Below is my column in the New York Post on President Joe Biden’s call to reform the Supreme Court by ending lifetime tenure for Supreme Court justices.
Here is the column:
President (and Supreme Court Chief Justice) William Howard Taft once said “presidents come and go, but the Supreme Court goes on forever.”
But not if Joe Biden has his way. Indeed, both the president and Court as we know it could be gone.
In a failed attempt to save his nomination, Biden offered to “reform” the Court by imposing an 18-year term limit that would jettison the three most senior conservative justices.
With only six months left in his presidency, Biden’s efforts are likely to fail, but, unfortunately, could set the stage for activists under a Harris Administration in seeking to change the Court forever.
For more than 50 years, Biden staunchly refused to play politics with the Supreme Court and support calls for “reforms” from the left of his party.
For a politician who has long been criticized for changing positions with the polls on issues from abortion to criminal justice to gun rights, the Court was one of the few areas of true principle for Biden.
Even though he refused to answer questions on packing the Court in the 2020 election, he ultimately rejected the call as president.
Yet Biden’s final principle fell this month when facing the premature and involuntary end of his candidacy. Faced with being a one-term president, the Supreme Court would have to be sacrificed.
Biden opted for the least of the evils in pushing for term limits rather than court packing.
It was the more popular option for Biden to yield on. Voters have always loved term limits.
The Associated Press-NORC Center for Public Affairs Research found 67% of Americans, including 82% of Democrats and 57% of Republicans, support a proposal to set finite terms for justices.
But there were few law professors and even fewer Democratic members clamoring for term limits until conservatives secured a stable majority on the Court. Then, suddenly, the Court had to be “reformed” without delay.
It is no accident that the first three justices who would be term limited off the Court are conservatives: Clarence Thomas (after 33 years on the Court), Chief Justice John Roberts (after 19 years), and Justice Samuel Alito (after 18 years).
Think, however, about the iconic decisions we would have lost with term limits in place. Liberal Justice Williams Douglas’s 36 years on the Court would have literally been cut in half. He would have been kicked off in 1957.
His famous opinions like Griswold v. Connecticut (1965), striking down bans on contraceptives, would not have been written — an ironic result for those seeking limits after the Court’s ruling in Dobbs.
Likewise, liberal icon Ruth Bader Ginsberg’s tenure would have ended in 2011 before she wrote her famous dissent Shelby County v. Holder (2013), defending voting rights.
Anthony Kennedy’s term would have ended in 2011 rather than 2018, before he wrote opinions such as United States v. Windsor, striking down the Defense of Marriage Act.
Obviously, other justices could have written opinions in these cases, but the point is that many justices wrote their best opinions after 18 years on the Court.
Moreover, the Framers clearly wanted these positions as lifetime appointments as an added protection against political pressure or influence.
For more than two centuries, presidents have struggled with the Supreme Court, but none (until now) have attempted to end life tenure on the Court.
Presidents have served as the firewall for the anger and radicalism that has periodically engulfed the Court.
Now President Biden is leading the mob for changing this institution for the first time since its founding.
It is a testament to what I call “an age of rage” in my new book. After years of supporting the Court when it was setting aside conservative precedent, liberals now want the Court changed to dump or dilute the majority.
It is unlikely to end there. After sending Thomas, Roberts, and Alito packing, many want to go further and pack the Court itself.
Democratic leaders such as Sen. Elizabeth Warren (D-Mass.) have called for outright court packing — a proposal that Vice President Kamala Harris has suggested that she might support.
Where Biden is a political opportunist in belatedly joining this movement, Harris is a true believer from the far left.
If she is elected, the Congress is still likely to be closely divided. That will only increase pressure to convert the Court into an alternative avenue for social and political reform.
Harvard professor Michael Klarman warned that all of the plans to change the country were ultimately dependent on packing the court.
With the 2020 election, he stated that Democrats could change the election system to guarantee Republicans “will never win another election.”
Notably, if Biden were to seek this change as a legislative matter without a constitutional amendment, future Congresses could short terms further from 18 to 8 years or even less.
In his speech, Biden declared that he wanted the membership of the Court changed with greater “regularity.”
If Congress has this authority, it could change the occupants of the Court faster than a South Beach timeshare condo.
That is clearly the opposite of what the Framers intended, but Biden insists that these times are different and democracy will only be safeguarded by attacking one of our core stabilizing institutions.
According to the Washington Post, the president made his pledge in a Zoom call to the left-wing Congressional Progressive Caucus, chaired by Rep. Pramila Jayapal (D-Wash.) and co-chaired by Rep. Ilhan Omar (D-Minn.). It did not succeed in resuscitating his candidacy.
The pledge will be dead on arrival with Congress. What is left is a King Lear-like tragedy of a president, betrayed by those closest to him, and wandering the land for continued relevance.
History will show a pitiful figure who offered up the Court as the cost of staying in power, only to lose his candidacy and his legacy.

Seeing the antisemitism going on, on college campuses, the pro-Hamas rallies in the streets, often violent, it is not vile rhetoric. It is look around you, see with your own eyes and use some common sense.
Denns, I just checked RCP – Trump is +2 nationwide over Harris that is +0.3 from yesterday. RCP continues to have Trump up in EVERY swing state.
WI is only +0.2 every other Swing state is +2 or more. Several swing states are +4 or more.
Nationwide Trump is 48.1 om 2020 2% of the vote went to independents. Om 2016 6% of the vote went to independents.
Trump has a larger share of the popular vote Right now than he had in 2016.
Absent some major change, or Harris getting 100% of the undecided vote – the election REMAINS over.
Harris is polling a bit better than Biden – but the more important factor is NOT that Harris is polling better – it is NOT much better.
It is that it is more likely that Harris voters will actually show up at the Polls.
Harris will still lose – Democrats will still lose the Senate, they probably will lose the house – but not by the massive margins that were likely if Biden had stayed in the race.

I’ve said it before. Polling this early is meaningless. There’s still four months to go and Trump is already backtracking on his promise to debate the Democratic nominee. Vance is getting weirder and weirder and now Trump is too.
Hurling insults is not going to be enough for Trump. He needs to do better than that.

Merchan has postponed Sentence – he has a serious problem – he F#$Ked up the trial so badly that the moment Sentence is passed – Trump will be able to appeal directly to the federal courts, – possibly (though unlikely) directly to the Supreme court.
The case will be thrown out quickly – though there are many many many fatal errors, one problem is that Merchan laughed at Trump’s immunity claims, and SCOTUS’s immunity decision states clearly that Merchan was REQUIRED to do an immunity analysis before the Trial – which he did not do. Further even if he found there was no immunity – he could not call Presidential advisors as witnesses. BTW that really predates the Immunity decision – it is called executive priviledge. Not only were several witnesses barred from testifying – Merchan allowed them to be questioned on issues that are directly inside the areas that SCOTUS set out as priviledged. Nor Can Merchan And Vragg claim harmless error. the DA made clear in his closing that the testimony that SCOTUS has said can not come in was critical to the case.
Personally I do not think it was – but then I do not think Bragg ever had enough to get an indictment. But Manhattan is falling off the left edge of the world.
Regardless, the federal courts are going to take the DA at his word – when he told the jury that meaningless testimony was critical, and SCOTUS barred WH staff from testifying – the case dies.
So what is going to happen ?
My prediction is that Merchan is going to stall. He is either going to wait until after the election and then vacate, or he is going to delay sentencing such that the Federal courts can not vacate before the election.

Interesting read about the recent “victory” of Maduro in Venezuela. Seems there was a real discrepancy between exit polls and the final result except there are, as yet no vote totals. Interesting history of the initial takeover by Hugo Chavez and the thing that most cemented his hold on power, was his seizure of the highest court by suddenly packing the court from 20 to 32 and he and then Maduro have not lost since. Just a warning for those who want to reform the court.
Polls of the Supreme Court popularity are always somewhat worrisome when you have the left wing echo chamber being the only purveyor of news. Then tend to ignore the followup investigations and the destruction of the quote “charges”

Turley, I don’t know what kind of drug you have to take to criticize Joe Biden, given Trump and Vance’s endless flip-flopping when it suits them, but here’s the thing: the majority of Americans (55.1%) disapprove of the SCOTUS and only 36.1% approve. Let’s look at the reasons: Obama was denied a nomination by Mitch McConnell after Scalia died, allegedly because of the proximity of the election. Scalia died on 2/13/2016, and the election was in November–almost 8 months later. Then, when the tables were turned and Ruth Bader Ginsberg died on September 18, 2020, it was OK with McConnell to let Trump shove Amy Coney Barrett onto the Court, even though the election, still in November, was less than 2 months away and Trump was behind in the polls. This is emblematic of the intellectual dishonesty and lengths to which Republicans will go to get power.
When Kavanaugh’s nomination was made, Republicans cut off witnesses form testifying about his history after the bombshell testimony of Dr. Christine Blasey-Ford. There were 25 witnesses who had something to say, but were denied the opportunity. Gorsuch, Kavanaugh and Barrett all claimed, during their interviews, that Roe v. Wade was the law of the land and that they would honor stare decisis. They each lied, and that’s how we got the Dobbs decision, which might, ironically, be the end of DJT’s political career.
Then, there are the ethics issues. At his beach home, Alito flew the US flag upside down, which was a symbol of solidarity with the J6 protesters. When the issue arose, he lied and claimed that it was his wifey, Martha-Ann, who did it. She claimed it was in response to a neighbor who posted an anti-Trump sign. However, according to local police reports (the police were called over this beef), that dispute occurred much later on. There was a second flag incident. “The House Select Committee investigating the January 6 riot has in its possession more than two dozen text messages, 29 in total, between former Trump White House chief of staff Mark Meadows and Virginia “Ginni” Thomas, a conservative activist and the wife of Supreme Court Justice Clarence Thomas, according to multiple sources familiar with the messages.
These text messages, according to sources, took place between early November 2020 and mid-January 2021. Thomas recently revealed that she attended the pro-Trump rally that preceded the US Capitol attack on January 6, 2021, but says she “played no role” in planning the events of that day.
The text messages, reviewed by CNN, show Thomas pleading with Meadows to continue the fight to overturn the election results.
“Help This Great President stand firm, Mark!!! … You are the leader, with him, who is standing for America’s constitutional governance at the precipice. The majority knows Biden and the Left is attempting the greatest Heist of our History,” Thomas wrote on November 10, 2020.
CNN first reported that the text messages were in the committee’s possession. The Washington Post first described their content.
Thomas regularly checked in with Meadows to encourage him to push claims of voter fraud and work to prevent the election from being certified. Meadows often responded. On that same day as the previous text, he wrote: “I will stand firm. We will fight until there is no fight left. Our country is too precious to give up on. Thanks for all you do.”
On November 24, 2020, Meadows promised he wasn’t done battling on then-President Donald Trump’s behalf and evoked his faith as a source of strength.
“This is a fight of good versus evil. Evil always looks like the victor until the King of Kings triumphs. Do not grow weary in well doing. The fight continues. I have staked my career on it. Well at least my time in DC on it.”
Thomas wrote to Meadows on November 19, 2020, “Sounds like Sidney and her team are getting inundated with evidence of fraud. Make a plan. Release the Kraken and save us from the left taking America down.” Attorney Sidney Powell, who worked on Trump-aligned lawsuits seeking to challenge the results of the 2020 election, was also referred to by herself as “The Kraken” in reference to the ancient mythological sea creature.”
Both Alito and Thomas refused to recuse themselves from cases involving January 6th. If this were any other court, that would be misconduct. Yes, there is the impeachment route–but what do you think Republicans would do?
There are even more ethical issues involving Thomas’s failure to report lavish vacations gifted to him by people with business before the Court.
Americans are disgusted with the SCOTUS–and for good reasons. If Trump were to somehow get back into office, there are reports that there will be generous offers made to Alito and Thomas to step down, paving the way for the appointment of 2 more radical judges like Alito, Thomas, Barrett, Kavanaugh and Gorsuch, and if they have liftetime appointments, America would be screwed for generations–forced to live under Christian Nationalist rules that most of us disagree with. Jonathan: There are some court decisions this week that should have caught your attention. But they apparently didn’t so here they are:
First, FL Federal District Judge Mark Walker issued a 2-page order permanently enjoining Gov. DeSantis from enforcing workplace restrictions on “woke ideology”. So this part of the governor’s “Stop Woke Act”, as it relates to the employer/employee relationship, is in Judge Walker’s ruling “violates free speech rights under the 1st and 14th Amendments to the US constitution”. Another indication that Gov. DeSantis’s “anti-woke” law does not comport with “free speech” protections.
Second, in another important court decision the NY Supreme court ruled yesterday, in a split decision, that Wayne LaPierre is banned from holding any position in the NRA for 10 years. Although AG Letitia James was not allowed to place a court appointed monitor over the NRA. That’s unlike the $475 million judgment imposed by Justice Engoron where a court monitor stills supervises the business activities of DJT’s companies after he was found liable for systematic business fraud.
In his decision Judge Cohen said his case “demonstrated that the NRA had a stunning lack of accountability and its leaders engaged in illegality and self-dealing…After years of corruption, the NRA and its senior leaders are finally held accountable”. This demonstrates AG James can walk and chew gum at the same time. DJT is not the only target of James’ fight against corruption in NY!
