
Below is my column in the Hill on the withdrawal of President Joe Biden from the 2024 election. After weeks of Democrats and the media raising the alarm of his mental capacity, Biden finally gave up his public refusal to step aside. Harris will now be the nominee through succession by defenestration, or being tossed from a window. Yet, there remains a lingering question of Biden’s capacity to serve for another six months as president.
Here is the column:
President Joe Biden’s decision to withdraw as the Democratic Party’s nominee solved an immediate problem for his party. Biden has plummeted in the polls as the vast majority of voters concluded that he is too diminished by age to serve another term. Yet, it has now created several new problems, including the obvious problem of a president who is viewed as incapable of running for an office that he continues to hold.
The Democratic Party essentially created its own political version of the 25th Amendment in forcing Biden off the ticket. This decision was about as voluntary as leaving a building by way of a window on the 46th floor. That is particularly the case when you are thrown out of the window by your closest friends.
The unseemly image of succession by defenestration will soon be whitewashed by a media that will praise Biden after weeks of declaring him incompetent and enfeebled.
That, however, leaves the lingering question after the fall. How can Biden remain in office when he is incapable of running for the office?
Biden is notably vague about the reason for his withdrawal after maintaining for days that he will be the party’s nominee. He simply says that it is in the best interests of the country.
The Democratic establishment has two equally unappealing options.
First, it could argue that Biden was withdrawing out of recognition that he is no longer politically viable. But that makes a mockery out of the democratic process. Millions of people went through the primary elections to select him as their nominee. Now he would be set aside and replaced by a vote of the party establishment like a shift in the Russian politburo.
Second, it could admit that Biden was, as stated for weeks in the media and by figures like Special Counsel Robert Hur, greatly diminished both mentally and physically. However, that makes this withdrawal an admission that could trigger a fight under the 25th Amendment.
The development could create a new constitutional controversy. The 25th Amendment was written with largely physical disabilities in mind. If a president is comatose, the incapacity is obvious and Section 4 allows the vice president and a majority of the Cabinet to sign a declaration to Congress that a president is incapable of holding office.
However, Harris is eager to avoid the image of Brutus in the dispatching of the president. To support such a declaration would risk Biden proclaiming “Et tu, Kamala?” to the nation. The key to succession by defenestration is not to be seen as the hand that pushes the president out the window. Politics follows the same rules as the mafia for capo di tutti i capi: Kill a don, never be a don. While sometimes honored in the breach in the mob, it is hardly an auspicious path for a politician.
There is, however, another intriguing possibility.
Section 4 provides that a president’s fitness can be put before Congress when the “Vice President and a majority of either the principal officers of the executive departments or such other body as Congress may by law provide.”
Previously Democrats have cited that language to suggest that they could create their own body to force former President Donald Trump out of office. Indeed, Rep. Jaime Raskin (D-Md.) sponsored legislation called the Oversight Commission on Presidential Capacity Act to create a commission empowered to examine a president to Congress on the president’s capacity. It would circumvent the necessity of getting Harris to be the primary hand that dispatched a president.
The question is whether Congress will now make this decision to warrant an investigation or even a Raskin-like bill.
This is different than President Lyndon Johnson’s decision on March 31, 1968, that “I shall not seek, and I will not accept the nomination of my party for another term as your president.”
That was before the end of the primaries. In this case, Biden won a primary in which the Democratic Party obstructed anyone who would challenge him and barred any debate.
Millions voted for him, and tens of millions of dollars were contributed to his campaign. He is now withdrawing weeks before accepting the nomination. That unprecedented decision alone would warrant a House investigation into Biden’s continuing capacity to serve in an office that he no longer believes he can run to occupy after January 2025.
Before this decision, a special counsel cited President Biden’s diminished faculties as a reason not to indict him for unlawfully retaining and handling classified material. Now, the president is effectively saying that, in addition to being allegedly too diminished to be prosecuted, he is too diminished to run for the office that he currently holds.
The question is whether Biden has ended the fight to retain his nomination only to trigger a fight to retain his office.

Harris is infamously known for having emerged from the political pack in San Francisco as married Willie Brown’s fellatio friend. In his 60s at the time, Brown was the long-time leader of the California Assembly, having been first elected in 1964 and serving as Speaker of the Assembly from 1980 to 1995. He represented an urban San Francisco Assembly District for his entire tenure.
The basic outline of Kamala Harris’ political career can be found on her Wiki page — basically accurate for the most part. She born in California but her family moved to Illinois when she was 2. Her mother brought her and her sister back to Berkeley when she was 6, but moved to Montreal, Quebec when she was 12 years old. She attended Howard University in Washington D.C., graduating in 1986.
She then enrolled at Hastings Law School (UC San Francisco), graduating in 1989. Whether she targeted Willy Brown 40 years her senior as being vulnerable to the honey trap of sexual favors in exchange for political opponents, or Willie Brown targeted her as an ambitious woman willing to trade sex with a married man for a start in politics is unknown.
In 1990 she was hired as an entry-level Deputy District Attorney in Alameda County. Four years later Willie Brown — who was still bedding Harris outside of marriage — appointed her to the Unemployment Insurance Appeals Board and the California Medical Assistance Commission. The Appeals Board position paid a salary of $97,000 a year — far in excess of what she was making for the Alameda DA. She stayed in that position for only 6 months because the seat she filled had only 7 months left in its term. Her relationship with Willie must have lasted longer than six months, because with one month left in the term, Brown appointed her to the Medical Assistance Commission, a job that paid $72,000 a year, but with a full term of 4 years remaining. This came as Brown was about to be replaced as Speaker, with Republicans having captured a majority of Assembly seats for the first time in decades.

The 25th Amendment, however, is entirely a political process. There is no way to remove a President, who is still alive, unless the VP approves of the President’s removal.
Notably, you failed to cite the actual text of the Amendment to bolster any part of your post. Biden, as you note, did not want to step down. Harris likely agreed not to dethrone him in exchange for his endorsement. Hence, this is a political process like impeachment, not one that requires the President to have a certain standard of mental acuity.

As an independent, I dislike the anti-corporate rhetoric from today’s GOP, which pushes me towards the now more corporate-friendly Democrats. If all other countries would enact free trade that would be one thing. I think two things are happening. First, American workers sense that the international trade system is rigged against them, and they respond favorably to a candidate that promises to protect them first and foremost over protecting an international system of free trade that they see as unfair. Second, corporations now are different than they were in the 1980s when Reagan promoted supply-side economics and its pro-corporate stance. Now many large corporations seem to care more about a cultural ideological agenda — DEI and ESG — than the bottom line, as strange as that may seem, and this perception comes through loud and clear through their advertising and public statements. The sense is that they are part of the corrupt globalist system. The larger ones also tend to capture the regulatory apparatus to impose greater regulations, which is their defense against their greatest long-term economic threat: small, dynamic, disruptive startups, who cannot absorb the cost of such regulations nearly as easily as the large behemoths can.

Protectionism and industrial policy are two aspects of Trump/Vance that I dislike. I can understand imposing tariffs to promote fair trade and reciprocity, but a basic tariff across the board makes no sense to me, and will fuel inflation and inefficiency. Picking winners and losers through industrial policy is also a bad idea, distorting the free market, which generally tends to maximise welfare. Daniel, I don’t think Trump is looking for a basic across-the-board tariff. It is hard to say, but I believe his rhetoric attempts to change present problems while he is not president. I interpret Trump based on his actions, not his words. Things are becoming more entrenched and have the rest of Biden’s term to play out.

Daniel, the first quote sounds like Trump. The second is not so much, but it isn’t clear.

Though Trump is appealing to the populist vote, I don’t think he envisions a foreign tax rate on everything. He is starting negotiations where one must give and take. He is a businessman and understands the dangers of relying too much on tariffs. The stick is seen, and the carrot moves backward on that statement.
You might feel otherwise, but if your worst interpretation were followed, it would still be better than what we have today.

That is the conclusion of research finding companies, consumers and the U.S. economy paid a heavy price for the Trump administration’s protectionist trade policies.
In new research, Mary Amiti, an economist at the Federal Reserve Bank of New York, and Sang Hoon Kong and David Weinstein, both economists at Columbia University, used movements in stock prices to measure the response to policy announcements on tariffs and the escalation of the U.S.-China trade war initiated by the Trump administration. “Stock prices are well suited for this purpose because firm market value equals the expected present value of future firm profits,” according to Amiti, Kong and Weinstein. “Therefore, movements in stock prices tell us about changes in the expected future value of firm-specific capital (both tangible and intangible).”
“The results suggest that markets interpreted the impact of the tariffs as much more negative than what economists initially estimated,” said David Weinstein in an interview. “Part of the reason stems from the fact that the U.S. tariffs rose significantly in 2019, and the earlier studies didn’t include these higher rates. Moreover, the new analysis suggests that the tariffs’ impact on productivity is likely to be a factor holding down U.S. growth rates. The tariffs protect the least efficient firms and reduced their incentives to innovate while hurting the most successful U.S. firms, reducing their ability to innovate.”

The idea of eliminating the income tax is an attractive one to anyone that has ever had to cut a check to Uncle Sam—but it is far from practical. Recently, former President Donald Trump suggested replacing the federal income tax with tariffs on imports. While it garnered significant attention, a closer examination quickly reveals why the policy is impractical.
The Proposal
In a private meeting with GOP lawmakers at the Capitol Hill Club in Washington, D.C., Trump floated the idea of a so-called “all-tariff policy.” A formal policy proposal has not been released by Trump or his campaign, but it appears the idea is if tariffs on imports were raised sufficiently, the federal income tax could be eliminated entirely.
Broadly, the concept aligns with Trump’s long-standing protectionist trade agenda, which he featured prominently in his first term and rhetoric since.
Tariffs can be thought of as taxes imposed on imported goods—they are ostensibly paid by importers, but the costs are typically passed down to consumers through higher prices for those goods.
When tariffs are applied broadly, as Trump appears to be suggesting, the price increase affects a similarly broad set of goods—essentially, everything that is imported. Retailers and wholesalers will pass on those added expenses to consumers, leading directly to higher prices at checkout.
Such price hikes in everyday goods disproportionately impact low and middle-income households, because they are the consumers that spend the highest percentage of their income on consumable goods. This converts a progressive income tax—higher income folks pay a higher rate—into a regressive tax, akin to a sales tax. As such, in the near term, the only groups benefiting from the elimination of a broad-based income tax and the ratcheting up of tariffs are those folks at the higher end of the socioeconomic spectrum.
Everyday necessities, like clothing, food, and household goods, as well as significant purchases like electronics, vehicles, and equipment, will immediately increase in price. Even goods entirely produced domestically, and thus not directly subject to tariffs, may see price hikes—as demand outstrips supply.
For example, if a broad 25% tariff on all imported goods is placed, the cost of every imported good will go up by at least 25%. Retailers and manufacturers will passed that added expense on to consumers, and prices will necessarily go up on any imported goods or goods that contain imported materials. This will cause consumers to choose domestically-produced lower cost goods, to the extent they are available.
As demand shifts to American made goods, in the absence of a matching level of increased production in every sector of the economy all at once, there will be more demand for domestic goods than supply. Prices will skyrocket just as they did during past supply chain crunches.
In essence, tariffs act as a regressive tax. They were broadly eliminated in favor of an income tax in the late 19th century for just that reason. It is unlikely that I or most in the country could have hit Trump at 150 yds – but then Most of us have little expereince or practive.
At 100yds most AR-15’s can put 5 consecutive shots in a 2″ circle with any shooter of basic competence – which purportedly Crooks was. Yet Crooks spray 5-8 rounds in an oval about 3ft high and 8ft wide all arround Trump – with only the first shot coming close – very very close.
If it had done more than graze Trump it more than likely would have killed him or at the very least removed him from the election.
Even if I do not have the experience and practice to make it – this apparently was an easy shot.
Hitting Trump in the body would have been much easier, but with lower odds of killing him.
Many factors including the load, and the calibur would increase the odds of killing with a body shot.
I am not an expert, nor am I trying to get into the clash of experts here.
But the fact is that Trump got incredibly lucky.
That (likely pos) AR had an MOA of 2 when the (likely pos) barrel was brand new. That means it would fire a group in a 2 inch circle if there were NO OTHER variables. So you’re wrong about that. No telling how many rounds had been fired thru it. That means the MOa was even larger for the “non experts”. Add in a wind variable and a non stationary target (the head) and its not so easy to hit but very easy to miss.
Add in a climb onto a roof, people shouting hey, he’s on the roof with a gun, a crawl up the roof, and a limited time to set up and fire, now its almost luck if he does hit.

It was 8 rounds. And one guy was hit 20-30 yards away from Trump.

With the right projectile, pretty much any center fire rifle round in the chest would have been fatal. A large caliber makes for fewer variables.
