Below is my column in the Hill on the withdrawal of President Joe Biden from the 2024 election. After weeks of Democrats and the media raising the alarm of his mental capacity, Biden finally gave up his public refusal to step aside. Harris will now be the nominee through succession by defenestration, or being tossed from a window. Yet, there remains a lingering question of Biden’s capacity to serve for another six months as president.
Here is the column:
President Joe Biden’s decision to withdraw as the Democratic Party’s nominee solved an immediate problem for his party. Biden has plummeted in the polls as the vast majority of voters concluded that he is too diminished by age to serve another term. Yet, it has now created several new problems, including the obvious problem of a president who is viewed as incapable of running for an office that he continues to hold.
The Democratic Party essentially created its own political version of the 25th Amendment in forcing Biden off the ticket. This decision was about as voluntary as leaving a building by way of a window on the 46th floor. That is particularly the case when you are thrown out of the window by your closest friends.
The unseemly image of succession by defenestration will soon be whitewashed by a media that will praise Biden after weeks of declaring him incompetent and enfeebled.
That, however, leaves the lingering question after the fall. How can Biden remain in office when he is incapable of running for the office?
Biden is notably vague about the reason for his withdrawal after maintaining for days that he will be the party’s nominee. He simply says that it is in the best interests of the country.
The Democratic establishment has two equally unappealing options.
First, it could argue that Biden was withdrawing out of recognition that he is no longer politically viable. But that makes a mockery out of the democratic process. Millions of people went through the primary elections to select him as their nominee. Now he would be set aside and replaced by a vote of the party establishment like a shift in the Russian politburo.
Second, it could admit that Biden was, as stated for weeks in the media and by figures like Special Counsel Robert Hur, greatly diminished both mentally and physically. However, that makes this withdrawal an admission that could trigger a fight under the 25th Amendment.
The development could create a new constitutional controversy. The 25th Amendment was written with largely physical disabilities in mind. If a president is comatose, the incapacity is obvious and Section 4 allows the vice president and a majority of the Cabinet to sign a declaration to Congress that a president is incapable of holding office.
However, Harris is eager to avoid the image of Brutus in the dispatching of the president. To support such a declaration would risk Biden proclaiming “Et tu, Kamala?” to the nation. The key to succession by defenestration is not to be seen as the hand that pushes the president out the window. Politics follows the same rules as the mafia for capo di tutti i capi: Kill a don, never be a don. While sometimes honored in the breach in the mob, it is hardly an auspicious path for a politician.
There is, however, another intriguing possibility.
Section 4 provides that a president’s fitness can be put before Congress when the “Vice President and a majority of either the principal officers of the executive departments or such other body as Congress may by law provide.”
Previously Democrats have cited that language to suggest that they could create their own body to force former President Donald Trump out of office. Indeed, Rep. Jaime Raskin (D-Md.) sponsored legislation called the Oversight Commission on Presidential Capacity Act to create a commission empowered to examine a president to Congress on the president’s capacity. It would circumvent the necessity of getting Harris to be the primary hand that dispatched a president.
The question is whether Congress will now make this decision to warrant an investigation or even a Raskin-like bill.
This is different than President Lyndon Johnson’s decision on March 31, 1968, that “I shall not seek, and I will not accept the nomination of my party for another term as your president.”
That was before the end of the primaries. In this case, Biden won a primary in which the Democratic Party obstructed anyone who would challenge him and barred any debate.
Millions voted for him, and tens of millions of dollars were contributed to his campaign. He is now withdrawing weeks before accepting the nomination. That unprecedented decision alone would warrant a House investigation into Biden’s continuing capacity to serve in an office that he no longer believes he can run to occupy after January 2025.
Before this decision, a special counsel cited President Biden’s diminished faculties as a reason not to indict him for unlawfully retaining and handling classified material. Now, the president is effectively saying that, in addition to being allegedly too diminished to be prosecuted, he is too diminished to run for the office that he currently holds.
The question is whether Biden has ended the fight to retain his nomination only to trigger a fight to retain his office.

There is just something about the way Kamala looks that I do not like. With respect to your allegations regarding Trump. He has been tried in the court that matters – that of voters and your case has been found woefully lacking on all charges. It is merely a question of time before the courts catch up.
BTW technically Trump has not been convicted – that does not occur until Merchan accepts the Jury verdict.
I do not expect that to occur before until as close as possible to the election – as the moment Merchan officially changes Trump’s status to a convicted felon Trump will be able to appeal directly to federal courts and he will likely get a very quick reversal of the verdict.
While there are dozens of grounds that will eventually lead to the reversal of this case – most will take a great deal of time.
But there are THREE that will result in near instant reversals before a judge that is not corrupt.
The first is the failure of Merchan to require a unanimous verdict on all elements.
The second is trying Trump for allegations he was not indicted or charged with, and doing so without notice prior to closing arguments as to what those other allegations even were.
The third is presenting constitutionally barred testimony. The most obvious is allowing witnesses to testify well beyond the crimes indicted and alleged. But Merchan prior to the start of the trial batted off as bogus Trump’s claims that Witnesses that were WH staff could not be required to testify. SCOTUS directly addressed that in the immunity case. Merchan has no argument for “harmless error” – because the prosecutor stated in closing that this evidence was CRUCIAL to their case.
Merchan after having railroaded Trump is now playing delay delay delay in order to delay Trump’s successful appeals as long as possible.
Regardless only in the tank left wing nuts do not understand that the lawfare against Trump was a FAILURE.
Fixing weaponized political prosecutions is now a Republican campaign plank.
I think if Kamala brings the lawfare up again, Trump should call her out on it and have a national discussion about the Biden role in using the courts as a political weapon. Jonathan: I have never seen such desperation by the GOP since Nixon was forced to resign. Kamala Harris has completely upended DJT’s game plan. Republicans are now having second thoughts about DJT’s pic for VP. They see JD Vance as a weak performer after his first campaign rally.

Polls used to be based on random telephone calls. That revealed a fraudulent result because pollsters would choose geographic areas heavily populated with a certain demographic favorable to the pollster’s intended result/outcome.

It is too early for reliable polling – While RCP is showing Trump/Harris now, it is clear that most of the polls are Trump/Biden.
Though in the few polls of Trump Harris there have been – Trump beats Harris by slightly larger margins than he beats Biden.
Harris has no blue collar appeal, no rust belt appeal. She is a west coast elite – that may play well in Hollywood, but not in Michigan or Pennsylvania.

But for the Florida problem, I would have preferred DeSantis, but I have no problem with Vance. I think politically DeSantis might have had a little more appeal to the ever diminishing Bush/Never Trumper wing of the party. He is definitely not a neocon, but I would describe him as Trump light. I think the neocon wing could have come back into the tent and saved face with DeSantis. I don’t see that happening with Vance.

“Got a weird lead on a story that people should look into. I got a call from a source close to Las Vegas Metro. The official story was that Joe Biden’s trip was cut short last week due to COVID. However, according to this source, US Secret Service informed LV Metro that there was an emergency situation involving Joe Biden and to close necessary streets so that POTUS could be transported immediately to University Medical, which they began to do in earnest. Then, mysteriously, there was a stand down order and the USSS informed local Vegas PD that they were going to “medivac” POTUS to Johns Hopkins, which they presumed meant fly him back east ASAP. Apparently the rumor mill in the police department was that Joe Biden was dying or possibly already dead.
I didn’t think too much about this lead, seemed too wild to be true, but given that Joe Biden has been out of public sight for days and dropped out of the race via an 𝕏 post, and his brother James indicated health was a factor, I’m beginning to grow more curious if COVID or something else has been more serious than reported. If anyone with LV Metro has information, please email Freedom@CharlieKirk.com. I want to hear if there is more to the official story than what they’re telling us.”

I don’t know who needs to hear this, but the medical event Joe Biden had in Las Vegas was on July 17, not July 5.
When you precede an accusation with “They”, especially one as serious as plotting assassination of a former President and candidate, please be specific about who you are accusing. I honestly don’t think professionals would tap a 20-year-old loser with poor shooting skills to do the job, do you? Professionals are about getting the job done. Sorry to throw cold logic at your fantasy conspiracy theory.
pbinca – I beleive the attempt on Trump is MOSTLY exactly what it appears – a seriously mentally disturbed young man provided an oportunity by a reckless secret service – that is complicit to the extent that they did not care – possibly even deliberately did not care enough to do their job.
That alone is damaging to democrats.
Add to that those like Destiny and his ilk who either refuse to condemn this or openly lament that Crooks missed and the damage is compounded.
Add to that a known Irainian plot to assassinate Trump with the Deep state doing nothing to thwart that – no heightened security, no notifying Trump.
Worse still.
Is that all democrats ? Most ? no. Too many ? yes.
Are there likely to be theories of multiple shooters and a deep state conspiracy ? Absolutely,

I am a simple man. I tend to believe the most obvious circumstances. I have no reason to believe Cheatle is incompetent. She was a career USSS agent with many years of experience on presidential details. She half-assed Trump’s detail on purpose. Her answers were simply too nonsensical to think otherwise. The roof slant was too great. No recordings exist of radio calls. It sounded a lot like Comey’s FBI tesimony. It either came from the Biden handlers or Mayorkas. If Trump had been hit, she would have been a hero to the left. But when you miss the king, you lose everything.

Yes, and how do you explain the radio silence from the Secret Service over this past week since the assassination attempt took place? Not one press conference. No regular updates. Not forthcoming with information provided to the media. No seriousness displayed BY the Biden adminstration officials responsible. Director Cheatle never even went to the sight herself! She went to Aspen for a “conference” instead. Stonewalling every day. Lying. Stonewalling. NO TRANSPARENCY WHATSOEVER. Why not?

It is beyond any doubt there was an assassination atempt.
It is however NOT known with certainty that Crooks was in it alone.
Even if he was it is not certain whether the Secret service leadership was merely incredibly incompetent or hopefully and intentionally reckless.
There are MANY unanswered questions. My quess is a few will NEVER be answered.
Does that mean we should not look ?
We now KNOW the Iranians were plotting to assassinate Trump. But Trump was not made aware and the SS did not increase security – if anything they weakened it.
Further we have plenty of left wing nuts on Social media lamenting the fact that Crooks missed.
It is possible and probable that Crooks acted alone.
It is NOT at this point an undisputed fact.
There are an enormous number of people who would semi secretly be happy to see Trump assassinated.
There are far too many who OPENLY want Trump assassinated.
Democrats have a tendency to try to DO all the things they TALK about.
It is perfectly reasonable to beleive there is a “they” even though that may never be proven.

The argument is that Crooks was the Patsy. There have been multiple audio analysts who have claimed that there are from 3-4 different shooters at 3 different ranges shooting 203 different caliber bullets.
I doubt that, I think ultimately that can be proven or disproven otherwise. It is highly likely that every single bullet fired will be recovered There should be the bullet that =Killed Crooks and multiple bullets fired by Crooks. A third calibur is a problem
Failure to find all bullets screams coverup.
Right now many of us do not trust Wray,. Biden, Garland or the Secret Service to investigate this. For very good reason
