Hunter Biden Loses Game of Chicken With Himself

Below is my column in the New York Post on the sudden guilty plea from Hunter Biden in his federal tax case. It was not the plea but the timing of the plea that was the surprise. What is missing is any cognizable legal strategy in waiting until the first day of the trial to make a “naked plea” when it offered the least possible benefit to him. It was like waiting for the water to reach the deck of the Titanic before asking about swimming lessons. He was a tad late and then unsuccessfully sought to plead guilty without admitting guilt.

Here is the column:

Hunter Biden just showed the perils of playing the game of chicken with yourself.

For months, many of us have marveled at the sight of Hunter careening toward a cliff while declaring publicly that he was prepared to go all the way.

The Justice Department was never going over the cliff because they had nothing to gain or lose in open-and-shut cases in Delaware and California.

There was never a serious question of convicting Hunter of these crimes, just a will of the Justice Department to secure them.

Special Counsel David Weiss inexplicably allowed serious felonies to expire, refused to bring obvious crimes as an unregistered foreign agent, and sought to cut an embarrassing sweetheart deal with Hunter to avoid any jail time on a couple of minor crimes.

The deal then collapsed in open court when a judge balked at a provision that would give Hunter sweeping immunity for any crime.

When she asked the federal prosecutor if he had ever seen such a plea bargain offered a defendant other than the President’s son, he admitted that he had not.

That is when the chest pounding began. Unwilling to accept anything but the sweetheart deal, Hunter’s defense counsel told the prosecutors in court to “just rip it up.” They did and Weiss was forced to actually prosecute Hunter.

According to the Justice Department, Weiss continued to try to cut a plea bargain with Hunter but was rebuffed by the defense.

They then went to Delaware, the home of the Bidens, and tried to convince a sympathetic jury that Hunter was a drug addict who was not responsible for his action as well as other unsupported claims.

It failed in spectacular fashion with a conviction on all counts.

Hunter then floored it for the California cliff on the tax charges as the Justice Department and most of us watched confused about how he was trying to intimidate. He hit the brakes as the trial was beginning.

Hunter has succeeded in putting himself in the worst possible position for a plea. He waited until he had little to trade and reportedly did not even inform the prosecutors of his decision.

But it gets worse. If he had agreed to a less generous plea deal last year, he could have secured a recommended sentence on both the gun and tax charges.

Instead, he will go into this sentencing with a past criminal record, an aggravating factor that could reduce the benefit of the belated plea.

In the end, Hunter had nothing to offer, nothing to bargain. He plead guilty to all nine counts.

This decision may still be based more on political than legal calculations. Hunter was almost certain to be convicted. But it would have taken time as his father’s administration (and pardon authority) wanes.

If Hunter still hopes for a presidential commutation or pardon, the chances of such executive action is dramatically improved after a sentencing.

The White House rarely considers pardons before a trial and sentencing. Indeed, they often wait for appeals to run their course.

Moreover, a demand for jail time seems likely from the Justice Department given this history and it is equally likely to be granted.

If that sentence is lengthy, it will add pressure on President Biden to take action with a commutation or pardon.

If President Biden does violate his promise to not pardon Hunter, it would not be a surprise for many. In 2022, I wrote that the President could resign or withdraw as a candidate and pardon Hunter.

I referred to this as “break-the-glass option”: “He would end his political career with an act as a father, which some would condemn but most would understand.”

The plea also avoided the massive influence peddling operation of the Biden family from being aired in open court.

The refusal of the Justice Department to charge Hunter as an unregistered foreign agent stands in flagrant contradiction to past and current cases under the Foreign Agents Registration Act (FARA).

None of this explains the logic of Hunter’s criminal defense strategy. A legal one-man game of chicken is certainly engrossing to watch, but leaves most lawyers wincing rather than flinching as the spectacle unfolds.

Hunter had a substance problem that he attributes to stress going back to the pre-Christmas fatal accident in which he observed the brutal and bloody deaths of his mother and 1 year old baby sister and in which he and Beau both suffered severe injuries when their station wagon was broadsided by a truck. Beau was 4. Hunter was only 3 years old. Then, he lost his brother Beau to brain cancer and went through a difficult divorce. Abusing substances to ease the suffering of emotional problems is not a moral failing. Hunter paid his back taxes. He pleaded guilty. He is substance-free now and in a good marriage. He should be praised for his sobriety and turning around his life.

        OTOH, you worship a sociopathic narcissist–someone who has NO conscience whatsoever, who exists solely to feed his massive, sick ego that requires attention, adulation and praise. This is a person who cannot stop lying. This is someone who sat idly by for over 3 hours while his followers, based on the deliberate lie that Trump won the election, but was “cheated” somehow, forced their way into our Capitol, assaulted and battered police officers, desecrated the Capitol, stole items, and hunted for Pence, the VP, because Pence refused Trump’s demand to reject certified votes. One of Trump’s fans was shot to death believing in him and his lie–Trump has never apologized to her family or owned up to his responsibility for causing her death. Trump ignored pleas from his family and staff to call off the violence until it was clear that Pence could not be persuaded to leave the Capitol grounds until he finished the job he came to do.

        This person you worship was adjudicated responsible for sexual assault, defamation, fraud and is charged with stealing classied documents, lying about reutrning them and hiding them. He has been convicted of 34 felonies. Many former members of his administration say he is unfit for office and want nothing to do with him. They say he is easily manipulated by savvy foreign leaders who don’t respect him because they see him for the weak egotistical loser he is. They say he should not be allowed anywhere near the White House. And, yet, you trash someone who has never been running for office, the son of a former candidate, who went through more trauma than most of us can ever imagine. That’s how you have become blinded to reality and human virtue and values. Hunter Biden is emotionally unwell, Trump is ethically unwell and a danger to not only America but the world because he has no bottom.

    There are significant implications for the case. Hunter’s only goal was to avoid a prison sentence, with the belief that it would not matter if the sentence was long or short, as he anticipates a pardon from Joe Biden.

    Hunter’s laughter as he thinks about the American people’s gullibility underscores his dismissive attitude. He is right. The American people have the greatest country in the world and are willing to squander that wealth because they are too lazy to look around and see what is happening.

  9. Jonathan: So what is the current status of the presidential campaign? Harris raised an enormous $361 million in August–easily dwarfing the $130 million raised by DJT. That probably explains why DJT is not spending money in states he thinks he will not carry–and concentrating his meager resources in a few battleground states. That also explains why DJT is not holding expensive public rallies but speaking to smaller indoor friendly audiences and giving interviews only to right-wing media. Doesn’t look like DJT has the money to vigorously campaign around the country like he did in 2020.

The issue of continuing school gun violence will be on the minds of voters in November. DJT is a steadfast supporter of weapons of mass destruction because he depends on endorsements from the NRA and gun advocates. Harris, on the other hand, supports bans on assault weapons and other gun restrictions. I would imagine that at the debate next week a Q will come up about the position of each candidate on gun restrictions. Will DJT support bans on assault weapons? We pretty much know how DJT will answer the Q. He will only offer “thoughts and prayers”. That answer will not play well with either Georgia voters or other victims of gun violence around the country!

  11. It’s surprising, but it also makes sense. Hunter Biden won’t likely be sentenced until December. If President Biden decides to do something about it he can commute his sentence without pardoning the charges. He did promise not to pardon him. But he didn’t say anything about commuting his sentence.

    Either way the president enjoys the new immunity protections SCOTUS claimed all presidents have.

    What is more interesting is judge Chutkan’s ruling on Trump. She is very inclined to allow Smith to file motions that will bring out previously sealed evidence against Trump including communications with former VP Pence. Her ruling could be overturned by SCOTUS, but it won’t stop damaging information from the public just prior to the vote and it has the potential to cost trump crucial votes.

      Just as VPs can’t declassify information like Presidents can.

      Presidential Immunity doesn’t cover Biden committing income tax fraud on not reporting and paying taxes on what sonny slipped into your pocket as your 10% of the take. It also doesn’t cover accepting bribes and selling influence to your office.

      They aren’t new, George – SCOTUS just had to write them in stone after Jack Smith decided Trump was one president that didn’t have any of those immunities that Obama did while ordering the assassination of Americans overseas without trial. Nobody questioned presidential immunities back in the era of Obama. Or after Biden murdered a family of ten civilians trying for a tough guy show after Americans were murdered in Afghanistan three years ago.

      BTW, George… as you were eager to move to Judge Chutkan and her fellow police state fascist, Jack Smith. That is interesting indeed George: how did Jack Smith’s prosecution of Obama and Biden’s most feared potential GOP nominee Governor Bob McDonnell in the 2012 election turn out when Jack Smith’s police state fascist lawfare ran into SCOTUS?

      As I recall, SCOTUS threw it all out in a unanimous decision – and went the extra step of naming Jack Smith as “a threat to our separation of powers”. Need the link or can you find it yourself?

      You almost blurted out that “this is police state fascist lawfare hoping to rig an election, straight from the era of Lenin and his chief prosecutor Lavarentiy Beria who famously told his boss “Show me the man and I’ll find you his crimes””.

My immediate impression was that Hunter had opted for the court of last resort, i.e., his “daddy.” Which means guilty plea, sentencing, pardon, all before November because a Kamala win is not at all certain. So, I think Turley nailed it. Add that response from the Hunter camp from the very beginning has been a total clown show, which suggests a both naivete and – surprise surprise – a serious lack of gray matter. And then you wonder about the incredible naivete attached to Biden family criminal activities?

  20. Dear Mr. Turley, I completely agree with Anonymous @8:39. I am not surprised at the outcome as it is the sad ending to a very, very sad life. The world did not know just how sad it was until his trial in Delaware on the gun charges. Even his own daughter, who tried to save him, was unable to. Perhaps, is he does end up cooling his heels in prison, I hope that he will be able to have some actual help and straighten out what is left of his life. Sad family, sad life.
