Hunter Biden Loses Game of Chicken With Himself

Below is my column in the New York Post on the sudden guilty plea from Hunter Biden in his federal tax case. It was not the plea but the timing of the plea that was the surprise. What is missing is any cognizable legal strategy in waiting until the first day of the trial to make a “naked plea” when it offered the least possible benefit to him. It was like waiting for the water to reach the deck of the Titanic before asking about swimming lessons. He was a tad late and then unsuccessfully sought to plead guilty without admitting guilt.

Here is the column:

Hunter Biden just showed the perils of playing the game of chicken with yourself.

For months, many of us have marveled at the sight of Hunter careening toward a cliff while declaring publicly that he was prepared to go all the way.

The Justice Department was never going over the cliff because they had nothing to gain or lose in open-and-shut cases in Delaware and California.

There was never a serious question of convicting Hunter of these crimes, just a will of the Justice Department to secure them.

Special Counsel David Weiss inexplicably allowed serious felonies to expire, refused to bring obvious crimes as an unregistered foreign agent, and sought to cut an embarrassing sweetheart deal with Hunter to avoid any jail time on a couple of minor crimes.

The deal then collapsed in open court when a judge balked at a provision that would give Hunter sweeping immunity for any crime.

When she asked the federal prosecutor if he had ever seen such a plea bargain offered a defendant other than the President’s son, he admitted that he had not.

That is when the chest pounding began. Unwilling to accept anything but the sweetheart deal, Hunter’s defense counsel told the prosecutors in court to “just rip it up.” They did and Weiss was forced to actually prosecute Hunter.

According to the Justice Department, Weiss continued to try to cut a plea bargain with Hunter but was rebuffed by the defense.

They then went to Delaware, the home of the Bidens, and tried to convince a sympathetic jury that Hunter was a drug addict who was not responsible for his action as well as other unsupported claims.

It failed in spectacular fashion with a conviction on all counts.

Hunter then floored it for the California cliff on the tax charges as the Justice Department and most of us watched confused about how he was trying to intimidate. He hit the brakes as the trial was beginning.

Hunter has succeeded in putting himself in the worst possible position for a plea. He waited until he had little to trade and reportedly did not even inform the prosecutors of his decision.

But it gets worse. If he had agreed to a less generous plea deal last year, he could have secured a recommended sentence on both the gun and tax charges.

Instead, he will go into this sentencing with a past criminal record, an aggravating factor that could reduce the benefit of the belated plea.

In the end, Hunter had nothing to offer, nothing to bargain. He plead guilty to all nine counts.

This decision may still be based more on political than legal calculations. Hunter was almost certain to be convicted. But it would have taken time as his father’s administration (and pardon authority) wanes.

If Hunter still hopes for a presidential commutation or pardon, the chances of such executive action is dramatically improved after a sentencing.

The White House rarely considers pardons before a trial and sentencing. Indeed, they often wait for appeals to run their course.

Moreover, a demand for jail time seems likely from the Justice Department given this history and it is equally likely to be granted.

If that sentence is lengthy, it will add pressure on President Biden to take action with a commutation or pardon.

If President Biden does violate his promise to not pardon Hunter, it would not be a surprise for many. In 2022, I wrote that the President could resign or withdraw as a candidate and pardon Hunter.

I referred to this as “break-the-glass option”: “He would end his political career with an act as a father, which some would condemn but most would understand.”

The plea also avoided the massive influence peddling operation of the Biden family from being aired in open court.

The refusal of the Justice Department to charge Hunter as an unregistered foreign agent stands in flagrant contradiction to past and current cases under the Foreign Agents Registration Act (FARA).

None of this explains the logic of Hunter’s criminal defense strategy. A legal one-man game of chicken is certainly engrossing to watch, but leaves most lawyers wincing rather than flinching as the spectacle unfolds.

The strategy was entangled with Joe’s campaign effort – keep the Tax trial from starting as long as possible and publicly airing financial records that implicate Joe and his Bag Man son from foreign influence payments. Once Joe capitulated to the Pelosi conspiracy delay was no longer necessary and the object was once again to keep the evidence from a public airing thus the guilty plea and sealing of the record. Next the sentencing comes in December before Joe departs and the full and unconditional pardon will already be prepared as a Happy New Years surprise (NOT). The pardon does no harm to Joe as he invokes the wet-eyed defense of a daddy! The full and unconditional pardon will stop any future prosecution at the Federal level and every one goes quiet! No states (the Blue types) with nexus to Hunter will bother to look into anything and statute of limitations will quietly run out!

The tariffs alone, which are, essentially, a sales tax, because the cost is passed on to consumers in the form of higher prices for goods, will cost the average American family north of $1,000, up to $4,000 per year. He’s either too stupid to understand that the Chinese and other exporting countries will simply raise the price of their goods to cover the cost of the tariffs, and American consumers will pay it or just plain cannot back down once he’s taken a position. The tariffs will not come from profits of exporters, and will not decrease demand for goods. Because we require a minimum wage in America, we cannot produce goods as cheaply as China and other countries. I’ve seen NO economist who has said that these tariffs are a good idea.

    Did you see that speech yesterday before the New York Economic Club in which Trump couldn’t even answer a simple question about whether he had a plan to help families afford child care? He said “child care is child care we have to have it”. It was little more than his usual word salad, but he appeared to be trying to claim that his tariffs would bring in more revenue than the cost of child care, which he considered to be minimal. He failed to come up with any nexus between tariffs and helping families afford child care–that’s because he doesn’t have any plan.

        Additionally, the 5th Amendment right to private property was initially qualified by the Framers and is, therefore, absolute, allowing no further qualification, and allowing ONLY the owner the power to “claim and exercise” dominion over private property.

        Government exists, under the Constitution and Bill of Rights, to provide maximal freedom to individuals while government is severely limited and restricted to merely facilitating that maximal freedom of individuals through the provision of security and infrastructure.

    So IF the Republicans – and Trump – actually have a set of balls after the election, no minor inconvenience EOS or pardon after the election is going to prevent The Family Bagman Formerly Known As The Crackhead Kid from being kryptonite that endangers all mobster Washington Democrats.

    The First Gun/Tax Felon Son knows where The Big Guy’s fifty years of felony skeletons are buried. I don’t believe he’ll refuse to rat The Big Guy out, if refusing to do so means he goes to prison to be a Cell Boy Toy, and leaves prison with a ring piece you could turn a Harley Davidson motorcycle around in.

    Whether a slap on the wrist and EOS or a full pardon on all convictions, a Trump administration can certainly subpoena the now free as a bird Crackhead Kid and compel him to testify under oath. EOS or pardon, the Fifth Amendment won’t save him when he faces no further charges or sentences for the crimes he would be asked about. No Executive Privilege for him.

    His family relationships won’t allow him to refuse to answer questions about tax fraud, money laundering, influence peddling, etc that Vice President Daddy Big Guy and Uncle Jim Big Guy were involved with.

    If he perjures himself in those answers – he goes to prison. If he refuses to answer – he goes to prison.

    Unless a Trump administration decides they’ll surrender to the media (and Dennis McIntyre) “nothing to see here” (as he didn’t fulfill his promise to appoint a Special Counsel to investigate Clinton/Obama/DNC corruption after the 2016 election), they can tell the Crackhead Kid to answer questions or go straight to jail like all of Merrick Garland and Robert Mueller’s victims went to jail.

    In fact, they can make home base for that investigation pretty much anywhere in the USA… oh, like Montana for example… or Idaho or Wyoming. Where the Crackhead Kid and any Soviet Democrat bureaucrat or politician they subpoena can sit in courtrooms that are the mirror opposite of Washington DC and New York courtrooms.

    If there’s nothing unfair about Republicans being hauled into Washington DC and New York courtrooms to testify on alleged federal crimes, certainly there’s nothing wrong with Democrats being hauled into Montana, Idaho, or Wyoming courtrooms and juries to do the same. Changes of venue happen all the time – ask Trump how Jack Smith works that angle.

    In fact – IF they have the balls – the Trump administration can subpoena Bolshevik Barack to also appear to be interrogated under oath at a courtroom not under the protective Washington DC/New York umbrella.

    Bolshevik Barack has no special status, other than presidential immunity for LAWFUL actions as president. Does ordering his Attorney Generals and FBI Directors to perjure themselves to FISA courts to obtain fraudulent spy warrants to fix an election meet the standard of lawful? Courts would determine that – and prosecutors could ask Comey and Obama’s AG’s if they made those felony perjured statements all on their own and hide it from Obama? Or did they inform Obama of what they were doing or receive instructions from him to do so? Would Obama’s former Attorney Generals and FBI Directors go to a federal prison like Leavenworth to protect him?

    The statute of limitations might allow them to escape jail for their 2016/2017 felonies – but that doesn’t allow them to escape being questioned under oath to determine if this was a massive RICO felony… with no statute of limitations protections.

    President Big Guy determined to declare Trump no longer had Executive Privilege while being investigated – President Trump can do exactly the same not only for former President Big Guy, but President Bolshevik Barack as well.

    After all, Bolshevik Barack was handed over 150 Suspicious Activity Reports from banks reporting VP Biden money laundering and inexplicable millions of dollars from adversarial nations. There’s some questions…

    Does a Trump administration even NEED The Crackhead Kid to rat out the senior partner in Biden White House Crime LLC?

    The current Attorney General instructed his prosecutor to say that while they had massive amounts of evidence of Big Guy felonies, that particular prosecutor was to tell Americans his Ouija Board had told him no jury would convict The Big Guy – same parole Clinton got and Trump allowed to stand.

    A Trump Attorney General could easily decide that prosecutor and his decision was rigged – a new prosecutor with the morals of Jack Smith would take the evidence they had and move forward with a Jack Smith style prosecution. Like Jack Smith, that prosecutor could decide to let SCOTUS sort out any errors in his prosecution three or four years and a couple of election cycles down the road.

    One thing is for certain: after being immersed in Washington DC Democrat crime and corruption for over 50 years, President Big Guy knows where every single Washington DC Democrat mobster’s felony skeletons are buried.     1. Before the end of his term in office, Biden will resign and Kamala Harris will become the first female President in history, even though she may have lost the election to Trump, whereupon she will pardon Hunter, noting that Hunter fell on his sword in order to spare his family almost certain grief, thus allowing Biden to avoid violating his promise not to do that himself.

    2. Biden serves out his term, but sometime before the end, he pardons Hunter himself, justifying this apparent violation of his promise on the grounds that the penalties levied against Hunter were too severe, even Draconian, and that the only way to avert such a miscarriage of justice is to grant pardon.

    The second seems more likely, as it would fully explain why Hunter pled straight guilty yesterday after the Alford plea was opposed, thus guaranteeing that sentencing will be far harsher (Draconian???) than it would have been if Hunter had sought a plea deal months ago (even weeks ago, perhaps), and thus giving his father justification for breaking his promise, and not requiring him to become only the second President in history to resign.

    An Alford guilty plea would have offered even better rationalization for such a pardon in either scenario, i.e. he wasn’t actually found guilty at all, he was simply trying to avoid grief for his family. Is he guilty? That depends on what your definition if “is” is. But the prosecution rejected the Alford plea, whereupon Hunter immediately made a straight guilty plea, which can legally can never be opposed by the prosecution.

    While all of that may be true, it raises an additional layer of speculation: the prosecution announced in no uncertain terms, that they had no prior knowledge of the sudden change of plea and were outraged (wink, wink), which prompted them to oppose — most sternly (wink, wink) — the Alford plea, and thereby gain some appearance of not being totally in the tank for Hunter, as they so clearly were with the absurd immunity agreement that blew up in the Delaware courtroom. Of course, as mentioned, Hunter’s immediate switch to the straight guilty plea was something that no prosecutor can legally oppose, but the DOJ really, really wanted to get this guy! (wink, wink).   20. Jonathan: Speaking of someone who “loses game of chicken” Elon Musk is facing that in Brazil! As long as he refuses to appoint a legal rep in that country X will be suspended. It’s a game of chicken Musk will eventually lose.

    Business Insider has an article today indicating Musk is two-faced. In China, X has been banned since 2009. Has Musk complained about that? Nope. Why? He built a huge Tesla factory in Shanghai in 2019. Last year, almost a quarter, or $21.7 billion, of Tesla’s revenue came from China. That’s why Musk doesn’t complain about X being banned in China!

    Unfortunately, Musk is facing headwinds in China. Business Insider also reports that Tesla’s market share in China has declined 6.5% between January and July of this year. So Musk doesn’t want to rock the boat by making the same claims in China that he has made in Brazil. Besides, Tesla doesn’t have a presence in Brazil although when Jair Bolsanaro was still president in 2020 he told Musk in a meeting he wanted to assist Musk in setting up Tesla in Brazil. That didn’t happen because Bolsanaro lost to Lula da Silva, tried to stage an insurrection to stay in power and when that failed Bolsanaro fled to South Florida to hang out with DJT.

    So it appears that as long as Musk and Tesla remain dependent on China, “free speech” is far from absolute with Musk!
