaration to Congress that a president is incapable of holding office.
However, Harris is eager to avoid the image of Brutus in the dispatching of the president. To support such a declaration would risk Biden proclaiming “Et tu, Kamala?” to the nation. The key to succession by defenestration is not to be seen as the hand that pushes the president out the window. Politics follows the same rules as the mafia for capo di tutti i capi: Kill a don, never be a don. While sometimes honored in the breach in the mob, it is hardly an auspicious path for a politician.
There is, however, another intriguing possibility.
Section 4 provides that a president’s fitness can be put before Congress when the “Vice President and a majority of either the principal officers of the executive departments or such other body as Congress may by law provide.”
Previously Democrats have cited that language to suggest that they could create their own body to force former President Donald Trump out of office. Indeed, Rep. Jaime Raskin (D-Md.) sponsored legislation called the Oversight Commission on Presidential Capacity Act to create a commission empowered to examine a president to Congress on the president’s capacity. It would circumvent the necessity of getting Harris to be the primary hand that dispatched a president.
The question is whether Congress will now make this decision to warrant an investigation or even a Raskin-like bill.
This is different than President Lyndon Johnson’s decision on March 31, 1968, that “I shall not seek, and I will not accept the nomination of my party for another term as your president.”
That was before the end of the primaries. In this case, Biden won a primary in which the Democratic Party obstructed anyone who would challenge him and barred any debate.
Millions voted for him, and tens of millions of dollars were contributed to his campaign. He is now withdrawing weeks before accepting the nomination. That unprecedented decision alone would warrant a House investigation into Biden’s continuing capacity to serve in an office that he no longer believes he can run to occupy after January 2025.
Before this decision, a special counsel cited President Biden’s diminished faculties as a reason not to indict him for unlawfully retaining and handling classified material. Now, the president is effectively saying that, in addition to being allegedly too diminished to be prosecuted, he is too diminished to run for the office that he currently holds.
The question is whether Biden has ended the fight to retain his nomination only to trigger a fight to retain his office.

If Harris is the candidate, not only will women turn out, but women of color will not only turn out in record numbers, they’ll get their husbands, sons, uncles, grandfathers, neighbors, members of their church and community at large to register and VOTE, just like they did for OBAMA. According to the FEC, some $100m in campaign funds has to go to Harris. If Harris is not the nominee, that money has to be refunded.

Just think how he will flip out if and when Harris beats him. He’s trying to change the ground rules for a second debate because he’s SCARED. Not one time, or even one year since the 2020 campaign when they had to run Biden from the basement because they knew he was too mentally incompetent to sell to American voters? Even Soviet Democrat voters and Identity Politics voters?
Not even an attempt to seed and grow a viable alternative if Biden became a disaster and threat to the Great March Forward? Better yet, seed multiple viable alternatives and see which grows best. Not even after watching the Cackling Vice President always being even less popular as Biden from the beginning to the end of his time in office? The stategists for the Soviet Democrats have had THREE YEARS to do something like that, just in case.
I won’t claim Soviet Democrats knew during the 2020 campaign that Bribery Biden would melt down to the point he was unsaleable when 2024 arrived.
But ALL of these people are well plugged into the interior of the White House. Never mind Schumer and Pelosi – Obama has loaded the Biden administration with his former Obama administration apparatchiks. Susan Rice as just one example and Lisa Monaco as Assistant Attorney General being another (Jack Smith’s partner back in the 2012 lawfare). Will anybody ask Obama a very simple basic question: “How often have you spoken to your former Vice President, President Biden over the last six months”?
They have all known, every single one of them and their media as well, that Biden was a ticking time bomb that could blow up in their faces for months – almost certainly they’ve known for years. If this was carefully calculated with a Plan B, Plan C, Plan D waiting in the wings, then here’s the obvious question:
If they had a Plan B for when Biden made the party vulnerable, then why did they wait until Biden blew up in their faces days before their convention? After Biden was locked in as the nominee in some states, with hundreds of millions in donations now locked to Biden, and Biden had to be replaced in a panic as Biden – AND Harris – increasingly became the face of a grossly incompetent.
These are the same people who orchestrated and kept the ‘Russia Dossier’ running for years after it failed to take out Trump in 2016. The people who can organize and implement reach into the top ranks of the FBI, CIA, etc to hide Biden criminality from not just American citizens, but congressional oversight committees for ten years.
I spent 30 years in the military (like tens of thousands of other Americans, not a appeal to authority when this is pretty common knowledge). You’re taught to ALWAYS have a Plan B (and Plan B.1 etc). You plan on the basis of “what if’s”. You want to avoid being on the verge of worst case scenarios when you break the glass to pull out your Plan B or Plan C, D, E, etc.
And you don’t wait until the moment you’re General George Custer leading the charge on the peaceful Indian village on the Rosebud before changing over to the Plan B. You redeploy your forces and strategic assets before you’re on the verge of disaster. Not after.
I believe that Occam’s Razor still stands; change my mind. Starting with your best guess at when this Plan B was developed. They didn’t develop this alleged Plan B if Biden thundered in during a debate weeks before their 2024 nomination campaign back during the 2020 campaign they ran from the basement.

Lin, people around him recognized the problems. His SOTU address involved memory from 50 years of training, which isn’t necessarily lost due to senility of various causes. Take a person who can’t remember his children’s names yet knows how to manage problems he faced throughout his life.
Thus, Biden could react to a problem he had faced for 50 years but would be lost in any new problem he faced. Therefore, he should have been challenged with unfamiliar things in the debates.

(1) A SOTU is addressed to the nation (and world at large), -not to the “people around him,” (who, I am sure, had seen a few equivocal manifestations of competency, as you hint at!) and of course, it is 100% prepared, scripted, and rehearsed, not coming from his “memory of 50 years.” So, to intended viewers and voters, it achieved its objective?
Lin, as you say, the SOTU was addressed to the world, scripted, on a teleprompter and rehearsed. That did not come from memory but was written by the speech writers. The way he delivered it and the few responses to the crowd were part of his continuous learning over 50 years. It did not tell us of his present mindset.
Those around him who brought different situations to the table should have known he was mentally impaired. You have been a lawyer for several years. If you ended up in Biden’s condition, you likely could give advice you would have given in years past while you had great difficulty with simple, unfamiliar problems. The present is most quickly forgotten.
Methinks that Republicans are desperate–they can only gerrymander so much and they keep losing elections because their radical right-wing agenda is unpopular. So, they figure out ways to avoid disclosing their true agenda. They don’t talk about their plot for a total abortion ban- see, what they plan to do, if they seize power, is pass a “conception personhood” law that gives full human rights from the milisecond a sperm penetrates the outer wall of an ovum. Their legislation would provide that this is the point in which that cell has full protection under the law, and ending its existence would be murder. Clever–huh? No need to try to attack the FDA’s approval of abortion medications, and they don’t have to admit they intended all along to ban all abortions, or that it’s a “state’s issue”. Pregnancies resulting from incest and rape will not be exceptions. They KNOW the abortion issue will sink them, so they go on the sly about it. That won’t work. We found out about Project 2025, so they try to back-pedal and pretend that’s not what they plan to do. It won’t work either.
Republicans chucked their “family values” and “back the blue” to fall in line with the Cult of Trump, who has never won the popular vote, and never will. Now, the Christian Nationalists have taken over the Republican party and they ignore the fact that Trump is a convicted criminal, an adjudicated fraudster, an adjudicated assaulter and defamer of a woman, who stole classified documents and tried to have his followers attack Congress to prevent Biden’s victory from being certified, all based on a Big Lie. All the “law and order”, “honesty” and “family values” that the Republican Party used to stand for are incompatible with Trump, and Republicans don’t have any viable alternative candidate, so they had to decide–which is it–seizing power to force their agenda on Americans, knowing that most of us do not agree with it–or falling in line behind a convicted criminal, cheater, liar misogynist, xenophobe, puxxy grabber and assaulter of women. Republicans have chosen, and so will America in November.

That’s an interesting and plausible-sounding hypothesis, but I’m not buying it, for a number of reasons. First, it fails the Hanlon’s Razor test. The Democrats are thoroughly unprincipled and corrupt , but not really that clever. Furthermore, I think that they were optimisic for quite some time that at least one of several things was going to happen to their and Biden’s benefit: Trump would self-destruct of his own accord by appearing to be arrogant, and overindulging his penchent for oversimplified insults/cheap shots (a prospect that, until quite recently, I would not have heavily bet against myself); one of the myriad lawfare attacks that they shamelessly shotgunned at him would inflict a politically mortal wound; Trump would reject their unfair unilateral terms for debate, so that they could continue to conceal Biden’s infirmaries, while claiming that Trump was afraid to debate him. What the Democrats/leftists/progressives/wokistas appear to have in common is their wholesale rejection of the real and the rational. Lacking even a passing acquaintance with reality does not enhance one’s ability to successfully predict outcomes.
